Resources Director by James E . Kerns for approval of changes in point of diversio n

of water from Rock Creek, pursuant to the provisions of ORS 540 .510 to 540 .530, for

certain water rights allowed by decree of the court in the matter of the Determin-

ation of the Relative Rights to Use of the Waters of Powder River and its Tribu-

taries, as follows :

Irrigation of a certain 23 .2 acres (amended to 40 .0 acres) in SW4 SW's of

Section 35, Township 7 South, Range 38 East, W .M ., by diversion of water from Roc k

Creek through the George (McCullough) Ditch, with a priority date of 1879, as ,

described by the certificate issued to C .E . Morris and recorded at page 45020 ,

Volume 37, State Record of Water Right Certificates .

Irrigation of a certain 40 .0 acres in NE/ NE% and 20 .0 acres (north o f

Willow Creek) in SW4 NE4 of Section 3, Township 8 South, Range 38 East, W .M ., by

diversion of water from Rock Creek, through the George (McCullough) Ditch, with a

priority date of 1874, as described by the certificate issued to Blanche McCulloug h

and recorded at page 4341, Volume 5 of said records.

Irrigation of a certain 38 .0 acres in NNa NE' of Section 3, Township 8

South, Range 38 East, W .M ., by diversion of water from Rock Creek, through the

Chambers Ditch, with a priority date of 1904, as also described by the certificat e

recorded at page 4341, Volume 5 .

The point of diversion for the George, or McCullough, Ditch is located 1700 feet North and 224 feet West from the Southeast Corner of Section 33, Townshi p

7 South, Range 38 East, W .M ., being within the NE' SE/ of said Section 33 .

The authorized point of diversion for the Chambers Ditch is located 154 2

feet North and 1732 feet West from the Southeast Corner of Section 33, Township 7

South, Range 38 East, W .M ., being within the NW'.; SEP of said Section 33 .

The applicant herein, owner of the lands above described, proposes t o

change from the above described points of diversion, without loss of priority, an d

to divert water for the said rights through the Wilcox Ditch from a point of diversio n

located 1500 feet North and 1410 feet West from the Southeast Corner of Section 33 ,

Township 7 South, Range 3S East, W .M ., being within the NW4 SW., of said Section 33 .

Notice of the application, pursuant to ORS 540 .520(2), was published i n the Record-Courier, a newspaper printed and having general circulation in Bake r

County, Oregon, for a period of three weeks in the issues of March 16, 23 and 30 ,

1978 .

On April 27, 1978, a protest against approval of said application wa s filed in the office of the Water Resources Director by Gerald O . Maxwell, et . al .

The protest alleges that the proposed changes in points of diversion would b e injurious to existing rights, contrary to ORS 540 .530 .

Pursuant to the aforesaid published notice, the matter of the applicatio n and the protest against it was brought to hearing before Mr . James W . Carver, Jr . , in the County Court Room of the Baker County Courthouse in Baker, Oregon, on May 9 ,

1978 .

The applicant, James E . Kerns, appeared without counsel and represented himself in the hearing .

The protestants appeared without legal counsel and, pursuant to an ora l

agreement among the several protestants, Gerald O . Maxwell acted as spokesman fo r

the protestants . DENIAL OF OBJECTIO N

The applicant owns the entirety of the SW' SW4 of Section 35, Township 7

South, Range 38 East, W .M . The certificate issued in the name of C .E . Morris an d

recorded at page 45020, Volume 37, State Record of Water Right Certificates, de -

scribes a right to use the waters of Rock Creek, with a priority date of 1879 ,

through the George (McCullough) Ditch, for irrigation of, among other lands, 40 . 0 acres in the said SW4 SW-a of Section 35 .

Prior to the hearing, the application listed only 23 .2 acres of the sai d

40 .0 acres in the said SW' SW4 of Section 35, to be involved in the proposed chang e

in point of diversion from the head of the George (McCullough) Ditch to the head o f

the Wilcox Ditch . During the course of the hearing, the applicant amended hi s

application to include the entire said 40 .0 acres . The protestants, through Mr .

