Methods

The four publicationsby Fitzgeraldin which new speciesofAcacia were describedhave different histories and deal with speciesfrom different geographicalareas. We consider here each paper separately,arranged chronologically by dateof publication. For eachpaper we provide information relevantto thetypification ofthe namescontained therein. For eachnew specieswe provide the taxon name and author citation, the placeofpublication and aprecisequotation ofthe type citation given in the protologue;this is followed by the type designationin which we give the dataon the type sheet,the abbreviationof the herbariumholding theprincipal type specimenand the abbreviationsofthe herbaria "Note" holding duplicatesof the type. Twenty-three new speciesof Acaci(l from south-westWestem were describedin this publication. These namesWere based on Fitzgerald's own gatheringsexcept for A. duriuscula arLd A. resinomarginea(which were basedon E. Kelso collections) ar,dA.andrewsii (which was basedon both C.R.P. Andrews and W.V. Fitzgerald material). Some Fitzgerald collections were made in September1898 and July 1899,but most were gatheredbetween June and November 1903.

Although many collectionsfrom WesternAustralia had beenmade earlier, it was not until the end of the 19th century and the beginning of the 20th, when Fitzgerald was collecting, that specimens began to be retained locally, first at the Western Australian Museum with the encoulagementof B.H. Woodward, and slightly later at the Bureau (later Department) of Agriculture with the appointunentof Alexander Morrison as the first official botanist (Green 1990). Even though these efforts provided focus for the beginning of two small herbalia in Perth many collections continued to leave the State. The collections of W.V. Fitzgerald provide an example of this outward flow of "Fitzgerald matedals. According to Green (1990: 24) donateda set of sPecimensto the Department of Agriculture, of which many duplicateswent to J.H. Maiden in NSW." In addition,NSW purchased a setofspecimensin aboutlate 1909(vlaJ. Staer,K.F. Kenneallypers comm ), which, asnotedbelow, we suspectrepresented Fitzgerald's personalcollection. Also, as will be seenfrom the discussions below, some specimenseven found their way to Europeanherbaria such as BM and K.

The bestrepresentation ofcollections on which Fitzgeraldbased his newAcacia namesfor species published in this 1904 paper are at NSW and PERTH. From our examinationof thesematerials we have discernedwhat appearto be pattems that reflect the historical flow of specimensreferred to above. This information has been used in our deliberations on the typification of Fitzgerald names. The Acacia specimensare accompaniedby two types of printed labels, both of which are annotatedin Fitzgerald's hand:

(1) Labels on pink paper stock. PERTH hasthe most comPrehensiveset ofspecimens with this type of label, both in terms of the number of taxa representedand the data content of the labels. Of the 21 speciesbased on Fitzgeraldcollections, PERTH hasspecimens with pink labelson all but one (i.e. A. acutata) whercas NSW has only 13. The labelsaccompanying theBM specimensare inFitzgerald's handand are from what wepresume was his personalherbarium. At NSW the specimensofthe samecollections (exceptA. hynesiqnaar'd A. kochii) are annotatedby Fitzgerald with the publishedname but unlike thoseat BM the rest ofthe label is not in his handand the specimensare not from his personalherbarium. Except where otherwise noted below, specimensthat we have seenof thesesame collections at K, MEL and PERTH are not annotatedby Fitzgerald. Sincethere are annotated sets ofFitzgerald specimensat both BM and NSW, lectotypification is regardedas desirable. In designatinglectotypes we have,exc eptforA. inaequiloba, given preferenceto the BM specimens.

Publication ofthis paperwas delayedfor someconsiderable time, apparentlyfor lack offunds for printing. On page 286 ofthe volume in which Fitzgerald's new specieswere published,the editor, JamesBritten, commented"We notewith regretthat thepublication of severalplants described by Mr. W.V. Fitzgerald on pp. 18-23 has been anticipated by Dr. Ewart and Dr. Jean White in their 'Contribution to the Flora of Australia' lEwart, White and Wood 191l]... It is right to say that the author is not to blame for this, at any rate in the majority of cases,as his paper had been in our possessionsome time before its publication ...." He goeson to say that becauseEwart and White had failed to include Latin diagnoses,their namescould not be regardedas validly published. While he "International was correctat the time he wrote the note,the CodeofBotanical Nomenclature"(Greuter er al. 1988) has requiredLatin diagnosesfor valid publication only since 193 5. Of the six speciesof Acqcia describedin this 1912 paper tkee had been published earlier by Ewa and White (1911), namely, A. ewartiqna W. Fitzg. ex J. White (= A. dielsit E. Plitzel), A. leptoneura Benth. var. eremophila W.Fitzg. exEwart&J. White (=A. eremophilaw.Fltzg.) andA. kochii W. Fitzg. exEwart &J. White. Both Fitzgeraldand Ewart & White basedtheir nameson the sameMax Koch collections, although we know (or presume) that they used different specimens. A similar situation was encounteredby Short (1992): MEL specimenswere usedby Ewart and White to describeTrichinium eriotrichumw.Fitzg. ex Ewart & White (1910)and, quite independently,Fitzgerald descdbedPtilo/rs eriotrichus (1912) on the basisof different specimensof the samecollection at NSW.

