1 Introduction

The Resettlement Action Plan for the Hubli-Dharwad BRTS Project was prepared to address and mitigate the impacts arising out of the Project. The RAP was prepared based on the socio-economic survey which was conducted during 07-09-2011 to 16-09-2011. The Government of Karnataka has approved the Resettlement Action Plan on December, 2012. The date of socio-economic survey and the notification for land acquisition under section 13 of the Karnataka Highways Act are the cut-off dates for identification of the Non-titleholders and titleholders respectively. The Hubli-Dharwad BRTS Company Limited has completed the Joint Measurement Certificate survey in all the villages. The village-wise JMC reports have been finalised. This addendum is an update to incorporate the changes in the impacts as a result of joint measurement surveys and alignment modification. This addendum should be referred in conjunction with already approved RAP 2012.

3 Extent of land to be acquired

72.29 acres of land is required to be acquired for the Project. The village- wise extent of land to be acquired and the details of land ownership are indicated below:

4 Magnitude of Impacts

4.1 Impact on Land and Structures

891 properties will be affected as per JMC. After verification of layouts approved by Hubli- Dharwad Urban Development Authority (HDUDA), around 17 acres of land was found be earmarked for the road margin during the layout approval process. Few of these lands were relinquished to HDMC/HDUDA and few were in the name of the Titleholders. These lands have now been taken over by the HDMC. After due transfer of lands required to be handed over as part of building plan approval to individual land owners. Accordingly, the number of titleholders has now been revised to 559. The number of titleholders is expected to still reduce after detailed verification in Hubli and Dharwad is completed.

Some of the titleholders had built their structures in violation of approved HDUDA layout and had constructed their structures within the reserved road margin. Titleholders have to Hubli-Dharwad BRTS Co. Ltd. Page 5

surrender their land as they had no legal rights over the road margin, but in cases where the structures in the road margin have been fully or partially affected, they have been accounted under the encroacher category and eligible for ex-gratia compensation for loss of structures and other assets lost to the project in accordance with the provisions of RAP.

4.2 Project Affected Persons

The total number of project affected persons is 1349. The village-wise distribution of PAPs by category is indicated in the following table. The details of the PAPs list with respect to village wise are enclosed in Annexure I.

52 percent of the major impacted structures belong to commercial category. Details of properties having major impact are given below;

Rehabilitation and resettlement assistance is as per the approved entitlement matrix. In case of major impacted title holders. R&R assistance is the form of shifting, subsistence allowance as well as livelihood assistance will be paid as per the norms in place.

4.4 Tenants

The total number of tenants as identified in the socio-economic survey was 468. After the verification was complete the number of tenants has reduced to 411. The total number of tenants requiring shifting is 348 out of which 95% of them are under commercial category. The details are as follows:

4.5 Squatters & Kiosks

The number of squatters identified during the socio-economic survey was 13, out of which 7 numbers were wrongly classified as squatters. In addition, the squatters were also included in other categories (licensed kiosk, tenants etc.). The revised number of squatters is now 85 and Kiosks is 02. 4.6 Licensed Kiosk 36 numbers of licensed kiosks were listed during the socio-economic survey. However, post verification only two licensed kiosks, one each at Hubli and Dharwad city respectively have been identified between Hosur Circle, Hubli to Jubilee Circle, Dharwad. Most of the names listed under licensed kiosk came under the squatters’ category after verification.

4.7 Impact on Religious structures During the socio-economic survey 15 community assets were identified under project impacts. Two additional community assets were included after the completion of JMC. As per JMC 17 community structures have been affected, among these the ISCON temple is coming under road margin and there is no structure, only name plate is getting affected. Hence, a decision was taken to remove this temple from the list of affected structures. As per the revised deign of ROB (2 lane ROB on either side of the existing ROB) the JMC at Navalur was completed. A tomb has been identified to be additionally affected in RHS, as per the JMC. However, this property also comes under the road margin as per the layout approved by HDUDA. Steps have been initiated by the Hubli-Dharwad BRTS Company Limited to acquire the land. The table below summarizes the revised list of community assets getting affected by the Project:

Out of the 17 community structures, 10 temples have started construction, and the construction of the remaining 6 is under progress. Rehabilitation assistance is being disbursed in phases for the reconstruction of the community structures that have relocated. The details of the meetings held with respect to various community assets are enclosed in Annexure II. The consultations will continue with those temple trusts where their relocation arrangements are not yet finalised.