Maxwell, objected to the amendment of the application . The amendment of the

application raises no new issues not already before the Director in this matter ;

therefore, the objection is denied .

FINDING S

Rock Creek, a tributary of the Powder River in Baker County, Oregon,is a

perennial stream which forms on the east slope of Elkhorn Ridge and flows easterl y

for a distance of approximately fifteen miles, to its confluence with the Powde r

River, near the town of Haines .

The flow of Rock Creek past the authorized and proposed points of diver-

sion is subject to fluctations from release of off-channel stored water through th e

Rock Creek hydroelectric power plant, which discharges into the channel of Roc k

Creek approximately one-eighth of a mile upstream from the head of Wilcox Ditch .

The record location of the head of the Chambers Ditch is between the hea d

of the Wilcox Ditch and the point of discharge from the Rock Creek hydroelectri c

power plant . V

In the vicinity of the said power plant, and downstream for a distance o f

approximately one-half mile, the channel of Rock Creek lies immediately adjacent t o

the bottom of a steep hillside which rises 640 feet in the horizontal distance o f

1500 feet . The hillside is composed of earth and loose rock and is subject t o

slides, especially when wet .

The Wilcox Ditch runs along the face of the hillside as it winds its wa y

out of the Rock Creek drainage, to where the ditch turns to the south, toward th e

Willow Creek drainage .

The Chambers Ditch, which has not been used for at least the last fiftee n

years, ran parallel to, and above, the Wilcox Ditch along the face of the hillside .

Whenever the Chambers Ditch would overtop or otherwise fail for any reason, th e

resulting slide would cause the Wilcox Ditch to fail, also . To alleviate th e

problems caused by failures of the Chambers Ditch, the users of the Wilcox Ditch an d

the Chambers Ditch agreed to discontinue use of the Chambers Ditch and carry the

additional water in the Wilcox Ditch for those lands formerly served through th e

Chambers Ditch . However, the change in point of diversion of water from Rock Cree k

from the head of the Chambers Ditch to the head of the Wilcox Ditch, made in fact ,

was not then made a matter of record pursuant to the provisions of ORS 540 .510 t o

540 .530 .

By the pending application in question, the applicant proposes to chang e

the points of diversion for all of the Rock Creek water rights appurtenant to hi s

lands to the head of the Wilcox Ditch and, by means of the Wilcox Ditch, convey th e

waters received under various priorities into a pipeline distribution system .

The protestants testified to the effect that they would not be directl y

injured by the proposed changes in point of diversion, per se, but that wate r

previously received through the George (McCullough) Ditch on the lower'portion o f

the applicant's property would be delivered to the highest point of his irrigated lands and would provide opportunity for use of that water on lands to which th e

water rights are not now appurtenant . Also, the opening of the headworks of th e

Wilcox Ditch earlier in the year to deliver Rock Creek water under a priority dat e

of 1874, which is an older priority date than now received through the Wilco x

Ditch, would provide opportunity to divert water into the Wilcox Ditch in additio n

to that to which the users on the Wilcox Ditch are entitled by their relative date s

of priority .

CONCLUSION S

ORS 540 .530(1) provides, in part : "If, after hearing or examination, th e

Water Resources Director finds that the proposed change can be effected withou t

injury to existing rights, he shall make an order approving the transfer . . ." .

Speculative violations of the water laws do not constitute an injury o f water rights upon which the pending application in question should be denied .

Approval of the proposed change in point of diversion from the head o f

the Chambers Ditch to the head of the Wilcox Ditch for diversion from Rock Creek o f

that water to which the applicant is entitled under a priority date of 1879 fo r

irrigation of the certain 40 .0 acres in SW/ SWa of Section 35, Township 7 South ,

Range 38 East, W .M ., would not result in injury to other water rights .

