Course Description: This one-day program trains mental health professionals to conduct evaluations of defendants’ intent for an alleged offense, responsiv e to a new provision of the Virginia law: Va. Code § 19.2-271.6. The training will be conducted by a team of mental health professionals and attorneys to address, comprehensively, the background and rationale behind the new law, the types of mental conditions the new law covers, the legal framework of intent and mental condition evidence, and how to conduct evaluations that appropriately address defendants’ intent.

Target Audience: Forensic mental health professionals and providers, attorneys and other legal professionals and providers, advocates and others

Award of five (5) accredited hours is available for physicians, psychologists, and social workers. To receive award of accredited hours full participation is required as well as an accreditation fee of $12 per credit hour = $60.00 (5 hours x $12/per hour).

Other forensic mental health professionals and providers may be interested in this program. Attorneys other legal professionals and providers may be interested in this program. Advocates may be interested in this program. All participants receive a general certificate of attendance awarded by ILPPP for up to five (5) hours expected for this live, interactive program

Desired Outcomes: At the conclusion of this activity, participants should be able to: Specifically for this program • Describe the purpose and effect of Va. Code § 19.2-271.6 regarding evidence of defendant's mental conditions • Identify the psychiatric and developmental conditions covered by the law • Explain the legal concept of 'intent' and identify basic differences between general intent and specific intent • Discuss how to conduct a forensic mental health evaluation that is responsive to § 19.2-271.6 And generally regarding ILPPP’s Forensic Series • Describe critical differences between clinical mental health care and forensic mental health evaluation. • Identify sources and/or citations of law that define parameters (boundaries, requirements) for provision of forensic mental health assessments and evaluations and discuss how these legal parameters guide forensic mental health practice. • Discuss how legal parameters inform forensic mental health practice, including encounters with defendants, attorneys, and courts, conducting interviews with defendants and other informants regarding the case, developing and presenting the assessment or evaluation report, and preparing for and providing expert testimony in judicial proceedings. • Identity legal and ethical, cultural competency and equity issues, involved in forensic mental health practice.
