Pump 21 is repaired and back in service.

Tay Fire and Emergency Services responded to three structure fires this month, and the cause of the fire was determined for each incident. There were no injuries to residents or firefighters.

One structure fire required crews to cut through the steel garage door in order to gain access to the fire. One structure fire originated in the basement, where firefighters deployed two of our smoke grenades, slowing the fire down until our attack teams were ready to enter the building and extinguish the remaining hot spots. In both cases, the fire spread was contained to the room of origin because of the efforts of firefighters on scene.

This month Tay Fire and Emergency Services responded to two false alarms at the Tay Shores Public School. The alarm company is investigating the cause and staff was advised that the system is repaired and ready for the opening of the new school year.

For the month of August there were 177 items that needed some sort of action whether it be attendance to an address, educating people on by-laws, or routine patrols made by staff etc. There have been no COVID related calls in the month of August.

The highest number of complaints for the month of August was for property standards at 12 and closely followed by Burning, Zoning and Dog related complaints at 10. Complaints in relation to Short term Rental properties continue to be received by staff on a weekly basis. Staff will continue to do routine patrols of the Township to ensure compliance with the by-laws.

Additional Items/ Future Considerations

Staff will be commencing the public process for STR properties within the Township which will take a considerable amount of staff time for the next 6 months and beyond.

The next court date is tentatively scheduled for December 3rd, 2020. Staff have proceeded with six Part 3 charges so far this year that date back to March 31st, 2020 that will hopefully be heard on a first appearance on that date.

Complaints related to dogs were low compared to the months of June/July. Most complaints were residents reporting that a dog was found at large. With the township office now open to the public residents can once again purchase dog tags. Staff will be following up with residents who had expressed an interest on purchasing a dog tag during the suspension of sales to advise them of the change.

Due to COVID -19, several DOLA Statements and Summons to court were sent to the City of to be reviewed by a Justice of the Peace. All DOLA Statements were approved and the court date that has been set for those matters is tentatively December 3rd, 2020.

Three Dogs were brought to the Township pound in the month of August. One dog was captured by OPP during a complaint and two were found at large by fellow residents. Two dogs remain in the pound as of the date of this report.

No kennel inspections took place in the month of August.

Report Title: Short Term Rental Review Work Plan

RECOMMENDATION: That Staff Report No. PPP-2020-42 regarding an overview of the Short Term Rental Review Work Plan be received for information.

INTRODUCTION/BACKGROUND: At the August Committee of All Council meeting, staff received direction from Council to start a public consultation process in regards to Short Term Rental (STR) properties within the Township of Tay. This report outlines the projected timeframe and work plan that staff will use during the process and what method will be utilized to obtain feedback from the public and operators of STR properties. Both the Planning and Development Services and Municipal Law Enforcement Divisions will work together on this review.

ANALYSIS: The following is the work plan that staff will be working from in order to have a projected timeframe to receive information from the public and STR operators on the impacts that these type of uses have on the residents of the Township.

September: In the first two weeks of September, Officer Kennedy and the Township’s Planner, Aleah Clarke, will formulate questions for two separate surveys. One survey will be sent to all known operators of STR properties within the Township, while the second survey will be available for the general public to fill out. The intent of this is to ensure that we are getting as much information as possible from both sides, to help determine the best way for the Township to possibly regulate STR properties. The surveys will also gather input from the STR owners respecting what best practices they employ when running an STR to prevent complaints being filed with Township staff.

October-November: Starting on the first week of October, staff plan to have the surveys go live on the Township website and all surveys sent by mail to owners of STR

Protection to Persons and Property 1 September 9, 2020 PPP-2020-42 properties and the abutting property owners within 120 metres. The public consultation process will run for a period of 6 weeks and will end on November 13th, 2020.

During the last two weeks of November and into December staff will gather all of the answers to the surveys and create a report that will be presented to Council at January’s Committee meeting which will outline the most common answers received and give Council insight on what direction the public would like to see the Township take on this matter. This report will also include staff’s recommendation on which route the Township should take to possibly enforce STR properties.