Approval of the proposed change in point of diversion from the head of

the George (McCullough) Ditch to the head of the Wilcox Ditch for diversion fro m

Rock Creek of that water to which the applicant is entitled under a priority dat e

of 1874 for irrigation of the certain 40 .0 acres in NE4 NE4 and 20 .0 acres (north

of Willow Creek) in SWh NE' of Section 3, Township 8 South, Range 38 East, W .M . ,

would not result in injury to other water rights .

Approval of the proposed change in point of diversion from the head o f

the George (McCullough) Ditch to the head of the Wilcox Ditch for diversion fro m

Rock Creek of that water to which the applicant is entitled under a priority date of 1904 for irrigation of a certain 38 .0 acres in NWh NEa of Section 3, Township 8

South, Range 38 East, W .M ., would not result in injury to other water rights ,

Mr . V . Kent Searles, Watermaster, has filed a statement to the effec t that the proposed changes in point of diversion may be made without injury t o existing rights .

No other objections having been filed and it appearing that the propose d changes in point of diversion may be made without injury to existing rights, th e application should be approved .

NOW, THEREFORE, it hereby is ORDERED that the requested changes in poin t of diversion of water from Rock Creek, as described herein, without loss of priority , are approved .

It is FURTHER ORDERED that the quantity of water diverted at the ne w point of diversion shall not exceed the quantity of water available at the ol d points of diversion under the subject rights .

It is FURTHER ORDERED that the following provisions shall be carried ou t prior to the diverting of water at the new point of diversion as herein confirmed :

That the diversion works shall include an in line flow meter, a weir, or other suitable device for measuring the water to whic h the applicant is entitled ;

That the type and plans of the measuring device be approved b y the watermaster before the beginning of construction work an d that the weir or measuring device be installed under the genera l supervision of said watermaster .

It is lURllllfR OKOVRI'U that the construction work shall be completed and

the change in point of diversion of water made on or before October 1, 1979 .

It is FURTIIER ORDERED that the certificate of water right heretofor e

issued to Blance McCullough and recorded at page 4341, Volume 5, State Record o f

Water Right Certificates, is canceled ; and in lieu thereof a new certificate b e

issued covering the balance of the right NOT involved in this proceeding ; and upon proof satisfactory to the Water Resources Director of completion of works an d beneficial use of water to the extent intended under the provisions of this order , a confirming certificate of water right shall be issued to the applicant herein .

It is FURTHER ORDERED that the certificate of water right heretofor e issued to C .E . Morris and recorded at page 45020, Volume 37, State Record of Water

Right Certificates, is canceled ; and in lieu thereof a new certificate be issue d covering the balance of the right NOT involved in this proceeding ; and upon proof satisfactory to the Water Resources Director of completion of works and beneficia l use of water to the extent intended under the provisions of this order, a con - firming certificate of water right shall be issued to the applicant herein .

THIS AGREEMENT, made and entered into this b1S day of March, 1967, by and between LOWER POWDER RIVER IRRIGATION

DISTRICT, a public or municipal corporation and irrigation district , organized under the laws of the State of Oregon relating to th e formation of irrigation districts, hereinafter referred to a s

"District", and HAROLD BANTA, ALLAN H . BANTA and TED W . WILLOUGHBY , both individually and as co-partners doing business as Banta 4

Willoughby, and ROBERTA A . BANTA, the wife of Allan H . Banta , hereinafter referred to collectively for convenience as "B R W" ,

WITNESSETH :

WHEREAS, the parties to this agreement acknowledge that since the inception of use by the District of water stored in Thie f

Valley Reservoir, all land owners within the Bottom Land Division have adopted the custom that, during the period of each year that water is released from the reservoir for irrigation purposes, al l water in the river channel, including stream flow and return flo w water, is treated as stored reservoir water and all such water has

been distributed each and every year since that time as though al l

of said water was stored reservoir water . The District is con-

sidered as releasing reservoir water for irrigation purposes durin g

the irrigation season of any year from the time water ceases to flo w

over the top of the lip of Thief Valley Dam . In treating such water as reservoir water, the District also controls the drainag e

of all such water within the District, including the redistributio n

and reuse thereof, no matter whether such water is returned t o

Powder River or otherwise returned to the distribution system .

