Main results of the Council

The Council adopted a joint action on the EU Police Mission in Afghanistan - EUPOL Afghanistan.

The Council unanimously accepted all the amendments voted by the European Parliament plenary on 25 April 2007 concerning a draft Regulation on advanced therapy medicinal products.

The Council adopted a Regulation on type approval of motor vehicles with respect to emissions (Euro 5 and 6).

The Council reached general approaches on three draft Regulations concerning the coordination of the social security systems:

- part of the draft implementing Regulation;

- part of the draft Regulation on the content of Annex XI of Regulation (EC) No 883/2004;

- annual updating of Regulation (EEC) No 1408/71, still in force.

Active ageing

TheCouncilendorsedajointEmploymentCommittee(EMCO)andSocialProtectionCommittee (SPC)opiniononactiveageing (9269/07) ,encouragingolderpeopletoremainactiveinlaterlife.

TheEUstartedtotacklethechallengescausedbytheageingoftheworkforceinthemid1990s. ThesubjecthasalreadybeendealtwithatEuropeanCouncillevel(2001StockholmEuropean Council;2002BarcelonaEuropeanCouncil;2006SpringEuropeanCouncil).

Takenasawhole,theEUismovingintherightdirection:peoplearestayingactivelongerthanin recentpastdecades.However,mostMemberStateshavetostepuptheirefforts.

TheEUhastakenanumberofconcretesteps,suchastheadoptionofDirective2000/78/ECon equaltreatmentinemploymentandoccupation,whichbansdiscriminationonthegroundsofage. Furthermore,anewstrategyonhealthandsafetyatworkisbeingdeveloped.

Increasingtheaverageexitagefromthelabourmarketwillbecrucialforensuringtheadequacyand sustainabilityofpensionandhealthcaresystems.

Thekeyelementsofthejointopinioncanbesummarisedasfollows:

– barrierstotheemployabilityofolderworkerscanbeovercomebyincreasingtraining,providing moreflexibleworkschedulesthatareadaptabletoworkers'needsandbetterworkingconditions;

– specialattentionshouldbepaidtounemployedolderpeopleastheyfaceparticulardifficultiesin reenteringthelabourmarket.MemberStateshavereportedonsomepromisingcomprehensive approachestothisproblem.Inparticular,activationstrategiesthatestablishtherightsandduties ofolderunemployedpeopleandconsiderboththesupplyandthedemandsideappeartobe successful;

– thequalificationsandskillsrequiredforgainfulworkhavetobeenhancedovertheentirelife cycle.Inparticular,employersshouldtakemoreinitiativestotrainandmotivatetheirworkers. Moreover,olderworkersshouldbeencouragedmorethaneverbeforetoparticipateinfurther educationandtraining;

– inallMemberStates,participationratesareloweronaverageforolderwomenthanforolder men.Reducingthegendergapinparticipationrateswillbeanimportantpartofanystrategyto mobilisemorefullythelaboursupplyofolderpeople;

– pensionreformshavebeenwidespreadintheMemberStates;itremainsimportanttofindthe rightbalancebetweenencouraginglaterretirement,closingpathwaystoearlyretirementand increasingflexibilityinwork/retirementchoicesandensuringthatotherwelfarebenefitsarenot usedaspathstoearlyexitfromthelabourmarket;

– alifecycleperspectiveisessential.Activeageingmustnotstartwitholderpeoplebutmuch earlierthanthis.Thereisabroadlinkagebetweendifferentpolicieswhichincludeeducationand training,health,familypolicyandcultureetc;

– thegoodpracticesmakeaclearcaseforcomprehensiveactionindifferentpolicydirections, namelychangingemploymentpracticestofacilitateretentionandhiringofolderworkers; promotingemployabilityaswellasincreasingthe“workability”ofallworkersthroughthelife cyclebyprovidingincentivesforemployerstohireormaintainolderworkers;

– thesocialpartnershaveakeyroleinaddressingandpromotingactiveageing,inparticularinthe fieldsoflifelonglearningandtheimprovementofworkingconditions;

– monitoringandevaluatingmeasuresareimportantforpolicyimplementation;

– thereisaneedformoreexchangeofgoodpracticeonactiveageing.

