Order Sri. N. Shantaiah, Peddapalli District has filed a complaint dated 24-11-2017 which was received by this Commission on 14-12-2017 for not getting the information sought by him from the PIO / O/o the Municipal Commissioner, Nizamabad Municipality, Nizamabad District.

The brief facts of the case as per the complaint and other records received along with it are that the complainant herein filed an application u/s 6(1) of the RTI Act, 2005 dated 23-09-2017 before the PIO requesting to furnish the below information:

The PIO / O/o the Municipal Commissioner, Nizamabad Municipality, Nizamabad District through letter no: 7715/2017 dated 03-11-2017 informed the complainant that the act does not mean that the PIO shall reshape the information and therefore requested to obtain the copies of the document as prescribed in sub section (F) of section 2 of RTI Act 2005. Aggrieved with the reply from the PIO, he preferred this complaint u/s 18(1) of the RTI Act before this Commission requesting to direct the PIO to furnish the information sought by him.

The complaint is taken on file and notices were issued to both the parties for hearing on 16-08-2018.

The case is called on 16-08-2018. The appellant Sri. N. Shantaiah is present. Sri M. Devendar, Manager, O/o the Municipal Commissioner, Nizamabad Municipality, Nizamabad is present.

The appellant through affidavit stated that the PIO provided false information. But the appellant did not specify the details of the information said to be false / incomplete.

The PIO stated that part information was furnished on 10-10-2017 and again through Lr.No. TMS/460/26348/CIC/2017 dated 15-02-2018 while requesting the applicant to visit the office on 20-02-2018 replied that 271 nos., of CC Drains and 59 nos. of CC Roads were constructed.

On perusal of the PIO letter dated 10-10-2017 and 15-02-2018 the Commission is of the view that the PIO did not furnished the information on each item of 7 items.

At the time of hearing the PIO handed over the information relating to item no. 2 & 5 to the appellant in presence of the Commission.

Hence, in view of the above position, the PIO is directed to furnish the information on each item within 7 days of receipt of this order through RPAD under copy to Commission.

With the above direction, the appeal is closed.