February-March : Depending on the outcome of the January report, staff will finalize a Licensing By-law, Regulatory By-law and/or Zoning By-law amendment that will come to the February or March Committee meeting for consideration. Staff may consider utilizing our solicitor in the review process before finalizing the draft Licensing or Regulatory By- law due to the perceived severity of this issue within the Township. The goal is to have a By-law passed by this time as set fines will need to be sent to the Ministry of the Attorney General for approval which could take up to three months.

April: Staff is aiming to have a finalized By-law written and enforceable by the start of the next “renting season” to get a better handle on the issue of STR properties within the Township. By-law staff will be able to enforce the By-law without set fine approval but charges will have to be laid via Information and Summons as there will be no set fine attached to the charges until approved by the Ministry of the Attorney General.

FINANCIAL/BUDGET IMPACT: As the survey will be created and managed internally by staff, the additional costs of executing this work plan are nominal. Minor costs for printing and mailing the survey will be incurred. Any legal costs for review of any licensing or regulating by-laws will be covered by the existing operating budget for legal and are not expected to be significant.

CONCLUSION: This is the projected timeframe that staff will be taking for this public consultation process. While this can change based on responses from the public, further Council recommendations or the time that the Ministry takes approving set fines, this is the work plan that staff feels would allow for potential regulations to be put in place for STR’s by the summer of 2021.

To whom this may concern: My spouse passed suddenly at 56 while driving, due to heart failure, leaving me in shock at age 50. I am still fighting with the court system to have his estate settled, over 5yrs and still stuck in the courts, now due to Covid19. In 2016, I had to move to look after my parents, and asked by phone to have auto withdraw set up on my spouses cabin that has no accessable water. Tay Township mailed me the forms to sign & I enclosed a copy from the bank to set up auto payment for the land taxes at 63 Longpoint rd To my shock an old neighbour called to say she had mail in her box for me, after opening the letter I was shocked that the nothing had been set up for automatic payment of taxes. I since then have had contact with Shelly, Kim and now Cynthia in getting this gross error, or fate, as some would say, that know my history I as a widow at 55, I've been on EI since March, and may not have a job to return to in the fall. I've been blessed so far to just hold onto what little I have, as I fight the courts to one day have ownership of my spouses estate. Please find it in your hearts to wave the penelty fees of 792.95, not anyone's fault, as fate would have the postal service may of played a roll, we don't know. INFORMATION BRIEFING NOTE Great Lakes Water Levels Impacts and Recommended Actions for the Severn Sound Area

Purpose In response to significant damages to municipal and private property due to high water levels on Georgian Bay, the Township of Tiny, Town of , Town of Midland and Township of Tay and Severn Sound Environmental Association are seeking support for a number of actions that will assist Severn Sound shoreline municipalities build resilience and manage challenges caused by significant water fluctuations (both high and low).

Background Severn Sound is a group of bays located in southeastern Georgian Bay, Lake Huron and was delisted as a Great Lakes Area of Concern (AOC) in 2003, one of only 3 of the 17 Canadian AOC’s delisted to date. The Township of Tiny, Town of Penetanguishene, Town of Midland and Township of Tay are 4 of the 8 founding members of the Severn Sound Environmental Association (SSEA), a watershed based Joint Municipal Service Board under the Municipal Act (Section 202) founded in 1997. The SSEA is not a conservation authority and the majority of our watershed is not within conservation authority jurisdiction.

Included in the variety of services the SSEA provides, SSEA works with 8 municipal partners as well as partnering with the Federal and Provincial Governments to provide cost effective environmental monitoring in the Severn Sound area including coordinating monitoring of Georgian Bay water levels at Midland Bay and climate monitoring. In July 2020, water levels of Lakes Michigan-Huron exceeded the monthly mean record high level for the fifth month in a row. Lakes Erie, Superior and Ontario were above their long-term averages, indicating that Great Lakes Basin-wide factors play a role in high water levels.