Community strategy 2007-2012 on health and safety at work - Council resolution

TheCouncilheldapolicydebatecovering,inparticular,thefollowingissues:

1. Concrete initiatives and measures to be taken by the Member States in order to improve health and safety at work and ensure a high level of protection;

2. Measures to be taken at European level to make "good work" an EU "trademark".

WelcomingtheCommission'sCommunicationoutlininganewCommunitystrategyforhealth safetyatworkfor20072012,whichincludestheambitiousgoalofreducingoccupationalaccidents intheEUby25%by2012,delegationsheldageneralpolicydebateonthistopicundertheheading of"GoodWork".

Affirmingthesocialandeconomicbenefitsofimprovinghealthandsafetyatwork,delegations highlightedtheimportanceofanumberofissues,including

– actioninkeyareassuchasSMEs,highrisksectorsandvulnerableworkers;

– education,trainingandawarenessraising;and

– researchandtheexchangeofinformation.

Delegationsalsounderlinedtheimportanceofsimplifyinglegislation,ensuringitsproper implementationandtheinvolvementofallactors,includingthesocialpartners.

Social security

– Implementing Regulation

PendingtheEuropeanParliament'sopinionatfirstreading,theCouncilreacheda partial general approachonadraftRegulationaimedatimplementingRegulation(EC)No883/20041onthe coordinationofsocialsecuritysystems.TheagreedtextcoversChapterIofTitleIII(sickness, maternityandequivalentpaternitybenefits)andChapterIofTitleIV(financialprovisions)ofthe Commissionproposal (9747/07 and 9752/07) .

Regulation(EC)No883/2004wasthefirststepofaprocessaimedatmodernisingandsimplifying EUrulesonthecoordinationofthenationalsocialsecuritysystems.Suchrulesareintendedto allowEUcitizenstomovefreelywithinEurope,whilemaintainingtheirsocialrightsand expectations(health,pensions,unemploymentprotection,etc.).

TheprocessmustbecompletedwiththeadoptionofanimplementingRegulation 2,forwhicha proposalisnowunderexamination.TheRegulationwillreplaceRegulation(EEC)No574/72 3, withprovisionsdesignedtostrengthencooperationbetweennationalinstitutionsandimprovethe methodsofdataexchange.

InaccordancewiththeapproachalreadytakenfortheadoptionofRegulation(EC)No883/2004,it hasbeendecidedtoaimfortheCouncil'sagreementonachapterbychapterbasis.On1June2006, theCouncilreachedapartialgeneralapproachonTitlesIandIIoftheproposal.On1December 2006,theCouncilreachedapartialgeneralapproachonChapter4ofTitleIII.Theexaminationof theCommissionproposalwillcontinueundertheforthcomingPortuguesePresidency.

ThedraftRegulationaimstoupdateandamendthereferencesincertainAnnexestoRegulation (EEC)No1408/71,totakeaccountofrecentchangesinnationallegislation.

Similarexerciseshavebeenundertakenatmoreorlessannualintervals.Thisupdateisintendedto bethelastoneforRegulation(EEC)No1408/71.

Supplementary pension rights

PendingthefirstreadingopinionoftheEuropeanParliament,theCouncilendeavouredtoreach agreementonageneralapproachonadraftDirectiveconcerningsupplementarypensionrights (9761/1/07 , 9763/07 ).

However,giventheimpossibilityofreachingacompromisethatwouldsatisfyallthedelegations, thePresidenthadtoconclude,withregret,that,atthisstage,theCouncilwasnotyetinapositionto agreeonatext,astherequiredunanimitywasnotachieved.

AssoonastheEuropeanParliamenthasadopteditsopinionatfirstreading,thepossibilityof resumingworkonthebasisofanamendedproposalfromtheCommissionwillbeexplored.

Supplementarypensionschemes,establishedinthecontextofanemploymentrelationship,are importantforcoveringtheriskofoldageintheMemberStates.

ThedraftDirectiveaimstofacilitatefreemovementofworkersthroughprovisions

• guaranteeinganadequateprotectionofdormantrightsofoutgoingworkers;

• ensuringthatworkersreceiveappropriateinformationintheeventofprofessionalmobility.

Alliance for Families - Council conclusions

TheCouncilheldanexchangeofviewsontheestablishmentofanAllianceforFamilies,covering, inparticular,thefollowingtopics:

1. Family-related areas regarding which Member States will contribute to the exchange of views and information within the Alliance for Families;

2. Knowledge, experience and facts that the Member States will need at their disposal to frame national policies to support families; role of existing or new instruments (such as the High-Level Group on Demography) and forms of cooperation (e.g. joint research activities, peer review activities, involvement of the social partners and of civil society) to that end.

