028/E BEST VALUE AND LOCAL ACTIVITY PERFORMANCE INDICATORS 2007/08 – FINAL OUT-TURN
The Executive considered the Best Value and local activity performance indicators for the 2007/08 year which were used as a measure to judge how services were performing. The local performance indicators had been reviewed to ensure they measured achievement towards local priorities, as set out in the Corporate Objectives and key priorities.
Members were advised that, of the 65 Best Value Performance Indicators set, 50.8% had improved and 66.2% had been met, slightly reduced from 2006/07, though significantly higher than the previous year. Of the 48 local performance indicators set, 43.5% had improved and 63% had been met, an increase on the previous year.
Members noted in particular the improved performance in relation to the following key service areas: days lost due to staff sickness, determination of planning applications, recycled household waste, processing of housing benefits claims and service delivery in the Contact Centre.
RESOLVED, That the Council's overall performance against the final Best Value and Local Performance Indicators for 2007/08 be noted.
AGENDA\EXECUTIVE\19AUG08 1 029/E SPECIAL PROTECTION AREA – INTERIM AVOIDANCE STRATEGY
As a result of the designation of the Thames Basin Heaths Special Protection Area and a lack of suitable avoidance or mitigation measures, the Council was having to refuse all but a few planning applications for residential development in the Borough due to the objection raised by Natural England. In order to satisfy Natural England that there was land available other than the Special Protection Area for recreation and dog walking, the Council had been working to identify sites as Suitable Accessible Natural Green Space (SANGS). Negotiations were progressing to bring forward sites as SANGS in Valley End, Chobham and Bisley owned by Surrey County Council and Surrey Wildlife Trust as well as other sites within the Blackwater Valley.
An Interim Avoidance Strategy document had been formulated consistent with the emerging Joint Strategic Framework being prepared jointly with South East of England Regional Authority and the other authorities affected by the Thames Basin Heath designation. This Strategy would need to be updated to reflect the designation of new SANGS, their respective schemes, monitoring and access management requirements and related information.
The Interim Avoidance Strategy set out the background to the Special Protection Area issue, the standard of provision required on SANGS, the schemes proposed as SANGS, future possible SANGS, the level of contribution required and a template for a legal agreement. Standards of proximity to SANGS would apply to developments of 10 or more dwellings; for site of fewer than 10 dwellings there would be no specified distance from a SANGS provided there was sufficient SANGS capacity within the Borough.
It was proposed that the Strategy be adopted as a interim planning guidance for use as the basis for advice to developers and by the Planning Applications Committee.
The Executive was asked to approve the use of Chobham Place Woods (10.78 hectares) as a SANGS in advance of the wider SANGS package which would come forward. Whilst Natural England had previously rejected this site as a SANGS it had now agreed in principle to its suitability as part of an emerging SANGS package at Chobham. The use of a SANGS was in perpetuity and therefore it was proposed that the use would be self-financing through the contributions from developers to cover a scheme of enhancements access management measures and the monitoring of visitor numbers for a period of 80 years. The contribution as at July 2008 had been calculated at £3,500 per dwelling. The site would provide mitigation for 280 dwellings. It was proposed that the site be used as mitigation for sites of fewer than 10 dwellings; and that these would be allocated on a first come, first served basis.
RESOLVED, That
(i) the Special Protection Area – Interim Avoidance Strategy, attached at Annex A to the report, be adopted as interim guidance; and
(ii) Chobham Place Woods be agreed for use as a Suitable Accessible Natural Green Space in accordance with the scheme of works set out in the Special Protection Area – Interim Avoidance Strategy.

