THE NATIONAL INSTITUTE OF DESIGN (AMENDMENT) BILL, 2019

The National Institute of Design (Amendment) Bill, 2019 was introduced in Rajya Sabha on July 30, 2019 and after discussion followed with reply by the concerned Union Minister,Shri Piyush Goyal it was passed in the House on 6 August 2019.Presently the same Amendment Bill is in the ambit of Lok Sabha for discussion and passing. The Bill seeks to amend the National Institute of Design Act, 2014, which declares the National Institute of Design, Ahmedabad as an institution of national importance for the promotion of quality and excellence in education, research and training in disciplines relating to design. During the discussion of the above Bill in Rajya Sabha1 ,some of the points raised by the Members were as follows : 1) Industry partnership with the NIDs is absolutely essential because ultimately, designing is meant for consumers; 2) There is a need to improve the faculty in the institutions in the relevant field. Alongwith views from the academia and university, assistance/ cooperation and views of Artists from different fields may also be taken. 3) Greater attention to the design of our crafts industry may be called for; 4) In addition to Principal Designer, the post of Registrar should also be provided for the purpose of fixing maximum of the pay-scale. 5) Need to give promotion of the Arts of , Nalanda, Bihar and ; 6) Funding may only be to the Government Institutes of Eminence like IITs, IIMS, IISC etc. 7) To promote Indian Design Mark Internationally through Embassies and Missions and Handicraft Associations.

Brief History

The National Institute of Design, Ahmedabad, set up in 1961 by the government of with the assistance of Ford Foundation and the Sarabhai family of Ahmedabad, is an autonomous organization under the administrative control of the Department of Industrial Policy and Promotion which is renamed as Department for Promotion of Industry and Internal Trade (DPIIT). It is a premier educational and training institution which conducts multidisciplinary graduate and post-graduate programmes, and also provides research avenues in the area of design education. Functioning from three Campuses viz at Ahmedabad and Gandhinagar in Gujarat and at Bengaluru in , NID, Ahmedabad has been recognized as a scientific and industrial research organization by the Department of Science & Technology, Government of India. It was declared as an Institution of National Importance with the passing of the National Institute of Design Act, 2014 which governs all matters relating to the affairs of the Institute.

Realizing the increasing importance of design in improving quality of products and services and thereby accelerating the economic and industrial development of the country, Government of India approved the National Design Policy (NDP) in February 2007. One of the components of the Action Plan for implementation of the National Design Policy was spreading quality education in design to all regions of India, and for this purpose, it envisaged setting up four more National Institutes of Design on the pattern of NID, Ahmedabad in different regions of the country during the 11th Five Year Plan (2007-12). In pursuance of the Policy, it was decided to set up four National Institutes of Design at Bhopal (Madhya Pradesh), (Andhra Pradesh), Kurukshetra () and Jorhat (Assam) on the lines of NID, Ahmedabad. Approval of the Cabinet to provide financial support of Rs 434 crore for establishing the four 3

NIDs and registering them as Societies under the Societies Registration Act, 1860 was sought, which was accorded on 28 February 2014 with the modification that the NID proposed to be established in Hyderabad may be located in Vijayawada.

Background of the present amendment Bill

As the new NIDs are being established on the pattern of NID Ahmedabad and will be developed as Centres of Excellence in design education, it is proposed to bring them within the ambit of NID Act 2014 and also to declare them as Institutions of National Importance. The present Bill to amend the NID Act,2014 for the purpose has been drafted in consultation with the Ministry of Law. Once the Bill is enacted, the provisions of NID Act will be applicable to the four new NIDs and each of them will be an Institution of National Importance. Before this National Institute of Design( Amendment) Bill, 2018was earlier introduced by Sh. Suresh Prabhu , Minister of Commerce and Industry in the Lok Sabha on December 18, 2018. The Bill however lapsed with the term of the 16th Lok Sabha getting over.

Presently, the abovementioned four Institutes do not have the authority to grant degree, diploma and other academic distinctions. Therefore, a need has been felt to give them statutory status so as to ensure the maintenance of similar standards and quality of education in all areas or disciplines relating to design, as the National Institute of Design, Ahmedabad. It is proposed to declare the aforesaid Institutes as institutions of national importance and to confer power on them to grant degree, diploma and other academic distinctions.

The objective behind this amendment is that by granting the status of institutions of national importance (INI) to new NIDS that design education will be socially inclusive and address the needs of design in various sectors, including agriculture, healthcare, transportation, rural housing, rural and urban sanitation and many other sectors of the Indian economy. It will also prepare highly skilled manpower to serve the nation and the world with talent, skill and training. Side by side achieving the SDGs for a sustainable planet through key design interventions such as strategic foresight and human centered processes shall be facilitated.

Key Features of the Bill2

● Granting Status of Institution of National Importance (Clause 4 Under Section 2) - The National Institute of Design (Amendment) Bill,2019 seeks to include four National Institutes of Design (NID) in the states of Andhra Pradesh, Madhya Pradesh, Assam, and Haryana within ambit of the law and declare them as institutions of national importance at par with the National Institute of Design, Ahmedabad by amending Section 2 of the said Act. On being declared institutions of national importance, they will be able to grant degrees and diplomas.

● Incorporation of each of New NIDs (Clause 6) - Substitution of Section 4 of the Act will provide incorporation of each of the aforesaid institutes. Each Institute shall be a body corporate by the same name as mentioned in column (4) of the Schedule3. It further provides that each of the institutes may establish Institute Campuses within or outside India.

● Some minor amendments to various sections of the Act including consequential amendments considered necessary are proposed in the Bill.

● Nomenclature of the post of Principal Designer (Clause 23 of Section 27) The Bill proposes amendment in the Section 27 of the said Act so as to designate the post of Principal Designer instead of the Senior Designer, as equivalent to a Professor.

Comparative Analysis of the provisions of the Principal Act and the Amendment Bill is given below :

In pursuance of the National Design Policy and to raise the design education to global standard of excellence in all regions of India, the Government of India set up four new National Institutes of Design in the States of Andhra Pradesh, Madhya Pradesh, Assam and Haryana, as societies under the Societies Registration Act, 1860. Presently, the said Institutes do not have the authority to grant degree, diploma and other academic distinctions. It is, accordingly, proposed to amend the National Institute of Design Act, 2014, inter alia, to provide for the following:— (a) to amend section 2 of the said Act, so as to declare the National Institutes of Design in the States of Andhra Pradesh, Madhya Pradesh, Assam and Haryana, as institutions of national importance; (b) to substitute section 4 so as to provide for incorporation of each of the aforesaid institutes; (c) to make consequential amendments to various sections of the said Act; (d) to amend section 27 of the said Act so as to designate the post of Principal Designer instead of the Senior Designer, as equivalent to a Professor. 4. The Bill seeks to achieve the above objectives.
