Meeting called to order by Oakland County Clerk Lisa Brown at 5:30 p.m. in the Courthouse Auditorium, 1200 N. Telegraph Road, Pontiac, Michigan.

Oakland County Clerk - Register of Deeds, Lisa Brown opened the evening with the introduction of the Honorable Judge Nanci J. Grant, Chief Judge of the 6th Circuit Court who gave the invocation.

Oakland County Clerk - Register of Deeds, Lisa Brown introduced the Oakland County Sheriff Honor Guard who posted the colors. The Oakland County Sheriff, Bouchard led the Pledge of Allegiance followed by the singing of our National Anthem by Houle.

Oakland County Clerk – Register of Deeds, Lisa Brown addressed the Board to acknowledge all Elected Officials present.

Moved by Zack supported by Kochenderfer the minutes of the December 8, 2016 Board Meeting be approved.

A sufficient majority having voted in favor, the minutes were approved as printed.

Moved by Kowal supported by Gershenson to approve and close the Journal for 2015 - 2016 Biennial Session and adjourn the 2015 – 2016 Session Sine Die.

Chairperson Michael Gingell as a “point of personal privilege” acknowledged three former Oakland County Commissioners in attendance: Eric, Wilson, Larry Obrecht and Greg Jamian.

Chairperson Michael Gingell addressed the Board to present a proclamation to honor Adele Houle who has garnered special recognition as the first runner-up in the level 8 category of the American Guild of Music’s competition for her outstanding vocal and musical talents at the North American Invitational Championship, and thanked her for performing the National Anthem at the 2017 Oakland County Board of Commissioners’ Inauguration.”

Oakland County Clerk - Register of Deeds, Lisa Brown read a communication from Wilma Cotton, Oakland County Board of Canvassers, commending the Oakland County Elections Division under the 5 Commissioners Minutes Continued. January 11, 2017 direction of Joe Rozell for their outstanding work planning and organizing the Presidential recount which was a hand recount of all ballots cast in over 500 live precincts plus an additional 500 absentee precincts.

Oakland County Clerk - Register of Deeds, Lisa Brown read a communication from Chairperson Michael Gingell reappointing the Energy and Reliability Study Group through June 30, 2017 to complete their responsibilities as charged in MR #16047. Without objection the appointments were confirmed.

MISCELLANEOUS RESOLUTION #17000 BY: Commissioner Michael Spisz, District #3; Commissioner , District #21; and Commissioner Eileen Kowall, District #6 IN RE: BOARD OF COMMISSIONERS - ESTABLISHMENT OF AN OAKLAND COUNTY HUMAN TRAFFICKING TASK FORCE To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS even with the diligent efforts of federal, state and local law enforcement, human trafficking is the fastest growing and second largest criminal industry in the world today, according to the U.S. Department of Health and Human Services; and WHEREAS human trafficking is a crime against humanity that violates the most basic human rights and victims suffer a horrible injustice; and WHEREAS human trafficking victims are children - boys and girls, along with adults - men and women who are recruited, harbored, obtained, or exported through force, fraud or coercion for the purposes of sexual exploitation, forced labor, involuntary servitude, debt bondage and other methods of slavery; and WHEREAS as many as 100,000 to 300,000 American children - boys and girls, as young as 11 years old, are at risk of being trafficked for commercial sex in the United States each year; and WHEREAS the State of Michigan has the 11th largest call volume to the National Human Trafficking Resource Center hotline; and WHEREAS President continues to address the injustice of modern slavery and human trafficking and has proclaimed January 2017 as National Slavery and Human Trafficking Prevention Month, culminating in the annual celebration of National Freedom Day on February 1; and 11 Commissioners Minutes Continued. WHEREAS Michigan Attorney General Bill Schuette has identified human trafficking as a serious concern for law enforcement agencies, coordinating efforts for training, awareness and victim care; and WHEREAS the Human Trafficking Commission Act, Act 325 of 2014, established the Michigan Human Trafficking Commission for the prevention, intervention, and rehabilitation to the illegal act of human trafficking in the State; and WHEREAS on January 14, 2015 a majority of the new legislation from the 2014 Human Trafficking Legislative Package took effect to fight against the horrific crimes of human trafficking; and WHEREAS the Oakland County Board of Commissioners recognized the seriousness of human trafficking and sponsored a successful event in 2014 to provide human trafficking professional training and public awareness in Oakland County. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners continue to recognize the ongoing threat of human trafficking of vulnerable adults and children and the safety of the citizens of Oakland County. BE IT FURTHER RESOLVED that the Oakland Board of Commissioners hereby authorizes the establishment of an Oakland County Human Trafficking Task Force to serve as the leading resource for Oakland County in the prevention, intervention, and rehabilitation related to the cruel and illegal act of human trafficking in all its forms, through education, advocacy and collaboration. BE IT FURTHER RESOLVED that the Oakland County Human Trafficking Task Force (OCHTTF) leadership will be appointed by the Chairman of the Board of Commissioners as follows: (1) Oakland County Commissioner to serve as Chairperson (1) Oakland County Commissioner to serve as Majority Vice Chairperson (1) Oakland County Commissioner to serve as Minority Vice Chairperson BE IT FURTHER RESOLVED that the Chairperson of the Oakland County Human Trafficking Task Force will appoint a representative (member) from each of the following to establish the Core Group: (1) Representative from the Oakland County Sheriff's Office (1) Representative from the Oakland County Health and Human Services Department (1) Representative from the Oakland County Prosecutor's Office (1) Representative from the Oakland County Circuit Court - Family/Youth Assistance (1) Representative from Oakland Schools (1) Representative from the Michigan Department of Health and Human Services (1) Representative from a Victim Services Agency – CARE House BE IT FURTHER RESOLVED that the appointments and length of service to the Oakland County Human Trafficking Task Force will be at the discretion of the Chairperson and will not exceed the term of the County Commission. BE IT FURTHER RESOLVED that other interested individuals, community organizations and non-profits may be invited to offer assistance by the Chairperson and Vice Chairperson of the Oakland County Human Trafficking Task Force. BE IT FURTHER RESOLVED that the Oakland County Human Trafficking Task Force shall be authorized to do the following: (a) Identify sources of funding to combat human trafficking in Oakland County and make recommendations to appropriate agencies to access this funding when relevant. (b) Identify opportunities to provide information and training regarding human trafficking to law enforcement, judicial, social services, health care, educational and other appropriate agencies. (c) Collect and analyze information regarding human trafficking in Oakland County. (d) Improve the coordination of information sharing and the activities of agencies combatting human trafficking in Oakland County. (e) Review existing services and activities to combat human trafficking in Oakland County, make recommendations for improvement and provide informational materials to assist crime victims in accessing these programs. (f) Improve public awareness of the crime of human trafficking and preventative measures. (g) Make recommendations to the Board of Commissioners regarding potential changes in federal, state, county or local policies or laws that would enhance efforts to combat and prevent the crime of human trafficking.