The Executive considered a report on the Members' Risk Register and Risk Management following a recommendation made by the Policy and Audit Scrutiny Committee (minute 003/P refers). The Committee had recommended that the Members' Risk Register be removed from the management system and any risk be incorporated into the Corporate Risk Register. It had also made further recommendations to the Risk Management Group on the review and management of the Risk Management System. All the recommendations had been supported by the Chairman of the Risk Management Group (currently the Head of Audit and Partnering).
RESOLVED, That the Members' Risk Management Register be removed from the Risk Management System, and that risks be incorporated into the Corporate Risk Register.
031/E REVIEW OF THE COUNCIL'S STAFF PRIVATE MEDICAL SCHEME
Following a review of the Council's staff private medical scheme, the Council had changed its provision a year ago from a medical insurance package to a deposit scheme. The Council made monthly contributions to the National Deposit Scheme on behalf of all members of staff in the scheme; this contribution varied depending on the age of the member.
A review of the Council's provision had been undertaken which had addressed concerns relating to the equality of contributions and a desire to make the scheme more widely available to staff. The Joint Staff Consultative Group (note 034/J refers) had recommended that the money previously set aside to provide insurance for an additional life assurance cover of 1 x annual salary should be used to make the Health Care Scheme more inclusive and help resolve any potential age discrimination issues. This money had become available as the Local Government Pension Scheme Regulations now ensured that that level of cover was provided as standard.
It was proposed that a review of the Scheme be undertaken after a further three years of operation.
RESOLVED, That
(i) the amount paid for all National Deposit Scheme members up to the age of 50 be increased to £50 per month so that younger members of staff are not discriminated against at the end of their first 5 years of membership;
(ii) the Head of Legal and Corporate Services be authorised, in consultation with the Human Resources Manager, to review annually the qualifying period for eligibility to join the Private Medical Scheme with the intention to reduce this to 12 months for all new starters over a period of two to three years as outlined in the report; and
(iii) at no time shall the cost of the Private Medical Scheme exceed the total sum made available in the budget, being £99,000 for 2009/10; and

032/E COMMUNITY FUND GRANTS
The Executive considered three applications for grant from the Community Fund Scheme from Frimley Parochial Church Council, in the sum of £8,000; Bisley and West End Parochial Church Council, in the sum of £12,300; and Our Lady Queen of Heaven Roman Catholic Church, in the sum of £14,800.
RESOLVED, That
(i) a one-off grant of £5,000 be awarded to Bisley and West End Parochial Church Council; and
(ii) the applications for grants by Our Lady Queen of Heaven Roman Catholic Church and Frimley Parochial Church Council be deferred for further information.
(Note: In accordance with the Surrey Heath Code of Conduct Councillor Keith Bush declared a prejudicial interest in respect of the application for grant from the Bisley and West End Parochial Church, as he was on the electoral roll for the Ecclesiastical Parish of Bisley and West End and a member of the church choir, and Councillor Wynne Price declared a prejudicial interest in respect of the application from Bisley and West End Parochial Church as a former church warden of the church; both councillors withdrew from the Chamber during the consideration of the application.)

REVIEW OF THE CORPORATE CAPITAL Portfolio: Finance PROGRAMME 2008/09 Ward(s) Affected: n/a
Purpose
To review the Corporate Capital Programme 2008/09 and approve any revisions necessitated by the capital outturn 2007/08.
Current Position
1. This report sets out the 2007/08 capital expenditure outturn and the level of slippage in the 2007/08 programme.
2. Attached at Annex A is a schedule setting out:
(a) actual expenditure on capital schemes for 2007/08 compared with the agreed Capital Programme;
(b) the amount of capital approval required to be carried forward to 2008/09 due to slippage after responses from Service Heads;
(c) the draft Corporate Capital Programme 2008/09 approved by the Council; and
(d) the revised 2008/09 Corporate Capital Programme taking account of the carry forwards.
3. Since the 2008/09 Corporate Capital Programme was approved by the Council the following slippage has occurred in 2007/08 expenditure:
(a) Line 2 - Blackwater Valley Project - work has not commenced
(b) Line 6 - Community Transport - only one vehicle replaced in year
(c) Line 7 - Arena Works - due to commence in the current year
(d) Line 9 - Planned Preventative Maintenance - level of work meeting criteria on rules of capitalisation varies each year
(e) Line10 - Provision of burial land - delay in legal agreements
(f) Line 12 - Recycling sites - delay in establishing new sites
(g) Line 14 - IT equipment/software - rolling programme linked to system reviews
(h) Line 16 - Land and Property Gazetteer - delay due to rolling programme linking to other systems
(i) Line 17 - Development Control Planning Delivery Grants schemes - remaining projects yet to be determined

