1. OFFICE OF THE SPEAKER ANNUAL REPORT OF THE SECTION 79 OVERSIGHT COMMITTEE: COMMUNITY AND SOCIAL DEVELOPMENT SERVICES (CSDS): (JULY 2016- JUNE 2017) from the Section 79 Oversight Committee :Community and Social Development Services :22 August 2017 and Section 79 Oversight Committee : Community and Social Development Services : 19 September 2017)

1. PURPOSE

The purpose of this report is to give an annual overview on the performance and findings of the Section 79 Committee: Community and Social Development Services, for the period July 2016 – June 2017. This report will also identify areas which require improvement, in order to achieve goals set by the Committee.

2. STRATEGIC OBJECTIVES

The Strategic Objectives addressed in this report are:

SO4: “Promote Good Governance and Active Citizenry” SO5: “Improved Financial Sustainability”

3. BACKGROUND

The Section 79 Oversight Committee: Community and Social Development Services was realigned, following the Council meeting of 31 August 2016, which endorsed the Governance Model that was initially approved by Council on 9 June 2011.

This report covers the activities and oversight findings of the Committee for July 2016- June 2017, noting that the Committee meetings and inspections resumed in quarter 2, following the Local Government Elections of 3 August 2016. Annual Committee findings are based on targets and performance of the Department for the period under review, based on the SDBIP targets and legislative requirements.

In terms of the strategic objectives outlined above, the Committee is responsible for ensuring that there is value for money, which is spent in line with the approved Service Delivery and Budget Implementation Plan (SDBIP).

The strategic objectives further necessitate legislative compliance, including transparency and involvement of the community in the affairs of the municipality, which could be realized through provision of information to communities on matters affecting them.

4. DISCUSSION

The City of Tshwane’s Annual Calendar of Council guides all oversight activities and specifies dates on which the Section 79 Oversight Committee conducts its meetings and inspections. In view of the above, the Committee held ten meetings, conducted eight inspection-in-locos, one Workshop and one Public Consultation during 2016/17 financial year.

The tables below provides a summary of Committee activities during the period under review:

4.1 QUARTER1.

During the first quarter of the 2016/2017 financial year the Section 79 Oversight Committee meetings did not take place from July – September 2016 due to Local Government Election of 03 August 2016.

4.2.1 BACKGROUND ON ODI STADIUM: Odi Stadium is situated on Plot 702 JR at Mabopane and it was transferred from North West Province to during the process of redefining the provincial boundaries. The land on which the stadium is situated was owned by Tutuni Investments LTD and it was transferred to the City of Tshwane when a settlement agreement was entered into.

During the meeting between the City of Tshwane and Gauteng Provincial Department of Sport, Recreation, Arts and Culture in March 2012, it was resolved that Odi Stadium be handed over to the City of Tshwane. The Gauteng Province finally handed the stadium to the City of Tshwane on 28 September 2012.

a) COMMITTEE FINDINGS ODI STADIUM

The challenges listed below noted during the inspection- in- loco, must be addressed. 1. Lack of maintenance of the stadium has resulted in the following:

 Currently the facility is not fenced and crime is rife.  The stadium consists of combo-courts for tennis, volley ball, basketball and two informal soccer training grounds which are not utilized by the community members due to the dilapidated status.  Athletics track and the soccer fields are covered with grass.

2. The stadium is declared unsafe for usage by engineers.

3. Lack of water and electricity resulting in the non-functioning of ablution facilities.

The Committee was briefed by the Sports Council (Stakeholders), on the below status of the stadium.  The stadium has 60 000 seater capacity.  It is a white elephant stadium situated 30km north of Pretoria in Mabopane and turned into a haven for criminals and vagrants  The stadium hosted matches of the professional soccer league, BOPSOL, in the late eighties and early nighties.  Professional teams that made use of the stadium include Orlando Pirates, Kaizer Chiefs, Moroka Swallows, Sundowns and Wits University. It was further noted that the stadium produced celebrated players like Peter Fuduwa Mokotedi, Nick Bazuka Seshweni and Lawrence Mmake.  Political parties use to hold rallies at the stadium.  Various stakeholders were committed to removing youth from the streets and criminal activities, by encouraging them to partake in sporting activities.  The dilapidated and abandoned venue should be restored and used to develop potential soccer stars of the future.  The non-functioning stadium had a negative impact on some small businesses, who benefitted financially from events held in the stadium.

4.2.2 BACKGROUND ON CALEDONIAN STADIUM: The Caledonian Stadium is a multi-purpose center, currently used for football games. The Arcadia Shepherds Football Club regards this stadium as its home ground. The stadium was also used as a dog racing track until this activity was moved to Lyttleton, in agreement with Council. Banyana Banyana and Bafana Bafana have utilized the stadium for practicing purposes. A budget approved for 2016/17 financial year to complete the facility is located within the Department of City Planning and Development and it is meant for the restoration and upgrading of the football ground with the view of preserving its heritage legacy.

 Lack of maintenance due to lack of funds is a major concern.  Lack of security guards has left the facility vulnerable to theft and vagrants  Lack of electricity.

4.3.1 BACKGROUND ON HM PITJE STADIUM The HM Pitje Stadium in Mamelodi was identified by the Gauteng Department of Sport, Arts, Recreation and Culture as one of four stadiums in Gauteng to be upgraded, in terms of the Legacy Stadium Programme. The City of Tshwane Community and Social Development Department is interacting with Gauteng Provincial Government to finalise upgrading of the stadium.