(h) Plan, coordinate and implement community events to expand public awareness, provide education and training, and the prevention of human trafficking. BE IT FURTHER RESOLVED the Board of Commissioners requests the cooperation of all related county agencies in the prevention, intervention, education and public awareness of human trafficking. BE IT FURTHER RESOLVED that the Board of Commissioners authorizes the expenditure of up to $50,000 available in the General Fund Assigned Fund Balance titled Board of Commissioners Projects. MISCELLANEOUS RESOLUTION #17001 BY: Commissioners Michael Spisz, District #3; Janet Jackson, District #21; Bill Dwyer, District #14; Wade Fleming, District #16; Eileen Kowall, District #6; Marcia Gershenson, District #13; Shelley Taub, District #12; Helaine Zack, District #18; David Woodward, District #19; Philip Weipert, District #8; Bob Hoffman, District #2; David Bowman, District #10; Nancy Quarles, District #17; and Gary McGillivray, District #20 IN RE: BOARD OF COMMISSIONERS — DESIGNATION OF JANUARY 2017 AS NATIONAL SLAVERY AND HUMAN TRAFFICKING PREVENTION MONTH IN OAKLAND COUNTY To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS human trafficking is a form of modern-day slavery and is a crime against humanity that violates the most basic human rights; and WHEREAS human trafficking victims are children – boys and girls, along with adults – men and women who are recruited, harbored, obtained, or exported through force, fraud or coercion for the purposes of sexual exploitation, forced labor, involuntary servitude, debt bondage and other methods of slavery; and WHEREAS as many as 100,000 to 300,000 American children – boys and girls, as young as 11 years old, are at risk of being trafficked for commercial sex in the United States each year as part of the $9.8 billion U.S. sex trafficking industry, according to a report from anti-trafficking group Shared Hope International ; and WHEREAS even with the diligent efforts of federal, state and local law enforcement, human trafficking is the fastest growing and second largest criminal industry in the world today, according to the U.S. Department of Health and Human Services; and WHEREAS the State of Michigan has the 11th largest call volume to the National Human Trafficking Resource Center hotline; and WHEREAS President Barack Obama continues to address the injustice of modern slavery and human trafficking and has proclaimed January 2017 as National Slavery and Human Trafficking Prevention Month, culminating in the annual celebration of National Freedom Day on February 1; and WHEREAS Michigan Attorney General Bill Schuette has identified human trafficking as a serious concern for law enforcement agencies, coordinating efforts for training, awareness and victim care; and

