Morning Session

Elections of Committee Leadership

The meeting was call to order by Representative Jennings at 8:35 a.m. The first order of business was to elect new officers.

Representative Jennings nominated Senator Baumgardner to be Chairperson of the Joint Committee on Corrections and Juvenile Justice Oversight (JCCJJO), seconded by Representative Humphries. There were no other nominations. Representative Jennings moved Senator Baumgardner be elected Chairperson of the JCCJJO by acclamation, seconded by Representative Smith. The motion passed.

Senator Pettey nominated Representative Jennings to be Vice-chairperson of the JCCJJO, seconded by Representative Smith. There were no other nominations. Senator Pettey moved Representative Jennings be elected Vice-chairperson of the JCCJJO by acclamation, seconded by Representative Smith. The motion passed.

Representative Highberger nominated Senator Pettey to be Ranking Minority Member of the JCCJJO, seconded by Senator Faust-Goudeau. There were no other nominations. Representative Highberger moved Senator Pettey be elected Ranking Minority Member of the JCCJJO, seconded by Senator Taylor. The motion passed.

Discussion of Possible Interim Study Topics and Number of Days to Request

The JCCJJO members discussed possible interim study topics and how many days to request for the 2018 Interim.

Senator Berger suggested the study of the utilization of electronic surveillance devices for nonviolent offenders to reduce the cost of overhead to our correctional facilities.

Representative Finney suggested the study of how to increase transparency and accountability following a police shooting, including reducing the time for victims’ families to be notified. Chairperson Baumgardner noted they are waiting on Governor Colyer to sign into law a bill regarding disclosure of body camera and dash camera recordings. Related to this topic, Vice-chairperson Jennings suggested the study of allowing the county coroner, rather than the county or district attorney, to determine whether the shooting was justified.

Senator Faust-Goudeau asked Vice-chairperson Jennings whether there was information on recent legislation that distributes funds to community-based programs that serve as an alternative to detention of juveniles. Vice-chairperson Jennings said receiving such information would be within the Committee’s purview. He suggested Committee members email Randy Bowman, Deputy Secretary for Juvenile Services, Kansas Department of Corrections, with particular concerns.

Senator Faust-Goudeau suggested the study of inmates’ ability to retain employment upon their release with employers they worked for when incarcerated.

Senator Pilcher-Cook suggested a briefing on qualifications for interested persons to volunteer within correctional facilities.

Senator Berger referred to Senator Faust-Goudeau’s suggested study topic and suggested a review of recidivism rates among inmates who participate in work-release programs.

Representative Humphries expressed interest in touring the private industries located within the Hutchinson Correctional Facility. Vice-chairperson Jennings suggested an all-day field trip to the El Dorado and Hutchinson correctional facilities.

Kansas Legislative Research Department 2 Joint Committee on Corrections and Juvenile Justice Oversight Minutes – May 2, 2018 Vice-chairperson Jennings suggested a study of human trafficking, noting a hearing on the topic during the session indicated a need for further consideration. Chairperson Baumgardner suggested the study of the number of beds needed for the victims of human trafficking. Representative Smith noted the Topeka Rescue Mission is a great resource on human trafficking. Representative Carlin suggested the study of the need for counseling and beds for male victims of human trafficking.

Senator Faust-Goudeau requested that Committee staff provide information on inmates’ employment upon leaving prison.

Senator Taylor suggested the study of the Sexual Predator Treatment Program (SPTP) at Larned State Hospital. Vice-chairperson Jennings stated that topic should be addressed by the Kansas Department for Aging and Disability Services. Chairperson Baumgardner requested that Committee staff provide information on the SPTP.

Given the study topics suggested, Chairperson Baumgardner suggested the need for three meeting days and perhaps a fourth to tour the El Dorado and Hutchinson facilities.

Ranking Minority Member Pettey suggested use of a web-based “Doodle” poll to coordinate members’ availability for interim meeting dates. She noted this had been helpful in scheduling meetings for the Juvenile Justice Oversight Committee.