The stadium has not been utilized since 2005, as it is non-compliant with safety and construction regulations. Due to its structural flaws, no occupational certificate has been issued. Emergency and seating requirements are also not adhered to.

The stadium has become a white elephant, denying the community of Mamelodi an opportunity to benefit from this facility. The status of the stadium has affected the sport development in the region, as this stadium was used to host professional soccer matches and social events. The Mamelodi school athletics and other soccer tournaments were previously hosted in this stadium. Informal traders from the neighboring communities were also benefitting from events hosted in the stadium. a) FINDINGS OF THE COMMITTEE

 The seating arrangement is non–compliant with the regulations and ergonomics.  Emergency routes will not accommodate crowd movement in an emergency situation. This renders the stadium unsafe should an emergency evacuation be required.  The slope of the main pavilion is steep and it is non-compliant with the guidelines for safety at sports grounds.

 The constructed facility does not reflect the design (e.g. bracing to support the columns was designed but not installed).  The media area is constructed with “park homes” or prefabricated structures, which are not ideal for long –term durability of the facility.  The raker beams are not properly connected to the columns as per the design principles.  The steel pavilion is positioned far from the pitch, which could result in non- attendance of matches.  The main pavilion is obscured by the stands, which are positioned closer to visual barriers (access ramps and columns).  Parking is inadequate.  Electrical equipment such as high-mast lights are defective and do not meet the required standards.  Change rooms, security control rooms and media gathering areas do not have air conditioning.  Crowd control and monitoring measures such as CCTV are not available.  Sliding gates are not working.

4.3.2 BACKGROUND ON SUURMAN LIBRARY: The Suurman Community Library Project was initiated to form part of a Multipurpose Community Centre for Suurman/Majaneng area.The project entails the construction of the Suurman Community Library (CONTRACT CB176/20120).

The feasibility study for the Multipurpose Community Centre was conducted during 2002/03 financial year and the following proposed facilities forms part of the Multipurpose Centre as per feasibility study outcome:

 Phase 1 – Clinic (nearby site)  Phase 2 – Community Hall  Phase 3 – Community Library  Phase 4 – Sport Facilities

SUURMAN COMMUNITY LIBRARY PROJECT:

The Suurman Community Library Project was executed in two phases. The 1st phase was the ground works and foundations which commenced in 2011/2012 financial year.

The scope of work entailed:

 Bulk earthworks,  Sub soil drainage system  Foundations

 The surface bed with the underground services.

Phase 2 of the Suurman Community Library Project was constituted by the building of the library which commenced in the 2012/13 financial year.

The scope of work entailed:

 Study halls  Reference rooms  Lending rooms  Children's rooms  Ablution facilities (Staff & Public)  Storerooms  Staff office (Librarian)  Parking & walkways

Progress on the multipurpose project:

In 2011/2012 and 2012/2013 financial years the department created 53 local job opportunities in total. Phase one, phase two and phase three (the library) superstructure is 100% completed and handed over. The library was officially opened on 3rd July 2015.

a) FINDINGS OF THE COMMITTEE:

 The ceiling has collapsed, which is a high risk safety hazard.  Air condition is not working  Down pipes are blocked.  Pigeons invasion are a health hazard.  Outside door is defective.

4.3.3. BACKGROUND ON CULLINAN LIBRARY PARK:

The Cullinan Library Park Project is inspired by the Library Park Development concept in Medellin, Colombia, which recognizes that libraries can and should also be cultural centers that provide facilities for access to information, educational resources, sport, and community assembly. The library utilized by the community in Dinokeng tsa Taemane Municipality was a rented facility. The facility was in rental arrears and the Department held a meeting with the City Manager to acquire a new facility to rent. Land was identified in Essenhout Road ERF 730 Cullinan. A site visit was conducted with the architects on 20 April 2012 to determine the suitability and accessibility of the site. The design of the facility consists of a lobby to give access to the facility; public toilets; toy library; Wi-Fi, lending section, reference section, group activities areas, store rooms and kitchen. The completed facility comprises of the following:

 Library with children’s section, lending section and study area.  Indoor Sports hall (indicate capacity) with kitchen.  2 (two) smaller activity halls.

 Accommodation for a caretaker.  A guard house.  4 (four) hard courts.  Parking with (capacity for 60 cars.)  Fencing.  An access road.

a) CHALLENGES:

The community members do not have access to the library due to administration constraints.

b) FINDINGS OF THE COMMITTEEE:

 The committee discovered that the Library is not operational.  The roof is leaking  The Basketball floor surface is uneven.  Cracks on the floor caused by floor expansion were visible.

4.3.4 BACKGROUND ON PILDITCH STADIUM:

Pilditch Stadium is an existing athletic Stadium with a synthetic athletic track and flood lights, synthetic athletic practice track, rollers skating track, cycling track. Main pavilion has change rooms, public ablutions, media area, and VIP area, Kiosks, parking area and grassed embankment seating areas on the Southern, Eastern and Northern side of the track. The grassed field inside the athletics track is utilized for soccer related activities. The need for the project emanates from a request received through the office of the Regional Executive Director in Region 3 after Athletics indicated that the Athletic track does not comply with the Standards of International Association of Athletics Federations Certified Track. a) FINDINGS OF THE COMMITTEE:  The upgrading of the existing roller skating, cycling track and Athletic track do not meet the OHS standards.  Pilditch track surface is uneven.  Water is penetrating to the Cycling track  Roller blade tracks have not been repaired.  Water drainage system on the track is faulty.

