Main results of the Council

The Council adopted conclusions on the single euro payments area, an initiative to be launched on 28 January with the aim of creating by a single integrated and competitive market for payments made in euros by 2010.

It reviewed certain issues to be submitted to the spring meeting of the , in particular with regard to the Lisbon strategy for growth and jobs, for which a new three-year cycle will be launched, and adopting conclusions on a current review of the EU's single market .

This was the first meeting of the Ecofin Council since Cyprus and Malta joined the euro area.

PRESIDENCY WORK PROGRAMME

TheCounciltooknoteofthepresentationbytheSlovenianpresidencyofaworkprogrammeon economicandfinancialaffairs(Ecofin)forthedurationofitsmandate( doc. 16495/2/07 REV2 ).The Councilheldanexchangeofviews.

UndertheSlovenianpresidency(JanuarytoJune2008),theEcofinCouncilwillfocuson:

• financialstabilityissues,namelytheEU’spolicyresponsetorecentdevelopmentsinfinancial markets,thefollowuptothecurrentreviewoftheLamfalussyregulatoryprocessandthe enhancementoftheEU’sarrangementsforfinancialcrisismanagement;

• thelaunchofanewthreeyearcycleofeconomicreformsundertheEU’sLisbonstrategyfor growthandjobs.

TheCouncilwillalsotakeforwardworkstartedlastyearinthelightofcommonobjectivesand prioritiessetbytheGerman,PortugueseandSlovenianpresidencies.Theseare:

• ensuringefficientandeffectivemanagementofeconomicpolicy;

• takingfurtherstepstowardscompletionoftheinternalmarket,inparticularwithregardto financialservicesandtaxation;

INTRODUCTION OF THE EURO IN CYPRUS AND MALTA

TheCouncilwasbriefedbytheCommissionandbytheCypriotandMaltesedelegationson experiencegainedsofarfollowingintroductionoftheeuroinCyprusandMaltaon1January.

Bothcountriesputeuronotesandcoinsintocirculationatthesametimeasadoptingtheeuroas theircurrency.TheCommissionwillcontinuetomonitorthesituation,incooperationwiththe CypriotandMalteseauthorities,andisexpectedtoapproveafullreportonthechangeovernext month.

PREPARATION OF THE SPRING MEETING OF THE EUROPEAN COUNCIL

The Lisbon strategy for growth and jobs: the next three-year cycle

TheCouncilheldapolicydebateonthenextthreeyearcycleoftheEU'sLisbonstrategyfor growthandjobs(200810),tobelaunchedbytheEuropeanCouncilatitsmeetingon13and 14March.

Thedebatecoveredthefollowingelements:

• reportfromtheCommissionontherenewedLisbonstrategyandthelaunchofthenewcycle; “Keepingupthepaceofchange”( doc. 16714/07 + ADD1 + ADD2 + ADD3 + ADD4 REV1 );

• draftbroadeconomicpolicyguidelines(BEPGs)forthe200810period;

• draftcountryspecificintegratedrecommendations;

• proposalforanewCommunitylevelLisbonstrategyprogrammeforthe200810period (16752/07 ).

TheCommissionsuggeststhatthemainfocusofthenewthreeyearcyclebeonimplementation anddeliveryofreforms,giventhattheLisbonstrategyisnowconsideredtobedeliveringonits objectives.Thefourcurrentpillarsofthestrategy–knowledgeandinnovation,employment,the businessenvironmentandenergyandclimatechange–continuetobevalid.Andwhilstevolving challengesneedtobeaddressed,thecurrentguidelinesarenotconsideredtorequireafundamental overhaul.

Nevertheless,implementationofreformsandrecommendationsneedstobeimprovedinanumber ofareas.Theseincluderesearch,innovationmechanisms,SMEs,thesinglemarket,the modernisationofpublicadministration,educationandskills,"flexicurity"(flexibilityandsecurity onlabourmarkets),socialinclusion,territorialcohesion,energy,climatechange,visibilityofthe socialdimension,andthesustainabilityandqualityofpublicfinances.

