ARGUMENT(S) Applicant has carefully considered the Final Office Action mailed on November 2, 2018 and respectfully requests reconsideration and asks that the present application be permitted to pass to publication in light of this response.

Remarks:

The Final Office Action continues to assert that a likelihood of confusion exists between U.S. Registration No. 4247301 (“the ˈ301 Registration”) and the present application. Applicant respectfully requests reconsideration of the rejection at least because (i) Class 034 allows for coexistence of Registrant’s goods and Applicant’s goods without likelihood of confusion; (ii) evidence indicates that goods in the ˈ301 Registration are sufficiently different from the goods in the present application and that no likelihood of confusion exists in the relevant marketplace; (iii) the Examining Attorney has failed to establish under the T.M.E.P. that Registrant’s goods and Applicant’s goods are related goods; and (iv) evidence indicates that crossover marks in the relevant goods are particularly rare.

i. Class 34 allows co-existence of Applicant’s goods and Registrant’s goods.

In International Class 034, similar marks for pipe tobacco and vaping products coexist without confusion. Applicant offers three examples shown in Exhibit 1 (emphasis added to pipe tobacco). Further, as shown in Exhibit 2, the same mark (VICTORY) coexists for pipe tobacco and electronic cigarettes. Indeed, the owners of the VICTORY marks agreed that the goods and consumers were sufficiently different that the marks could coexist without confusion. See Exhibit 3. Additionally, as shown in Exhibit 4, Applicant offers examples of registered marks showing the coexistence of tobacco products, cigarette rolling papers, smoking pipes, smoking articles, and vaping products. This additional coexistence is further proof of the clear distinctions between Registrant’s and Applicant’s goods, the relevant consumers, and the channels of trade, and further evidences the lack of a likelihood of confusion between Applicant’s mark and the mark of the ˈ301 Registration.

i. Applicant’s goods are sufficiently different from Registrant’s goods to render confusion unlikely even when marketed in the same retailer.

Applicant’s goods do not include Registrant’s goods and are not typically for use with Registrant’s goods. First, electronic cigarette lanyards, oral vaporizers for smoking purposes, and electronic smoking pipes (the goods recited in the present application) are not for use with pipe tobacco (the one and only good in the ˈ301 Registration) because the goods recited in the present application are typically used with electronic smoking paraphernalia -- i.e. vaping tanks and the like -- whereas the goods recited in the ˈ301 Registration are incapable of being used in such applications. Second, the same distinction exists between cigarette rolling papers (the only remaining good recited in the present application) and pipe tobacco.

In an April 3, 2018 Office Action, the Examining Attorney cited evidence of an online retailer as marketing the relevant goods in the same channels. However, sales of relevant goods in the same store are outweighed by the differences in the nature of the goods. The North Face Apparel Corp v. Sanyang. Industry Co., Ltd, 116 U.S.PQ.2d 1232, 16 (T.T.A.B. 2015). Such a difference exists between Applicant’s goods and Registrant’s goods as shown by the evidence discussed below. Further, no other evidence exists showing that consumers would believe that Applicant’s goods and Registrant’s goods were sold by the same company “even when offered in the same store.” See id.

Applicant’s and Registrant’s goods are marketed in distinct categories by retailers. In particular, the distinctions in goods are made clear by e- retailers and brick and mortar retailers’ separation of the products. By separating the products into distinct categories and different online – and physical – retail sections, retailers demonstrate the real world understanding that Applicant’s and Registrant’s goods are different products offered to different consumers. Further, the distinct sections are being marketed to consumers who are very knowledgeable and loyal to their particular brands and understand the differences in products by the category they are clicking on or seeking out in a store. In other words, the categories exist so that consumers know where to go to the get the products they desire, and the consumers of products in one category are knowledgeable about these products and unlikely to purchase the products in the other category.

