Link to map: https://bit.ly/2TLNZ1m Relevant LGA: Fraser Coast Regional Council The agreement contains the following statements: [Explanatory notes in brackets inserted by the National Native Title Tribunal] 7.1 The Parties: (a) consent to the doing of the Agreed Acts to the extent that they are Future Acts; and (b) subject to compliance with this ILUA, if any of the Agreed Acts done prior to Registration are invalid Future Acts, agree to validate those Agreed Acts. 9. To avoid any doubt and for the purposes of section 24EB(1)(c), Subdivision P of Division 3 of Part 2 of the NTA does not apply to the doing of the Agreed Acts. “Agreed Acts” means all acts necessary to give effect to this ILUA including but not limited to the following acts and any acts done as part of, or in relation to, them: (a) the Original Grant; (b) the Renewal; (c) the Variation; and (d) the Redescription of the Existing Lot and creation of the Sales Permit Lot and the Balance Lot. “Balance Lot” means the lot described as Lot 138 on AP23253 on the administrative plan of the ILUA Area following the Redescription. “Existing Lot” has the same meaning as ILUA Area. “Redescription” means the redescription by the State of the Existing Lot as the Sales Permit Lot and the Balance Lot in accordance with the administrative plan of the ILUA Area at Schedule 3. “Sales Permit” means Sales Permit 20080805 for the getting of quarry material issued under the Forestry Act agreed by the State and the Proponent on 15 February 2013 and as varied from time to time, including by the Renewal and the Variation. “Sales Permit Lot” means the lot described as Lot 1 on AP23253 on the administrative plan of the ILUA Area following the Redescription and which includes the area that is subject to the Sales Permit. Any person claiming to hold native title to any part of the area covered by the ILUA may object in writing within the notice period to the registration of this agreement if they think that the application to register the ILUA has not been properly certified. If you wish to object to the registration of this agreement (and you hold or claim to hold native title in any part of the area covered by the agreement) you may only object for one reason: in your view, the application to register the ILUA has not been properly certified, as stated in section 203BE(5)(a) and (b) of the Native Title Act 1993 (Cth). You must make this objection in writing and send it to the Native Title Registrar, National Native Title Tribunal, GPO Box 9973, Brisbane, QLD, 4001 by 6 May 2019. Generally, procedural fairness will require that the material you provide is given to certain other persons or organisations for comment. It may also be taken into account in the registration of other ILUAs and claimant applications and thus be provided to relevant persons or organisations for comment.
