Recommendation(s): That the applications relating to Woodhall Spa and Mareham Le Fen be noted.

That the application to register land as Barrowby Village Green under the Commons Act 2006 be approved.

Background

1. At present there are three applications for the registration of land as town or village greens in which are being processed by the County Council as Commons Registration Authority. These relate to the following areas:

• Land at Alexandra Road, Woodhall Spa • Land adjacent to Main Street, Mareham le Fen • Land adjacent to Road/Low Road, Barrowby

Land at Alexandra Road, Woodhall Spa

2. This application relates to an area at the northern end of Alexandra Road which is owned by District Council (see Appendix A). The application has recently been advertised in accordance with the regulations and an objection from the District Council has been received. The representations are currently being reviewed by the Council's Legal

Services and the Applicant. Further updates on this application will be presented to the Committee. Land adjacent to Main Street Mareham le Fen

3. An application has been received for the registration of the Kime Memorial Lawn in Mareham le Fen (see Appendix B). Under the recent Growth and Infrastructure Act 2013, in some circumstances any land subject to planning permissions may not be claimed and registered as a village green. Information relating to planning consents is currently being awaited from the Planning Inspectorate and East Lindsey District Council. Pending this information, the application may be progressed to the statutory advertising stage. Further updates on this application will be presented to the Committee

Land adjacent to Casthorpe Road/Low Road Barrowby

4. Barrowby Council have applied to register the 'Village Green' (also known as Steven's Gutter – see Appendix C) under S.15(8) as landowners. The relevant title deeds have been provided and checked. Under the regulations, any landowner may voluntary register land as a village green and therefore the Committee is asked to approve the application and registration of the land.

Conclusion

5. It is recommended that the existing position relating to the applications for Woodhall Spa and Mareham le Fen be noted and that the application for Barrowby be approved.
