All Rights Reserved.1 Working for and with a judge can be an exciting but intimidating challenge. In many respects, law school is great preparation, and many of the skills you have learned will be invaluable. However, many challenges you will face in chambers can seem quite foreign at first, and there is surprisingly little guidance out there on how to address them. This handout is intended to fill some of those gaps. A lot of the guidance contained in this handout will, like so many things in law, vary depending on facts and circumstances. For example, this handout is intended to be useful both for full-time clerks as well as summer interns and school-term externs. Of course, the roles of each of these positions differs in some respect, so keep that in mind as you read. In addition, as is elaborated further later on, every judge is different. No matter what, respect his or her wishes at all times and never take anything contained herein or elsewhere as advice to the contrary. This handout assumes you have received an assignment from your supervisor in chambers and that you are having a hard time with next steps. The goal is not so much to tell you how to write it (there is simply too much variation out there for that), but, instead, to provide some guidance as to what types of questions you can ask and what next steps might look like. -

INSIGHTi Haiti: Concerns After the Presidential Assassination Updated July 19, 2021 Armed assailants assassinated Haitian President Jovenel Moïse in his private home in the capital, Port-au- Prince, early on July 7, 2021 (see Figure 1). Many details of the attack remain under investigation. Haitian police have arrested more than 20 people, including former Colombian soldiers, two Haitian Americans, and a Haitian with long-standing ties to Florida. A Pentagon spokesperson said the U.S. military helped train a “small number” of the Colombian suspects in the past. Protesters and opposition groups had been calling for Moïse to resign since 2019. The assassination’s aftermath, on top of several preexisting crises in Haiti, likely points to a period of major instability, presenting challenges for U.S. policymakers and for congressional oversight of the U.S. response and assistance. The Biden Administration requested $188 million in U.S. assistance for Haiti in FY2022. Congress has previously held hearings, and the cochair of the House Haiti Caucus made a statement on July 7 suggesting reexaminations of U.S. policy options on Haiti. LETTER TO G20, IMF, WORLD BANK, REGIONAL DEVELOPMENT BANKS and NATIONAL GOVERNMENTS We write to call for urgent action to address the global education emergency triggered by Covid-19. With over 1 billion children still out of school because of the lockdown, there is now a real and present danger that the public health crisis will create a COVID generation who lose out on schooling and whose opportunities are permanently damaged. While the more fortunate have had access to alternatives, the world’s poorest children have been locked out of learning, denied internet access, and with the loss of free school meals - once a lifeline for 300 million boys and girls – hunger has grown. An immediate concern, as we bring the lockdown to an end, is the fate of an estimated 30 million children who according to UNESCO may never return to school. For these, the world’s least advantaged children, education is often the only escape from poverty - a route that is in danger of closing. Many of these children are adolescent girls for whom being in school is the best defence against forced marriage and the best hope for a life of expanded opportunity. Many more are young children who risk being forced into exploitative and dangerous labour. And because education is linked to progress in virtually every area of human development – from child survival to maternal health, gender equality, job creation and inclusive economic growth – the education emergency will undermine the prospects for achieving all our 2030 Sustainable Development Goals and potentially set back progress on gender equity by years. -

www.icnl.org [email protected] PRESENTED TO UN HUMAN RIGHTS COMMITTEE SUBMISSION Draft General Comment No. 37 (Right of Peaceful Assembly) Introduction ICNL is grateful for the opportunity to provide comments on the revised draft General Comment No. 37 on Article 21 (right of peaceful assembly) of the International Covenant on Civil and Political Rights (ICCPR). Please find below principal comments relating to the following issues of general significance: (1) the definition of “assembly”; (2) assemblies through digital means; (3) authorization and notification requirements; (4) use of force in the context of assemblies; and (5) the fundamental nature of peaceful assembly rights. Accompanying these principal comments, we have attached a marked-up version of General Comment No. 37 which addresses the text of the Comment in greater detail, indicating proposed edits (including edits on a number of specific or technical issues not raised in our principal comments) and rationales for these edits. We hope the Committee will find these comments helpful in its review of the draft Comment. Principal Comments 1. THE DEFINITION OF “ASSEMBLY” The conception of “assembly” set forth in the draft General Comment, at paras. 4 and 13, is limited to gatherings of persons with a common expressive purpose in a publicly accessible place. In our view, this conception omits historically and currently important forms of assembly that require protection against restrictions, while also 1126 16th Street NW #400 Washington, DC 20036 2/21/2020 leaving insufficient room to encompass evolving and future forms of assembly. We would recommend clarifying that the protections of article 21 apply to gatherings where the participants intend to engage in important civic activities other than common expression; to gatherings in private, non-publicly-accessible places; and to gatherings “by persons,” in various forms, rather than “of persons”.