AlargemajorityofthedelegationswarmlywelcomedtheinitiativeofthePresidencyestablishing anAllianceforFamilies.

Accordingtothe2007SpringEuropeanCouncilconclusions,theEuropeanAllianceforFamilies constitutesaplatformfortheexchangeofviewsandknowledgeonfamilyfriendlypoliciesand goodpracticeatEuropeanlevel.

Itaimstoaddress,withinthecontextofdemographicchange,issuesrelatedtofamilyfriendly policies,tosearchforforwardlookingpoliticalresponsesandtomakeknowledgeandexperience availableforallactors,soastoreinforcesharedefforts.

Followingthedebate,theCouncilandtheRepresentativesoftheGovernmentsoftheMember States,meetingwithintheCouncil,adoptedconclusionsontheimportanceoffamilyfriendly policiesinEuropeandtheestablishmentofanAllianceforFamilies (9317/1/07) .

Social services of general interest

TheCounciltooknoteofanoralprogressreportbythechairoftheSocialProtectionCommittee,as partoftheopenconsultationmentionedintheCommissioncommunication: Implementing the Community Lisbon programme: social services of general interest in the EU ( 9038/06 ).

Theaimofthecommunicationwastoidentifythespecificcharacteristicsofsocialservicesof generalinterestandtoclarifyhowEUstateaid,internalmarketandpublicprocurementrulesapply totheseservices.Itistoberecalledthatcertainsocialservicesareexcludedfromthescopeofthe "services " Directive.

Thecommunicationpresentedanopenlistofcharacteristicsreflectingthespecificnatureofsocial servicesofgeneralinterest.Inadditiontothetraditionalcriteria(universality,transparency, continuity,accessibility,etc),thesecharacteristicsrefertotheorganisationalconditionsand modalitiesapplyingtothoseservices.

ThecommunicationconstitutedastartingpointforaconsultationbytheCommissionofMember States,serviceprovidersandusersofservices.

ItisenvisagedthattheCommissionwillseektoidentifythebestapproachtotakewithregardtothe increasinginteractionofthemodernisationoftheSocialServiceswiththeapplicationof Communitylaw,includinggivingconsiderationtotheneedfor,andlegalpossibilityof,alegal proposal.

Food improvement agents package

PendingtheEuropeanParliamentfirstreadingopinion,theCouncilreachedgeneralapproacheson threedraftRegulationsconcerning:

– commonauthorisationprocedure( 9536/07 ADD 1 );

– foodadditives( 9536/07 ADD 2 );

– foodenzymes( 9536/07 ADD 3 ).

IttooknoteofaprogressreportregardingadraftRegulationon:

– flavourings( 9536/07 ADD 4 ).

Thefreemovementofsafeandwholesomefoodisanessentialaspectoftheinternalmarket.It contributessignificantlytothehealthandwellbeingofcitizens.Toensureahighlevelof protectionofhumanlifeandhealth,thesafetyofadditives,enzymesandflavouringforuseinfood stuffsforhumanconsumptionmustbeassessedbeforetheyareplacedontheCommunitymarket, inthelightofharmonisedrules.

ThepackageoffourdraftRegulationsisdesignedtooverhaultheCommunity'srulesonfood improvementagents.

Theproposalsaimatreviewingthecurrentlegislationonfoodadditivesandflavouringsandat introducingasimplifiedcommonCommunityapprovalprocedureforfoodadditives,flavouringsto betterreflecttechnologicalandscientificdevelopmentsandenzymes,whichwouldbe basedona scientificevaluationbytheEuropeanFoodSafetyAuthority(EFSA).Underthenewproposed system,harmonisedCommunityruleswouldbelaiddownforthefirsttimefortheevaluation, approvalandcontrolofenzymesusedinfood.

LegalbasisproposedforthefourRegulations:Article95oftheTreaty–qualifiedmajorityrequired foraCouncilDecision;coDecisionprocedurewiththeEuropeanParliamentapplicable.

Advanced therapy medicinal products

TheCouncilunanimouslyacceptedalltheamendmentsvotedbytheEuropeanParliamentplenary on25April2007concerningadraftRegulationonadvancedtherapymedicinalproducts (9756/07) .