TheLisbonstrategyisimplementedundernationalreformprogrammesforthememberstates,with aCommunitylevelLisbonprogrammetocomplementthese.

TheCouncilisscheduledtoapprove,atitsmeetingon4March,areporttotheEuropeanCouncil ontheBEPGsandonthecountryspecificrecommendations.

Key issues paper on economic and financial affairs

TheCouncilheldapolicydebateonthemainmessagestobeconveyedtothespringmeetingofthe EuropeanCouncil(13and14March)asregardseconomicandfinancialaffairs,onthebasisofa draftkeyissuespaperpreparedbythepresidency.

Itisexpectedtoapprovethepaperatitsmeetingon12February.

Thedraftkeyissuespaperexaminesthefollowingissues:theeconomicsituation,economicgrowth anddownsiderisks;structuralreformsforgrowthandjobs,implementationinmemberstatesand actionatCommunitylevel;publicfinancesandtheirpotentialcontributiontomacroeconomic stability;theefficiencyandstabilityoffinancialmarkets;economicandmonetaryunionintheEU.

TheEconomicandFinancialAffairsCouncilisoneofanumberofCouncilconfigurations contributingkeyissuespaperstotheEuropeanCouncil;thepermanentrepresentativescommittee andtheGeneralAffairsandExternalRelationsCouncilwilldrawonthemainmessagesin preparingdraftEuropeanCouncilconclusions.

Single market review - Council conclusions

TheCounciladoptedthefollowingconclusions,tobeforwardedtothespringmeetingofthe EuropeanCouncil(13and14March).

"TheCouncilWELCOMESthepublicationoftheSingleMarketReviewbytheCommission.

TheCouncilUNDERLINESthattheSingleMarketisofcrucialimportanceforEurope’s competitivenessintheglobalisedeconomy.Itisthereforepartoftheoveralleconomicpolicy strategyoftheEUasrecognisedintheIntegratedGuidelines.AcompetitiveSingleMarketisakey driverofeconomicgrowthandthesuccessfuleconomicperformanceofSMEswilldependontheir capacitytogrowandoperatecrossborderastheydoontheirdomesticmarket.Itprovidestheright environmenttoenablelivingstandardsofEurope'scitizenstorise.TheCouncil(Ecofin)therefore EMPHASIZESthatthecorefocusoftheSingleMarketasadriverforgrowthshouldbeatthe centreofmeasurestakenforward,includinginthecontextoftheCommunityLisbonProgramme.It alsoUNDERLINEStheimportanceoftheSingleMarketforincreasingtheeconomicadjustment capacityofEuropeancountriesaswellastheirresiliencetoshocks,especiallywithintheMonetary Union.

Deliveringresultsthroughabetteruseofinstruments

TheCouncilSHAREStheCommission’sviewthatanimpactdrivenandresultorientatedapproach isneeded,whichtargetsactionwhereitwillhavemaximumimpact,underpinnedbyrobust economicevidence,andusesallavailabletoolstoenableresponsivenessinarapidlychanging globalcontextandenlargedEuropeandWELCOMESthefocusonimprovedgovernanceofthe SingleMarketinlinewiththebetterregulationagendaaswellastheprinciplesofsubsidiarityand proportionality.Creationofnewadministrativeburdensongovernmentsandbusinessesshouldbe avoided.TheCouncilAGREESthat:

– Usingabettertailoredmixofpolicyinstruments isimportantforensuringthattheSingleMarket regulatoryenvironmentisbothefficientenoughtoreachitsobjectivesandflexibleenoughto respondtotheincreasedpaceofchangeinglobalmarkets.

