RECOGNITION OF FORMER COMMISSIONER JOE HARRIS — Victor Bird and Vice Chairman David Conway Bird recognized former Commissioner Joe Harris for his dedicated service to the Oklahoma Aeronautics Commission from 2005 through 2017. Harris thanked the Commission and stated he was proud to serve the State of Oklahoma.

6. DIRECTOR’S REPORT— Victor Bird A. Star Spangled Salute, Tinker Air Show Commissioners were briefed on the Star Spangled Salute Air Show, which was held May 20-21, 2017 at Tinker Air Force Base. Bird reminded commissioners that the Commission sponsored the event and stated air show organizers did not anticipate the approximately 247,000 people that attended and for the first time ever, the gates on Saturday were actually closed due to the maximum capacity crowd. Thirty legislators accepted the invitation to attend the air show as guests of the Commission. Bird reiterated how important events such as the Star Spangled Salute Air Show because Sunday two House members attended the show that the agency had been working with during the legislative session, and those members were amazed at the capability of the Thunderbirds. Bird remarked that he was able to make the point that their skill is only made possible with the hours of training done in military training routes.

B. FAA Mike Monroney Aeronautical Center Pathfinder Award Keynote Address Bird briefed the commission on the Director’s speech given at the FAA Pathfinder Award ceremony. He was presented a framed plaque by Michelle Coppege, the Director of the FAA Mike Monroney Aeronautical Center.

C. Airport Tour with Senator regarding FLIGHT Act Bird briefed the commission on a tour he attended with Senator Jim Inhofe that included Bristow, Frederick and OU Westheimer Airports, as well as Consolidated Turbines. Senator Inhofe gave remarks regarding the FLIGHT Act, current legislation and military training airspace. Bird stated the day was good press coverage including an NPR reporter that accompanied them on the flight the entire tour.

D. Airports and Economic Development for Higher Education Administrators Bird briefed the commission on a seminar given at the State Regents for High Education attended by Chairman Stucky, Grayson Ardies and Bird. The meeting was dedicated to economic development, and the three spoke on developing a local airport.

E. 2017 AAAE/USCTA Policy Board Meeting and Contract Tower Workshop and meetings with delegation in Washington, DC. Bird briefed the commission on his attendance at the US Contract Towers Workshop where he served on the policy board. Bird reported that he visited with the Oklahoma Delegation regarding aviation issues in Oklahoma and met personally with Congressman Steve Russell and Senator Jim Inhofe.

F. Meeting with new Oklahoma Secretary of Transportation, Mike Patterson.

Bird briefed the commission on his meeting with Transportation Director Mike Patterson who was appointed as Secretary of Transportation. Bird discussed military airspace, ATC privatization and several other issues.

7. LEGISLATIVE, CONGRESSIONAL AND REGULATORY UPDATE — Victor Bird, Sandra Shelton The Commission was briefed on legislation and public policy issues concerning airports, aviation and aerospace in the state.

A. 2017 Commission Initiatives signed by Governor Shelton gave a brief description of the legislation signed by the Governor during the 2017 legislative session.

a. HB 1510 Aviation License Plate Shelton stated the aviation license plate bill was placed into an omnibus bill and was signed by the Governor. She said the agency was currently in the process of designing the plate with selected artist, Chris Nick and negotiating with the Boeing Corp. regarding sponsorship. Shelton said 100 tags must be sold before the Oklahoma Tax Commission would place them into production and that they would have an annual fee of $35 which would assist aviation programs within the agency. Shelton stated the Commission would net $24 per tag and the law would go into effect November 1, 2017.

b. SB 230 Women in Aviation Day Shelton stated the state would now have a Women in Aviation and Aerospace Day which would be December 9th, annually. Shelton said the date is the birthday of Pearl Carter Scott, who began to fly with Wiley Post at the age of 13. She reported the bill garnered 7 House authors and 4 Senate authors.

c. SB 47 Aviation & Aerospace Day Shelton stated that Oklahoma Aviation Day would be concurrent to National Aviation Day which was observed in the United States on August 19 annually to celebrate the history and development of aviation and aerospace. She commented that it coincided with the birthday of Orville Wright who, with his brother Wilbur, made significant contributions to powered flight.

d. HB 2179 Aircraft Pilot Passenger Protection Act Modification (APPPA) Shelton stated the Commission sought protection insofar as incompatible development similar to the FAA’s view of the issue, and provided leniency for micro-siting applications. She stated that the Commission had made a request in both the House, which passed HB 2179 without contention, and in the Senate with companion bill, SB 477 which was offered to OAC from Senate leadership to address military training routes and tall structure incompatibility. Shelton said APPPA was passed in 2010 and that HB 2179 would tweak the existing law in several areas She said this law applied to all public-use airports, including Oklahoma’s military airports and only applies to airspace in the immediate vicinity of public-use and military airports, the remaining 95% of Oklahoma’s airspace is unaffected by this law. She said it is important to note that this law did not provide protections for military training routes or drop zones.

e. SB 254 Airport Safety & Standards Inspection Program Shelton said the airport inspection program legislation was signed into law twice this session by Governor . First via SB 254 by Senator Adam Pugh, and ultimately via HB 1681 by Representative Harold Wright. She said the Commission currently inspected all public-use airports to ensure our airports are safe for the flying public and collect vital airport safety data.

f. SB 433 Aircraft Registration Fee Modernization Shelton said SB 433 adjusted the fee schedule for inflation through a 50% increase across the board to the aircraft registration fees while keeping registration at affordable rates for aircraft owners.

