Amendment to Condition 6;

Prior to any works commencing on site, including any site clearance a scheme shall be submitted to and approved in writing by the local planning authority, for traffic management. This scheme at a scale of 1:200 shall detail measures to prevent access and traffic from the proposed development travelling along Tor Y Mynydd Lane. This scheme as approved shall be implemented fully on site prior to the first occupation of any dwelling. In addition the scheme shall include temporary works to be implemented during construction, which shall be fully implemented prior to any site clearance or construction works taking place, and retained until the implementation of the permanent traffic management.

2.

Representation received from Local Members in relation to foul and surface water drainage problems in this locality.

A further consultation has been undertaken with Dwr Cymru/Welsh Water who confirm that they have no objection to the proposed development and that the problem which did exist here were historical pre- dating 2003/04 and no problems have been encountered since.

Conditions are recommended in relation to both surface and foul water drainage requirements and the department is satisfied that theses address the matter.

Report of the Head of Planning

1. APPLICATION NO P/2005/166 PROPOSED THREE NO. FOUR BEDROOM RESIDENTIAL PROPERTIES WITH DOUBLE GARAGE, DRIVEWAYS, NEW ACCESS ROADWAY AND PEDESTRIAN FOOTPATH BETWEEN COOK REES AVENUE AND MOORLAND ROAD, NEATH

The Sub Committee visited the above mentioned location with the Local Member in attendance. The Local Member drew the attention of the Sub Committee to the actual location of the proposed development which was to the rear of Kingdon Owen Road. The report submitted to the Planning and Development Control Committee on 30th January 2007, did not specifically mention the impact upon the residents of Kingdon Owen Road. However, the report submitted to the Planning (Site Visits) Sub Committee had been amended accordingly.

The Development Control Manager indicated that, following the site visit, the original recommendation of conditional approval remained unchanged.

The Sub Committee discussed the application and the proposed conditions set out in the circulated report.

RECOMMENDED: that the application be granted, subject to the conditions contained in the circulated report.

2. PLANNING APPLICATION NO.P/2006/870 PROPOSED ONE DWELLING (OUTLINE) AT THE OLD STAR INN, PONTARDAWE ROAD, PONTARDAWE

The Sub Committee visited the above mentioned location and a copy of the original report was submitted for Members’ consideration.

The Development Control Manager indicated that, following the site visit, the Officer’s original recommendation of approval remained unchanged.

The Sub Committee discussed the application and expressed concern over the proposed dwelling being situated outside the Unitary Development Plan boundary.

RECOMMENDED: that, notwithstanding the recommendation of approval made by the Head of Planning, the Authority be minded to refuse the application, for the reasons set out below:

Reason:

On the grounds that the application is outside the settlement boundary as defined by policies within the Neath Port Talbot Deposit Draft Unitary Development Plan, where there is a presumption against development within the open countryside.