WHEREAS the Human Trafficking Commission Act, Act 325 of 2014, established the Michigan Human Trafficking Commission for the prevention, intervention, and rehabilitation to the illegal act of human trafficking in the State; and WHEREAS on January 14, 2015 a majority of the new legislation from the 2014 Human Trafficking Legislative Package took effect to fight against the horrific crimes of human trafficking; and WHEREAS the Oakland County Board of Commissioners sponsored a successful event in 2014 to provide human trafficking professional training and public awareness and in 2015 created the Oakland County Human Trafficking Task Force; and WHEREAS Oakland County continues to enhance public awareness to educate people about the signs and consequences of human trafficking and to bring an end to the injustice suffered by the victims of this crime; and WHEREAS all people must work to dismantle trafficking networks, help survivors rebuild their lives, address the underlying forces that push so many into bondage, develop economies that create legitimate jobs, and build a global sense of justice that says no child or adult should ever be exploited. NOW THEREFORE BE IT RESOLVED the Board of Commissioners recognize the month of January 2017 as "Human Trafficking Awareness Month" in order to bring awareness and prevention to the crime of human trafficking in Oakland County and every day strive to restore to all people the most basic rights of freedom, dignity and justice. Berman, District #5; Commissioner Eileen Kowall, District #6; Commissioner David Woodward, District #19 IN RE: BOARD OF COMMISSIONERS – NOTICE OF CANCELLATION OF CONTRACTUAL AGREEMENT WITH THE AREA AGENCY ON AGING 1-B To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS the Area Agency on Aging 1-B (AAA 1-B) was established in 1974 in response to the 1973 amendments to the Older Americans Act (OAA), which called for the creation of regional planning and allocation agencies to bring structure to the delivery of social and nutritional services to older adults; and WHEREAS the AAA 1-B works in partnership with the Aging and Adult Services Agency of Michigan formed under the Older Michiganians Act of 1981; and WHEREAS the AAA 1-B is a non-profit organization that is responsible for services to Michigan residents age 60 and older residing in Livingston, Macomb, Monroe, Oakland, St. Clair, and Washtenaw counties; and WHEREAS the AAA 1-B has provided supportive services for Oakland County seniors since 1974; and WHEREAS the Oakland County Board of Commissioners (BOC) has appropriated annual funds to support the AAA 1-B since inception in 1974; and WHEREAS Oakland County has provided more than $2 million in funding to AAA 1-B in the last ten years; and WHEREAS the terms and conditions of Oakland County’s financial support of AAA 1-B are contained in a contractual agreement that expires on September 30, 2017, unless otherwise cancelled under the terms of the contract; and WHEREAS a County Commissioner representing each of the six member counties is appointed by their respective County Board of Commissioners as a member of the Governing Board of AAA 1-B; and WHEREAS the Governing Board of AAA1-B, through their outside counsel, have notified County Commissioner appointees that they will be excluded from AAA 1-B meetings and leadership decisions until they are appointed by their Board of Commissioners for the current term of office; and WHEREAS under Michigan law, County Commissioners commence their term of office on January 1st and the first available meeting of the County Board of Commissioners to appoint a representative to AAA 1-B is often more than a week later; and WHEREAS ignoring the objections of County Commissioner appointees, the Governing Board of AAA 1-B proceeded with business critical to the leadership and management of AAA 1-B at the commencement of the new term of office, scheduling a closed session on January 3, 2017; and WHEREAS due to the timing of this special meeting, 6 members (more than 30%) of the 19 member Governing Board were excluded from participating in this important meeting; and WHEREAS the actions of the Governing Board during this period of time coincide with the resignation of the longtime Chief Executive Officer of AAA 1-B; and WHEREAS the actions of the Governing Board demonstrate a lack of respect for the elected officials of member Counties and a lack of appreciation for the long term financial support provided by member County governments; and NOW THEREFORE BE IT RESOLVED the Oakland County Board of Commissioners directs that written notice be provided to the administration of the Area Agency on Aging 1-B of the intent of Oakland County to exercise their right to cancel the contractual agreement between the County and AAA 1-B upon 90 days’ notice. BE IT FURTHER RESOLVED the Oakland County Board of Commissioners reserves the right to withdraw this cancelation upon receiving a full and complete report from the leadership of AAA 1-B regarding their strategic plan and actions taken to amend the policies, procedures and by-laws of AAA 1- B to ensure that the elected representatives of the member Counties shall not be excluded from the business of the Governing Board in the future.