The 100 year flood level for the Severn Sound and Township of Tiny coastal section of Georgian Bay, as calculated by Ontario Ministry of Natural Resources and Forestry (MNRF) Great Lakes Technical Guide, is the 178.0 m above sea level (masl) elevation. Several SSEA member municipalities recognize the 178.0 masl contour (100 year flood level) as the flood hazard or regulatory limit to development in their Official Plan documents. A 15 m setback is also applied to land development to accommodate wave uprush. Based on water level data from the Canadian Hydrographic Service (CHS) gauge in Midland Bay (managed and monitored by SSEA), the hourly maximum level reached in 2020 was 177.73 masl, only 27 cm below the 100 year flood level. These levels do not account for wave uprush. In the Great Lakes, the 100 year flood level is defined as the peak instantaneous still water level having a 1% probability of occurring in any one year.

Guidance from Binational, Federal and Provincial agencies indicate that climate change in playing a primary role in water level fluctuations for Lakes Michigan-Huron due to an absence of control structures at the inflow and outflow. Increasing shoreline resilience and adaptation measures is broadly recognized as being critical to protecting shoreline communities. In particular, the Ontario Government included actions targeted at Great Lakes flooding issues in the 2020 Protecting People and Property: Ontario’s Flooding Strategy. The SSEA supports these recommendations, in particular providing financial support to “enhance flood plain mapping” in areas outside of a conservation authority like Severn Sound.

Water Level Impacts High water levels, combined with wave uprush storm events, have caused damage to municipal infrastructure, residential properties, and natural areas in Severn Sound shoreline communities resulting in significant costs to municipalities and private landowners and business owners. Impacts of shoreline flooding and erosion include: destruction of beachfront property and structures, damage to roads and trails, flooding of private wells and septic systems, and damage to habitat such as tree die back, and wetland inundation.

To support Municipal emergency preparedness, SSEA staff completed a desktop mapping inventory of building structures adjacent to Severn Sound Southern shoreline areas with potential flood risk during high water condition periods. The Severn Sound area needs floodplain mapping and modeling that would assist municipal planning departments by identifying lands at risk of flooding due to high water levels.

Recommendations The Following actions are critical to ensure resilience in Severn Sound shoreline communities:

1. The Ontario Government invest technical and financial support for Severn Sound and its member municipalities to develop critical flood plain and wave up-rush mapping and modelling and further the development of Light Detection and Ranging (LIDAR), and monitoring/modelling data and upgrading weather stations. 2. Support efforts for shoreline communities to build resilience and support emergency preparedness measures including green infrastructure and private land stewardship. 3. Support municipal planning departments by reviewing and creating progressive planning policies, including the Provincial Policy Statement and the Provinces Low Impact Development policies 4. Through the Ministry of Natural Resources and Forestry, conduct a review of the 178m high water level, considering recent water level data and climate extremes 5. Support watershed organizations in providing resources and guidance for municipalities & residents for resilience and adaptation measures 6. Urge the Federal Government to support Great Lakes Action Plan 2030. This would include Governments of Canada and Ontario committing to establishing and funding Shoreline Resiliency Priority zones, including Southeastern Georgian Bay/Severn Sound, to identify and address significant threats from climate change (high water levels, stronger wind/wave energy, erosion, sudden spring thaws, ice jams) impacting natural and built infrastructure on Great Lakes shorelines, with an emphasis on naturalization and green infrastructure solutions

RECREATION Port McNicoll Recreation Committee Staff is currently working with the Port McNicoll Recreation Committee on some Fall youth programming. Details are being ironed out regarding some outside boot camp style programming with proper COVID precaution in place.

Fall Programming Staff is in the final stages of a plan to facilitate some Township run Adult Active Living Classes for the Fall Program set (10 week program from first week of October to first week of December).

Youth Dances The Victoria Harbour Recreation Committee will not hold a September youth dance. The Committee hopes to be able to resume come October.

PARKS MacKenzie Park Washrooms Staff has begun compiling a comprehensive list of all quotes obtained from the various independent trade contractors for the various aspects of this project. The building was demolished by Township Staff and the project is now ready for excavation and foundation/footing work. Staff is working with the various contractors who have been awarded different aspects of the project to put a plan in place for work to commence.

Veterans Park Playground Replacement The installation of the new playground equipment for Veterans Park in Waubaushene occurred August 5th-7th. The feedback from area residents and users has been very positive.

