MINUTES of a meeting of the PLANNING COMMITTEE held on Monday 4th January 2021 at 7.30 p.m. using Zoom video conferencing.

P70/20. APOLOGIES FOR ABSENCE Apologies were received from Cllr Stubbings and it was RESOLVED to accept this apology.

P71/20. MINUTES The minutes of the meeting held on 7th December 2020 were CONFIRMED as a correct record and SIGNED.

P72/20. DECLARATION OF INTERESTS Members were reminded of their responsibilities to declare any disclosable pecuniary interest that they may have in any item of business on the agenda and would be moved to the virtual waiting room if they did. Cllr Williams declared that as he is a member of EHDC Planning Committee and may be involved in the consideration of a planning application should it come before the District Council, he could participate in the discussion of all items on the agenda but would not vote and reserved his position until such time that he heard the full debate at the District Council. Cllr Luff declared a non-statutory personal interest in item P75/20 (j) as the applicant is a customer of his.

PLANNING AND TREE APPLICATION DECISIONS The following decisions were noted at the meeting: a) 28259/003: Glendale, Road, , , GU35 8JQ Proposal: Single storey extension to rear and oak canopy to open porch Decision: REFUSAL b) 58939 PARISH: Badgers, Furze Vale Road, Headley Down, Bordon, GU35 8EP Proposal: Larch in the rear garden and adjacent to the western boundary - Prune branches overhanging neighbouring property roof and chimney, leaving a distance of 3 metres from the neighbouring house and 5 metres from the chimney (see photographs). P75/20. PLANNING APPLICATIONS It was RESOLVED that the following comments on the planning applications received from the Head of Planning and Development Services, EHDC, be passed to EHDC: a) 34153/014 – Mr Roe – Oak framed extension over existing low-level wall and associated canopy over existing hard standing area following removal of conservatory to rear of property, Kentmere, 44 Furze Hill Road, Headley – NO OBJECTION but would wish to see an improvement in the design of the roof pitch of the extension to alleviate the strange looking half hip in front of the upstairs window. b) 58997 – Mr R Hall (on behalf of Headley Tennis Club) – To replace the existing nine 7m floodlighting poles with metal halide lighting with nine 8m poles with LED lighting. This will improve the tennis court floodlighting with less peripheral light pollution, Tennis Pavilion, Mill Lane, Headley – NO OBJECTION to the proposal provided that the peripheral light spill is reduced as indicated, and subject to the following corrections to the application form and location plan submitted to East Hants District Council: i) The Tennis Club should be the applicant. ii) It should be indicated on the application form that there is a hedge adjacent to the application site. iii) Headley Parish Council should be indicated as the owner of the site. iv) The site location plan has a blue line indicating the application site with red indicating further interest/ownership. This should be the other way round. The Diocese land should not be included in this plan. c) 57839/003/LBC – Mr A Greensmith – Installation of a new window in the existing first floor bathroom, Anbury, New Inn Fields, Sleaford – NO OBJECTION d) 20583/032 – Benchmark Resources Ltd – Redevelopment of the site to provide a new 73 bed hotel and leisure facilities, erection of 14 holiday lodges and a holiday cottage surrounding the lake, together with car parking and associated works, Headley Park Hotel, Picketts Hill, Headley – NO OBJECTION provided there is sufficient car parking for guests of the hotel, chalet tenants and possible hirers of the function room; that stays at the chalets are no longer than 3 weeks; that external noise is monitored and not excessive; and provided the environmental conditions are adhered to. e) 33633/003 – Mr J Leaton – Single storey rear extension to replace existing conservatory, rear decking, cladding to front and rear elevations plus partial garage conversion and car port, Sedgewood, 69 Furze Hill Road, Headley – NO OBJECTION provided the colour of the Cedral cladding is agreed with the District Council first. f) 22382/010 – Mr K Tomkin – Single storey extensions to side and front (renewal of 22382/009), The Annexe, Vale End, Whitmore Vale, Grayshott – NO OBJECTION g) 56449/001 – Mrs Bett – Lawful development certificate for an existing use – of the site (being land extending to 9.64 acres with building sited thereon) for commercial equine purposes, The Old Barn, Frensham Lane, – We are unable to comment as this is a question of legal evidence. We would like to highlight, though, that this plot of land has been subject to many previous refusals of permission that the Parish Council has brought to the District Council’s attention on many occasions in applications numbered 20148 and 56449. h) 26899/001 – Prior Notification – Mr White – Enlargement of a dwelling house by construction of additional storey(s) incorporating a maximum height of 7.8 metres, Cheriton, 133 Seymour Road, Headley Down – We OBJECT to this tall, additional storey as it is out of keeping with the surrounding properties which are proportionately chalet style bungalows, and so we feel that this application is contrary to saved Policy H10 (a). i) 36773/013 – Ms K Hill – Single storey front/side extension to garage, Oakridge, Arford Common, Headley – NO OBJECTION subject to the protection of trees during construction. j) 57041/005 – Outline Planning Permission – Mr A Haynes – with all matters reserved – single storey dwelling, Whitehall Nursery, Red Lane, Churt Road, Headley – We continue to OBJECT to the proposal for a new dwelling on this site and repeat our previous comments submitted on application 57041/003. We support the District Council’s reasons for refusal of that application and the Inspector’s reasons for dismissing the subsequent appeal. If the District Council is mindful to give permission, then any such property should be in place of the existing two properties (as indicated in the Design Statement) and a condition put in place to ensure this. An agricultural/horticultual occupancy tie should be placed on the proposed dwelling, if permitted. k) EH121 – Variation of condition 12 of Planning Permission 30633/038 to improve the noise bund in both length and height at Grundon Sand and Gravel Ltd, Frith End Sand Quarry, Grooms Farm Lane, Frith End – NO OBJECTION