WHEREAS, District water is diverted from Powder River at various points throughout the District into the principal water deliver y

ditches which are owned by groups of the members of the District .

The water is delivered to the individual users under the syste m

established by the District . Two of the said points of diversio n are the Cranston and Perkins ditch diversions . A new diversio n

dam has been constructed in Powder River downstream to provide

a common diversion point for both ditches . This dam will b e

hereinafter referred to as the "new Cranston-Perkins dam" an d is located in the NWSW/ of Section 17, Township 8 South, Rang e

42 E . W . M . Applications to change the points of diversion o f

the Cranston and Perkins ditches to said new point have been file d

with the State Engineer of Oregon ; B $ W filed protests agains t

such changes . WHEREAS, the waters distributed by the District, with tw o

exceptions previously approved by the District, are used and reuse d

within the Bottom Lands Division of the District . The said Botto m Lands Division consists generally of those lands within the Distric t

lying on both sides of Powder River between the river and th e uppermost principal water delivery ditches .

WHEREAS, B ; W are members of the District and are the owner s

and purchasers of lands within the District, . some . of which lie in

the Bottom Lands Division . Certain persons included within th e

collective, term "B W", have also made entry on government land s

inside the District . B $ W have filed applications and secure d

permits for appropriation of waters of Powder River for irrigation

and supplemental irrigation of their lands lying outside the Bottom

Lands Division of the District by pumping, from a point of diversio n

on Powder River located in the SW)SEh of Section 17, Tp . 8 South ,

Range 42 E . W . M ., being 660 feet north and 30 feet east from th e

quarter corner of Secs . 17 and 20 in said Tcwnshin and Range . Th e particular description of the lands for which such application fo r

WHEREAS, the District is in the process of correcting and adjusting the rights to reservoir waters in the District so tha t water right certificate No . 12310 issued to the United States-o f

America-Bureau of Reclamation, evidencing the water rights t o said reservoir waters, will be correctly amended to reflect th e acreuEton and rights within the District . WHURUA,i, the District is instituting n project to divert th e waters of Powder River, primarily by pumping, at certain points o f diversion below the new Cranston-Perkins Dam . These points o f diversion are designated as follows :

Point 1 : Approximately 1340 feet West and 650 feet South o f the northeast corner of Section 21, Township 8 South, Range 42 E . W . M.

Point 2 : 60 feet North and 760 feet East from the wes t quarter corner of Section 22, Township 8 South , Range 42 E . W. M .

Point 3 : 840 feet North and 1350 feet West from the southeas t corner of Section 26, Township 8 South, Range 42 E . W. M .

Point 4 : 1,810 feet South and 1,820 feet East from the wes t quarter corner of Section 25, Township 8 South , Range 42 E . W . M.

Point 5 : A point not yet designated but which would b e downstream and easterly from said diversion poin t 4, located between said diversion point 4 and th e easterly boundary of the District .

Diversion Point 1 is fixed and determined . The other diversio n points may be changed .

WHEREAS, the parties desire to settle all matters in controvers y between the District and B 4 W .

NOW, THEREFORE, in consideration of the mutual promises, covenant s and agreements by he parties hereto to be kept and performed, it i s hereby understood and agreed by and between the parties as follows :