Oakwood Outdoor Rink Staff has completed an initial site cleanup of the area. The temporary winter rink boards have been left up until it is determine if any site works will be completed this year (before the snow).

FACILITIES Facility Rentals/Bookings Staff is in the very preliminary stages of trying to determine when and how indoor and outdoor facility rentals/bookings will re-open.

Miscellaneous Facility Work New flood lights at the Waverley Cenotaph (one was vandalized).

New pulley systems for the Waubaushene Cenotaph Flag Poles.

Front entrance of Municipal Office and all three Library Brach entrances were power washed and sprayed for spiders.

Report Title: Monthly Activity Report – Water Wastewater Operations

ORIGIN: Superintendent of Water & Wastewater Operations for the period of Aug 1, 2020 to Aug 31, 2020.

TREATMENT PLANTS: Port McNicoll Wastewater Treatment Plant train 1 sewage return pump failed this was the original pump installed in 2002. We have replaced this 7 ½ hp 600vac 3phase pump with the spare we had on hand and have sent the failed pump out for repair. Victoria Harbour Wastewater Treatment Plant Bio solids loading pump has been repaired and reinstalled in the sludge holding tank. On August 3, 2020 we had a heavy rainfall which caused a sewage surge through the VHWWTP and we were able to quickly divert the excess surge flows to the Sludge storage which we used as equalization to prevent a sewage by pass from occurring. Victoria Harbour Water Treatment Plant has had some issues with chlorination this month while we were awaiting our replacement chlorine pump however we have now received the new pump and installed it to address the chlorination issues and it is performing well. The variable speed controller on our reverse flow cleaning system for the Pall filters failed on August 9, 2020 due to a communication error, these units have had this issue previously. We had a spare CPU control board on hand to replace the failed unit and the pump is now back in service.

DISTRIBUTION & COLLECTIONS SYSTEMS: We have been experiencing hydro supply problems at Mitchell’s Beach sewage pumping station and Tay hydro has now resolved the issues with installing a separate transformer for our sewage pumping station.

The sewer flushing and CCTV for Victoria Harbour was conducted between August 3rd and 14th and we received the report on the August 25th, 2020. There are a number of immediate repairs required to address infiltration in the area of the beaches which we will obtain pricing on before proceeding with repairs. These will require trenchless technology to ensure no damage to the newly paved road surfaces. We had a water main break off the truck main servicing Port Mc Nicoll along Vents Beach Road requiring the isolation of the water system west of Vents Beach road for a period of approximately 6 hrs. The Ellen Street sewage pumping station pump 1 was replaced and the new check valve assembly installed. The sewage pumping station is now fully operational. We are still waiting on parts to repair the damaged pump for pump 1. Obtaining a new impeller for this pump is challenging as we had to send it back to the manufacture to determine its replacement.

Sewer Backups There were no sewer backups during this period.

ADVERSE DRINKING WATER: There was one adverse water quality report during this period, AWQI # 151332, which required the resampling of the roadside water sampling station located on Third Avenue in Port McNicoll. As directed by the SMDHU sampling was completed and all follow up samples both at this location and before and after this location came back with satisfactory results two days in a row, no further action was required and the AWQI was closed.

RECOMMENDATION: That report OS-2020-73 regarding the Disposal of Surplus and Unserviceable Equipment Float be received; And that staff proceed immediately with posting the surplus and unserviceable equipment float for online auction in as-is where-is condition; And that staff advise the resident that inquired about purchasing the equipment float that they may bid on the float via online auction.

INTRODUCTION/BACKGROUND:

Staff have received an inquiry from a resident about purchasing our old and unserviceable equipment float that has not been in use since its replacement with our current large equipment float. The old float would not pass a safety inspection and is not worth repairing to make road worthy. The resident wishes to acquire the old float for on private property use; a use that would not require a safety.

The Township’s asset disposal policy would normally have us send the equipment to auction either physically or by posting the item on an online auction site such as GovDeals.com. Either auction option would cost us approximately 15% of the auction sale amount in commission.