4.3.5 BACKGROUND ON LOTUS GARDEN MULTIPURPOSE CENTRE.

The project started in 2011 with the appointment of professional team for detail design and implementation and the master plan for the complex. The original master plan consist of the main soccer/rugby field with athletic tracer, main pavilion, ablution and changing facilities, seating embankment, combo of two practices soccer and cricket field, six hard courts, club house, guard house, community library, internal roads, parking areas and boundary wall.

The project has been divided into 3 phases:

Phase 1: Sport complex Phase 2: Library information (future phase) Phase 3: Community hall (future phase)

The project was not funded during 2014/15 financial year and there were no developments taking place on the side. During this period a lot of vandalism occurred, copper pipes were stolen, toilet sanitary and tiles were broken, electrical cables and irrigation pumps were stolen. This damage led to delays in terms of progressing with other project activities.

Phase 1: Sport Complex:

The following scope of work is completed to date:

 Construction of masonry retaining wall for the entire site  Construction of bulk earthworks  Construction of bulk Storm water  Construction of gate and other access control measures and fence  Landscaping  Kerbs and paving  Planting of grass

The current scope of work to complete the existing multipurpose facility involves repairs of work on the vandalism and damages include the following:

 Ablution block  Guard house  Perimeter lighting  Pump and Irrigation system  Top dress of grass  Electrical reticulation  Repairs and additional work on seating embankment  Installation of flood lights  Construction of the two combo hard courts  Installation of goal post  Erecting of catch ball fence

Progress to date on current scope:

4.4.1 BACKGROUND ON MULTIPURPOSE CENTER:

Olivenhoutbosch is a located within the southern region of the City of Tshwane. The community in this area practiced soccer on an informal scraped field, as there were no facilities for sports. In addition, there is no community hall and an existing library is small to accommodate the local community. The Gauteng Provincial Government is in the process of ensuring adequate access to library services, by upgrading the Olivenhoutbosch Library. The Department is addressing the other needs of the community, through development of the Olivenhoutbosch Multipurpose Center. The Olivenhoutbosch Multipurpose facility was implemented in phases and the Department indicated that this was due to financial constraints. Items completed in terms of the scope of the project are as listed, followed by pictures:  Clearvu” fence erected around the center.

a) FINDINGS OF THE COMMITTEE ON OLIVENHOUTBOSCH MULTIPUPOSE CENTER:

 The committee discovered that the Zion Christian Church (ZCC) is occupying the parking belonging to the multipurpose center.

4.4.2 BACKGROUND ON LAUDIUM LIBRARY

The library was established in 1970 under Pretoria Council and was taken over by the Centurion Town Council in 1994. During the amalgamation process in 2000, it

was handed over to the Tshwane Metropolitan Council. This library operates with three (3) staff members, one Librarian and two Library Assistants. Services offered include issuing of books, magazines, newspapers, DVD and CDs. The library opens daily from 13:00 to 17:00 except on Saturday, where operations are from 08:30 to 13:00.

The Laudium area has expanded substantially in the last fifteen years, as a result the facility cannot accommodate the growing population. There is no study room in this library.

The facility used was not designed to be a library and it does not comply with the library building requirements. The structure is affected by the dolomite in the area and there are structural defects, with cracks on the wall. The top structure is about to collapse in the south eastern corner. The operating hours are from 13h00 weekdays and the library does not open on Saturdays, as a result access to this facility is limited.

a) FINDINGS OF THE COMMITTEE

 The library has three (3) staff members, which are the Librarian and two Library Assistants.  This library is operated weekdays from 13h00 to 17h00 in one large room and there is no separate study area.  The library has no educational toys to enhance cognitive and childhood development.  The committee took note of the fact that the community in Laudium has expanded substantially in the last 15 years and the facility has not kept pace with the increase of the population.  The building is not suitably structured for studying and it is located in a dolomite area.  There are structural defects and cracks have developed on the walls, mainly on the south eastern corner of the top structure, due to instability of the foundation that is sinking.  The Library does not open on Saturday, as a result access to this facility is limited.

4.4.3 BACKGROUND OF ERASMIA LIBRARY

The library started operating on the 1st of March 1964 in the community hall. In 1991, it was relocated to a rented building in Shezan Centre where it is currently situated. This library is used by the local community and the neighboring communities from Laudium, Gerharsville, Hennops River, Laezonia and Schurveburg. It operates from 08:30 to 17:00 and closes during weekends.

The services rendered include assistance to learners with school projects, reference facilities, provision of books and CDs, photocopying and fax.

a) CHALLENGES The library facility is extremely small, there is no study area and this facility is understaffed, operating with one Librarian and a Library Assistant.

b) FINDINGS OF THE COMMITTEE

This library is in a small rented facility and the municipality pays R21, 450.67 for monthly rental fee. The library has an average internal usage of 2000 people per month.

4.4.4 BACKGROUND ON THE SINKHOLE AT LAUDIUM CRICKET STADIUM

There is a sinkhole that has developed at the Laudium Stadium which poses imminent danger to the community. The sinkhole appears to be extending in a northern direction beyond the surface. Cracks are visible on the ground, about 1-1.5m beyond the southern edge of the sinkhole.