Options
4. Of the £2,163,000 slippage, £32,000 was contractually committed at 31st March 2008. However these sums are required to enable planned schemes to be completed. The Executive has the option of agreeing these carry forwards, amending them or rejecting them.
Proposal
5. It is proposed that the 2008/09 Corporate Capital Programme is adjusted by £2,163,000 to take account of carry forward budget provision from 2007/08.
Resources Implications
6. The Prudential Code for Capital Finance in Local Authorities requires that actual capital expenditure during the financial year is recorded. Actual capital expenditure for 2007/08 was £2.2m.
7. The budget impact of these schemes was considered and approved when the schemes were incorporated into the draft capital programme.
8. The Capital Reserves available for capital expenditure amounted to £20m at 31st March 2008.
Recommendation
9. The Executive is advised to RESOLVE that
(i) the carry forward budget provision of £2.163 million from 2007/08 into 2008/09 Capital Programme be approved;
(ii) the revised 2008/09 Capital Programme of £3.725 million be noted; and
(iii) the capital outturn expenditure for 2007/08 of £2.244 million be noted.

UPDATING OF STREET TRADING CONTROLS IN Portfolio: Community SURREY HEATH Ward(s) Affected: All
Purpose
To set out proposals for updating street trading controls in the Borough and seek agreement for their information, subject to consultation.
Current Position
1. On 29th April 1992 the Council passed a resolution bringing into place controls for street trading under Section 2 of the Local Government (Miscellaneous Provisions) Act 1982. The resolution designated all streets in the Borough as either “prohibited streets” or “consent streets”.
2. For the purpose of the resolution each street includes all forecourts, roads, footways, or other areas adjacent to those streets and open, as a matter of fact to the public without payment, for a distance of 50 metres from the centre of those streets. This is referred to as the 50M rule.
3. In prohibited streets the Council may not entertain any application for street trading. For the most part, the prohibited streets in the Borough are busy roads, where trading would have an adverse effect on road safety.
4. In consent streets the Council has to consider any application for a street trading consent and has the discretion to refuse such applications, or approve them subject to any conditions considered appropriate. Consents may be issued for periods of up to a year.
5. The Council currently has 5 annual consents in place for fixed trading pitches in the Borough and short term consents are issued periodically for temporary trading, most frequently in Camberley Town Centre. The issue of temporary consents has enabled a number of successful French markets in Princess Way, Camberley.
6. Mobile traders, such as ice-cream vendors, also require a consent and may only trade in consent streets.
7. Consents are issued by Environmental Services under delegated powers; however, ward councillors, the Police and the Highway Authority are always consulted before deciding whether or not to issue a consent. The Council charges for the issue of consents, as permitted by the Act.
Reasons for proposed change
8. Camberley Town Centre would benefit from changes to street designations. In particular, Park Street is currently a prohibited street and should be made a consent street, to allow suitable stalls to operate, now that it has been pedestrianised. Designating the High Street as a consent street would enable stalls to operate if the street were closed to traffic during an event in the town centre.
AGENDA\EXECUTIVE\19AUG08 10 9. The prohibited street regime is very inflexible and can prevent trading in locations that would otherwise be suitable. As a result traders can be denied suitable opportunities and the Council can lose income. The problem is caused by the 50M rule, which in some cases extends the prohibition into areas where it is unnecessary.
10. A considerable number of new streets have come into existence since the Council made its resolution in 1992 and these streets have not been designated. These streets are not affected by the Council’s current controls and it would be appropriate to update any new resolution so as to suitably designate the new streets.
Options
11. Option 1 - To make a new resolution under Section 2 of the Local Government (Miscellaneous Provisions) Act 1982, which would:
a) re-designate Park Street and the High Street in Camberley Town Centre as consent streets;
b) change the designation of prohibited streets so that only public highway will be prohibited. Other areas within the 50M rule will become “consent”; and
c) designate new streets not included in the current resolution in accordance with Annex A.
12. Option 2 - To make a new resolution under Section 2 of the Local Government (Miscellaneous Provisions) Act 1982, which would not include the proposed change to the way currently prohibited streets are designated.
13. Option 3 – Take no action and leave the street trading controls as they are now.
Proposal
14. It is proposed that option 1 is pursued. Implementing this option would create a more flexible regime for street trading borough-wide. The greater flexibility would not reduce the Council’s control over street trading, as the ability to refuse applications not considered suitable would be retained.
15. The proposals for Camberley Town Centre would reflect the changes taking place as a result of the Atrium development and enable suitable street trading to take place. The Town Centre Manager is of the view that suitable street trading would enhance the town centre and fully supports these proposals.
Procedure for making the proposed changes
16. In order to implement the changes set out in either options 1 or 2 it will be necessary to follow the procedure set out in Section 2 of the Act. This is a laborious process involving the following stages:
a) Publishing a notice in a local paper stating the Council’s intention to make a resolution under the Act, including a draft of the resolution.
b) Serving copies of the advertisement on both the local highway authority (Surrey County Council) and the Chief Constable of Surrey Police.
c) Allowing a 28 day period for consultation.

