1 Match-Fixing in London Olympic Year Scandals
MATCH-FIXING IN LONDON OLYMPIC YEAR SCANDALS, LESSONS & POLICY DEVELOPMENTS Kevin Carpenter Solicitor, Hill Dickinson LLP, Consultant and Editorial Board Member, LawInSport 2012 was predicted to be the year when match-fixing, particularly that related to sports betting, became the principal issue of sporting integrity worldwide with London hosting the Olympic Games. As it transpired there was only one such scandal at the 2012 Games and it was not related to betting. Yet the Olympics did provide the actors in the fight against match-fixing with many invaluable lessons. Developments in the field of match-fixing during 2012 came instead from outside of the Olympics with the progression and revelation of numerous instances of match-fixing and the advancement of new public and private policies to detect, deter and educate. This paper will examine issues ranging from the increasing use of polygraph (lie-detector) tests and the role of national and international bodies, to the sports that have been knee-deep in the match-fixing mire during 2012 and whether the current approach to sanctioning is proportionate. Sports affected during 2012 Football As ever, being the most popular sport worldwide, football accounted for a large proportion of match-fixing activity in 2012. Changes at the top of football’s world governing body FIFA, with Ralph Mutschke taking over from Chris Eaton as Director of Security, allowed Eaton to reveal some uncomfortable allegations upon taking over as Director of Sport Integrity at the newly formed International Centre for Sport Security (‘ICSS’) based in Doha (to which I will return later). The principal of which was a claim that the 2010 World Cup match between Nigeria v Greece was under investigation for match-fixing.1 Nigeria having previous being part of an alleged fixed friendly match with Argentina back in June 2011. -

Entertainment and Sports Law Journal, 15: 2, pp. 1–9, DOI: https://doi.org/10.16997/eslj.204 ARTICLE Sports Corruption: Sporting Autonomy, Lex Sportiva and the Rule of Law Tom Serby Anglia Ruskin University, GB [email protected] An apparent escalation in on-field corruption (doping and match-fixing) in professional sports has led to increasing numbers of athletes facing bans and a loss of livelihood as a consequence of decisions taken by sporting tribunals, as part of a regulatory system referred to as lex sportiva. This has led to challenges in domestic courts from athletes over the lawfulness and fairness of these proceedings (for example Pechstein and Kaneria). These challenges to the legitimacy of lex sportiva (and to the principle of the autonomy of sport) echo Foster’s (2003) critique of lex sportiva/global sports law as: a cloak for continued self-regulation by international sports federations…a claim for non-intervention by both national legal systems and by international sports law… [which] opposes a rule of law in regulating international sport. The paper considers what is the ‘rule of law’ that regulates on-field corruption, and concludes that it is a complex web of law, since sports governing bodies now share with the state many aspects of the sanctioning of on-field corruption. The paper considers how the doctrine of ‘the autonomy of sport’ has informed the development of lex sportiva in regard to athlete corruption, and the competing claims of private sports law and national legal systems over the regulation of athlete corruption. -

December 2018 Bottisham & District Branch of The Royal British Legion REMEMBRANCE SUNDAY This year saw the centenary of the signing of the Armistice which ended World War 1 and was commemorated by some special services across the country and indeed the world. We in Bottisham and the surrounding villages held our own special day with a parade and service at Swaffham Bulbeck Parish Church. It was held there for a number of reasons, but the main one was to showcase the wonderful display of thousands of crocheted poppies, made by local volunteers. Cascading down from the top of the tower and floodlit at night, it made a wonderful statement. The Bottisham Branch would like to thank everyone who attended, particularly all those who took part in the parade. The Cadets of the Burwell detachment of the Cambridgeshire Army Cadet Force, The Scouts, The Guides, The Cubs and Brownies. Great to see so many young people there. Also thanks to the Deputy Lieutenant of Cambridgeshire, representing the Queen, Mrs. Penny Walkinshaw. The Branch would like to apologise for the lack of House to House collections this year for the poppy appeal. This was due to being let down by Haig House in the supply of the required ID cards to allow the collectors to call. Normal service should be resumed next year. CHAPTER 5 Case Studies In this chapter, case studies are presented to analyze the economic contribution in terms of content exportation and ripple effects. Examples of cross-border success cases from certain countries are presented on the basis of the availability of statistics and related information. 1. Exportation of Contents Exporting content and creative products/services can contribute to the economy in terms of domestic industry development and its sustainability. Export of contents is defined as selling products in each sector, such as TV broadcast programs, films, animation, games and music overseas. This includes revenues when TV programs are traded, or games and CDs/DVDs are shipped to other countries. There are various ways of exporting contents. However, this report does not focus on its definition in details, but rather overviews the current export trend of content products originating in the Asian region. According to UNCTAD report (2010), during 2002-2008, trade in goods and services from the creative industries grew on CAGR of 14%. World exports of audiovisual content services, which amounted to 13.7 billion USD in 2002, reached 26.4 billion USD in 2008, much through trade in the form of rights transactions as the means for buying and selling creative content. -

BEFORE AN APPEAL PANELOF THE CRICKET DISCIPLINARY COMMISSION OF THE ENGLAND AND WALES CRICKET BOARD. 1. Determination An Appeal Panel of the Cricket Discipline Commission (CDC) (Edward Slinger, (Chairman), Ricky Needham, Cliff Pocock, Tim O’Gorman and Mike Smith) sat on 10 December 2012 and between 22 April and 26 April 2013 in the Hearing Rooms of The International Dispute Resolution Centre, London, to consider an Appeal by Danish Kaneria against findings, dated 22 June 2012, of a Disciplinary Panel of the England & Wales Cricket Board (ECB) following hearings occupying 18 – 22 June 2012. Mr Ian Mill QC & Mr Nick De Marco represented ECB Mr Tim Moloney QC & Mr Jude Bunting represented Danish Kaneria. 2. Introduction These proceedings arise from charges brought in relation to events which occurred towards the end of the 2009 English domestic cricket season culminating in a Pro 40 Competition match played at Durham between Essex and Durham on 5 September 2009. The charges alleged: Danish Kaneria i. A breach of 2009 ECB Directive 3.8.5 in that Danish Kaneria induced or encouraged, or attempted to induce or encourage, Mervyn Westfield not to perform on his merits, that is, deliberately to concede a minimum number of runs in his first over of the match between Essex and Durham. ii. A breach of 2009 ECB Directive 3.3 in that Danish Kaneria conducted himself in such a manner as might bring the game of cricket or any cricketer into disrepute by inducing or encouraging Mervyn Westfield not to perform on his merits. Mr Kaneria contested the two charges brought against him. -