A water pipe is visible in the sinkhole along the downslope side and it appears to be hazardous. The grass in the area seems to be greener/more overgrown indicating that water has been ponding or leaking in that area for a while.

a) FINDINGS OF THE COMMITTEE

The committee were informed that the development of a sinkhole at the Laudium cricket ground was discovered during May 2016. The sinkhole measures 7.5m (north- south) by 3.8m (east-west). The hole is approximately 5m deep and poses an imminent danger to the community. An investigation into the cause and proposed rehabilitation was conducted by Geo Buro Geotechnical Surveys. The committee were informed that a study was paid for by the Roads and Transport Department; however the department does not have the required funding for the rehabilitation costs which is estimated at over R2mil.

A Bill of quantities have been prepared based on the conditions at the time of the investigation, however quantities may change depending on when rehabilitation starts according to the geotechnical report.

Floodlights was installed by the Laudium Cricket Club at their own expense after receiving the permission from the City of Tshwane.

The floodlights were installed in a substandard which led the pole to collapse. The entire job including the wiring was done inadequately done. The poles pose danger to the community A requisition to remove the pole was considered.

4.4.5 BACKGROUND ON NEW GARANKUWA LIBRARY

The project started in the 2015/16 financial year with the identification of an appropriate site. Then followed the procuring of the services of the project team which consisted of a principal agent, quantity surveyor, civil and structural engineer and electrical and mechanical engineer through City of Tshwane’s Integrated Project Delivery Unit (IPDU). The architectural services were sourced in-house from the Tshwane Corporate and Shared Services Department. The detail designs and the tender document were completed in April 2016. The tender was advertised in May 2016 and the contractor was appointed through the IPDU in June 2016.

Scope of work:

The construction of a community Library of 1000 m² with lending section, fiction and children’s sections, study area, offices, store rooms, parking area, landscaping and fencing. General progress of project at 65%. The anticipated completion date for the project is 30 June 2017.

a) CHALLENGES:

 Community disruptions and site stoppages arose from time to time and the ward councilor intervened to resolve the disputes between the community and the main contractor.  The quality of work done by local sub-contractor was of low quality and caused most of the challenges.

b) FINDINGS OF THE COMMITTEE

 During the visit on the site, the committee expressed contention on progress and quality of workmanship in the New Rankuwa library project.  The building of the structure was completed to the roof level.  The running electrical wire through the channel between ceiling joists has been installed, however the ceiling boards were in the process of being mounted and quality of the boards were compliant with the building core standards.  The contractor expressed dissatisfaction on the late payments  At the entrance of the facility there is a hole which poses a safety risk and the surface of the floor is uneven.

4.4.6 BACKGROUND ON GIANT STADIUM

The Giant Stadium is located on erf 2001, Soshanguve Section F and comprises an area of approximately 56 hectares. The total facility design consists of a roofed main stadium with 50,000 seats, internal roads and parking areas for 6000 cars on site, ticket offices, caretaker’s house, sportsman accommodation, administrative building, 2 soccer practise fields with change rooms, ablutions and floodlights, 1 synthetic athletics stadium with spectator stand with change rooms, ablutions etc., indoor sport hall, Olympic swimming pool, mini tennis stadium, mini basketball stadium, mini netball stadium, cricket field with change rooms/ablutions, mini softball stadium with change rooms/ablutions, 2 hockey fields, 5 ticket offices and a bowls facility.

a) FINDINGS OF THE COMMITTEE

 The Ceiling is collapsing due to inferior material used when the building was being constructed.  The committee noted that even though the building was completed in 2014 the infrastructure is deteriorating due to substandard construction.  Lack of maintenance  Insufficient security personnel to cover the entire facility, which has exposed the facility to vandalism of the building and theft,

 During events fire extinguishers are being removed by spectators as they are not mounted properly posing a safety hazard.  The committee discovered that a CCTV is not installed.  Due to poor infrastructure the leakage from the ceiling has damaged the carpet.

4.4.7 BACKGROUND ON REFILWE STADIUM:

Inspection in Loco was cancelled.

a) REASON: Since the budget for Refilwe mini stadium project for 2016/2017 was not utilized, the committee resolved that another be scheduled as soon as the project is rolled out.

4.4.8 WORKSHOP ON INTERLINKING SPORT, RECREATION, ARTS AND CULTURE:

The purpose of the workshop was to outline the structure, functions and objectives of the amalgamation of the Social Development and Sport, Recreation, Arts and Culture (SRAC). The information imparted was to ensure how the scope of the amalgamation would be implemented, cascaded and benefit the community to improve service delivery. The synopses of the workshop provided insight into existing programs and projects to the committee.

4.3 LEGAL PARAMETERS

The Department in rendering services to the community is guided by the following policies, By-Laws and legal prescripts:

 Sport and Recreational Services Facility User Policy  City of Tshwane Museum Art Gallery and Heritage Site Policy  Sport Recreational Services By-law.  City of Tshwane Heritage Resources Arts and Culture Management By-law.

Section 152 of the Constitution of the Republic of South Africa, Act 108 of 1996.

(Unaltered) “(1) the objects of local government are-

a) to provide democratic and accountable government for local communities; b) to ensure the provision of services to communities in a sustainable manner; c) to promote social and economic development; d) to promote a safe and healthy environment; and e) to encourage the involvement of communities and community organizations in the matters of local government.

