MINUTE of MEETING of ANGUS COUNCIL held in the Town and County Hall, on Tuesday 22 May 2007 at 4.00 pm.

1. INTERIM CHAIRMAN OF MEETING

In terms of Section 4(4) of the Local Government etc () Act 1994, Mr David Sawers, Chief Executive, in his capacity as Returning Officer, took the chair and welcomed all members to the first meeting of Angus Council following the ordinary election of Councillors on Thursday 3 May 2007.

2. NOTIFICATION OF MEMBERS ELECTED

There was submitted and noted a return of the undernoted persons elected as Councillors for the eight wards within the Angus Local Government area following the ordinary election of Councillors on 3 May 2007.

The Chief Executive reported that he had received notification that Councillor Myles was the Leader of the Angus Alliance Group, comprising Councillors Andrews, Brown, Fairweather, Lumgair, Mackintosh, May, Leslie Melville, Millar, Murphy, Myles, Nield, Rymer, Salmond, Thomson, Whyte and that Councillor Rob Murray was the Leader of the SNP Group.

3. DECLARATIONS OF INTEREST

The Council resolved to note that no declarations of interest were made.

4. ELECTION OF PROVOST

Councillor Murray, seconded by Councillor Morrison, moved that Councillor Oswald be elected the Convener of the Council, to be known as the Provost, in terms of Section 4(1) of the Local Government etc (Scotland) 1994.

5. ELECTION OF DEPUTE PROVOST

COUNCILLOR MYLES, SECONDED BY COUNCILLOR MACKINTOSH, MOVED THAT COUNCILLOR MURPHY BE ELECTED AS DEPUTE CONVENER OF THE COUNCIL, TO BE KNOWN AS THE DEPUTE PROVOST, IN TERMS OF SECTION 4(2) OF THE LOCAL GOVERNMENT ETC (SCOTLAND) ACT1994.

Councillor Murray, seconded by Councillor Bill Middleton, moved as an amendment, that Councillor Oswald be elected. 223

6. THE ETHICAL STANDARDS IN PUBLIC LIFE ETC (SCOTLAND) ACT 2000 THE COUNCILLORS’ CODE OF CONDUCT

With reference to Article 12 of the minute of meeting of the Strategic Policy Committee of 6 February 2007, there was submitted Joint Report No 439/07 by the Chief Executive and the Director of Corporate Services advising members of their responsibilities as Councillors under the Councillors’ Code of Conduct and associated statutory guidance issued by the Standards Commission.

The Council resolved:-

(i) to note the legislative framework on the behaviour and conduct required of Councillors which was aimed at promoting the highest standards in public life; and

(ii) to note the specific requirements in relation to registration and declarations of interest.

7. MEMBERS’ ALLOWANCES 2006-2007

With reference to Article 5 of the minute of meeting of Angus Council of 18 May 2006, there was submitted Report No 440/07 by the Director of Corporate Services giving details of the amount of allowances and expenses paid to Councillors for the period 1 April 2006 to 31 March 2007, in terms of the Local Authorities etc (Allowances) (Scotland) Regulations 1995.

The Council resolved to note the Councillors’ allowances and expenses, as detailed in the Appendix to the Report.

8. REMUNERATION OF COUNCILLORS 2007/2008 AND BEYOND

There was submitted Joint Report No 441/07 by the Chief Executive and the Director of Corporate Services providing background information relating to the remuneration of Councillors and proposing a salary payment structure which complemented the Council’s Committee structure and complied with the Remuneration Regulations.

The Council resolved:-

(i) to note the background details provided in relation to the remuneration of Councillors;

(ii) to note the Leader of the Council remuneration of £30,905;

(iii) to pay the Provost (Civic Head) 75% of the Leader of the Council’s salary (£23,179) and to reimburse any receipted expenditure incurred in carrying out civic duties up to a yearly sum of £3,000; 224

(iv) to approve the remuneration of Senior Councillors as follows:-

Convener of Corporate Services £21,301 Convener of Education £21,301 Convener of Infrastructure Services £21,301 Convener of Neighbourhood Services £21,301 Convener of Development Control £21,301

Leader of Main Opposition Group £21,301

(v) to note the basic Councillor salary of £15,452;

(vi) to note that the budget provision was sufficient to meet these costs; and

(vii) to delegate authority to the Chief Executive to apply any non-material changes to the remuneration structure in consultation with the Leader of the Council and the Leader of the Opposition.

9. APPOINTMENT OF STANDING COMMITTEES

(a) Structure and Compositions

The Council resolved to note the standing Committees of the Council as set out in Standing Orders.

(b) Election of Conveners and Vice Conveners

(i) Strategic Policy Committee

Councillor Murray, seconded by Councillor Oswald moved the appointment of Councillor King as Convener of the Corporate Services Committee.

(c) Appointment of Members

The Council resolved to approve the appointment of members of each of the standing Committees as detailed in the APPENDIX to this minute.

The Council further resolved to note that appointments to both the Education and the Social Work and Health Committees were subject to satisfactory Disclosure Scotland checks.

(d) Education Committee

The Council resolved:-

(i) In terms of Section 124 of the Local Government (Scotland) Act 1973, to appoint to the Education Committee the following two persons representing religious interests:-

− David Adams, representing the Church of Scotland; and

− Bill Simpson representing the Roman Catholic Church

(ii) to await notification from the Head of Law and Administration with regard to the third religious representative; and

(iii) to appoint two persons nominated by the Teachers Panel of the Angus Joint Negotiating Committee for Teachers who were employed as teachers in educational establishments under the management of the Council.

10. OTHER APPOINTMENTS

(a) Representation on Statutory Boards and Committees

There was submitted Report No 442/07 by the Director of Corporate Services advising the Council of the appointments which fell to be made to various Statutory Boards and Committees.

The Council resolved:-

(i) to amend the membership of the Licensing Board to comprise nine members and to appoint the following members:-

(c) Charitable Trusts Administered by the Council

There was submitted Report No 444/07 by the Director of Corporate Services informing members of the existence of various charitable trusts in Angus and seeking the appointment of Trustees to administer their funds.

The Council resolved to appoint as Trustees as per the Appendix to Report No 444/07, subject to amending reference to Ward 4 to Ward 8 in the case of the Montrose Charities and amending the Trustees responsible for the charities within the Tannadice area to Councillors for Ward 2.

(d) Ex Officio Justices of the Peace

There was submitted Report No 445/07 by the Director of Corporate Services relating to the appointment of ex officio Justices of the Peace and recommending the Council appoint up to seven ex officio Justices of the Peace to the Commission of Angus.

The Council resolved to appoint the undernoted as ex officio Justices of the Peace to the Commission of Angus:-

11. TIMETABLE OF MEETINGS

With reference to Article 8 of the minute of meeting of Angus Council of 15 February 2007, there was submitted a copy of the Timetable of Meetings for the period April-June 2007.

The Council resolved:-

(i) to note that the date set for the meetings of the Environmental and Leisure Services and Housing Committees would now be the date for the meeting of the Neighbourhood Services Committee and that reference to the Resources and Central Services Committee should now read Corporate Services Committee;

(ii) to otherwise adopt the Timetable of Meetings as previously agreed; and

(iii) to remit to the Director of Corporate Services to bring forward a Report on a Timetable of Meetings for the period August 2007–March 2008.
