Introduction

Eliaser Tuhadeleni (Kaxumba kaNdola), Andimba Herman Toivo ya Toivo and 35 other Namibians were taken prisoner after the 26 August 1966 “Battle of Omungulugwombashe” and taken to Pretoria for trial. They were accused under the infamous “Terrrorism Act” which had been passed in the South African Parliament only after their alleged crimes, and made applicable retrospecticely. Therefore, the trial became known as “Terrorism Trial”, although it was not the only trial conducted under this Act.

The accused were under threat of the death sentence, but international pressure led to them being sentenced to imprisonment of various length, several to life imprisonment, which they served on . Apart from those who were released after serving shorter sentences, and those who died on the Island, all prisoners were finally released in 1984.

The trial received considerable international attention, with international observers being sent to attend the proceedings, and a substantial literature about the case exists. Reporting on the trial and in particular the famous speech by were instrumental in promoting international support for cause.

Administrative History

These archives are photocopies of the court proceedings of the South African “Terrorism Trial”, The State vs Eliaser Tuhadeleni and 36 Others”, held in Pretoria between 1967 and 1968.

The copies are in the same order as the originals which are kept at the National Archives of South Africa in Pretoria.

The original documents in Pretoria also contains dictabelts, i.e. sound recordings of some of the court proceedings. Those have not been copied.

The majority of the documents are in Afrikaans, while some are in English. The spoken testimonies by the accused and some state witnesses, if they were given in Oshiwambo, were translated mostly into Afrikaans, and sometimes into English, and the translations were transcribed. No original Oshiwambo text has been preserved.

The photocopying of the originals was done by National Archives of Namibia staff in March/April 2001, and the quality of the copies is good. There is some duplication of documents, since this is also the case in the original.

In addition to the court proceedings, the archives also contain copies of items found on the accused during their capture, and presented to the court as evidence, including documentation such as correspondence, SWAPO literature, etc.

The accession comprises of nine standard archival boxes.