2) A municipality must strive, within its financial and administrative capacity, to achieve the objects set out in subsection (1).” Section 152 of the Constitution of the Republic of South Africa provides a framework, within which the municipality and Department in particular, should conduct its business. The discussions below will indicate provisions of the Constitution upheld and provide recommendations if there are areas for improvement. The analysis on whether the Department has satisfied the relevant regulations will be further supported by lessons from other countries or spheres of government. 4.3.1 INTERNATIONAL LEGISLATION, TRENDS AND ACCORDS: a) ODI, CALEDONIAN, HM PITJE AND GIANT STADIA

The United European Football Association (UEFA) guide to quality Stadiums (2011) requires that a specific set of standards and regulations be respected and certain structural and design criteria be applied as follows:

 That modern stadium designs should focus on the need to create people friendly structures which provide maximum comfort and safety.  That stadiums should aim to serve the community at large.  That stadium design should incorporate the latest technological advances in order to offer the best possible facilities. According to the UEFA-CAFÉ PUBLICATION, particular attention is now given to facilities for disabled  supporters, with the recognition that they need special seating and access arrangements to ensure complete mobility within the stadium complex. Valuable reference commonly known as “The Green Guide” produced by the Scottish office of the United Kingdom government, emphasizes amongst others the following:   Fire Safety and prevention  Structural safety  Architectural design  Operational safety  Segregation of rival supporters.

The Committee findings from the above mentioned stadia clearly demonstrate the need for the Department to address challenges reported during the inspections. These include safety features as the stadium is declared unsafe for usage by engineers, lack of water and electricity resulting in the non-functioning of ablution facilities. The “Green Guide” may be utilized in upgrading the stadium to comply with minimum safety standards.

ATHLETIC TRACKS ON PILDITCH STADIUM

The Mondo designed Track at the London 2012 Olympic Stadium was tested by Labosport, one of the Independent Labs accredited with the International Association of Athletics Federation (IAAF). The IAAF wants to ensure that all the structures of the Tracks are suitable for all the events that will take place in the Stadium. Labosport has made sure the London 2012 Track Complied with the set standards for shock absorption and degree of deformation. In recent decades, technological advances have changed the face of modern athletics. London 2012 Games main Stadium on the track consists of the most advanced position, forefront and lead on the cutting-edge of effective technology. All the Tracks were designed and laid by Mondo, an Italian company that has provided all the tracks at the main Olympic stadium since the 1992 Games in Barcelona.

Unlike other track designs that combine traction and shock absorption in an upper layer of rubber granules, the Mondo track separates these functions, with a cushion backing for shock-absorption and a solid upper layer that optimizes slip resistance, traction and durability.

This design cuts the need for the spike on athlete’s running shoes to penetrate the running surface. Shoes used on tracks fitted by the Italian firm are considerably shorter and non-penetrating.

This means that less time and energy is lost going into the track and retracting the spikes afterwards. Both the layers in the track are made of rubber, explain Joe Hoekstra, Mondo’s Project Manager for London 2012.

b) LIBRARIES: SUURMAN, LAUDIUM, ERASMIA AND CULLINAN.

The role and purpose of the public library is that according to (IFLA/UNESCO PUBLIC LIBRARY MANIFESTO, 1994) the Library is a gateway to knowledge, it provides a basic condition for lifelong learning, independent decision-making, and cultural development of the individual and social groups.

In terms of ISO/TR 11219: 2012 Qualitative Conditions and basic Statistics for library buildings, function and design provides guidance on the selection of technical building equipment for the different functional arears of libraries.

The International Building Code is the most widely used model code in the U.S for construction of local facilities buildings. This code is updated by the International Code of Council every three years. The code emphasizes the importance of structural strength and fire protection requirements in buildings.

4.3. 2 COMPLIANCE WITH THE CONSTITUTION OF SOUTH AFRICA

In accordance with the context of the report regarding the upgrading of Stadia and the integrity of all municipal facilities+, Section 156 19(a) of the Constitution of the Republic of South Africa, the Municipality has executive authority in respect of, and has the right to administer Local Sport Facilities as Local Government matter, as listed in part B of schedule 5 to the Constitution. Further in accordance with the provision of section 153 of the Constitution of the Republic of South Africa, Act 1996, the Municipality is required to inter alia, give priority to the basic needs of the community, and to promote the social cohesion and economic development of the community.

A local authority may issue a safety certificate in respect of the design of a new stadium as contemplated in Section 9(a) of the constitution of the Republic of South Africa.

4.3.3 LOCAL GOVERNMENT LEGISLATION

In terms of Section 4(2) (g) of the Municipal System Act, 2000, oblige the Municipality, within the Municipality’s financial and administration Capacity and having regard to practical consideration, to promote and undertake development in the Municipality.

Development contemplated in the aforesaid provision, as defined in section 1 of the Municipal Systems Act, 2000, means sustainable development, including, integrated social, upliftment of a community aimed at improving the quality life of its community members with specific reference to the poor and other disadvantaged sections of the community, and ensuring that development serves present future generations.

 Municipal facilities must be in possession of a current certificate issued by the Fire Services of a local authority after consultation with a competent person registered in terms of the Engineering profession of South Africa, Act, 1990 (Act No: 114 of 1990) who specializes in civil and structural design of stadiums, which certifies the structural integrity of a stadium.  The validity of the certificate contemplated in regulation 3 (1) shall be subject to a library in possession of:

1. A current fire safety compliance certificate in respect of the Municipal facilities issued by the head of the fire department, located within the immediate vicinity of a stadium. 2. A current electrical compliance safety certificate, issued by a local authority after consultation with a competent person registered in terms of the Engineering Profession of South Africa Act, 1990 (Act No, 114of 1990) who specializes in the electric design of municipal facilities. 3. A current Occupational Health and Safety compliance certificate, issued by the local head of the department of Labor in respect with all facilities. 4. A current certificate issued by a Local Head of the Department of Health, in respect of all aspects of food integrity, waste management, water and sanitation applicable, by law

4.3.4 COUNCIL STRATEGIES/ BY-LAWS

The municipal processes followed by the Department in formulating its predetermined objectives, result in adoption of the institutional Integrated Development Plan (IDP) and SDBIP by Council as a resolution. The Committee then conducts oversight on the Department’s key performance indicators (KPIs) to determine whether set objectives are met within the allocated budget and timeframes. The oversight activities are supposed to further determine whether services are provided in accordance with policies and by-laws of Council, relevant to the Department. In essence, the 2016/2017 financial year Committee findings in terms of performance of the Department, will be tracking implementation of Council resolutions by the Department. This report will focus solely on the Council resolution relating to the SDBIP.