Thus,anagreementatfirstreadingwasreachedwiththeEuropeanParliament.Thetextnowagreed willbeformallyadoptedassoonasithasbeenlegallyandlinguisticallyfinalisedinalltheofficial languages.

ThemainobjectiveofthisdraftRegulationistocreateasinglelegalframeworkforthreekindsof advancedtherapies(genetherapy,somaticcelltherapyandtissueengineering)wherescientificand technicaldevelopment,duetoscientificprogressincellularandmolecularbiotechnology,hasbeen veryfast.

Inordertosafeguardpublichealth,thedraftRegulationlaysdownspecificproceduresfor authorisationofadvancedtherapyandmedicinalproductsaswellasforpharmacovigilanceand postmarketingsurveillance.TheseproductswereauthorisedbytheEuropeanMedicinesAgency (EMA)throughacentralisedprocedure.TothisaimanewcommitteeonAdvancedTherapieswill replaceEMA,withrepresentativesofMemberStates'competentAuthorities,patientsand clinicians.

Developmentsinthisfieldareofgreatimportanceforfuturetreatmentofillnesses.Thereis, consequently,asignificantneedtocreateCommunityrulesinordertofacilitateinnovation, developmentandclinicaluseonanemergingmarket.BothEuropeanpatientsandtheEuropean pharmaceuticalindustrywillbenefitfromrulesensuring,simultaneously,health,safetyandequality intheaccesstothemarket.

Combating HIV/AIDS within the EU and in the neighbouring countries - Council conclusions

TheCouncilheldapolicydebateoncombatingHIV/AIDSwithintheEUandintheneighbouring countriescovering,inparticular,thefollowingtopics:

– How to intensify both prevention efforts and civil society involvement, in each country and at EU level; examples of best practice ;

– Access to antiretroviral treatment and prices of antiretroviral drugs; sustainability of universal access to treatment also in some parts of Europe, measures / initiatives appropriate to tackle this problem .

RecognisingthatpreventionisakeyelementtoconcretisetheeffortsaimedatfightingHIV/AIDS disease,thedelegationssuggestedanumberofexamplesofbestpractice,suchas:

• theuseoftheInternettoinformalargenumberofpeople;

• programmesofeducationonhealthmattersaddressedtoyoungpeople;

• identificationofhighriskpopulationgroupsandpreparationofinformationprogrammestargeted atsuchgroups;

• personaladvice,preservingthepatient'sanonymity;

• distributionofcondomsatlowprices;

• endofstigmatisation,withrespectforhumanrightsandoftherighttoprivacy.

Concerningaccesstoantiretroviraltreatmentsataccessibleprices,thedelegationsunderlinedthe needtonegotiatewiththepharmaceuticalindustryandtoshowsolidaritywiththecountriesin economicdifficulties.

TheCouncilfurtheradoptedconclusionsbasedontheoutcomeofthePresidencyconferenceonthis topic,heldinBremenon1213March2007.

Prevention of injury and promotion of safety

TheCounciladoptedaRecommendationonthepreventionofinjuryandthepromotionofsafety (9476/07 and 8344/07 ).

IntheEU,therateofaccidentsandinjuriesisincreasingandbecomingaleadingcauseofdeathand chronicdisabilityamongchildren,adolescentsandyoungadults.

TheRecommendationaims,inparticular,toimprovetheuseofexistingdataaswellasthe development,whereappropriate,ofinjurysurveillanceandofreportingmechanisms,withaviewto ensuringacoordinatedapproachacrossMemberStatestodeveloptheirnationalpolicies,including theexchangeofbestpractice.

Thepriorityareasidentifiedare:

• thesafetyofchildrenandadolescents;

• thesafetyofelderlycitizens;

• thesafetyofvulnerableroadusers;

• preventionofsportsandleisureinjuries;

• preventionofinjuriescausedbyproductsandservices;

• preventionofselfharm;

• preventionofviolenceagainstwomenandchildren.

Towards a Europe free from tobacco smoke

TheCouncilheldanexchangeofviewsasacontributiontotheconsultationlaunchedbythe CommissionGreenPaper 1onthepolicyoptionsatEUlevelfortacklinginvoluntaryexposureto environmentaltobaccosmoke(passivesmoking).

Thedebatefocused,inparticular,onthefollowingtopic:

– Effective and appropriate measures and level (national or EU) at which they should they be taken.

