NOW, THEREFORE, THE STATE HIGHWAY COMMISSION hereby declares and fixes the reasonable and safe prima facie maximum speed limits on the sections of highways described herein to be as tabulated under the heading, "Zone Speed," and it is ordered that the State Highway Engineer be authorized to proceed with the erection of appropriate signs showing the maximum speed limits as tabulated under the heading, "Zone Speed." Upon completion of each construction project all such signs applying to that project shall be removed. The completion and/or acceptance of each project shall cancel the provision of this Minute applying to said project.

WHEREAS, the State Highway Commission of the State of Texas has found in order to promote the Public Safety, to facilitate the Safety and movement of traffic, to preserve the financial investment of the public in its highways and to promote the National Defense, public necessity re­ quires the laying out, opening, constructing, reconstructing, maintaining, and operating of Controlled Access Highways in the State of Texas as a part of the State Highway System at such locations as are necessary to complete the National System of Interstate and Defense Highways through­ out the State of Texas; and,

WHEREAS, the State Highway Commission has found and deter­ mined that each of the following listed parcels of land, same being more particularly described in the exhibits attached hereto, and such additional lesser estates or property interests described thereon, are necessary and suitable for use for such purposes and it is necessary to acgulre fee simple) title to said land, as provided by law, as a part of the State Highway Sys­ tem to be so constructed, reconstructed, maintained, and operated thereon and in the exercise of the police power of the State for the preservation of human life and safety, and under existing laws, the highway to be con­ structed on each such parcel of land is designated as a Controlled Access Highway; and,

55012 Con inued — It is understood that the responsibility of the Texas Highway Department is confined to the pavement and its support, and all other features necessary now or in the future to provide an adeguate travel facility shall be the responsibility of the City of Hereford.

Upon acceptance of the provisions of this Order by the appropriate officials of the City of Hereford, the State Highway Engineer is directed to proceed with the development of plans and when the City has fulfilled its obligations under this Order and when plans are complete, the State High­ way Engineer shall submit the work for finance consideration of the High­ way Commission in the next available program.

It is understood that the City may discharge its construction obligations as outlined herein in any manner as they may elect. WHEREAS, in SCURRY COUNTY, U. S. HIGHWAY 84 has been completed on new location at the City of Snyder; and

WHEREAS, it would be of benefit to the traveling public to retain the old location of U. S. Highway 84 on the State Highway System; NOW, THEREFORE, IT IS ORDERED that the old location of U. S. Highway 84, from the new location of U. S. Highway 84 southeast of the City of Snyder to the new location of U. S. Highway 84 northwest of the City of Snyder, be retained on the State Highway System as a Toop, and be marked as a Business Route for U. S. Highway 84.

It is understood that, within the City of Snyder, this Toop will be eligible for normal maintenance as a State maintained Loop in accordanc with policies of the Department, but the State does not obligate itself hereby to participate in its reconstruction or major improvement.

WHEREAS, in WILLIAMSON COUNTY all highways serving the City of Taylor passing through the downtown business district and in­ creased traffic volumes have created a very unsatisfactory traffic situation on both local and through traffic; and,

WHEREAS, this situation was recognized as early as 1956 at which time a study was authorized by Commission Minute No. 39717, but the plan developed by the Highway Department was not acceptable to the local governments at that time.

NOW, THEREFORE, IT IS ORDERED that the State Highway Enginea||r review the previous plan and make such engineering and traffic studies as required to establish an adeguate plan for the future arrangement and development of all State Highway routes in and through the City of Taylor, which plan will provide for the ultimate highway needs in this area.

IT IS FURTHER ORDERED that upon completion of the plan it be submitted to the City of Taylor and Williamson County and if acceptable the plan will be the basis for making location surveys, determining right of way requirements and holding public hearings for the various increments of the work as authorized by the State Highway Engineer.

55031 WHEREAS, the Texas Highway Department entered into a contract Claims with Gulf Bitulithic Company and Texas Bitulithic Company for the con­ struction of 1.335 miles of INTERSTATE HIGHWAY 610 in HARRIS COUNTY based on their low bid of $3,113, 090.93, Project 1-610-7(80)014;

WHEREAS, after satisfactory completion of the contract the contractors filed a claim with the Department in the amount of $220,760.40 consisting of four items as follows: (1) Alleged work re­ quired to be done but for which no payment was allowed $17,614.57; (2) Alleged additional quantities of Common Road Excavation for which no I payment was allowed $20,776.60; (3) Price increase on Common Road Ex­ cavation in excess of 540, 000 cubic yards $144,369.23; (4) Tiquidated damages withheld $30,000.00 (100 days at $300.00 per day); and WHEREAS, after extended study of this claim by the Claims Committee and after detailed explanations by the Department engineers in charge of the work and after conference between the contractors and the Claims Committee, no justification could be found for the payment of items (1) (2) (3) of the claim, and it is recommended by the Claims Committee and concurred in by the applicable engineers in charge of the work that they be denied; and

WHEREAS, realizing the complex nature of the work performed, adverse weather conditions, overrun in certain items of work, and other factors, it is the recommendation of the Claims Committee that payment of item (4), liguidated damages withheld in the amount of $30,000.00, be conditionally approved;

NOW, THEREFORE, IT IS ORDERED by the State Highway Com­ mission that items (1) (2) (3) of the claim as stated above be denied and that a 100 day extension in time and payment of item (4), liguidated damages withheld in the amount of $30, 000.00, is hereby approved only upon the condition that its acceptance by the contractors shall relieve the Department from any further claims by the contractors for the construction I of said project or for any items of whatever nature related thereto.