Alternatively the item could be posted for sale on the Township’s website at no cost, or offered directly to the resident that inquired about purchasing it. The Manager of Roads and Fleet Services has suggested a fair market value of approximately $500 for the old float.

ANALYSIS:

Getting the old float to a physical auction site would cost more than it is expected to return at auction, which is likely why it is still in our possession after a decade of not being used.

Posting for auction online on GovDeals.com is rather effortless; one of the Operational Services Administrative Assistants can get it posted in short order. This option is in line with our asset disposal policy and makes the asset available for purchase to the public at large, in a fair fashion. Once sold the purchaser would be responsible for removing it from our site.

Selling the float to the resident that inquired, directly, seems to be the least transparent way of disposing of an asset.

FINANCIAL/BUDGET IMPACT:

At an estimated value of $500 the financial impacts are negligible. The value is in getting unused and unwanted equipment off of our property and out of the way.

CONCLUSION:

Staff recommends that the old float be posted to GovDeals.com for auction as soon as possible and that the resident that inquired about its purchase be informed so that they can bid on the float if they are interested in doing so.

Zoning Certificates

1. For the month of August, 15 applications were received with an average review time of 2 days.

2. Staff have finalized the Site Plan Agreement for 4956 Talbot Street, which is presently with the applicant for execution. When finalized the development would be a new industrial type building, which is 670.32 square metres in size.

3. Staff has received the latest submission for 400 Newton Street, which is presently in circulation for comments from internal and external departments and agencies.

4. A Site Plan Application has also been received for 219 Pine Street (Waubaushene Gospel Hall). Staff have requested some additional items for the drawings including floor plans and zoning information of the existing and the proposed addition (123m2). Once this additional material is provided the application can be circulated.

5. Two Public Meetings occurred on August 26th, 2020, one being the Housekeeping to the General Zoning By-law and the other being the Talbot Street Corridor review from First Avenue to Seventh Avenue.

6. It is the intention of staff to bring both of these reports back to Council for consideration at the October COAC meeting once additional consultation occurs with our agricultural community.

7. Through a letter from the Minister Steve Clarke (Ministry of Municipal Affairs and Housing), the Proposed Amendment 1 to A Place to Grow: Growth Plan for the Greater (A Place to Grow) has been passed. These changes came into effect August 28, 2020. The date by which upper and single-tier municipalities must update their official plans to conform with the policies in A Place to Grow will remain July 1, 2022. For lower-tier municipalities, the deadline for conformity with this Plan will continue to be one year after the relevant upper-tier conformity amendment takes effect.

8. With the staffing changes within the Operations Services Department, there may be a delay in the review and approval of new and existing development applications. Planning and Development Services staff will continue to strive to ensure development applications proceed forward and that developments are approved.