The level of support to be provided to vulnerable groups include assistance to help them to include in the eligible ongoing Government programme. In addition cash allowances will be given to vulnerable families, who are under major impacted category, as an additional livelihood in addition, a medical camp for affected non-title holder families providing for free health and dental check-up was organised by Hubli-Dharwad BRTS Company limited on 17- 07.2014 in at the SDM Super Speciality Hospital, Sattur.

5 Price Negotiation Committee meeting details As per Government Order the price negotiation committee has been constituted, the committee meetings have been organised for all project affected villages/towns. The Government has approved the negotiated price as recommended by the committee. The details of the price finalised by the committee are as follows:

6 Applicability of the provisions of the “Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act (RFCTLARR Act) 2013.

The applicability of the provisions of the RFCTLARR Act to the on-going process of land acquisition for the Hubli-Dharwad BRTS project has been ascertained:

a) By taking legal opinion. b) By obtaining clarifications from the Commissioner, Land Acquisition, Rehabilitation and Resettlement, Upper Krishna Project, Bangalore.

The legal opinion has clearly stated that the on-going process which is governed by the Karnataka Highway Act will not be affected by the new land acquisition Act (RFCTLARR, 2013). Moreover, the clarification obtained from the Commissioner, Land Acquisition, Rehabilitation and Resettlement has also stated that the compensation for the land to be acquired could be compared, and the final compensation may be fixed in such a way that it is advantageous to the project displaced persons. The provisions of RAP which govern the fixing of compensation for land and structures to be acquired have been compared with those of the RFCTLARR Act and find that the RAP package with focus on consent award; minimum compensation @ 2.5 times the guidance value; structure valuation without depreciation; 25% additional compensation for partially affected structures etc is more beneficial than the compensation to be fixed as per the new Act. It is seen that the terms of the Resettlement Action Plan are advantageous to the land losers who have come forward for

a consent award. The consent prices are finalized on the basis of the recommendations of the negotiation committee headed by the Deputy Commissioner who is responsible for fixing the fair value that is acceptable to the land losers. Comparison of compensation amounts as per the RFCTLARR Act and consent price as per the RAP is being done and informed to land losers. Only in cases where land losers are agreeable for consent award as per present RAP, consent awards are being prepared. In other cases, the HDBRTS Co is finalizing general awards as per the RFCTLARR Act. The Compensation paid under consent award will be compared with the compensation eligible as per the provisions of RFCTLARR ACT-2013 and the difference if any will be paid as an additional compensation. A format for comparing the compensation amount at village level as per the awards is designed and provided in Annexure V. Based on the differences, individual differences in compensation amounts will be derived and payments will be as needed. So far as the Rehabilitation and Resettlement assistance is concerned, the entitlement matrix has been revised periodically as mandated by the RAP. In case of fully displaced families appropriate assistance will be extended for the resettlement of the displaced families and restoration of livelihood impacts, if any. All minutes of price negotiation committee’s are available in project files.

7 Alternative Analysis

In case of Navalur ROB and Dharwad corridor alignments were made to accommodate the best technical solution and also keep in the mind of minimizing the land acquisition and R&R impacts. These are described below.

7.1 Railway Over Bridge

The realignment of Navalur ROB has been examined in detail in consultation with the Technical Committee of KRDCL. The technical committee made site visits during 4th January, 2014, 4th March, 2014 and 23rd May 2014 and also held discussions with the officers of the KRDCL, DULT and Hubli – Dharwad BRTS Company. On the basis of the recommendations of the technical committee, the design consultant has been asked to prepare GAD for two 2 lane ROBs to be constructed on either side of the existing ROB at Navalur. GAD has been submitted to the Railways on 11th June, 2014. JMC has been completed. The related photo-documentation of the technical team visits to the site; negotiation committee meetings and the finally approved alignment are enclosed in Annexure III. As a result of this alignment the land acquisition and R& R impacts encountered in this ROB is summarised below:

7.2 BRTS Corridor alignment in Dharwad

On the basis of representations received from few project affected persons in Dharwad, M/s. Hubli-Dharwad BRTS Company Ltd. had examined other alternatives to the design of BRTS corridor proposed in the DFR and approved by the State Government. The detailed process followed to evaluate and finalize the options in Dharwad as well as the photo documentation of the process is enclosed in Annexure IV. As a result of final alignment choices in Dharwad will involve acquisition of 6 acres 12 guntas of land belonging to 162 titles. 110 tenants and 9 squatters will also be affected.