B. 2017 Laid Over Commission Initiatives

a. HB 2253 Aircraft Excise Tax Charter Exemption Clean-up Bird stated HB 2253 was an important bill to the agency, as it made up 92% of agency revenues. He reported that Oklahoma had more exemptions to the aircraft excise tax than any other state, with 18 total exemptions, which was a loss to the state of up to $2.6 million per year. Bird stated the bill was laid over by the House of Representatives.

b. SB 705 Raising the Cap on Aircraft Excise Tax Bird stated that a cap of $4.5 million was placed on the agency in 2015, and to date, $600,000 of those funds had gone into General Revenue. Bird reported that SB 705 was laid over, but his intention was to revive the bill where it left off because the funds were paid for by the users of the system, and it was intended they be used in the Oklahoma Airport System.

c. SB 630 Drones / Protecting Property and Privacy Rights Bird stated the bill was laid over and he did not feel that the measure would be revived due to ongoing federal legislative action.

d. SB 477 Protection of Military Training Airspace; Conference Committee Bird stated that SB 477 was the companion bill to HB 2179 and that the agency was asked by the Senate President Pro Tem, Mike Schulz, and the Chairman of the Oklahoma Strategic Military Planning Commission, Mike Cooper, to use SB 477 as a vehicle to protect military training airspace (MTA). He said HB 2179 did not protect low-level training routes such as military training routes (MTR’s). He reported that SB 477 would have protected the integrity of MTRs but that the wind industry was opposing the bill.

C. Congressional Issues

1. FAA Reauthorization a. Air Traffic Control Privatization Bird stated the federal delegation had been opposed to air traffic control privatization and that on the merits, the bill would be devastating to the State of Oklahoma.

1. Aircraft Pilot and Passenger Protection Act Administrative Rules Changes Bird stated the agency will be addressing some rule changes regarding HB 2179.

8. FINANCIAL REPORT— Jane Mitchell The Commission was briefed on the current budget figures for FY2017. Mitchell stated the Commission had an ending cash balance of 5.3 million with just under 3.5 million encumbered. She stated the agency had pre-encumbered 1.3 million for projects approved in the Capital Improvement Program (CIP) but they had not yet been granted. She said to date, June 30, the Commission expenditures had been $6.149 million. She pointed out the FY2018 projected budget for the Commission.

9. OKLAHOMA MUNICIPAL LEAGUE (OML) CONFERENCE — Sandra Shelton The Commission approved $250 for OAC to exhibit at the 2017 Oklahoma Municipal League Annual Conference (OML) & Expo, be held Sept. 12 - 14, at the Cox Business Center in Tulsa. Shelton briefed the Commission on the OML conference which brings together a statewide audience of over 400 mayors, councilmembers, trustees, city managers, clerks, electrical superintendents, public works directors and other municipal officials representing approximately 120 Oklahoma municipalities. Shelton said the delegates meet to learn, to listen, to question and to discuss the issues of the state’s cities and towns. She said OAC would have a general session presentation on the Aviation Economic Impact Study on Thursday afternoon, as well as a booth at the convention center in Tulsa where the expo is held. Commissioner Amis made a motion to approve the booth cost of $250 at the OML Expo; Commissioner Putnam seconded the motion.

CONTRACT FOR AVIATION LICENSE PLATE IMAGE USE — Sandra Shelton Oklahoma Aviation License Plate - The Commission approved entering into a contract with artist Chris Nick and the Oklahoma State Senate Historical Preservation Fund, Inc. (OSSHPF) for image use rights of the Oklahoma Aviation license plate. Shelton said the license agreement stated the copyright would remain with the artist, while providing OAC with a non-exclusive, worldwide, perpetual and royalty-free license to use, reproduce, distribute and display said artwork in print or digital media for any Oklahoma Aeronautics Commission, and Oklahoma State Senate Historical Preservation Fund, Inc. endeavor – for- profit, promotional, or otherwise. 11. TINKER AND THE PRIMES EVENT 2017 — Sandra Shelton The Commission approved booth space for the 2017 Tinker and the Primes event held August 21-23 at the Reed Center in Midwest City. Shelton said the purpose of Tinker and the Primes was for Tinker Air Force Base to share current and future requirements with Oklahoma aerospace and defense companies that wanted to do business with Tinker. The Commission and the Oklahoma Department of Commerce shared an exhibit booth during the event for a total cost of $2,300, with the Commission’s share being $1,150. Commissioner Amis made a motion to approve $1,150 for booth space at Tinker and the Primes; Commissioner Putnam seconded the motion.