Exhibit 5 (screenshots from Smoker’s Online Outlet – www.smokersoutletonline.com -- from April 29, 2019) and Exhibit 6 (screenshots BnB Tobacco – www.bnbtobacco.com – from April 29 and May 1, 2019), are examples of the distinct differences in how retailers characterize and separate the products in these distinct categories. See also Exhibit 31 – Declaration of Rachel Poole (May 1, 2019) (authenticating Internet evidence included in Exhibits 5-9).

Similarly, the “Pipe Tobacco” webpage for BnB Tobacco expressly states: “Pipe tobacco is used in smoking pipes where a smoke is produced when natural or flavored tobacco leaf is burnt.” This is very clearly a different application and use than vaping products and accessories for such products.

Additionally, the BnB Tobacco RYO page suggests the use of RYO papers as a cheaper alternative to buying a pack of cigarettes -- not vaping, pipes or pipe tobacco -- “ We have one of the largest selections of RYO tubes, injectors, and accessories for anyone that wants to save money by switching to RYO. RYO is the way to go if you want to save as much as 40% off of what it would cost you to buy a regular pack of brand name smokes.” While the BnB Tobacco page further indicates that “value blends can also be bought which are sometimes used for RYO, in addition to traditional pipe smoking,” the implication is clear that this is an exception and not a mainstream practice, and has nothing to do with vaping products. Consequently, while rolling papers can be used to roll a “value pipe tobacco,” evidence shows this practice to be the exception and not the rule.

The “E-Cigs” section of Smoker’s Online Outlet also makes clear that these products are a “smoke free alternative.” In other words, “E- Cigs” are not similar to, or in competition with pipe tobacco, which is intended to create smoke, as vaping products are intended to preclude or avoid smoke.

Brick and mortar tobacco shops are akin to their online counterparts in their separation of Applicant’s and Registrants goods. For example, Tobacco and Vape King (located in Arlington, VA, Woodbridge, VA, Waldorf, MD, and Washington, DC, www.tobaccoandvapekings.com) categorizes its products as follows:

Tobacco (which clearly includes pipe tobacco from tobacco from the picture) Hookah Electric cigaratte [sic] Vaping liquid Maeng Da Rolling Papers Glass pipes Wood pipes Cigar Roller Vaporizer O.P.M.S. (i.e. Kratom extract) Others

In addition to smoke shops that provide products of varied nature, the marketplace includes stores that specialize in pipe tobacco or vaping products alone. See, e.g. Exhibit 8 (screenshots from Georgetown Tobacco website – www.gttobacco.com) and Exhibit 9 (screenshots Capital Vape Supply website – capital-vape-supply.mycloveronline.com).

As described above, regardless of whether Applicant’s goods and Registrant’s goods are marketed in the same channel, confusion is unlikely because the nature of the goods is sufficiently different and because consumers, who are loyal to one type of product or another, are unlikely to assume they come from the same source. Applicant further notes that there is no allegation that Registrant’s mark is in any way famous such that it would be entitled to a broad scope of protection outside of its very limited recited goods.

i. The Examining Attorney has failed to provide evidence that Applicant’s and Registrant’s goods are related.

Under T.M.E.P. §1207.01(a)(iv), the Examining Attorney must provide evidence showing that the goods and services are related to support a finding of likelihood of confusion. See, e.g., In re White Rock Distilleries Inc., 92 U.S.P.Q. 2d 1282, 1285 (T.T.A.B. 2009) (finding Office had failed to establish that wine and vodka infused with caffeine are related goods because there was no evidence that vodka and wine emanate from a single source under a single mark or that such goods are complementary products that would be bought and used together). To date, the Examining Attorney has failed to provide evidence establishing the goods and services are related. Like the wine and vodka infused with caffeine in White Rock Distilleries, there is no evidence that pipe tobacco and vaping products emanate from a single source under a single mark despite the fact that there may be certain similarities between the products. Nor has the Examining Attorney provided evidence that the goods would be bought or used together, or that other sources use the same or similar marks for both classes of products. Just as wine drinkers and vodka drinkers were presumed to differentiate between the two types of products (despite the fact that certain outlets may carry both categories), pipe smokers and vapers or RYO users should also be presumed to so-differentiate absent evidence to the contrary. Accordingly, the Examining Attorney has not established under the T.M.E.P. that Applicant’s goods and Registrant’s goods are related goods.

i. Crossover marks in Applicant’s goods and Registrant’s goods are rare.