4.3.5 GENDER EQQUITY AND WOMEN EMPOWERMENT (GEYODI) ON ODI, HM PITJE AND CALEDONIAN:

The departmental compliance in this category is measured through its adherence to legislation and policy requirements to accommodate the needs of GEYODI category. The services considered in this regard include employment of the targeted groups, ensuring suitable accommodation in the workplace and all departmental facilities.

The status of Odi, HM Pitje and Caledonian stadia, demonstrate that there is no compliance within safety measures applicable in the stadium. In the process of upgrading the stadium/stadia, the Department should consider the requirements below.

According to the Safety at Sports and Recreational Events Regulations,( Act 2 of 2010), a stadium must have a local authority approved accessible permanent purpose specific accommodation and facilities in place for use by the physically challenged spectators as contemplated in section 8(2) of the Act.

The Stadium must provide the following: a. Un-obstructed viewing platforms or ramps (including a seat for an assistant to wheelchair bound spectator). b. Access to electrical power for electric wheelchair. c. Ablutions and other support services should be close to the physically challenged platforms or viewing ramps. d. Convenient access and egress measures in and out of a stadium and its precincts including dedicated access and egress gates providing direct wheelchair access into a stadium to physically challenged viewing areas. e. The quality of viewing positions for physically challenged persons must be varied to allow physically challenged persons the same viewing opportunities as able- bodied spectators at a stadium. f. It must be possible for a wheelchair bound persons to access a stadium at all of the public entrances, including the VVIP, VIP media, broadcasting and player facilities to their viewing positions, without undue in- convenience to themselves or the general body of spectators. g. A physically challenged spectator must not be accommodated in any position within a stadium where his or her inability to move quickly would create a danger to himself or herself and the general body of spectators in the event of an emergency. h. A physically challenged spectator viewing platform or ramp must be positioned in such a way that it is protected from the elements. i. A challenged spectator viewing platform or ramp must:  Not be located where sight lines of physically challenged person can be impaired by the celebration of able-bodied spectators, who might end up hurting the physically challenged.  Not impair the sight lines of the general body of spectators. j. A specialist accessibility consultant must be consulted in order to ensure that the provisions relating to a physically challenged person in the Act and these regulations are complied with.

ANALYSIS FOR COMPLIANCE ON ODI, HM PITJE AND CALEDONIAN STADIA:

The stadia do not comply with the Geyode regulations. The condition of the stadia violate the rights of people with disability to have a safe access to the facility. The status of the stadia do not promote the advancement of disability rights and there are no provisions for key interventions to empower people with disability during events.

The current status of the stadia do not serve as a moral guidelines that provide a unique opportunity to improve the quality of life for a challenged and particularly vulnerable segment of our fellow citizens.

4.3.6 OCCUPATIONAL HEALTH AND SAFETY COMPLIANCE ON :  SUURMAN, ERASMIA AND LAUDIUM LIBRARIES  ODI,HM PITJE, CALEDONIAN AND GIANT STADIA  LAUDIUM CRICKET FIELD SINK HOLE

The current dilapidated status of the above Stadia do not meet the core standards of OHS, leaving the health and safety of employees and spectators at risk. The OHS requirements compels a stadium to be in possession of:  A valid certificate issued by the fire services of a local authority, after consultation with a competent person registered in terms of the Engineering Profession of South Africa.  A current fire safety compliance certificate in respect of the stadium issued by the Head of the Fire Department, located within the immediate vicinity of a stadium.  A current Occupational Health and Safety compliance certificate, issued by the local Head of the Department of Labor in respect of stadiums.  A current certificate issued by a local Head of the Department of Health, in respect of all aspects of food integrity, waste management, water and sanitation.

The Committee has discovered that the above stadia do not meet the standards of the current fire, electrical, occupational health and safety requirements as per the report of the Department to the Committee in the November 2017 inspection.

1. ANALYSIS ON SUURMAN LIBRARY: The library does not have an occupational certificate which is a high risk factor. The ceiling of the library is non-compliant and does not meet library requirements and specifications. In order for the municipality to provide efficient and effective service delivery in constructing facilities extensive training is required. Mechanical properties of material used, such as toughness, strength, weight, hardness and elasticity to determine a suitable size, thickness of the ceiling did not meet the required building standard.

` 2. ANALYSIS OF PILDITCH STADIUM: The facility requires upgrading to regain its status as a number one Athletic Stadium in the Country. It is badly damaged and amenities affected include Cycling and Skating Tracks. The Tartan Track has deteriorated in such a way that no major Athletics Championships could be held as it poses a danger to athletes

3. ANALYSIS OF LOTUS GARDEN

The Lotus Garden project is a multiyear project constructed in phases, due to budget constrains this project was immensely affected and delayed, as a result crime escalated and compromised the budget of department. The prevalence of crime was also due to insufficient security personnel.

