INDICTMENTANDCHARGES TheinitialindictmentagainstMomirTalićandRadoslavBrñaninchargedbothaccusedwithindividualand superiorresponsibilityinrespectoftheallegedpersecutionofBosnianMuslimsandBosnianCroatsinthe AutonomousRegionofKrajina(ARK)betweenAprilandDecember1992.Bothaccusedchallengedtheform oftheindictmentresultinginthreefurtherindictmentsbeingfiled.TheillhealthofMomirTalićresulted inseparatingtheproceedingsagainsthimfromthoseagainst RadoslavBrñaninon20September2002. Subsequently, on 7 October 2002, the Prosecution filed a new, fifth amended indictment against the accusedRadoslavBrñaninonly. ThefinalindictmentbroughtagainstMomirTalićwasthefourthcorrectedamendedindictmentanditwas filedon10December2001.ThisistheoperativeindictmentinthecaseandallegesthatMomirTalićwas ChiefofStaff/DeputyCommanderoftheJNA5 th CorpsinBanjaLukaasof26July1991.Heremainedin thispositionuntil19March1992,whenhewasappointedCommanderofthesameCorps,whichwasre designatedasthe1 st KrajinaCorpsoftheRepublikaSrpskaArmy(VRS).Byvirtueofhisauthority,General Talić, directly or through his Chief of Staff, his assistants, heads of branches, and other officers, commandedallunitsofthe1 st KrajinaCorpsandunitsattachedtoit.Hedirectlycontrolledtheworkof theCorpsCommand;madedecisionsfortheCorpsandsubordinateunits;assignedtaskstosubordinates; issuedorders,instructionsanddirectives;ensuredtheimplementationoftheseorders,instructionsand directives and bore full responsibility for their completion; monitored the situation in the area of responsibilityoftheCorps;ensuredthepassageofinformationtosuperiorcommands,civilianandpolice bodies;andwasresponsiblefortheoverallstateandconductoftheCorps. According to the indictment, it was in this capacity that Momir Talić implemented the policy of incorporating the ARK into a Serb State. The implementation of that policy required the permanent removaloftheBosnianMuslimandBosnianCroatpeople,andthedestructionoftheircultureinthose municipalitieswheretheyhadlivedforcenturies.TheindictmentalsostatesthatGeneralMomirTalićwas publicly named as one of the members of the ARK Crisis Staff. This Crisis Staff, later renamed War Presidency,wasoneofthestructuresputinplace bytheleadershipofthe BosnianSerbsinorderto achievethecommonpurposeofthejointcriminalenterprise.ItisallegedthatGeneralMomirTalićand othermembersoftheARKCrisisStaffwerecoperpetratorsinthisjointcriminalenterpriseand,assuch, theirparticipationintheexecutionofthecommon purposeoftheenterpriseincludedactivitiesofthe CrisisStaff.TheaccusedGeneralMomirTalićwasallegedlycriminallyresponsibleforconductofother participants in the joint criminal enterprise, including members of the ARK Crisis Staff and those implementingitsdecisions,whentheirconductwaswithinthecommonpurposeoftheenterpriseorwasa naturalandforeseeableconsequenceoftheexecutionofthecommonpurpose. MomirTalićwaschargedonthebasisofindividualcriminalresponsibility(Article7(1)oftheStatute)and superiorcriminalresponsibility(Article7(3)oftheStatutewith: • Genocide;complicityingenocide(genocide,Article4) • Persecutions;deportation;inhumaneacts(crimesagainsthumanity,Article5) • Extermination; wilful killing; torture (crimes againsthumanity,Article5;and grave breachesofthe GenevaConventions,Article2) • Wanton destruction of cities, towns or villages, or devastation not justified by military necessity; destruction or wilful damage done to institutions dedicated to religion (violations of the laws or customsofwar,Article3) • Unlawful and wanton extensive destruction and appropriation of property not justified by military necessity(gravebreachesoftheGenevaConventions,Article2) THETRIAL ThetrialofRadoslavBrñaninandMomirTalićcommencedon23January2002.