1 . During the irrigation season and so long as sufficien t

water is available at Diversion Point 1, under the provision s

of this agreement, B W shall deliver into the Cransto n , Ditch , at a place designated by the District, whatever water is available ,

not exceeding 3 .125 cubic feet per second, and the District wil l

deliver from the Cranston ditch into Powder River above the presen t B 8 W pumping site in the SW h;SE4, Sec . 17, Twp . 8 South, Rang e 42 E . W . M ., or some other equally satisfactory place or sourc e

in substitution thereof, a like amount of water, not exceedin g 3 .125 cubic feet per second, to be used by B $ W, as hereinafte r

set forth . B F, W shall at all times deliver into the Cransto n

ditch at said place an amount of water equal to that being delivere d

for their use by the District from the Cranston ditch into Powde r

River, or other place of substitution, but B F, W will not b e

required to deliver such water at any other time . The District shall not be obligated to deliver from the Cranston ditch, or other place of substitution, at any time any more water than th e amount delivered by B 8 11 into the Cranston ditch by pumping a t

Diversion Point 1 . The District will not object to B ( W pumpin g

whatever water is at Diversion Point 1, not to exceed 3 .125 cubi c

feet per second, Te,• rdless of pumping by District at any 44WA -

stream diversion points . The exchange of this water shall b e

subject to all restrictions and limitations contained in thi s

agreement ; the right to this exchange of water shall be permanent ,

subject to compliance by B 8 W with the terms of this agreemen t

and to all other restrictions, conditions and limitations containe d

in this contract, and if B $ P1 do not so comply, the District ma y

immediately terminate this exchange of water and stop deliverin g

said water to B N; so long as they refuse to comply .

examined said easements and do hereby approve them . The District

grants B $ W the right to use such easements in accordance wit h

the terms thereof, and in accordance with and during the existence of this agreement .

3. No diversions of water will be made by the Distric t

between the new Cranston-Perkins dam and Diversion Point 1 .

4. The District will include, within its application fo r

appropriation of water from Powder River below the new Cranston -

Perkins dam, Diversion Point 1 above described . Diversion Point .

1 will be used by B 4 W for the placement of water from Powde r

River into the Cranston ditch pursuant to this agreement . It is

contemplated that the 3 .125 cubic feet per second of water required OW to be replaced in the Cranston ditch by pumping will be provide d

under the water filings of the District, and will be accomplishe d either by amendment of the applications presently filed in the b n

office of the State Engineer, if that be possible, or if not, throug h

supplemental filings which will be promptly made . The District wil l use all reasonable efforts to secure water rights for this appropria- rious

tion of water, but if B 4 W are not satisfied then B 4 W may procee d in the name of the District to file for or perfect any existing

filing of the District, at B $ W expense, to secure a water right

for Diversion Point 1, not to exceed the stated amount of 3 .12 5

cubic feet per second .

5. B f W agree that when the District is releasin g

reservoir water during any irrigation season, and whenever the

District is delivering water to B y W from the Cranston ditch under the provisions of Paragraph 1, B 4 W will not pump an y water to lands outside the Bottom Lands Division of the Distric t

from any other sources of water within said Bottom Lands Divisio n

except from the sources and in the amounts specified in thi s

paragraph under the restrictions and limitations specified i n

this paragraph :

(e) Any other water not included within the , definition o f the term "surface water" .

Whenever there is not enough water at one or more of the lowe r pumps of the District in operation, including the pump at Diversio n

Point 1, to meet the requirements of said pumps within the limit s

of the water permits or water certificates hereafter issued t o

the District, then By W shall not pump any water in excess o f 5 cubic feet per second from the sources specified in this paragraph '

and under the limitations therein specified . Except as provided

in this paragraph and as otherwise provided in this contract, an d

so long as B $ W comply with all terms, conditions, restriction s

and limitations contained in this contract, the District will no t

interfere with or object to the pumping and use of said amounts o f

water from said sources on lands outside said Bottom Lands Division .

The prohibition of this paragraph shall remain in full force an d

effect unless hereafter changed by mutual agreement of the parties .