4.4.1 NUMBER OF SDBIP TARGETS RELATIVE FOR THE 2016/2017 FY:

4.4.5. MAIN REASONS IN THE SDBIP WHICH RECORDED AS NON- ACHIEVEMENT/ NON-COMPLIANCE 1. The Upgrading of Refilwe (712916) is at 0% and the project was on the IDP for 2014/2015 budget. The project commenced in March 2015 as a joint venture. A dispute between the two contractors emerged, and the project was abandoned.

4.4.6 MAIN REASONS PROVIDED BY THE DEPARTMENT FOR NON-ACHIEVEMENT:

Motla Projects and Sedikwe Construction was appointed on 15 May 2014/2015 financial year. A dispute occurred between the two joint venture partners which lasted for approximately three months which resulted on the cancellation of the project. Progress at the end of 2015 was at 21%. The completion of the project was set on the 30 December 2016. R8.450.700.00 of funds was forfeited on suspend account during 2014/2015 financial year. During 2015/2016 financial year the project was allocated 15.000.000.00. R11.500.000.00 funds was transferred to assist with the completion of Cullinan library. Funds forfeited in 2015/2016 is R1.775.122.00. The project is on the SDBIP for 2016/2017 with budget allocation of R10.000.000.00. No expenditure to date.

4.4.9 MEASURES IN PLACE TO COMPLY / ACHIEVE THE NON- ACHIEVEMENT TARGET: 1. New tender is compiled for advertisement 2. A report seeking extra funds and appointment of new contractor is in process of approval. 3. Constant follow up has been made by the department and relevant Stake holders.

4.4.7.1 ANALYSIS FOR COMPLIANCE: There is lack of compliance on the SDBIP time lines and non-adherence in achieving set goals. All the targets the department confirmed they will be relatively complete by the end of quarter 3 are delayed. The following 2015/2016 financial year facilities are not yet utilized by the community members.  Zithobeni mini stadium  Cullinan library park  Olivenhoutbosch multipurpose center is also not utilized by the community members.

The following projects are not yet completed 2016/2017 financial year:  Rethabiseng greening  Lotus Garden multipurpose center  New GA Rankuwa library  Refilwe Stadium

The department seem to have regressed from what they have planned to achieve in Q3 with regard to projects implementation. The performance analysis for the 3rd quarter shows a lot of indicators that were not achieved according to the set timelines.

Challenges identified included the delays within the construction which resulted in major contributing factor for the backlogs. The department need to engage to in the process of creating a dedicated capacity to complete projects and meet timelines. In terms of section 46 (I) (a) (iii) of the MSA, the municipality must reflect on measures taken to improve performance. That is where targets are not achieved. The corrective action plan is developed to capture targets not achieved and measures to be instigated thus far.

Analysis on Department The general observations made regarding performance of the Department is a lack of compliance on the SDBIP with time lines, resulting in delayed completion or handing over of projects as scheduled due to insufficient allocated budget.

4.4.4 MEASURES IN PLACE TO COMPLY / ACHIEVE NON- ACHIEVED TARGETS  New tender compiled for advertisement  A report seeking extra funds and appointment of new contractor submitted for approval.

The Committee notes that there is lack of compliance on the SDBIP time lines and non- adherence in achieving set goals, as a result they did not provide comprehensive reasons for non-achievement. The targets set by the Department were achievable.

4.5 INTER GOVERNMENTAL RELATIONS

4.5.1 OR TAMBO GAMES

The OR Tambo Games for Gauteng Municipalities which were conceptualized by the South African Local Government Association (SALGA) Gauteng in 2006, are hosted annually on a rotational basis by all member municipalities, where officials and Councilors are allowed to participate. The involvement of the municipality in the games included arrangement for all departmental teams to practice every Wednesday, from the 14 September to 19 October 2016, in preparation for the tournament. The tournament was hosted by Ekurhuleni Municipality on the 20-21 October 2016.

CHALLENGES  Departmental teams were not all provided with ample time to train for the tournament, the Tshwane Metropolitan Police Department was negatively affected in this regard.  The late distribution of gear/sports attire demoralized participants.

4.5.2 PUBLIC PARTICIPATION

4.5.2.1 HOMELESSNESS AND SUPPORT FOR SCHOOLS FOR LEARNERS WITH SPECIAL NEEDS POLICIES

The review of the current City of Tshwane Homelessness policy and approval for street homelessness is showing a vast growing challenge that needs to be addressed by the City. Research report shows different categories of homeless people in the

City of Tshwane. Report asserts that some of homeless people do not afford to travel between their places of stay and opt to sleep on the streets to save their travelling expenses.Another category of homeless people are those who are temporarily stranded and living in streets is a viable option to them due to lack of affordable accommodation, unemployment, substance abuse, mental illness and poverty. Women and children falls within a group that is mostly affected by homelessness. During the session role players/ Stake holders voiced their concerns and inputs on the tabled policy

CHALLENGES ON HOMELESSNESS

Community members complained on the communication breakdown in the City of Tshwane, consequently information on Public Participation was not published on the website of the City and had difficulty reaching the officials. A community member raised a concern regarding the time frame on the implementation of the policy. The bulk of homeless people are illegal immigrants. Due to insufficient public ablutions in the city, homeless people are forced to use the streets as toilets and where there are facilities, they have to pay to utilize them. Some stakeholders indicated that lack of title deeds deprives them from being funded. Due to lack of employment, youth end up engaging in substance abuse.