Becausethree of the speciesin this 1912 paper were basedon Max Koch collections,it must be recalled that Koch's numbersare taxon numbers,not collecting numbe$, thus one often encounters specimenswith the samenumber but with different dates. This unfortunatesituation often leads to difficulties when typifying names based on Koch collections. Therefore, in order to specify unambiguouslya particular gatheringone must associatethe taxon numberwith a date ofcollection. At NSW the problem is sometimescompounded by the earlier policy of not mounting specimens;as a consequencethere is the potential for labels and their associatedspecimens to become separated and mixed.

Note. As evidencedby sheetsat BM, MEL, NSW andPERTH thereis variationin the dateofcollection of Koch 1616. Koch's own labelsgive the dateas August and Septemberof both 1904and 1905. The BM sheetof 1616 supportstwo specimensand two labels (one annotatedAugust 1905 by Koch, the other september 1904by Fitzgerald). The leflhand specimenon the sheet(which we havechosen as the lectotype)is the more informative and we asumethat the Fitzgeraldlabel with the september1904 date belongs to this specimen. The single MEL specimenof Koch 1616 (which is dated by Koch as September1905) is the holotypeof A. kochiiW.Fitzg. ex Ewart & White (t9l l).

3. Speciesdescribed in Maiden, J. & Proc. Roy. Soc. New South Wales 51: 71-124 0917)

In this paper tkee new Kimberley Acacia specieswere described,namely, A. curticarpa, A. kimberleyensisand. A. pachyphloia. Although Maiden provided the Latin descriptionsand added some observationsof his own he clearly attributed thesetaxa to Fitzgerald (see protologues,also footnote on title page of paper). Thus, as with Short (1993), we regard the author citations to be W. Fitzg. in Maiden, not W. Fitzg. ex Maiden & W. Fitzg. as is given by Chapman(1991).

A knowledgeofthe history ofthepublication ofthesethree names bears on the typification of them. "Notes Initially Fitzgeraldprepared the descriptionsas part ofa largemanuscript entitled on the Flora of North-West Australia with descriptionsofsome new generaand species". As discussedby Short (1993) this manuscript was completed by, at the very least, early 1912. A copy was submitted to J. Britten (BM) around this time with the requestthat it be published,but this never happened. The manuscript indicates by symbols that Fitzgerald specimensof a number of the species,including A- curt'icarpa and A. kimberleyensis,were depositedat BM. In 1916Fitzgerald submittedanother "with copy of the manuscriptto J.H. Maiden (NSW), along someherbarium specimens" (Maiden in Fitzgerald 1918). Maiden subsequentlycommunicated this to the Royal society of where it was published in 1918. In the previousyear, however,Maiden had publishedfor Fitzgerald the three newAcaciaspecies;this wasdone in the contextof areview ofAcaciaspecies"MrFitzgerald has recordedas new for the tropical west" (Maiden 1917). In his own publication Fitzgerald (l9lg) merely listed thesethree names,noting that they had aheady beenpublished in Maiden's paper. As a matter of interest, in 1906 Fitzgerald had published photographs and habitat notes, but no "The descriptions,ofA. curvicarpa andA. kimberleyensisin WesternMail" (perth).

Fitzgerald collectedthe matedal ofhis thrce rrcwAcactaspecies when he was a memberofcharles crossland's expeditionto the Kimberleyin 1905. with referencetoFitzgerald's Kimberley collections "have Maiden (1917; 108) statedthat some been very much dispersed,and no completeset ofthem ..Some exists;". He further notedthat he had receivedFitzgerald specimens from two sources:(l) of Mr. Fitzgerald's specimenscame into my carethrough purchase from a personinto whosehands they ,,Some had passed...."li.e. via L Staerin about late 1909, K.F. Kenneally pers. comm.l; (2) of Mr. Fitzgerald'sAcacias from the herbariumofthe w.A. DepartmentofAgriculture (receivedby me from Dr. F. Stoward) are published in the presentpaper." The following year(1918) in a sedesof notes prefacing Fitzgerald's most important publication on the Kimberley, Maiden statedthat,.In Apdl, 1917,I receivedfrom Dr. Stoward,specimens of53 speciesnow describedin this paper. Theseare in the National Herbarium of Sydney,and the original set is with Dr. Stowardat perth.', Although there were noAcacia speciesdescribed in this work, Maiden's comment showsthat he consideredthe first setofFitzgerald's Kimberley specimensto be in Perthand the duplicateset atNSW. In our typification of A. curticarpa andA. kimberleyensis(below) we have adoptedthat point of view in regardingthe PERTH specimensas the primary set.
