I N T R O D U C T I O N

The Criminal Justice System has come to realize the terrible price paid by victims of violent in our society. They suffer indignity, physical and mental impairment, and in all too many instances, loss of life.

Often they are confused by the complicated Criminal Justice System and their search for answers to personal injury, or the loss of a loved one.

This handbook, in an attempt to provide help and support to victims of violent crimes, was published by the Crime Victims Reparations Board of the Louisiana

Commission on Law Enforcement.

The Louisiana Commission on Law Enforcement receives aid from all Sheriffs,

District Attorneys, and numerous other agencies of the state in providing services, including cash payments, to all qualified victims of violent crime in Louisiana.

All funds utilized for these purposes are generated by court fines, and/or fees at the local, state and federal level and do not come from tax revenues.

134 Louisiana Address Confidentiality Program

Louisiana’s Address Confidentiality Program (ACP) is administered by the Louisiana Secretary of States Office and provides victims, who have moved to a new location unknown to their abuser, with a substitute address for use when interacting with state and local agencies. The program also provides participants with a cost-free first-class mail forwarding service.

To participate in the program, a client must meet all of the following criteria: --Be a victim of abuse, sexual assault or stalking --Be concerned for the safety of self, children or household members --Be a resident of Louisiana --Relocate or plan to relocate to an address unknown to her/his abuser --Not have made any public record in a new location such as : telephone, utilities, driver’s license, etc. --Live in a residence that the victim does not own. --Be 18 years of age or older, be a parent of guardian acting or behalf of a minor or an incapacitated individual.

The Crime Victims Reparations Program

Eligibility, Benefits, and Applications

Victims of violence and their families must deal with emotional, physical, and financial aftermath of crime. The Louisiana Crime Victims Reparations Fund helps innocent victims and their families when they have no other means of paying for the financial cost of crime. The fund is administered by the Crime Victims Reparations Board under the jurisdiction of the Louisiana Commission on Law Enforcement. The money in the fund comes from people who break the law.

Who May Qualify

An innocent victim of a violent crime who suffers physical and/or emotional harm or death or catastrophic property loss.

A person who legally assumes the obligations or voluntarily pays certain expenses related to the crime on behalf of the victim.

Immediate family members needing counseling as a result of the consequence of death of the victim.

What Crimes Are Covered

Crimes that involve the use of force or the threat of the use of force and result in a personal injury, death or catastrophic property loss.

Only these motor vehicle related crimes: DWI, Hit and Run, victim of a driver who is fleeing apprehension by law enforcement, or a victim whose injuries were intentionally inflicted with a vehicle.

Applications are also available from all Louisiana sheriffs’ offices. The victim reparations coordinators provide assistance to victims who ask for help in filling out application forms. Victims may also get an application directly from the Crime Victim’s Reparations Office by calling 1-888-6- VICTIM.

The Louisiana Protective Order Registry (LPOR)

The LPOR is a statewide repository of court orders issued to prohibit domestic abuse and dating violence, and to aid law enforcement, prosecutors and the courts in handling such matters, was established by legislative act (La. R.S. 46:2136.2) in 1997. The Judicial Administrator’s Office of the is responsible for developing and disseminating standardized forms, called “Louisiana Uniform Abuse Prevention Order” forms, and for collecting and entering the data from all courts into the registry.

Records contained in the registry are made available to state and local law enforcement agencies, district attorney offices, the Department of Social Services, office of family support, support enforcement services, office of community services, the Department of Health and Hospitals, bureau of protective services, the Governor’s Office of Elderly Affairs, elderly protective services, the office of the attorney general, and the courts.

Registry staff respond on a 24/7 basis to requests for order verification submitted by examiners with the FBI’s National Instant Criminal Background Check System (NICS), which is designed to prevent the sale of firearms and ammunition to those who are the subject of a qualifying order of protection.

Staff respond on a 24/7 basis to requests for order verification submitted by local, state, and out-of-state law enforcement officials conducting investigations involving the subject of a Louisiana order of protection.

In addition, The LPOR staff respond to calls for general information during business hours about:  orders of protection  how to obtain them,  technical assistance in the use of the standardized order forms and the forms-related software, and  requests for referrals from victims of domestic violence who are searching for assistance that is provided in their respective community.