– Theproposalforasystemformarketmonitoring ,welltargetedandbuildingonexistingdataand procedures,couldhelptoprioritiseactioninmarketswheretherearegenuineandsignificant barrierstomarketfunctioningandcompetition,theremovalofwhichwouldresultinsignificant economicbenefits,includinglowerpricesandbetteraccesstooffersforconsumers.Thiswill helptoachieveatargetedandevidencebasedapproachtotheSingleMarket.TheCouncil INVITEStheCommissiontoimplementthissystemofmarketmonitoringandtoworkclosely withtheMemberStatesthroughtheEPCtoassesstheresultsandevaluatethemethodologyfor continuousimprovement.TheCouncilSTRESSEStheneedforfurtheranalysisonthe functioningoftheservicessector,whichisthecoreoftheEuropeaneconomy.

– Improvedimplementationandenforcementofexistinglegislation isnecessarytoenhancethe competitivenessandperformanceoftheSingleMarket.Moreemphasisshouldbeputon effectiveandconsistentimplementationandenforcement,includingbetterinformationand appropriateredressmechanismsforconsumersandbusinesses.

Priorityareasforaction

TheCouncilSTRESSESthatgreaterconsumerconfidenceandimprovedpartnershipsbetween MemberStatesandtheCommissionwillbekeytothesuccessfulimplementationofthisstrategy.In linewiththenewfocusontargetingactionwhereitwillhavemaximumimpact,theCouncil:

– CONSIDERSthattheopeningofservicesmarkets iscrucialtoEurope’sfutureprosperity. ServicesarenowamajoreconomicdriverinEurope,accountingfor70%ofEurope'soutput, 68%ofemploymentand96%ofnewjobscreated.Rapidandeffectiveimplementationofthe ServicesDirectivebytheendof2009isnecessarytocreateagenuinesinglemarketforservices.

– AGREESthateffortstoliberalisenetworkindustries needtocontinue.MemberStatesshould takethenecessarystepstoachieveatrulycompetitive,interconnectedandsingleEuropewide internalmarketforelectricityandgas.Inlinewiththerequirementsdefinedby2003Energy DirectivesandthecallsoftheMarch2007EuropeanCouncil,thosestepsincludemoreeffective separationofsupplyandproductionactivitiesfromnetworkoperations(unbundling)and providingfairnetworkaccess.Particularattentionshouldbegiventoimprovingand strengtheningtheindependenceoftheregulatoryauthoritiesAlsothetelecommunications packageneedstobeagreedupon.MemberStatesshouldtransposetheDirectiveforthe completionoftheEUpostalinternalmarket.

– AGREESthatimprovingthetaxenvironment isimportant.ItNOTESthatnationalruleson taxationdifferbetweenMemberStates.ThefunctioningoftheSingleMarketmaybeimproved throughcontinuingeffortstotackletaxfraud,eliminateharmfultaxcompetitionandthrough strengthenedcooperationontaxationbetweenMemberStatesand,whereappropriate,at Europeanlevel,whilerespectingnationalcompetences.TheCouncilwillcontinuetoworkin thisarea,includingaddressingobstaclestotheInternalMarket.

– UNDERLINESthatpromotingthefreemovementofknowledgeandinnovation shouldbea priorityandinthisrespectLOOKSFORWARDtofurtherprogressonacommonEUframework forpatentprotection,safeguardinglegalcertaintyandavoidingdiscrimination.Educationshould begivenutmostimportancetofacilitatethemovementtowardsa“knowledgebaseeconomy”.In addition,theconditionsforfinancinginnovativeSMEsthroughriskcapitalshouldbeimproved. TheCouncilSTRESSESthattheframeworkconditionsforaneffectivecompetitionpolicy shouldbeimprovedtoreinforcethebenefitsofinnovationfortheSingleMarket.TheCouncil alsoAGREESontheimportanceofpromotingtherightconditionsforSMEs tofosterinnovation andgrowth,inparticularbyallowingthemtotakefulladvantageoftheopportunitiesofthe SingleMarket,byimprovingtheiraccesstopublicprocurementand,byreducingfurther administrativeburdensandobstaclestocrossbordertrade.