P76/20. APPLICATIONS TO LOP/FELL TREES It was RESOLVED that the following comments on the tree applications received from the Head of Planning and Development Services, EHDC, be passed to EHDC: a) 30937/014 – Mrs J Record – Prune one beech tree, Arford Lodge, Bowcott Hill, Headley – We would be reluctant for work to be carried out on this tree and refer the matter back to the Arboricultural Office as no access could be gained to the site. b) 53515/002 – Mr Rutter – Prune one beech tree, Sunflowers, 70 Furze Hill Road, Headley – No access could be gained to the rear of the garden and we refer the matter back to the Arboricultural Officer. c) 27495/005 – Mrs Richmond – Fell one silver birch and prune one oak, Julfa, Honeysuckle Lane, Headley Down - No access could be gained to the rear of the garden and we refer the matter back to the Arboricultural Officer. d) 59033 – Mr Quick – Prune sycamore trees and fell one sycamore, rear of 2 Stonehill Park, Stonehill Road, Headley Down - No access could be gained to the rear of the garden and we refer the matter back to the Arboricultural Officer.

P77/20. APPEALS Appeal Ref APP/M1710/W/20/3249462 – Application 56449 – Moonlight Ridge Stables Ltd – New permanent essential rural worker’s dwelling following removal of mobile home (additional information received 27/8/19), The Old Barn, Frensham Lane, Churt. An appeal has been made against the District Council’s refusal and this will be determined on the basis of a Hearing. It was AGREED to forward the following comment to the Inspector:

“This site, one of many sold off from the main estate covered by an Article 4 Direction, is sandwiched between two established equine businesses. It was given permission for personal equine use some years ago and has been the subject of many applications and subsequent refusals over the years. The owners have deliberately and knowingly breached the conditions, finally applying in December 2020 for a Lawful Development Certificate for an equine business.

Irrespective of the success or otherwise of the Lawful Development Certificate to operate an equine business, and considering the history of refusals on the site, there remains no justification for the owners to be able to convert an unlawful mobile home into a residential dwelling for all the reasons previously documented. We trust that the Inspector will review the detailed objections to Application 56449 by the Parish Council, and the EHDC Officer's Report, both of which detail the planning history of this site, and the many policy reasons for refusing permission for the so called "rural worker's dwelling". Furthermore, we have concerns over the potential to separate the dwelling from the equine business in the future. The red line site area on the appeal drawing clearly excludes the stables and storage barn from the application under appeal.

Therefore, the Parish Council fully supports the Planning Department of EHDC in their reasons for refusal and requests that enforcement action be taken to remove the unlawful mobile home. However, should the Inspector decide to allow the Appeal then strict conditions should be in place to prevent the separation of the equine business (and all the land associated with it) from the residential dwelling.”