12. EAA AIRVENTURE OSHKOSH 2017 — Grayson Ardies The Commission was briefed regarding the Aeronautics Commission’s participation at AirVenture Oshkosh, July 24-28. Ardies reported that OAC partnered with several other Oklahoma entities to rent booth space in one of the large exhibit hangars. Ardies stated the president of EAA would speak at the Oklahoma Inhofe Luncheon.

AVIATION ECONOMIC IMPACT STUDY UPDATE — Grayson Ardies Ardies briefed the Commission on the Oklahoma Statewide Economic Impact Study for the state’s 109 publicly owned airports and four military aviation facilities. Ardies said the study was a two-year effort and was coming to a conclusion. He highlighted the artwork of the

Executive Summary for Commissioners, as well as the preliminary study results for the total economic impact of aviation in the state. Ardies stated the Commission would also provide training regarding the impact results.

14. AOPA Regional Fly-In (Norman, OK) — Grayson Ardies The Commission approved a sponsorship in the amount of $1,500 for the Regional Fly-In event at the OU Max Westheimer airport in Norman, OK. Ardies reported the event would be held September 8th and 9th. Commissioner Amis made a motion to approve $1,500 for sponsorship at the AOPA Regional Fly-In; Commissioner Putnam seconded the motion.

15. THREE-YEAR CAPITAL IMPROVEMENT PROGRAM — Grayson Ardies A. The Commission approved an amendment to the Three-year Capital Improvement Program that amended a previously approved FY 2018 project at Lawton Fort Sill Regional Airport to construct a new terminal building. Ardies stated the amendment moved the project to FY 2020 with a total project cost estimated to be $3,500,000 and would be funded with $500,000 state grant funds, and $3,000,000 local matching funds. Commissioner Potter made a motion to approve the amendment; Commissioner Amis seconded the motion.

16. CAPITAL IMPROVEMENT GRANT PROGRAM - Dale Williams A. The Commission approved a state grant for a project that was currently identified in the Commission’s approved Capital Improvement Program at Claremore Regional Airport. Ardies stated the project consisted of reconstructing runway 17/35 and crack repair on the connecting taxiways. He said, based on bids, the total project cost was $2,266,500 and would be funded with $2,037,600 federal grant funds $113,200 state grant funds, and $115,700 sponsor matching funds. Ardies stated that the Commission would provide half the sponsor’s required federal matching funds. Commissioner Amis made a motion to approve the grant; Commissioner Putnam seconded the motion.

B. The Commission approved a state grant for a project that was identified in the Commission’s approved Capital Improvement Program at Elk City Regional Airport. Adies reported that the project consisted of rehabilitating and widening the parallel taxiway system, installing new medium intensity taxiway lights, crack repair and seal coat north 1,000 ft. of the parallel taxiway, and the crack repair and seal main parking apron. He stated that based on bids, the total project cost was $1,429,751 and would be funded with $1,286,775 federal grant funds $71,487 state grant funds, and $71,489 sponsor matching funds. Ardies stated that the Commission would provide half the

C. The Commission approved an amendment to state grant LAW-17-S. Ardies stated the project consisted of a detailed visual, geotechnical, and hydrologic study of the airside pavements at the Lawton-Ft. Sill Regional Airport. Ardies reported that the original project cost was $162,688 and would be funded with $154,553 state grant funds and $8,135 sponsor matching funds. He commented that the amendment funded the additional specialized equipment and manpower to complete coring the pavement. Ardies stated the original coring costs were based on the available records indicating the pavement thickness was 12 inches, however the actual thickness was 27 to 30 inches which resulted in the total project cost of the amendment estimated at $4,573 and would be funded with $4,344 state grant funds, and $229 sponsor matching funds. Commissioner Putnam made a motion to approve the grant; Commissioner Amis seconded the motion.

Ardies stated the project consisted of installing new LED medium intensity runway lights, an omnidirectional approach light system (ODALS), runway end identifier lights (REILs), new precision approach path indicators (PAPIs), new electrical vault, an electric gate, and a new automated weather observing system (AWOS). Ardies reported that based on bids, the total project cost was $1,182,303 and would be funded with $426,120 federal grant funds $673,393 state grant funds and $82,790 of

Ardies reported that the basic maintenance project consisted of crack repair on runway 17/35 and the total project cost was estimated at $150,000 and would be funded with $142,500 state grant funds, and $7,500 sponsor matching funds. Commissioner Putnam made a motion to approve the grant; Commissioner Potter seconded the motion.

AIRCRAFT PILOT AND PASSENGER PROTECTION ACT (APPPA) — Catherine Taber The Commission was briefed on the number of APPPA permits issued or denied, and other APPPA actions that have occurred since the May 17, 2017, Commission meeting. Taber said the Commission had 6 permits pending for a wind farm near Vici, and had issued 23 for the same wind farm. Taber said the Commission was holding off on a ruling for a power line near El Reno because it would possibly be moved. She said there were 14 permits issued for a wind farm in Talihina and 5 permits for a wind farm near Anadarko.