8 Public Consultations and outreach

Consultations were undertaken to disseminate information about project to the potentially affected people, and to seek public views and suggestions. In pursuance to the public consultations held earlier, the proposal to construct VUPs at Unkal (cross), Unkal (village) and Navanagar was dropped. The construction of BRT bus only flyovers are proposed in these three locations. 18 focus group discussions and 45 number of community meetings have been held till date with the project affected persons.

Hubli – Dharwad BRTS Company has continued its initiative to have public engagements with stakeholders through focus group discussions, workshops etc. The details of the focus group discussions that have been held with the project displaced persons is enclosed as Annexure II.

Additional Impacts: The project has triggered additional land acquisition and R&R impacts due to the proposed Dharwad terminal. The separate assessment will be carried out to describe the details of the impacts and proposed suitable mitigation measures in accordance with objectives and entitlements adopted for the project.

9 RAP Implementation Schedule

The revised and updated RAP implementation schedule is provided in Table 13. This provides the key benchmarks of implementing the RAP.

10 Budget and Cost The cost estimates are based on recommendation of negotiation committee and approval of the Government. The project has a budget approval for Rs. 2400 million. The estimated budget is slightly above this amount. Once the spending reaches the approved amount of INR 2400 million. The project will seek Govt. approval for additional amount required for the implementation of Land Acquisition and R&R impacts.

Note: The land acquisition and structure compensation amounts may vary based on final awards. R&R cost has increased due to the adding of new encroachers and subsequent revision @ 10% every financial years for 2 years. The revised estimated is Rs. 3.45crores.

11 Monitoring and Evaluation

The Monitoring and evaluation consultants have come on board on 01.07.2013. Their assignment is scheduled to be completed on 30.06.2015. As on date, the Monitoring and evaluation consultants have submitted quarterly reports as required. .As the acquisition of land is still to be completed fully, the services of M&E consultants will be extended to monitor the implementation and provide concurrent feedback. These consultants will also undertake limited impact assessments. A final impact evaluation on the outcome of compensation and assistance provided to PAPs will be undertaken with another consultants after at least one year substantial implementation to allow sufficient lead time for measuring the impacts and outcomes. To support HDBRTS two community level organisers were employed to ensure continuity to follow-up with the PAPs on regular basis after the contract with NGO which provided support as a part of initial implementation was terminated.

Outcomes of the meetings:

1) Periodic meetings with the communities made it possible to motivate them to form a trust for taking up relocation of idols and reconstruction of religious structures with the financial support from Hubli-Dharwad BRTS Company Ltd. 2) After discussions and feedback from the community, design changes like construction of three bus-only flyovers instead of vehicular under passes, change in the design of ROB proposed to be constructed at Navlur etc. have been made. 3) The focus group discussions and community meetings also helped in disseminating information about the re-settlement action plan and the entitlement matrix, and have facilitated acquisition of land by consent and also helped the project authorities to identify vulnerable groups requiring support as per the entitlement matrix.

Chronology of events, communications and consultations regarding alternatives for BRTS in Dharwad city stretch

The Hubli-Dharwad BRTS Company Limited has been very pro-active in disseminating information about the project including the land acquisition and resettlement and rehabilitation matters through public hearings, focus group discussions, negotiation meetings with project affected persons, Public Information centre, monthly newsletters, website and series of presentations by communication and outreach consultant etc. Alternative analysis for the BRTS corridor was done during the detailed feasibility stage itself and the most optimal alignment and cross-sections were finalized. The DFR was thoroughly reviewed by the World Bank.