6. B f N agree that they will not, between April 1 and Octobe r

1 of any year, put water from any source within said Bottom Lands

Division not specified in Paragraph 5 into their system which

irrigates lands outside the Bottom Lands Division of the District . , 7. B N must provide whatever facilities are neCoSSary

including, but not limited to, pickup ditches, toe ditchos, flumes ,

etc ., so that all surface water on their land within the Botto m

Lands Division of said District shall be returned to the Dunca n

or Perkins ditches, or to Powder River below the B W pump s

located in the SW;SE/ of said Sec . 17, or such other ditches or drains as may be provided and/or maintained by the District o r

the Southside Improvement District, at such places upon such

lands as are convenient therefor and acceptable to the District

during the period between April 1 and October 1 of each year .

The basis for this requirement is the contention of the Distric t

that the return flow of surface water from Thief Valley Reservoir ,

or the early stream flow rights within the Bottom Lands Division ,

must not be interfered with, and that such surface water may no t

be utilized on lands which do not carry primary reservoir right s

(as to reservoir water) or early stream flow rights as regards stream flow . B $ W are prepared to accept and acquiesce in suc h

contentions . No one shall divert surface waters into drain s

except at those places which the District approves or directs .

GRANT. ROSE & DARON The provisions of this paragraph are a general requirement which will be uniformly applied throughout the District .

3 . It is agreed that the term "surface water" as use d in this contract applies to all water having its origin eithe r in reservoir storage or early stream flow rights, and whethe r excess water, return flow water, or surface waste from B 3 W lands or the lands of others . It also applies to water reachin g the land through rainfall or other natural supply if and so lon g as such waters become intermingled with the said stream flow o r reservoir water to the point where the same cannot be accuratel y measured and segregated therefrom . The burden of making suc h segregation shall always be upon the landowner . This provision shall not apply to stream flow water of Ruckles Creek under wate r rights appurtenant to B F, W lands, or from B 3 W private reservoir s or wells but shall apply to any water voluntarily discharged fro m wasteways in the principal water delivery ditches within the

District . It is further understood that this provision shall i n no way be construed to mean that surface water' cannot be reuse d on lands with water rights under Water Certificate No . 12310 within the

Bottom Lands Division . Such right of reuse is expressly recognized .

9 . B FT W agree to the change of the points of diversion o f the Cranston and Perkins ditches to the site of the new Cranston -

Perkins dam which is approximately 125 feet South and 1000 fee t

East from the west quarter corner of Section 17,- being within th e

NWkSW%, Sec . 17, Twp . 3 S ., R . 42 E . W . M ., and will withdraw al l objections thereto filed with the State Engineer . B F, W wil l also withdraw their objections filed with the Civil Defense Agenc y to the use of disaster relief funds for said dam and other connecte d purposes, and advise such agency, together with the Bureau o f

Reclamation and the office of Emergency Planning of the with- drawal of such objections .

10. B iV relinquish entirely any claim to return flow wate r

in Powder River above and at the point of the new Cranston-Perkin s r dam . The District has no obligation to B F, W to pass any wate

through or over the new Cranston-Perkins dam, and the Distric t

shall have full control of the distribution of ail water in Powlo r

River above and at the point of the new Cranston-Perkins dam durin g

the irrigation season each year to serve the lands within th e

District to the greatest extent possible within the limits of th e

water rights appurtenant to such lands as established or as adjuste d

under the provisions of this agreement . Nothing herein containe d

shall be construed to in any manner affect the right of B $ W to receive, on an equal basis with other users, their appropriat e

share of the water distributed by the District on those lands know n

as the Lew and Jeppeson places lying therein, upon which they hav e

been paying reservoir assessments, as the same may be adjusted in th e

water filings of the District under the provisions of Paragrap h

17 of this agreement, or their right to stream flow water unde r early rights appurtenant to either of said places, or to affec t

in any manner their right to receive such water through the ditche s in which they may now or hereafter hold ditch rights, or to take

any steps authorized by law to secure the proper application o f

said water to the lands within the Bottom Lands Division upon which the same is appurtenant . ;

