The Council of the City of met at Andrew S. Haydon Hall, 110 Laurier Avenue West, Ottawa, on Wednesday, 08 June 2016 beginning at 10:10 a.m.

The Mayor, Jim Watson, presided and led Council in a moment of reflection.

RECOGNITION - MAYOR'S CITY BUILDER AWARD

Mayor Jim Watson and Councillor Jody Mitic presented the Mayor’s City Builder Award to Marcel Gibeault in recognition of his volunteer work in the community and his support for Franco-Ontarian culture. Mr. Gilbeault has given generously of his time, skills and leadership in establishing and supporting La Societé franco-ontarienne du patrimoine et de l’histoire d’Orléans; Rendez-vous des aînés francophones d’Ottawa (RAFO); Mouvement d'implication francophone d'Orléans (MIFO); the Orléans Recreation Complex (today the Bob MacQuarrie Recreation Complex - Orléans; and other community projects.

PRESENTATION - CITY OF OTTAWA - 2016 SENIOR OF THE YEAR AWARD

Mayor Jim Watson presented the Province of Ontario Senior of the Year Award, Ottawa municipality certificate, to Marjorie Shaver-Jones, in recognition of her outstanding contributions to the community after age 65. Ms. Shaver-Jones serves as President of the Copeland Park Community Alliance, and actively volunteers with the Federation of Citizens’ Associations of Ottawa and the Kanata Theatre.

 Petition received, containing 70 signatures of residents, requesting that the Statement of Work concerning the Airport from to the Ottawa Macdonald-Cartier Airport be put on hold until negotiations can proceed to complete the proposed extension of the Trillium O-Train line from Greenboro Station to Riverside South. (reference: Transportation Committee Report 15, Item 6 of the Council Agenda)

Other Correspondence Received:

 Submission received, containing 94 signatures of residents, requesting that the Statement of Work concerning the Airport Parkway from Brookfield Road to the Ottawa Macdonald-Cartier Airport be put on hold until negotiations can commence with the Ottawa Macdonald-Cartier International Airport Authority to build a light- rail stop inside its passenger terminal, which should be included in the proposed extension of the Trillium O-Train line from Greenboro Station to Riverside South. 1. WATER ENVIRONMENT STRATEGY – PHASE 2

ENVIRONMENT COMMITTEE AND AGRICULTURE AND RURAL AFFAIRS COMMITTEE RECOMMENDATIONS

That Council:

1. Approve the Water Environment Strategy Phase 2 report and 2016-2018 Workplan, attached as Document 1 and as described in this report.

2. Direct staff to report back on the implementation of the approved 2016-2018 Workplan as part of the report to the 2018-2022 City Council on a proposed 2019-2022 Water Environment Strategy workplan, for their consideration.

2. ZONING BY-LAW AMENDMENT – PART OF 3940 DUNNING ROAD

That Council approve an amendment to Zoning By-law 2008-250 for part of 3940 Dunning Road to prohibit residential uses on the retained farmland, and modify regulatory provisions, as detailed in Document 2.

WHEREAS the French recommendation contained in the above-noted staff report as presented to the Agriculture and Rural Affairs Committee, was incorrect and did not match the English recommendation; and,

WHEREAS the English version of the recommendation contained in said report was correct;

THEREFORE BE IT RESOLVED THAT the French recommendation be corrected to accurately reflect the wording contained in the English recommendation, as follows:

Que le Conseil approuve une modification au Règlement de zonage 2008-250 en ce qui a trait à une partie du 3940, chemin Dunning, afin d’interdire des utilisations résidentielles sur les terres agricoles conservées, et de modifier les dispositions réglementaires, comme il est précisé dans le document 2.

5. SMART CITY INITIATIVES

COMMITTEE RECOMMENDATION

That City Council recommend that the Finance and Economic Development Committee be assigned governance over Smart City initiatives, and that staff be directed to come back to the Finance and Economic Development committee and Council with a report on a vision and roadmap for Ottawa to become a Smart City which builds on the work and investment being made by Hydro Ottawa.

6. AIRPORT PARKWAY (BROOKFIELD ROAD TO OTTAWA MACDONALD CARTIER INTERNATIONAL AIRPORT) AND LESTER ROAD (AIRPORT PARKWAY TO ) WIDENING ENVIRONMENTAL ASSESSMENT STUDY – RECOMMENDATIONS

COMMITTEE RECOMMENDATIONS

That Council:

1. Approve the results of the Airport Parkway and Lester Road Widening Environmental Assessment Study, as described in this report and supporting documents; and

2. Direct staff to finalize the Environmental Study Report and proceed with its posting for the 30-day public review period in accordance with Ontario Municipal Class Environmental Assessment process.