2012 and 2013

 During the initial stages of the project itself, three Public consultation meetings were held on 28th November, 2012, 29th November, 2012 and 2nd February, 2013. Proceedings of the public consultations are already a part of the RAP which has been duly disclosed on the website of Hubli-Dharwad BRTS Company limited.  In June, 2013, one, Mr Shashank Angadi gave a representation to the World Bank raising questions on the feasibility of BRTS project and cross-sections adopted for Dharwad, and suggested some alternatives. The alternatives were analysed by the Hubli-Dharwad BRTS Company limited and DULT and a detailed reply was sent to him on 29/6/2013.  In July, 2013, a similar representation was received from Secretary, Dharwad Land Losers (Represented by Mr. Anil Manjanbail) Association to HDBRTSCO and DULT. The alternatives proposed and clarification sought was reviewed and detailed explanation was given on each of the alternatives suggested by Mr. Anil Manjanbail by the HDBRTSCO on 14/8/2013.  A grievance was registered at Grievance redressal cell of HDBRTSCO by Ms. Nirmala Bikkanavar on 23-07-2013 against road widening upto 35 m in Dharwad and with a suggestion to consider flyover from Toll naka to jubilee circle or from NTTF to Jubilee circle with one way provision. Reply was furnished to her on 7/8/2013 by the GRC.  During visits of the Commissioner, DULT, opportunity was given to the PAP s affected in Dharwad to discuss their grievances and suggestions. A letter received from Basavaraj Bikkanavar on 13/12/2013 referring to one such meeting is an ample indication of the readiness with which DULT and HDBRTSCO engaged with PAPs. Many such informal opportunities were provided even during the visits of World Bank Mission. In fact, a meeting was held with such PAPs including Mr. Manjanbail, Mr. Bikkanavar and others during the World Banks’s visit on 15th and 16th June, 2013.  Meanwhile, in July, 2013, a representation was received from Dharwad-Hubli Mahanagara Samagra Abhivruddi Sangha requesting that RTS be implemented with a uniform RoW of 53m between Hubli and Dharwad.

2014

 In March, 2014, the representatives of HDBRTSCo conducted a focus group discussion with Dharwad PAPs. Photographs are enclosed in Annexure-1.  The HDBRTSCO started evaluating the feasibility of the elevated BRTS corridor from NTTF to Jubilee Circle. Soil investigations were done.  From August, 2014 to November, 2014, HDBRTSCO and DULT received a series of petitions and e-mails from Mr Datt Kulkarni and others; Gaikwad and 65 other members; Thinkers forum etc opposing any proposal to construct an elevated BRTS corridor and supporting the at-grade option of the DFR. The thinker’s forum and others made representations to HDBRTSCO to avoid modifying the approved designs due to pressure from private property owners and implement the BRTS project as per the original designs. Statements were also made that the implementation of the BRTS project would be stalled if the original designs are modified to accommodate the flyover. The concerns were widely published in various newspapers. Copies of newspaper articles enclosed in Annexure-2.  HDBRTSCo did an alternative analysis of both at-grade and elevated options.  As a spate of emails was being received from both the parties, the HDBRTSCO held a joint consultation meeting on 7/10/2014 to appraise both the parties about the alternatives. The meeting was held under the Chairmanship of MD, HDBRTSCO. Mr. Anil Manjanbail, Mr. Bikkanavar, Mr.Puranik and others represented the pro-flyover group. Datt Kulkarni, Sanjeev Hiremath and others represented the pro-at-grade group. During the meeting both the parties put their points of concerns and as no consensus were reached, a decision was made to escalate these issues to the Government and it was recorded that the decision of the Government would be final. The minutes of the meeting, photographs and the list of people who attended is enclosed in Annexure-3.  On 19/12/2014, a meeting was held under the Chairmanship of honorable district in- charge minister which was attended by the MLAs, and MLCs of Hubli and Dharwad and the Honorable Mayor of Hubli-Dharwad. The alternative analysis was shared to all the members well in advance by the Hubli-Dharwad BRTS Company Limited. Detailed deliberations were made on both the options and a final decision was made to go-ahead with the 35m DFR option. The copy of the proceedings of the meeting along with the list of attendees and the alternative analysis report shared is enclosed in Annexure-4.  Negotiations committee meetings with Dharwad PAP s were held on 12/2/2015, 25/2/2015, 12/3/2015 and 13/4/2015 to explain the features of BRTS project; provisions of RAP; applicable land acquisition norm including the new Act; consent price etc. Mr. Anil Manjanbail and others attended the meeting. The proceedings of the meetings and the photographs are enclosed in Annexure-5.  Accordingly, the at-grade option of BRTS which is a part of the DFR approved by the GOK and the World Bank is proposed to be implemented.