11. The District shall at all times have full and complet e

control over all waters diverted into the principal water deliver y

ditches within the District, including surface waters as that ter m

is defined in this contract . The District shall have the sole powe r

of directing the manner and amount of water that shall be delivere d

from said ditches ; the exchange of water under Paragraph 1 is a n

agreement made under this power . If said directions are not complie d

with the District may take possession and control of all diversio n

facilities . The District shall also have such control of all such

surface waters to direct the distribution thereof . GRANT, ROSE at OARON

12 . Except as provided herein, B lV abandon any clai m

previously asserted that the District or any of the water users

therein have heretofore abandoned any water returned to the ditche s per to Powder 121\er, 1. 1V agree that the District has plans for the roll ntilisatien of water in Powder Urns helow the new

Cranston-Perkins dam within the next ten years . 1i $ 1V will not

during this period of time take any steps to make a claim for an y

additional amount. of this water unless the District voluntarily

terminates its project or eotd project is otherwise terminated by

14. B 8 W shall install, maintain and operate, at their expense ,

a pumping plant and pipeline for the purpose of pumping water fro m

Powder River to the Cranston ditch at the site of the aforesai d

Diversion Point 1 . The installation shall be accomplished i n

a good and workmanlike manner and strictly in accord with th e

requirements of the easement acquired therefor by the District .

15. B $ W agree not tooperate their irrigation system ,

their pumps in the SWbSE' of Sec . 17, Township 8 South, Rang e 42 E . W . hl ., or the pumps at Diversion Point 1, in such a manne r

as to violate any of the terms of this agreement, and further agre e

not to change the points of diversion of waters obtained under thei r

said applications and permits or water delivered or allowed t o

them under the terms of this agreement without first obtaining th e

consent of the District .

B 8 IV shall not dig any drains within thirty (30) feet of sai d principal water delivery ditches, measured on the level from top of bank ofdrain ditch to top of bank of water delivery ditch ; the presently constructed drain in the SW4SE4 of Sec . 17, Twp . 8

South, Range 42 E . W . M ., which is dug under the Perkins ditch, is an exception to this provision, but B F, W agree to keep said Perkin s ditch at said place lined and otherwise maintained so that n o water from the Perkins ditch will leak or be drained into sai d drain ; the small drain ditch under the Perkins ditch is also a n exception to this provision, but it shall also be maintained so as not to obtain any water from said Perkins ditch, and further, i f additional drainage in such area is developed by B $ W, sai d small drain shall not he enlarged at such close distance bu t shall be replaced at least as far away from said Perkins ditc h as the required minimum distance .

17. B F, W agree to accept and approve adjustments of reservoi r water appurtenant to lands under the District's water right certificate No . 12310, which includes B f W lands within the Botto m

Lands Division of the District, so long as such adjustments do no t exceed the 7,326 acres presently assessed by the District . The

District may also make such other adjustments as may be approved by election or otherwise lawfully made .

18. It is agreed that the District shall continue to contro l the distribution, drainage, redistribution and reuse of all water s of Powder River appurtenant to land within the District, durin g the period of each year when reservoir water is being used, th e same as if all such waters were reservoir water . The provision s of this paragraph are a general requirement which will be uniforml y applied throughout the District .

20 . The execution of this contract does not obligate th e

District to exchange any more water than that covered by thi s

agreement with B A W, nor to provide B A W any more water in the

future, and B A W are not obligated to participate in any water s

hereafter developed by District unless they so desire .

21. It is further understood and agreed that this contrac t

is indivisible and that if any part, term or provision of thi s

contract shall be finally held by the courts to be invalid the n

the entire contract shall be null and void and the rights an d

obligations of the parties thereunder immediately terminated an d

all parties restored to their former position .

22. This settlement agreement is executed by Allan H .

Banta, Ted W . Willoughby and Harold Banta, both individually and on behalf of the partnership of Banta A, Willoughby, and als o

by Roberta Banta, the wife of Allan Banta, It is approved by

and joined in by Floy M . Banta, the wife of Harold Banta, an d

by Joan Willoughby, the wife of Ted W . Willoughby, to the extent of any interest they may have in the matters involved herein . I t

This investigation was brought about by apparent discrepancie s in certificate 4575 when Mr . Nesden Foye filed a transfer application . N6 . T-2905 for change in use of water on October 19, 1973 .

