1.0 Project Introduction

1.1 Description of Activity

A 1-bedroom, 69.6m² sleepout/shed has been constructed at 121 Waimate North Road, Kerikeri. The building has been classed by the Far North District Council as a residential dwelling. The building is approximately 828m from Kerikeri airport runway, within the 1.2km radius. As the building has been classed as a residential dwelling a Resource Consent is required. Refer to the Requirement for Resource Consent Letter, BC Number EBC-2020-11082/0/A from the Far North District Council, Appendix 1.

1.2 Scope

O’Brien Design Consulting were engaged by Phil and Elaine Addy to undertake an application for Resource Consent due to the breach of the following activity:

• Far North District Plan Section 15.2.5.1.2.

NOISE:

Subject to other rules in the Plan defining permitted activities, any new land use is permitted provided it is not a noise sensitive activity within 1.2km radius of the centreline of the runways at each of the Kaitaia, Kerikeri and Airports. For the purpose of this rule each end of the runway is defined as the point where the runway clear strip ends and the approach slope starts. Land within the 1.2km radius is identified on the Kaitaia, Kerikeri and Kaikohe Airport Buffer Area Maps located in Appendix 4.

A Resource Consent as a Discretionary activity is required due to the existing building, classed as a residential dwelling, being identified as a noise sensitive activity within a 1.2km radius of Kerikeri Airport runway. This report addresses each criterion outlined in section 15.2.6.2.

2.0 Site Description

Lot 2 DP 393624 is located off 121 Waimate North Road, Kerikeri and is zoned Rural Production in the Far North District Plan. Access to the 21,550m² property is currently gained via a metal right of way which enters the property from the northwest.

A 1-bedroom, trimline, sleepout/shed is located to the southwest of the lot. The remainder of the property is grassed, fenced pasture used for grazing. The lot slopes moderately to the east. A stream runs along the eastern boundary. Refer to Photographs 1 and 2 showing the building and property.

Rural lots used for grazing are located to the north and south of Lot 2, orchard is located to the east. Residential properties are located to the west. Kerikeri Airport runway is located approximately 830m to the southwest. Refer to the Site Location Plan, Section 2.1, showing Lot 2 and the distance from Kerikeri Airport runway.

3.0 Far North District Plan Assessment Criteria

Objective, Section 15.2.2.1: “To maintain the safe and efficient operation of the airports in the District”

Policy, Section 15.2.3.1: “That restrictions be imposed on use and development which could limit the operation of the airports”.

Policy, Section 15.2.3.2: “That provision be made for the continued use and any future requirements for expansion of existing airports”.

3.1 Airport Noise: Assessment Criteria 15.2.6.2.

(a) Whether the proposed land use is a noise sensitive activity which could limit airport operations.

The construction of a shed/residential dwelling at 121 Waimate North Road is not an activity which could limit airport operations. Far North Holdings owns and operates Kerikeri Airport. In correspondence dated 16th June 2020, Far North Holdings state that they do not have an objection to the dwelling. The letter from Far North Holdings is provided in Appendix II.

The sleepout is insulated which will assist in reducing noise for the occupants.

(b) Whether acoustic insulation should be required as a condition of consent.

As Far North Holdings are not opposed to the proposal, it has not been considered necessary to determine whether further acoustic insulation would be required.

4.0 Summary

The sleepout is within the 1.2km radius of the Kerikeri airport runway. Residential use of the building will not limit the operation of the airport or create any safety issues. Far North Holdings who own and operate Kerikeri Airport do not have any objection to the existing building.

Requirement for Resource Consent

PIM Assessment of your application has highlighted the need for Resource Consent that must be granted prior to any building works or earthworks commencing.

The site is zoned Rural Production under the District Plan and Resource Consent is required for breach of the following:

Rule: 15.2.5.1.2 NOISE Reason: The definition for Residential Dwelling within the Far North District Plan is as follows: A building, a room or a group of rooms, used, designed or intended to be used by one or more persons as a self contained single, independent and separate household. Any accessory building providing sleeping accommodation and bathroom facilities but no cooking or dishwashing or laundry facilities will be treated as forming part of a residential unit / dwelling. Assessment of your application now considers the building to be a residential dwelling. As per the above rule, the proposed works are considered a Noise sensitive activity within 1.2km of the runway of the nearest Airport and requires Resource Consent.

Please note there may be other rule breaches found during the Resource Consent process. It is your responsibility to ensure the Resource Consent approved plans match the Consented approved plans.
