Reviews are conducted in line with Cabinet Office guidance to ensure that an ALB’s delivery contributes to departmental strategic priorities and to examine the body’s efficiency, effectiveness, accountability and governance arrangements in a fair and transparent way. 1.2 The Sentencing Council is a Non-Departmental Public Body (NDPB) sponsored by the Ministry of Justice (MoJ); its remit is to issue guidelines on sentencing for the judiciary and criminal justice professionals and to increase public understanding of sentencing. 1.3 The review consulted key stakeholders (see Annex C) and considered a range of evidence including reports and advice published by the body. It was supported by a critical friend, the Chief Executive of the Law Commission, who provided input throughout the review and challenge to the assumptions and recommendations. 1.4 The review found that the current delivery model as a NDPB is still the most appropriate, that the Council’s functions are still required, and that the Council is effective and efficient in the delivery of its responsibilities. Tailored Review of the Sentencing Council of England and Wales 3 1.5 Key recommendations from this review are as follows: Recommendations Page Number Form and Functions 1. Publish a description of how the Council’s Business Plan is devised and its priorities set p14 Internal governance With a view to improving its internal governance the Sentencing Council should: 8. Collaborate with the Department to agree and implement a Framework Document. It should be published on the Sentencing p10 Council website and reviewed every three years; 9. Clearly define the role of the Senior Management Team in its Annual Reports and Framework Document; and p11 10. Consider expanding the remit of its Governance Committee to include formal responsibility for the Council’s risk register and p11 Business Plan. This should include monitoring performance against Business Plan objectives with the appropriate authority for ensuring the Council’s compliance with the risk register, and for meeting its Business Plan objectives.     Annual consultation on the Ministry of Justice and its Arms Length Bodies’ statistical work-plan 2013/14 Overview by the Ministry of Justice’s Chief Statistician It is with pleasure I bring forward the Ministry of Justice’s consultation on forthcoming work for 2013/14. This is the fourth year in which we have consulted on the Ministry of Justice’s work-plan and the previous consultations have led to wide-ranging improvements to the methodology, presentation and dissemination of statistics in Ministry of Justice and its Arms Length Bodies. Following consultation with our users, we have, over the past year: - Worked hard to improve the commentary surrounding our statistics. We have aimed to focus more on interpretative commentary; to better explain why trends are behaving as they are and to give the wider context. - Launched the Justice Data Lab; a new service helping organisations working with offenders assess the impact of their work on re- offending. - Significantly developed data linking across the Criminal Justice System and with Other Government Departments to improve our knowledge of the offender population. - Expanded the POLICE.UK website to include justice outcomes as well as crimes. - Produced several new publications exploring the following topics in detail: -Sexual offences -Language services in courts and tribunals -The relationship between employment and re-offending - Undertaken a UK Statistics Authority assessment on the Offender Management, Safety in Custody and MAPPA reports. All these have now taken on board the recommendations from the assessment and are all designated as National Statistics. - Begun the UK Statistics Authority assessment process for our Youth Justice Statistics publication to gain National Statistics status.

Why is government intervention necessary? The law governing sentencing procedure has undergone a substantial and significant degree of change over the past 30 years and has become overwhelmingly complex and disparate. The current provisions governing sentencing procedure run to over 1300 pages, with provisions contained in Acts as varied as the Company Directors Disqualification Act 1986 and the Dangerous Dogs Act 1991. In practice, many sentencing determinations require the judge to have reference to overlapping, technical and complex sentencing regimes alongside the current law. Practitioners and the judiciary reported to us that they find it complex and difficult to understand the current law. This leads to delay, costly appeals and the imposition of many unlawful sentences. Government intervention is required to simplify and streamline the law in this area so as to ensure that it is accessible and avoid undue errors and delays. The policy objectives are: (1) to ensure the law in relation to sentencing procedure is readily comprehensible, and operates within a clear framework; (2) to increase public confidence in the criminal justice system; (3) to ensure the criminal justice system operates as efficiently as possible.

    TNI – IDPC – Sentencing Council Expert Seminar on Proportionality of Sentencing for Drug Offences London – 20th May 2011 The Expert Seminar on Proportionality of Sentencing for Drug Offences was an initiative of the Transnational Institute (‘TNI’) working together with the International Drug Policy Consortium (‘IDPC’) and co-hosted by the Sentencing Council of England and Wales (‘SC’). The seminar was funded by the European Commission and the Open Society Institute and took place in London, England on 20th May 2011. Thanks are due to Mike Trace for chairing. This seminar is the third in a series of expert discussions on drug policy designed to feed into moments of opportunity for policy and law reform at national and international level with detailed technical analysis and through examples of best-practice from across different jurisdictions. The moment of opportunity in this case was the Sentencing Council’s consultation on sentencing for drug offences which is due to produce definitive sentencing guidelines for England and Wales in the next year. The first in the seminar series was on the classification of controlled substances1 and the second on threshold quantities2. Two more are currently scheduled for this year; one on mild plant based stimulants such as khat, coca, ephedra and kratom, and another on the future of the UN drug conventions3. The seminar was held under Chatham House rule to ensure confidentiality and to allow participants a free exchange of ideas. A total of 31 people attended and comprised a mixture of domestic and international policy officials, the judiciary, and practitioners as well as representatives from non-governmental organisations and academic institutions.
