INTRODUCTION The matter before the Court is the Second Amended Complaint filed by the Commonwealth of Massachusetts, through its Attorney General, Martha Coakley. Together with the United States trustee, the Commonwealth seeks, inter alia, the denial of Alec G. Sohmer’s discharge pursuant to 11 U.S.C. § 727(a)(2), (3), (4), and (5). On August 28, 2009, this Court granted the Joint Motion to Sever and Conduct Trial on Plaintiffs’ 1 Case 06-01433 Doc 247 Filed 07/20/10 Entered 07/20/10 14:25:47 Desc Main Document Page 2 of 44 Claims pursuant to 11 U.S.C. § 727. The Commonwealth and the United States trustee (collectively, the “Plaintiffs”) asserted, and the Court agreed, that trial on the claims arising under 11 U.S.C. § 727 would promote the interest of judicial economy as the Commonwealth’s claims under 11 U.S.C. § 523(a) would be rendered moot if the Plaintiffs prevailed on the claims under 11 U.S.C. § 727. As a result of the August 28, 2009 order, the Court conducted a three and one-half day trial beginning on February 23, 2010 and concluding on March 10, 2010 with respect to the Count I of the Second Amended Complaint.
