3. La spécificité des syndicats mixtes loi SRU (Article L.5722‐7 du Code Général des Collectivités Territoriales)

La Loi SRU (articles 111‐112 codifiés aux articles L.1231‐10 à L.1231‐13 du code des Transports) a offert la possibilité aux AOT de prélever un versement transport additionnel (VTA) pour celles qui s’associent au sein d’un syndicat mixte de transport, exerçant obligatoirement trois compétences cumulatives :

- La coordination des services sur un territoire ; - La mise en place d’un système d’infformation à l’attention des usageers ; - La création d’une tarification coordonnée et de titres de transport uniques ou unifiés.

Ainsi, le syndicat mixte SRU peut prélever le VTA au taux maximal de 0,5%, destiné au financement des transports en commun, « sur les espaces à dominante urbaine (EDDU)1 d’au moins 50 000 habitants, incluant une ou plusieurs communes centres de plus de 15 000 habitants, dès lors que le syndicat mixte associe au moins la principale AOTU. »

Hors des ressorts territoriaux, le taux du VTA est fixé à 0,5% maximum. A l’intérieur des ressorts territoriaux, des règles précises fixent les modalités de mise en place du VTA. (http://circulaires.legifrance.gouv.fr/pdf/2009/9/03/cir_26797 2.pdf)

Impact de la loi sur la ssimplification du droit et l’allègement des démarches administratives du 22 mars 2012

Son article 33 dispose que le code général des collectivités territoriales est ainsi modifié :

1° L’article L. 2333‐67 est complété par un alinéa ainsi rédigé : « TToute modification de taux entre en vigueur au 1er janvier ou au 1er juillet de chaque année ; la délibération fixant le nouveau taux est transmise par l’’autorité organisatrice des transports aux organismes de recouvrement avant, respectivement, le 1er novembre ou le 1er mai de chaque annnée. Les organismes de recouvrement communiquent le nouveau ttaux aux assujettis au plus tard un mois après ces dernières dates. »

2° L’article L. 2531‐4 est complété par un alinéa ainsi rédigé : « TToute modification de taux entre en vigueur au 1er janvier ou au 1er juillet de chaque année ; la délibération fixant le nouveau taux est transmise par le Syndicat des transports d’Île‐de‐‐France aux organismes de recouvrement avant, respectivement, le 11er novembre ou le 1er mai de chaque année. Les organismes de recouvrement communiquent le nouveau ttaux aux assujettis au plus tard un mois après ces dernières dates. »

En application de cet article, venant modifier les articles L.2333‐67 et L.2531‐4 du Code Général des Collectivités Territoriales, les changements de taux de versement transport entreront désormais en vvigueur les 1er janvier et 1er juillet de chaque année. Les délibérations corresspondantes, qui devront mentionner de manière précise l’une des deux dates précédentes, devront être adressées à l’ACOSS avant les 1er mai et 1er novembre. Ainsi, l’ACOSS informera les assujettis avant les 1er juin et 1er décembre.

Ces délibérations étant soumises au contrôle de légalité des préfets, il faut veiller aux délais de transmission pour que celles‐ci puissent être adressées à l’ACOSS avant les 1er mai et 1er novembre.

Afin d’éviter toute imprécision, nous vous incitons à joindre, à votre délibération de changgement de taux de VT, la liste des communes composant votre ressort territorial ainsi que les taux de chaque commune en cas d’assujettissement progressif notamment.

Enfin, nous vous conseillons de ne pas attendre la date butoir des 1er mai et 1er noovembre pour envoyer vos délibérations car tout retard dans l’envoi entrainera le report du changement de taux de VT à la date suivante.

1. Les AO ayant instauré le versement trransport

En 2015, hors Île‐de‐France, le versement transport est prélevé dans 243 AOM et 2 syndicats mixtes SRU1.

Toutes les AOM de plus de 100 000 habitaants lèvent le versement transport à l’exception du Grand Nouméa2, alors qu’elles sont 71 % dans celles de moins de 100 000 habitants.