A crossover mark is a mark that is present on two distinct goods. A lack of crossover marks is significant because it shows that distinct goods do not emanate from the same source. See North Face Apparel, 116 U.S. P.Q. 2d. at 1232 (while opposer provided evidence that the relevant could be sold through the same channels of trade, this evidence was insufficient to show that consumers would believe that the same company that sells Applicant’s goods would also sell Opposer’s goods, even when the goods are offered in the same store). There are no crossover marks in Pipe Tobacco and E-Cigs at Smoker’s Online Outlet. There are also no cross over marks between Pipe Tobacco and “E-Smokes” (i.e. Vape, Pods, E-Cigs, Disposables) at BnB Tobacco. Of the 29 Pipe Tobacco marks offered at Smoker’s Online Outlet there is a single crossover mark for pipe tobacco and rolling papers – BUGLER. Of the 52 Pipe Tobacco marks offered at BnB Tobacco there are only three crossover marks for pipe tobacco and rolling papers – BUGLER, GAMBLER, and KENTUCKY SELECT. Simply put, crossover marks are rare for Registrar’s goods and Applicant’s goods in these exemplar online retailers. Moreover, no evidence of crossover advertising for specific marks exists to promote the practice of using pipe tobacco with rolling papers.

Based on the evidence above, as well as the remarks previously presented, it is respectfully requested that the Examining Attorney withdraw the rejection of record, allow the application, and pass it to publication. EVIDENCE SECTION

ARGUMENT(S) In response to the substantive refusal(s), please note the following:

Applicant has carefully considered the Final Office Action mailed on November 2, 2018 and respectfully requests reconsideration and asks that the present application be permitted to pass to publication in light of this response.

Remarks:

The Final Office Action continues to assert that a likelihood of confusion exists between U.S. Registration No. 4247301 (“the ˈ301 Registration”) and the present application. Applicant respectfully requests reconsideration of the rejection at least because (i) Class 034 allows for coexistence of Registrant’s goods and Applicant’s goods without likelihood of confusion; (ii) evidence indicates that goods in the ˈ301 Registration are sufficiently different from the goods in the present application and that no likelihood of confusion exists in the relevant marketplace; (iii) the Examining Attorney has failed to establish under the T.M.E.P. that Registrant’s goods and Applicant’s goods are related goods; and (iv) evidence indicates that crossover marks in the relevant goods are particularly rare.

i. Class 34 allows co-existence of Applicant’s goods and Registrant’s goods.

In International Class 034, similar marks for pipe tobacco and vaping products coexist without confusion. Applicant offers three examples shown in Exhibit 1 (emphasis added to pipe tobacco). Further, as shown in Exhibit 2, the same mark (VICTORY) coexists for pipe tobacco and electronic cigarettes. Indeed, the owners of the VICTORY marks agreed that the goods and consumers were sufficiently different that the marks could coexist without confusion. See Exhibit 3. Additionally, as shown in Exhibit 4, Applicant offers examples of registered marks showing the coexistence of tobacco products, cigarette rolling papers, smoking pipes, smoking articles, and vaping products. This additional coexistence is further proof of the clear distinctions between Registrant’s and Applicant’s goods, the relevant consumers, and the channels of trade, and further evidences the lack of a likelihood of confusion between Applicant’s mark and the mark of the ˈ301 Registration.

i. Applicant’s goods are sufficiently different from Registrant’s goods to render confusion unlikely even when marketed in the same retailer.

Applicant’s goods do not include Registrant’s goods and are not typically for use with Registrant’s goods. First, electronic cigarette lanyards, oral vaporizers for smoking purposes, and electronic smoking pipes (the goods recited in the present application) are not for use with pipe tobacco (the one and only good in the ˈ301 Registration) because the goods recited in the present application are typically used with electronic smoking paraphernalia -- i.e. vaping tanks and the like -- whereas the goods recited in the ˈ301 Registration are incapable of being used in such applications. Second, the same distinction exists between cigarette rolling papers (the only remaining good recited in the present application) and pipe tobacco.