WHEREAS the staff report entitled “Airport Parkway (Brookfield Road to Ottawa Macdonald- Cartier International Airport) and Lester Road (Airport Parkway to Bank Street) Widening Environmental Assessment Study – Recommendations” was considered by Transportation Committee at its meeting of June 1, 2016; and

WHEREAS staff had included a number of internal and external stakeholders as part of the public consultation process, including Healthy Transportation Ottawa, Citizens for Safe Cycling and Accessibility Advisory Committee; and

WHEREAS, due to an oversight by staff, the Environmental Stewardship Advisory Committee (ESAC) did not participate in the consultation process; and

WHEREAS the staff report stated that the Environmental Stewardship Advisory Committee (ESAC) had been included as part of the public consultations and the Advisory Committee has requested that the report be amended to remove the incorrect reference;

THEREFORE BE IT RESOLVED that the report be amended to remove reference to consulting with the Environmental Stewardship Advisory Committee (ESAC).

C. GREENSCAPING PILOT PROJECT – EAST

COMMITTEE RECOMMENDATIONS

That Council:

1. Approve a waiver to Section 3(2) of the City of Ottawa Encroachment By-law 2003- 446 to permit a Greenscaping Pilot Project for three sections of the inner boulevard along Somerset Street East, as described in this report, and delegate authority to the General Manager, Planning and Growth Management, in consultation with the Ward Councillor, to waive encroachment fees for as long as the greenscaping is maintained by the Action Sandy Hill Community Association; and

2. Direct Planning and Growth Management staff to develop a Community Initiated Boulevard Greenscaping Program, based on information collected through the Somerset Street East Greenscaping Pilot Project, and report back to Transportation Committee and Council Q2 2018.

That Council:

1. Waive the prohibiting provisions of the Encroachment By- law to allow for the installation of charging stations on the City’s road allowance on Bank Street between Catherine Street and Wellington Street, as described in this report.

2. Waive the prohibiting provision of the Encroachment By- law to allow for the installation of art on the City’s road allowance on Bank Street between Catherine Street and Wellington Street, as described in this report.

MOTIONS OF WHICH NOTICE HAS BEEN PREVIOUSLY GIVEN

MOTION NO. 33/5

WHEREAS it has been five decades since the collapse of the Bridge during construction on August 10th, 1966, which caused the deaths of nine workers and injured 55 more; and

WHEREAS that disaster prompted significant changes to construction workplace safety standards in the Province in Ontario; and

WHEREAS the deaths of 26 workers in the Westray Mine disaster on May 9th, 1992, prompted the Federal Government to amend the Criminal Code of Canada in 2004 to hold corporations, their directors and executives criminally accountable for the health and safety of workers (the “Westray Amendments”); and

WHEREAS despite these legislative changes, according to the most recent statistics compiled by the Association of Workers’ Compensation Boards of Canada, 919 workers across Canada died in 2014 as a result of workplace

OTTAWA CITY COUNCIL 15 MINUTES 33 WEDNESDAY, 08 JUNE 2016 accidents or illnesses and this rate of workplace death and injury has not abated since; and

WHEREAS it was not until June 2015 that the first conviction under the Westray Amendments was obtained in the Province of Ontario;

THEREFORE BE IT RESOLVED that Ottawa City Council petition the Attorney General and the Labour Minister for the Province of Ontario to improve coordination between Occupational Health and Safety Act investigators, police and Crown Attorneys with a view to ensuring that the spirit and intent of the Westray Amendments are properly considered and applied in all cases of workplace fatalities and serious injuries.

That the Rules of Procedure be suspended due to timelines, as this event will begin prior to the next scheduled City Council meeting, to consider the following Motion:

WHEREAS BIA is to hold the 24th Annual Rib Fest festival; and

WHEREAS Sparks Street, from Lyon Street to Bay Street is required to be closed; and

WHEREAS the closure of Sparks Street, from Lyon Street to Bay Street as outlined is required to accommodate the event set-up commencing at 9:00am on Tuesday, June 21, 2016; and

WHEREAS the street festivities will commence on the morning of Wednesday, June 22, 2016, and setup of the street party stage and other on-street attractions takes several days; and

WHEREAS the City of Ottawa’s Special Events on City Roads By-law (2001- 260) prohibits road closures before 6:00pm Monday to Friday; and

WHEREAS the Sparks Street road closure will end, and re-open at 7:00pm Sunday, June 26, 2016;

THEREFORE BE IT RESOLVED that in order to allow for the issuance of the required permits, Council approve the closure of Sparks Street, from Lyon Street to Bay Street from 9:00am on Tuesday, June 21, 2016 to 7:00pm on Sunday, June 26, 2016, providing it meets all terms and conditions contained within the issued permit.