2. Les AO ayant instauré le versement trransport additionnel (VTA)

La perception d’un versement transport addditionnel, disposition autorisée ppar la loi SRU, concerne désormais 7 syndicats mixtes SRU :  le Syndicat Mixte des Transports en commun de l’Hérault (depuis 2004)  le Syndicat Mixte des Transports Collectifs de l’Oise (depuis 2007)  le Syndicat Mixte des Transports Suburbain de Reims (depuis 2010)  le Syndicat Mixte des Transports « Fil Vert » des Hautes‐Pyrénées (depuis 2010)  le Syndicat Mixte de coordination des Transports d’Eure et Loir (deppuis 2014)  le Syndicat Mixte des Transports de l’Agglomération Lyonnaise1 (depuis 2015)  le Syndicat Mixte Intermodal Régional de Transport du Nord‐Pas de Calais (depuis 2015)

3. Les AO n’ayant pas instauré le versement transport

En 2015, dans 65 ressorts territoriaux, lee VT n’avait pas été instauré pouur financer le réseau de transport :  1 RT de plus de 100 à 200 000 habitants : Nouméa2

En 2015, parmi les syndicats mixtes SRU, 11 d’entre eux ne levaient pas cet impôt.

II. LE PRODUIT DU VERSEMENT TRANSPORT EN 2015

Le versement transport France entière s’élève à 7 671 millions d’€, en progression par rapport à 2014 de plus de 2% en monnaie courante eet constante :

. Province : 3 918 millions d’€, + 1,4% en euros courants et constants . Île‐de‐France : 3 753 millions d’€, + 4% en euros courants et constants (données STIF).

Le versement transport additionnel collecté en 2015 est de 31 millions d’€,, connaissant une baisse de ‐6,7% en monnaie courante et constante par rapport à l’année précédente.

A NOTER :

L’évolution du VTA est à prendre avec précaution : en 2014, le Syndicat mixte des transporrts du Rhône (SMTR) levait à la fois du VT et du VTA, et il ne lui était pas possible de les différencier. Ainsi, le produit tottal de VTA 2014 comprenait, pour le SMTR le VTA levé sur le Rhône, le VT et le VTA de la Communauté d’Agglomérattion Villefranche‐Beaujolais‐ Saône et le VT et le VTA de la Communauté de communes de l’Est Lyonnais. En 2015, le SYTRAL a pris la suite du SMTR et désormais, les deux produits VT et VTA sont bien distincts ce qui explique la baisse de VTA entre ces deux années. Pour les traitements statistiques ci‐après, le produit de VT 2015 de Villefranche‐sur‐Saône n’a pas été pris en compte, ils ont ainsi été réalisés sur 245 ressorts territoriaux sur les 246 recensés en 2015.

Répartition du produit du VT selon la taille des ressorts territoriaux en 2015

Les 28 ressorts territoriaux ayant un TCSP lourd en service perçoivent à eux seuls 63% du produit du versement transport hors Île‐de‐France. Les 11 ressorts territoriaux de plus de 200 000 habitants et ceux de 100 à 200 000 habitants en collectent respectivement 10% et 19% tandis que les ressorts de moins de 100 000 habitants se partagent les 8% restant.

Le rendement du VT par habitant, c’est‐à‐dire le produit du VT rapportéé au taux de 1% et à la population, s’élève à 72€ en moyenne en 2015, enregistrant une évolution quasi‐nulle de 0,1% en monnaie constante. Si le rendement progresse dans les agglomérations de moins de 100 000 habitants (+0,9% dans celles de moins de 50 000 habitants et +0,7% dans celle de 50 à 100 000 habitants), il connait une diminution dans les autres strates : modérée dans les agglomérations de 100 à 200 000 habitants (‐0,2%), plus importante dans les agglomérations de plus de 400 000 habitants dotées d’un TCSP lourd en servvice (‐0,6%), celles de plus de 200 000 habitants (‐1%) et celles de moins de 400 000 habitants avec TCSP lourd en service (‐2,2%).

Le produit du VT a augmenté dans 154 ressorts territoriaux, tandis qu’il a accusé une baisse dans 84 ressorts territoriaux.

Ainsi, 42 RT ont vu leur produit du VT augmenter au‐delà de 10% tandis que 9 RT ont vu leur produit du VT diminuer de plus de 10%.

Les marges de manœuvres sur les taux s’amenuisant, on observe, pour 2015, près d’une trentaine d’augmentation de taux de VT, essentiellement dans les ressorts territoriaux de 100 à 200 000 habitants :

En 2015, dans 61% des ressorts territoriaux, le taux de VT était fixé au taux plafond. Dans les agglomérations à TCSP, les marges de manœuvre sont quasi inexistantes. En revanche, les autres AO disposent de plus de flexibilité parce qu’elles ont décidé la réalisationn d’un TCSP ou car elles ont encore la possibilité d’actionner le levier « commune touristique ».