I am writing in response to the notice of violation given by officer Rob Kennedy on August 6, 2020. Recently I registered a business under the name 'Alternative Lifestyles'. The purpose is to design and build high quality housing alternatives that can provide more attainable home ownership in this current housing market. Our units do not require a blackwater sewer system and are capable of off-grid options. About 6 weeks ago or so, my partner and I completed our first design. People from the neighbourhood started hearing about our project and became interested in our idea;viewing and taking photos. This led to a local facebook post garnering the attention of Paul Raymond and Rob Kennedy of Tay township. Both members of Tay township expressed enthusiasm regarding the post. Rob Kennedy personally stopped by and spoke to Marc Walker regarding the tinyhome and to see if there were any violations being committed. Rob asked if our tinyhome was listed on airbnb and he was told it was not. At the time Rob asked it was not listed on airbnb. At this time our tinyhome was up for sale and continues to be for sale as you can also view from our website. It was also at this time that it was expressed to Rob Kennedy that if someone was interested in purchasing our tinyhome model that they would be allowed to stay in it to test out the functionality of the unit and decide if they wish to purchase. Rob acknowledged this and did not express any further concerns. He was shown inside the unit and shown the incinerating toilet system to which he seemed to express much positive enthusiasm. About 4 weeks after Rob Kennedy viewed our tinyhome we listed our unit as a limited time offer business promotion online with Airbnb to try and garner attention of potential buyers. Rob Kennedy claims to have seen we had an airbnb listing and came to give notice of a zoning violation soon after. Rob Kennedy claims we have a travel/camper trailer instead of acknowledging we have an actual Tinyhome . To my understanding, Ontario has given authority to all municipalities to create the by laws to allow such Tinyhomes. They are recognized in other municipalities around Ontario and recognized across Canada in places like Vancouver, Alberta and Quebec. By definition our Tinyhome is not a temporary living space such as a camper trailer and the term 'Tinyhome' is not defined or recognized in the Tay by laws. Our units are winterized, sewerless and built by a seasoned licensed contractor. Features that travel/camper trailers are not required to have. Giving an unclear Notice of violation instead of trying to create a solution affects not only the community which I grew up in but it also affects my livelihood. This notice would restrict my right to gain and maintain a livelihood and not be deprived thereof thereby causing injury. Therefore, to prevent such an injury from happening, I request the township to acknowledge, define and permit tinyhomes as a viable housing option and create the by laws necessary to make them lawful in Tay township. We ask for the support from the Tay township Council to address the by laws regarding more affordable alternative housing solutions. Furthermore, we would like to bring to the attention of the council, the outpouring of community support for these types of alternative solutions. Within less than 24hrs we managed to get close to 1000 signatures and comments from people in and around the area that not only support what we're doing but support Tay township to prioritize this issue. I truly appreciate your time concerning this matter as it is becoming a topic of great importance in the area. We hope to be able to move forward in a positive manner and continue to keep an open discussion. My partner and I will be available to assist in any way possible.

After all the stories Ive heard, and the womans lives that have been affected by poverty and much more, I want to cry. Give this man a chance. He is doing the best he can. I still have received no help yet but will. But I have to keep striving, I won't quit. I plan to go back to school next year for Business. And am opening other businesses as well. This life can be soo good. But it shouldn't have to be like this.

4 Monitoring Programs Field/data collection: Open Water, Inland Lakes, PGMN, PWQMN/Tributaries, Stream Temperature, Stream Invertebrates and Climate

Adapting to COVID-19 Challenges

Due to COVID-19, both Provincial laboratories that SSEA sends water samples to for open water, lake, stream and groundwater monitoring programs have temporarily stopped accepting non-essential (i.e. not drinking water related) samples. We are reviewing our COVID-19 safety protocols for fieldwork, and will commence sampling in some capacity as soon as possible. The bulk of the work for many SSEA sampling programs (e.g. stream invertebrates, groundwater sampling) normally occurs in late summer into fall, and will hopefully not be impacted. In the meantime, there will be a focus on updating datasets and reporting on 2019 Raw Water Intake Sampling results.

Open Water • Completed 2 water quality sampling events at the raw water intake at the Tay Area and Rope Subdivision water intakes, using new safety protocols • Open Water sampling program on hold pending re-opening of MECP labs

Inland Lakes • Inland Lake sampling program on hold pending re-opening of MECP labs

Climate • Compilation of monthly Georgian Bay water level, regional climate data and ice off data

In support of the Economic Development Corporation of North Simcoe (EDCMS)A business recovery survey was completed by local North Simcoe businesses in July 2020. There were three open‐ended questions. Complete responses to the questions were provided. Each business that expressed interested in receiving the survey results will be sent the results and discussion on questions and comments will be provided. A recurring suggestion for EDCNS to support business was a shop local campaign. EDCNS will launch a campaign, I Love My Local … , the first week of September 2020.

DIRECT MAILING PROJECT Final expenses for the Direct Mailing Project have come in and the project has officially wrapped. Thank you to sponsors NSCFDC, Downtown Midland BIA and the County of Simcoe. We put the Discovery Guide in almost 22,000 homes and had the same number of eyes on the full-page ad in the Midland Mirror.

TIAO GRANT AWARDED We applied for, and received, a grant from TIAO in the amount of almost $24,000 for the purposes of marketing our region. The basis of the proposal is providing 2020 Discovery Guide advertisers with a no-cost opportunity for the 2021 publication.