Proof No .225 claimed the irrigation of :

4 .0 acres in the NEk NE I.; 2 .0 acres in the SWk NE k 4 .0 acres in the SEk NE k Section 2 5

from Warm Creek with a date of priority of 1869 through Wright Ditches .

ProofNo .227 claimed the irrigation of :

from Big Creek with a date of priority of 1871 through the Clarks-Wrigh t Ditch .

ProofNo .229 claimed the uses of power, bathing, hotel, and the irrigation of :

from Hot Springs with a date of priority of 1869 through ditches and pipes . The power consisted of utilizing 80 feet of fall through a 4-inch pipe wit h 0 .25 cubic foot per second of water .

Warm Creek appears to be shown on the adjudication map as Ho t Springs Creek and on the U . S . G . S . quad as Bazine Creek .

During a field inspection on February 13, 1971, Mr . Foye in- dicated that he thought this 10 .0 acres under Proof No . 225 was west o f Warm Creek . The adjudication map does locate this area . See Finding LV , Volume 5, page 238 for stipulation between J . M. Goble, W . K. Goble and Dunham Wright and Certificate 4175 ,

The State Engineer's Findings entered November 17, 1915 provide d for the irrigation of 2 .0 acres and 0 .25 cubic foot per second of water for power with a date of priority of 1869 from Hot Springs but omitte d the bathing and hotel uses claimed . These'uses were not contested in th e proceeding nor were they otherwise disposed of in the Findings . Subsequently , the Decree entered March 18, 1918 not only omitted the hotel and bathin g uses but also omitted Hot Springs as the source .

Mr . Foye stated that the power use was abandoned in the lat e 1920's when the Pondosa Mill was started . This occurred due to a swap of ho t water from the Hot Springs for electricity from the mill .

The 2 .0 acres in the NE : SES and 16 .0 acres in the NA- SE ;:, Sectio n 25, claimed in Proof No . 231 is shove on the adjudication map in these 40 ' s . However, the State `_'nginece ' s it : .i : : :,; erroneously described the location a s 2 .0 acres in the NEI: NE : and1 .0 ee_es in the NW :; NE, Section 25 . Sub- sequently, this error was carried on in the Decree and certificate .

Mr . Foye's transfer No . T-2905 requested the change in use of wate r from the irrigation of 6 .0 acres in the SE- NE4, Section 25 and the powe r use from Warm Creek or East Prong Hot Spring Creek, with a date of priorit y of 1869, to use in a pool, store, guest house and domestic purposes .

Four of the six acres involved in the transfer appear to be fro m Warm Creek claimed in Proof No . 225 . The 2 .0 acres and power use then must, b e claimed under Proof No . 229 from Hot Springs but was erroneously described in the certificate . The 2 .0 acres in the S E Jr NE/ is in lawn and yard and is stil l being irrigated from the Hot Springs . The power use is long since gone .

The point of diversion, as shown on the map submitted with th e transfer as being 1620 feet south and 100 feet west from the NE corner o f Section 25 is clearly the location of the Hot Springs and not the East Pron g of Hot Springs Creek as designated . Therefore, the transfer application is , in effect, requesting a change in point of diversion from Warm Creek to Ho t Springs .

If the Findings, Decree and certificate had described the use o f water as claimed in Proof No . 229, the transfer application would not have been submitted . The transfer application should not have been filed because :

(a) The 4 .0 acres from Warm Creek could cause injury t o existing rights if changed to Hot Springs for othe r uses . may Page 3

(b) The power right has been abandoned .

(c) The remaining 2 .0 acres is and will continue to be . used for irrigation of lawn and garden“;rvm 1/0 Sir, 3 i

I instructed Dlr . Foye not to correct and return the transfe r application as directed in Wesley Carr's letter of January 9, 1974 bu t to wait further instructions .