Duringthedebate,thedelegationsreferredtothenationalbindingmeasuresalreadytakenand appliedintheircountries,withtheaimofstoppingsmoking,inparticularinenclosedorpublic areas.Theyrecalledthatthemoreefficientmeasuresinvolveabanontobaccoadvertising; preventionofaddictioninrelationtoyoungpeople;incentivesforpeopletochangetheirhabits voluntarilyratherthanbindingmeasures;informationcampaignsabouttheconsequencesof smokingforhealth.

Anumberofthesemeasureswouldbemoreefficientifappliedatlocalorregionallevel,evenif financedbyEuropeancontributions.

Guidelines for the Employment Policies of the Member States*

TheCouncilreachedpoliticalagreementonadraftDecisionestablishingtheGuidelinesforthe EmploymentPoliciesoftheMemberStatesfor2007( 9766/07 + ADD1 ).

AsproposedbytheCommission,theGuidelinesadoptedin2005and2006(10205/05 and 9471/06 ) remainunchanged,thenextfullrevisionoftheintegratedguidelines(EmploymentandBroad EconomicPolicyGuidelines)beingscheduledfornextyear.

Simplification of administrative procedures

TheCounciladoptedaDirectiveaimedatsimplifyingandrationalisingprovisionsofCommunity DirectivesconcerningprotectionofthehealthandsafetyofworkersthatobligetheEUMember StatesandtheCommissiontodrawupreportsontheirpracticalimplementation (PE-CONS 3617/07) .

EUROPEAN SECURITY AND DEFENCE POLICY

EU Police Mission in Afghanistan

TheCounciladoptedtodayajointactionontheEUPoliceMissioninAfghanistanEUPOL Afghanistan.

Themissionaimsatcontributingtotheestablishmentofsustainableandeffectivecivilianpolicing arrangementsunderAfghanownershipwhichwillensureappropriateinteractionwiththewider criminaljusticesystem.Itwillalsosupportthereformprocesstowardsatrustedandefficientpolice servicewhichworksinaccordancewithinternationalstandards.

Themissionwillcarryoutitstasksthroughmonitoring,mentoring,adviceandtrainingatthelevel oftheAfghanMinistryoftheInterior,regionsandprovinces.Itwillworktowardsajointoverall strategyoftheinternationalcommunityinpolicereformandsupportthegovernmentof Afghanistanincoherentlyimplementingitsstrategy.

TRADE POLICY

Ukraine - Steel

TheCounciladoptedaDecisionconcerningtheconclusionofanagreementbetweentheECand Ukraineontradeincertainsteelproducts (8597/07 + COR 1)fortheyear2007aswellasa RegulationonadministeringcertainrestrictionsonimportsofthoseUkrainianproductsintotheEC (8610/1/07 REV 1) whichprovidesfortheeffectiveapplicationoftheagreement.

Thisnewagreementfixesquantitativelimitsforimportsofsteelproductsandwillapplyfromthe dateofitsentryintoforceuntil31December2007oruntilUkraine'saccessiontotheWorldTrade Organisationifthatoccursfirst.Itcouldbeautomaticallyrenewedforoneyearattheendof2007. Thisagreementreplacesthepreviousonewhichexpiredattheendof2006andtakesaccountofthe developmentoftraderelationsbetweenthetwopartiesinthissector.

ENVIRONMENT

Motor vehicles emissions (Euro 5 and 6) *

TheCouncil,acceptingalltheamendmentssuggestedbytheEuropeanParliamentinitsfirst readingopinion,adoptedaRegulationontypeapprovalofmotorvehicleswithrespecttoemissions fromlightpassengerandcommercialvehiclesandonaccesstovehiclesrepairandmaintenance information(PECONS 3602/2/07 + 9156/07 + ADD 1 ).

TheRegulationharmonisesthetechnicalrequirementsforthetypeapprovalofmotorvehicleswith regardstoemissions,whileensuringahighlevelofenvironmentalprotection.

Agreement on air services with Kyrgyz Republic

TheCounciladoptedaDecisionapprovingthesigningandprovisionalapplicationofanagreement betweentheEUandKyrgyzRepubliconcertainaspectsofairservices.

TheagreementistheresultofnegotiationsunderamandatebywhichtheCommissioncan negotiatewithanythirdcountrywithaviewtobringingMemberStates'existingbilateralaviation agreementswiththatcountryintolinewithCommunitylaw.
