The Technical Bid ( Part-I )& Financial Bid ( Part-II ) to be eventually drawn in P1 Contract are invited by the Chief Construction Engineer, Lower Indra Irrigation Project, At/PO: Khariar, Dist. Nuapada (Odisha) on behalf of Hon’ble Governor of Odisha on-line Percentage rate bids through e - procurement for execution of the works detailed in table below. The Bid should be submitted by the eligible class of contractors as mentioned below registered with the State Governments and contractors of equivalent grade / class registered with Central Government / M.E.S. / Railways / C.P.W.D. and other State Government for execution of Civil Works through On-line in the Govt. website www.tendersodisha.gov.in . The bidders should have necessary portal enrolment (with own digital signature certificate). The registered bidders from outside of Odisha can also participate in this on-line tender process after necessary portal enrolment but shall have to subsequently undergo registration with appropriate authority of the state Govt. within a month of acceptance of bid. The bidders from outside of state are to submit an undertaking in form of an affidavit, that they are not registered under VAT Act in the state of Odisha as they have not started any business in the state and they have no liabilities under the Act. 1. The Technical Bid must be accompanied with required E.M.D. / Bid Security amount specified for the work in the table above in shape of N.S.C. / K.V.P. /Post Office Time Deposit Accounts / Post Office Savings Bank Account / Deposit Receipt of Nationalized Schedule Bank duly pledged in favour of the Executive Engineer Lower Indra Dam Division, Dam site,Tikhali without which the tender is liable for rejection. In case the contractor proposes to engage machineries and equipments as asked for in the tender document, owned or hired but deployed outside the state, he / she is required to furnish additional 1% E.M.D. / Bid security. The entire Bid security including the additional bid security shall stand forfeited incase the contractor fails to mobilize the machineries within the stipulated time as per the tender document. 4. The Technical Bid (Part-I) should be submitted online in www. tendersodisha.gov. in . Furnishing with scan copies of valid Registration Certificate, VAT Clearance Certificate (TIN), PAN card, Bid Security ,cost of Bid documents and Affidavit about the authenticity of the tender documents No relation Certificate etc. on “on line ” are mandatory along with the tender documents otherwise his / her bids shall be declared as non- responsive and thus liable for rejection.

5. The Financial Bid (Part-II) documents consisting of plans, specification and schedule of quantities of work are available in the web site www.tendersorissa.gov. in . and set of terms and conditions of the contract and other necessary documents can be seen in the web site till date 15.12.2016 up to 3.00 PM i.e. last date of availability of tender on online for bidding. Interested tenderer may obtain further information at the web site www. tendersodisha.gov. in .

6. Additional performance security shall be obtained from the bidder, when the bid amount is less than the estimated cost put to tender. In such an event, the bidder who have quoted less bid price than the estimated cost put to tender shall have to furnish the exact amount of differential cost i.e. estimated cost put to tender minus the quoted amount as additional performance security in shape of Demand Draft/Term Deposit Receipt pledged in favour of the Executive Engineer Lower Indra Dam Division,Dam site,Tikhali in the sealed evolve along with the price bid at the time of submission of bids. The bids of the technically qualified bidders will be opened for evaluation of the price bid in case of the bidders quoted less bid price/rate than the estimated cost put to tender and have not furnished the exact amount of differential cost(i.e. estimated cost put to tender minus the quoted amount) as Additional Performance security in shape of Demand Draft/Term Deposit Receipt, their price bid will not be taken into consideration for evaluation even if they have qualified in the technical bid evaluation.

7. The single tender received in the 1 st call shall be cancelled without opening of the bid. The acceptance of a single tender received even after re-tendering should have prior approval of next higher authority. When in response to a notice calling for tenders, only a single tender is received in the 1st time the tender shall be cancelled without opening of the bid and fresh tender be invited publicly. If single tender received even after re-tendering then the approval of next higher authority should be obtained, if the tender is otherwise in order and acceptable.

8. If the rate quoted by the bidder is less than 15% of the tender amount then such a bid shall be rejected and the tender shall be finalized basing on the merit of rest bids. But if more than one bid is quoted at 14.99%(Decimal up to two nos will be taken for all practical purpose without rounding up)less than the estimated cost the tender accepting authority will finalize the tender through a transparent lottery system where all bidders/their authorized representative, Concerned Executive Engineer and DAO will remain present.

9. Before acceptance a tender the successful bidder will be requested to submit a work programme basing on the financial achievement so as to complete the work within the stipulated period and in case of failure on the part of the agency to achieve the milestone, liquidated damage will be imposed. 10. The bids for the work shall remain open for acceptance for a period of 90 (Ninety) days from the last date of receipt of bids. If any bidder / tenderer withdraw his bid / tender before the said period or make any modification in terms and conditions of the bid, the E.M.D deposited at the time of submission of the tender shall stands forfeited.

11. No Engineer of Gazetted rank or other Gazetted officer employed in the Engineering and Administrative duties in the Engineering department of State Government is allowed to work as a contractor for a period of two years after his retirement from the Government service without permission of Government.

13. The technical bid will be opened in the office of the Chief Construction Engineer, L.I.I.Project, Site-office,Khariar,Dist-Nuapada on dated 20.12.2016 at 11.00 Am . The successful lowest bidder only shall submit the originals of all the scan documents within 5 days from the date of opening of the Financial Bid (Part-II) during office hours for verification in the office of the undersigned.

14. The Bidder must go through the Bid documents meticulously before uploading the tender to the web site.

15. The Proforma / Table(s) furnished in the bid documents should be filled in properly & be submitted. Extra papers may be added if necessary. Filling of tables in complete shape is mandatory, failing which the Bid is liable for rejection.

16. The Bidder should only furnish the documents of machinery & equipments owned or hired as sought for by the Department and not the total machinery & equipments owned or hired should not be uploaded as it decreases the specified bytes.

17. The abstract of balance sheet, profit & loss account liquid assets/bank balance etc duly audited by the chartered accountant only be uploaded.

18. The contractor has to quote the percentage excess or less up to two digits only after decimal point. If he quotes the percentage excess or less up to more than two digits after decimal point, the first two digits after decimal point shall only be considered without rounding as per office memorandum of Government of Oddisha,Works Department file No. 07556900042013( Pt-II) 7885/W Dated 23.07.2013 para 16.4

19. In the eventually of failure on the part of lowest successful bidder to produce the original documents, he/she shall be debarred in future from participating in tender for three years and will be black listed by the competent authority as per office memorandum of Government of Odisha, Works Department file No. 07556900042013( PT-II) 7885/W Dated 23.07.2013 para 15.6.4.

20. If the bidder back out from the offer before acceptance of the tender by the competent authority, the EMD deposited by the bidder shall be forfeited.

21. The Chief Construction Engineer, Nuapada, Site office, Khariar reserves the right to reject or accept any or all the tenders without assigning any reasons thereof.