e) Passing the resolution (if that is the decision after considering any representations).
d) Advertising the passing of the resolution for two consecutive weeks in a local paper. The first advertisement must be published at least 28 days before the resolution comes into force.
Resource Implications
17. It is anticipated that implementing the proposals would lead to an increase in the number of consents issued each year. It would be possible to undertake this work without additional resources.
18. Any increase in the number of consents issued would result in additional income to the Council. This would probably be in the range of £1,000 - £3,000 per year.
Recommendation
19. The Executive is advised to RESOLVE that
(i) the following draft resolution be approved:
"Pursuant to the Local Government (Miscellaneous Provisions) Act 1982, the Council:
a) designates as prohibited streets, those streets listed in Annex A to this report, including all, roads, footways, and areas open as a matter of fact to the public without payment within a distance of 50 metres from the centre of those streets which are part of the public highway;
b) designates as consent streets,
1) all forecourts, car parks and other areas adjacent to the streets listed in Annex A to this report open, as a matter of fact to the public without payment, for a distance of 50 metres from the centre of those streets, which are not part of the public highway;
and
2) those streets listed in Annex B to this report, including all forecourts, roads, footways, or other areas adjacent to those streets and open, as a matter of fact to the public without payment, for a distance of 50 metres from the centre of those streets."
(ii) the Head of Environmental Services be authorised to implement the procedure set out Section 2 of the Local Government (Miscellaneous Provisions) Act 1982 for publicising and consulting on the draft resolution (Steps a, b and c set out in paragraph 16 above); and
(iii) the Head of Environmental Services be authorised to determine any objections to the draft resolution as set out at paragraph (i) above, after