– TAKESNOTEoftheproposalsforretailfinancialservicesintheSingleMarketReview,and AGREESthatgreatercompetition,enhancedefficiencyandmoreopportunitiesforbusinessin retailfinancialserviceswillpromotejobsandgrowthandbenefitconsumers.Inthiscontext,the CouncilBROADLYSUPPORTStheinitiativesidentifiedbytheCommissionintheareaof retailfinancialservices,andinparticular

• ENCOURAGESthedevelopment,bythebankingsector,ofasetofcommonruleson bankaccounts,tofacilitatebankswitchingandaccessbynonresidents,tothebenefitof allconsumers,bearinginmindthepositiveeffectsexpectedfromincreasedcustomer mobilityoncompetition;

• SUPPORTStheCommissioninitsintentionstolookintotheobstaclestobroader productavailability,inparticularassessingthepossibilitiesofa28 th regimeandfurther useofcompetitionpolicytools;

• SUPPORTSexaminationbytheCommissionofpossibleimprovementstofinancial servicesredressmechanisms;

• AndENCOURAGESgreaterandcontinuedengagementwithconsumerssoastotry out,whererelevant,theproposedmeasureswithconsumertestingpanels,and/ordiscuss themwithexpertgroupsgatheringprofessionalsandusers.

– INVITEStheFSCandtheEFCtoexaminetheforthcomingdetailedinitiativesbythe Commission.Inthefirsthalfof2008,andinadditiontotheconsiderationofprogressonthe SingleEuroPaymentArea(SEPA),theCouncilwillexamineinparticulartheCommission WhitePaperonthemortgagecreditsectorforconsumersandthecommunicationbythe Commissiononfinancialeducation,settingoutsuggestionsforthedeliveryoffinancial education,recognizingthatfinancialeducationisprimarilyamatterforMemberStates.

TheCouncilUNDERLINEStheimportanceoftheexternaldimension oftheSingleMarket Review.TheUnion'sinternalandexternalpoliciesneedtobeharnessedinordertorespondtothe opportunitiesandchallengesofglobalisation,inlinewiththeEUdeclarationonglobalisation adoptedbytheEuropeanCouncilinDecember.AwellfunctioningSingleMarketcanenhance MemberStates'capacitytocompeteinaglobalisedworld."

FINANCIAL SERVICES – SINGLE EURO PAYMENTS AREA - Council conclusions

– EMPHASISESitssupportfortheaimoftheSingleEuroPaymentsArea(SEPA):toachievean integratedmarketforpaymentservicesineurowhichissubjecttoeffectivecompetitionand wherethereisnodistinctionbetweencrossborderandnationalpaymentsineurowithintheEU;

– WELCOMESthesubstantialprogressachievedbyindustrytoachievetheSEPA;

– RECOGNISESthattheSEPAprojecthasnowmovedfromthepreparatorytotheoperational stageandthereforecallsuponindustrytoredoubleitseffortsandcompletework,inparticularin relationtotheoutstandingstandardsrequiredinthecardsmarketandinthecustomertobank andbanktocustomerspace;

TheCounciladoptedadecisionauthorisingGermanyandPolandtoapplyaspecialmeasurein relationtotheconstructionandmaintenanceofborderbridgescrossingtheOderandtheLausitzer Neisserivers (16447/07) .

Thedecisiondefineswhichbridgesaredeemedtobepartofeachterritoryfortaxationpurposes regardingthesupplyandacquisitionofgoodsintendedforthosebridges.

Thismeasurederogatesfromdirective2006/112/EConthecommonsystemofvalueaddedtax.

APPOINTMENTS

Euratom scientific and technical committee

TheCounciladoptedadecisionappointingthemembersoftheEuratomscientificandtechnical committee(STC)foraperiodoffiveyears (15047/2/2007 + 16067/07 ADD1) .

In2004,theCouncilappointedSTCmembersfortheperiodfrom1May2004to30April2009. However,followingtheaccessionofBulgariaandRomaniatotheEU,anewdecisionappointing themembersofthecommittee(41followingaccession)wasrequired.