In an April 3, 2018 Office Action, the Examining Attorney cited evidence of an online retailer as marketing the relevant goods in the same channels. However, sales of relevant goods in the same store are outweighed by the differences in the nature of the goods. The North Face Apparel Corp v. Sanyang. Industry Co., Ltd, 116 U.S.PQ.2d 1232, 16 (T.T.A.B. 2015). Such a difference exists between Applicant’s goods and Registrant’s goods as shown by the evidence discussed below. Further, no other evidence exists showing that consumers would believe that Applicant’s goods and Registrant’s goods were sold by the same company “even when offered in the same store.” See id.

Applicant’s and Registrant’s goods are marketed in distinct categories by retailers. In particular, the distinctions in goods are made clear by e- retailers and brick and mortar retailers’ separation of the products. By separating the products into distinct categories and different online – and physical – retail sections, retailers demonstrate the real world understanding that Applicant’s and Registrant’s goods are different products offered to different consumers. Further, the distinct sections are being marketed to consumers who are very knowledgeable and loyal to their particular brands and understand the differences in products by the category they are clicking on or seeking out in a store. In other words, the categories exist so that consumers know where to go to the get the products they desire, and the consumers of products in one category are knowledgeable about these products and unlikely to purchase the products in the other category.

Exhibit 5 (screenshots from Smoker’s Online Outlet – www.smokersoutletonline.com -- from April 29, 2019) and Exhibit 6 (screenshots BnB Tobacco – www.bnbtobacco.com – from April 29 and May 1, 2019), are examples of the distinct differences in how retailers characterize and separate the products in these distinct categories. See also Exhibit 31 – Declaration of Rachel Poole (May 1, 2019) (authenticating Internet evidence included in Exhibits 5-9).

Similarly, the “Pipe Tobacco” webpage for BnB Tobacco expressly states: “Pipe tobacco is used in smoking pipes where a smoke is produced when natural or flavored tobacco leaf is burnt.” This is very clearly a different application and use than vaping products and accessories for such products.

Additionally, the BnB Tobacco RYO page suggests the use of RYO papers as a cheaper alternative to buying a pack of cigarettes -- not vaping, pipes or pipe tobacco -- “ We have one of the largest selections of RYO tubes, injectors, and accessories for anyone that wants to save money by switching to RYO. RYO is the way to go if you want to save as much as 40% off of what it would cost you to buy a regular pack of brand name smokes.” While the BnB Tobacco page further indicates that “value blends can also be bought which are sometimes used for RYO, in addition to traditional pipe smoking,” the implication is clear that this is an exception and not a mainstream practice, and has nothing to do with vaping products. Consequently, while rolling papers can be used to roll a “value pipe tobacco,” evidence shows this practice to be the exception and not the rule.

The “E-Cigs” section of Smoker’s Online Outlet also makes clear that these products are a “smoke free alternative.” In other words, “E-Cigs” are not similar to, or in competition with pipe tobacco, which is intended to create smoke, as vaping products are intended to preclude or avoid smoke.

Brick and mortar tobacco shops are akin to their online counterparts in their separation of Applicant’s and Registrants goods. For example, Tobacco and Vape King (located in Arlington, VA, Woodbridge, VA, Waldorf, MD, and Washington, DC, www.tobaccoandvapekings.com) categorizes its products as follows:

In addition to smoke shops that provide products of varied nature, the marketplace includes stores that specialize in pipe tobacco or vaping products alone. See, e.g. Exhibit 8 (screenshots from Georgetown Tobacco website – www.gttobacco.com) and Exhibit 9 (screenshots Capital Vape Supply website – capital-vape-supply.mycloveronline.com).