PUBLICATION OF INFORMATION REGARDING Portfolio: Finance BAD DEBTORS Ward(s) Affected: All
Purpose
To decide whether to publish the identity of bad debtors (council tax and sundry debts) by placing the committee items for write offs in respect of both of these matters into the open part of the Committee Agenda
Background
1. Under the Council’s Financial Regulations the write off and disposal of amounts or items of over £1,000 can only be written off with the approval of the Executive.
The Legislation
2. All personal data, that is, any information from which a living individual can be identified, must be processed in accordance with the eight data protection principles (“DP principles”) as set out in Schedule 1 to the Data Protection Act 1998 (“the Act”) namely –
(i) Fairly and lawfully processed; (ii) Processed for limited purposes; (iii) Adequate, relevant and not excessive; (iv) Accurate and up to date; (v) Not kept for longer than is necessary; (vi) Processed in line with individuals rights; (vii) Secure; (viii) Not transferred to other countries without adequate protection.
3. If an individual consents to the processing of information about themselves there is no breach of the data protection principles.
4. The Council does not of course have the consent of the relevant person to the publication – if the item were placed in the open part of the Agenda and therefore available to members of the public, this would be held to be a publication in terms of the data protection legislation. Such action would be viewed as processing in breach of the DP principles. However, if processing was necessary for the exercise of a function of a public nature exercised in the public interest by any person, it is likely that Information Commissioner (“ICO”) who oversees compliance with the Act would find that there was no breach. Whilst this argument can be put in relation to the recovery of council tax and sundry debts, no guarantee can be given as to whether such arguments would be accepted by the ICO.
5. The ICO has also stated that even if a matter has gone to Court and an Order or sanction has been made against an individual, it does not necessarily mean that the Council are entitled to publish the information. The Council have to consider the impact on the person whose data is being published and consider whether they are a vulnerable member of society and how would disclosure impact upon them. If the Council is not aware of the status/circumstances of each individual person they wish
AGENDA\EXECUTIVE\19AUG08 43 to name the Commissioner’s advice is that the Council should not disclose the information.
6. At the present time the analysis/risk assessment in paragraph 5 above is not undertaken.
7. In view of the importance of this issue, the ICO has issued formal written guidance which is attached at Annex A.
8. To summarise, the ICO’s best practice advice is, do not publish. If a data controller wishes to go ahead, then a risk assessment should be undertaken along the lines set out in the ICO’s written advice.
9. Whilst the ICO’s advice is specific to the use of personal information held for collecting and administering council tax, it can be equally applied to the use of sundry debtor information as data held by the Council in this area is also deemed to be personal information pursuant to the Act.
10. The ICO has statutory enforcement powers to prevent a particular use of personal information. This would generally initially take the form of service of an Enforcement Notice upon the organisation. If there was failure to comply with the Enforcement Notice, it would be open to the ICO to consider prosecution which would of course include a claim for costs against the organisation. Apart from his enforcement powers the ICO is required to promote good practice in the handling of personal information and to this end he has issued a Framework Code of Practice for sharing personal information. All those processing personal information are required to have regard to it when conducting their own processing of personal information.
11. Failure to make enquiries along the lines set out in the ICO’s written guidance set out at Annex A and failure to heed the ICO Code of Practice can lead to a claim for maladministration as in a recent Ombudsman case involving the London Borough of Camden who failed to make the relevant enquiries before issuing bankruptcy proceedings.
12. Subsequent advice received from the ICO indicates that if the Council has forewarned those who are or may become liable for payment of Council Tax, of what might happen in the event of default in payment i.e. their names will be published, subsequent publication in those circumstances would be fair under the first data protection principal as prior notice had previously been given.
Options
13. To place agenda items regarding proposals for write off of both council tax and Sundry debtors accounts for discussion in the open part of the agenda, thereby publishing the information without the appropriate risk assessment being undertaken and without having forewarned of this course of action.
14. (a) With immediate effect, to revise the sundry debt invoices and council tax bills so that an informative is placed on them to indicate that in the event of non- payment and the matter being considered for write off, personal information in the form of the name of the debtor will be considered by the Executive in open session and –
AGENDA\EXECUTIVE\19AUG08 44 (b) prior to the write off proposal being placed on the Executive’s Agenda for consideration, the appropriate analysis/risk assessment as set out in the ICO’s guidance at Annex A be carried out.
Proposal
17. To adopt the option set out in paragraph 14(a) and 14(b) above.

Recommendation
19. The Executive is asked to RESOLVE that
(a) with immediate effect, to revise the sundry debt invoices and council tax bills so that an informative is placed on them to indicate that, in the event of non- payment and the matter being considered for write off, personal information in the form of the name of the debtor will be considered by the Executive in the public part of the meeting; and
(b) prior to the write off proposal being placed on the agenda for consideration by the Executive, the appropriate analysis/risk assessment as set out in the ICO’s guidance at Annex A be carried out.

WRITE-OFF OF BAD DEBTS OVER £1,000 Portfolio: Finance

Purpose To seek approval to write-off irrecoverable sundry debtors bad debts over £1,000.
Background
1. Financial Regulation 22.2 requires that any bad debt in excess of £1,000 shall only be written-off with the approval of the Executive. The following is a bad debt for Arts & Leisure Services which Legal and Corporate Services have recommended for write-off.

2. The above debt has been subject to the relevant recovery action and tracing enquiries have been undertaken.
Options
3. The debt is now deemed to be irrecoverable and therefore should be written off. The only other option would be leave it in the accounts which would show a false situation.
Proposal
4. It is proposed that the debt set out above, having been deemed irrecoverable, be written off.
Resources Implications
5. The cost of writing off this debt will be met from the relevant revenue service.
Recommendation
6. The Executive is advised to RESOLVE that a bad debt of £4,000 in respect of the sundry debt be written off in 2008/09.