4.5.2.2 CHILDREN/ SCHOOL OR LEARNERS WITH SPECIAL NEEDS IN THE CITY OF TSHWANE POLICY The indigent policy is not catering for children with special needs. This policy is designed to address the needs of learners with visual impairment, hearing impairment and various physical disabilities. The affected leaners have the right to access quality education and most are from disadvantaged background. They also need municipal intervention pertaining to access to municipal services and payments.

CHALLENGES The community indicated that a structured committee be established to ensure that the policy is implemented to benefit children with special needs. Old aged disabled persons require educational skills to be able to meet their needs of subsistence.

4.5.3 STATE OF THE CITY ADDRESS (SOCA) 1) INDIGENT PROGRAM:

The Executive Mayor has indicated that in order to cater for the underprivileged households, the City of Tshwane has put in place the Indigent programme, which allows eligible households earning a specific combined gross income to qualify for rebates, support or a service subsidy determined by the Municipality. In terms of the Indigent policy, beneficiaries need to be re-evaluated every 24 months to verify their economic and social position. Qualifying beneficiaries will be re-registered. The non-qualifying households who are illegally receiving the indigent benefits will be addressed through the road show evaluation across the City from September 2016 to call upon residents to reapply in order to affirm their qualification.

2) EPWP

The Executive Mayor has emphasized to prioritize the proliferation of EPWP job opportunities for community members. He indicated that the City is looking into creating 23 000 EPWP job opportunities to alleviate poverty. These job opportunities will be supported by the building of new fire station in Mamelodi. A budget of R660 000 000 that will be invested to industrial nodes such as Waltloo, Rosslyn, Kangala and bulk infrastructure projects.

The Mayor indicated that the City believes in making this opportunities in order to cover a large number of community members and exclude people who were previously employed, ranging from one to three months, which will ensure that the EPWP program does not benefit the same group of individuals. The approach that the City will take during recruitment will ensure that Councilors will not be involved in the process of recruitment to avoid the abuse of the EPWP program for political purposes and vote buying.

3) HOMELESSNESS The issue of Homelessness was also addressed by the Executive Mayor, indicating that the City will alleviate this challenge by converting some of its property to repurpose with a view to create homeless shelters.

5. COMMENTS FROM STAKEHOLDER DEPARTMENTS

None

6. IMPLICATIONS

6.1 Financial Implications

The budget short falls and delays in appointing service providers need to be avoided through proper planning and monitoring of projects, as these factors have negative financial implications upon the City. A budget to fill all vacant positions at libraries be availed to avoid shortage of staff at libraries and be opened for sufficient time during exams and be opened on Saturdays.

6.2 Human Resources

The lack of security personnel in the sport facilities is a concern, as this has a potential of exposing assets to vandalism and theft.

6.3 Communication

The resolutions emanating from this report will be communicated to the relevant department for implementation.

6.4 Constitutional and legal factors The Committee and Department derive their mandates from the Governance Model, which is in terms of Section 79 of the Municipal Structures Act, Act 117 of 1998 as well as the following legislations, polices and by-laws:  Constitution of the Republic of South Africa, Act 108 of 1996.  Local Government Structures Act, Act 117 of 1998.  Local Government Municipal Systems, Act 32 of 2000.

6.5 Previous Council and Mayoral Committee resolutions The Committee is mandated by the following Council resolutions in its operations:  Governance Model of the City of Tshwane: 09 June 2011.  Rules and Orders By- law: 29 November 2012.

7. CONCLUSION

The report highlight activities and findings of the Committee, in line with its terms of reference and advice Council on its findings from meetings and inspections conducted. The general challenges reveal that there is no compliance with regard to facilities inspected by the committee and the Department has been managing its facilities with difficulty due to the usage of sport and recreational services facilities for commercial purpose at no cost. There has been chronic backlog which has adversely affected service delivery due to insufficient budget which has delayed them from meeting their targets as planned.

In terms of mitigation measures, the Department is upgrading the Caledonia stadium at a budget of R33.000.000 and Refilwe mini Sport ground R15.000.000.

The Committee recommendations provided below are expected to assist in addressing challenges identified, inclusive of non-adherence to deadlines and regulations.

 that there was no budget allocated for the library; and

 that the holes on the Stadium grounds was caused by dolomite;  that the lighting at the stadium was inadequate, due to the two high most lights which had fallen;  that the grass field to pitch on was damaged ;  that there was no budget allocated to maintain the stadium; and  that the staff component at the stadium was inadequate to run the facility.

23. That the Sport and Recreation Department investigate the possibility of entering into a partnership with other stakeholders to maintain the facility and repair the damage caused by the dolomite.

24. That cognizance be taken of the challenges experienced at the Laudium Libriary with specific reference to the fact that the building was falling apart.

25. That the Sport and Recreation Department establish if the building can be repaired by the insurance cover, as stated in the occupational certificate.

26. That should the City of Tshwane’s insurance not cover the repair of the Ladium Library building the possibility be investigated that 80

the building be demolished and that an alternative construction method be followed which will complement the area.

27. That the Sport and Recreation Department investigate the possibility that the City of Tshwane enter into a partnership with stakeholders to rebuild the Ladium Library. 28. That a complete list of the City of Tshwane assets inclusive of Stadiums ,venues and clubs in and around Tshwane be submitted at the next Meeting of the Section 79 Oversight Committee: Sport and Recreation.