As described above, regardless of whether Applicant’s goods and Registrant’s goods are marketed in the same channel, confusion is unlikely because the nature of the goods is sufficiently different and because consumers, who are loyal to one type of product or another, are unlikely to assume they come from the same source. Applicant further notes that there is no allegation that Registrant’s mark is in any way famous such that it would be entitled to a broad scope of protection outside of its very limited recited goods.

i. The Examining Attorney has failed to provide evidence that Applicant’s and Registrant’s goods are related.

Under T.M.E.P. §1207.01(a)(iv), the Examining Attorney must provide evidence showing that the goods and services are related to support a finding of likelihood of confusion. See, e.g., In re White Rock Distilleries Inc., 92 U.S.P.Q. 2d 1282, 1285 (T.T.A.B. 2009) (finding Office had failed to establish that wine and vodka infused with caffeine are related goods because there was no evidence that vodka and wine emanate from a single source under a single mark or that such goods are complementary products that would be bought and used together). To date, the Examining Attorney has failed to provide evidence establishing the goods and services are related. Like the wine and vodka infused with caffeine in White Rock Distilleries, there is no evidence that pipe tobacco and vaping products emanate from a single source under a single mark despite the fact that there may be certain similarities between the products. Nor has the Examining Attorney provided evidence that the goods would be bought or used together, or that other sources use the same or similar marks for both classes of products. Just as wine drinkers and vodka drinkers were presumed to differentiate between the two types of products (despite the fact that certain outlets may carry both categories), pipe smokers and vapers or RYO users should also be presumed to so-differentiate absent evidence to the contrary. Accordingly, the Examining Attorney has not established under the T.M.E.P. that Applicant’s goods and Registrant’s goods are related goods.

i. Crossover marks in Applicant’s goods and Registrant’s goods are rare.

A crossover mark is a mark that is present on two distinct goods. A lack of crossover marks is significant because it shows that distinct goods do not emanate from the same source. See North Face Apparel, 116 U.S. P.Q. 2d. at 1232 (while opposer provided evidence that the relevant could be sold through the same channels of trade, this evidence was insufficient to show that consumers would believe that the same company that sells Applicant’s goods would also sell Opposer’s goods, even when the goods are offered in the same store). There are no crossover marks in Pipe Tobacco and E-Cigs at Smoker’s Online Outlet. There are also no cross over marks between Pipe Tobacco and “E-Smokes” (i.e. Vape, Pods, E- Cigs, Disposables) at BnB Tobacco. Of the 29 Pipe Tobacco marks offered at Smoker’s Online Outlet there is a single crossover mark for pipe tobacco and rolling papers – BUGLER. Of the 52 Pipe Tobacco marks offered at BnB Tobacco there are only three crossover marks for pipe tobacco and rolling papers – BUGLER, GAMBLER, and KENTUCKY SELECT. Simply put, crossover marks are rare for Registrar’s goods and Applicant’s goods in these exemplar online retailers. Moreover, no evidence of crossover advertising for specific marks exists to promote the practice of using pipe tobacco with rolling papers.

Based on the evidence above, as well as the remarks previously presented, it is respectfully requested that the Examining Attorney withdraw the rejection of record, allow the application, and pass it to publication.

3) The parties recogni ~e and acknowledge the differences between their products and trade channels, and that they have coexisted simultaneously for at least four (4) years. The parties are unaware of any actual confusion between them, their marks, and their respective products during their peaceful coexistence in the marketplace.

4) Registrant hereby consents to use and registration by Applicant of the VICTORY brand for use with electronic cigarettes and refillable cartridges, specifically U.S. Trademark Application Serial No. 85966141 filed June 21, 2013.

5) Applicant hereby consents to continued use and registration by Registrant of the VICTORY brand for use with tobacco cigarettes.

6) The parties recognize and agree that compliance with the above provision will prevent conflict between the marks and preclude a likelihood of confusion between the marks. The parties further agree to cooperate in the filing of any documents with the United States Patent & Trademark Office and foreign counterparts thereof.

7) Should the need arise, the parties will cooperate to take steps necessary to prevent the possibility of customer confusion arising in the future.
