n Thursday, January 7, 2010, Sunnyside Ave and Bank Street formed the two kilometre Oroute from Carleton University to the Aberdeen Pavilion at Landsdowne Park for the ceremonial procession honouring slain Ottawa policeman, Const. Eric Czapnik. Thousands of Ottawa police officers, RCMP and military police, US and International police, Quebec police, paramedics, and local dignitaries marched along the streets, which were lined by hundreds of people, including students from Hopewell Avenue Public School, who held a large handwritten banner reading, “Thank you to Eric Czapnik and every police that keep us safe.” Czapnik was stabbed to death on Dec. 29 outside the Civic campus of the Ottawa Hospital, where he had been sitting in his cruiser taking notes. Czapnik, who had been with the Ottawa Police Service since 2007, is only the second Ottawa police officer to be killed while on duty in more than 25 years. Kevin Gregson, a suspended RCMP officer from Saskatchewan, has been charged with first-degree murder. Bronson Avenue was closed from Colonel By Drive (southbound) to Riverside Drive (northbound). Sunnyside Avenue was closed from Bronson Avenue to Bank Street. Bank Street was closed between Riverdale (northbound) and Fifth Avenue (southbound). Southbound traffic on Bronson Avenue was diverted onto Colonel By Drive, Hog’s Back Road and Brookfield Road, and then onto the Airport Parkway. ere are some amazing photos from Tom’s recent trip to Wakatobi, Indonesia. He spent 11 days there, doing three dives Hper day for 10 days, always with camera in hand. He finds that if for some reason he can’t have a functioning camera when he’s diving, he feels lost, empty, and unfulfilled. Fortunately all went well on this trip and he produced over 2000 photos. From that collection, he had serious problems selecting a “reasonable” number for display. But they are there on his photo web site, at: http://www.flickr.com/photos/ tta/. He selected a much smaller number for publishing in this issue of OSCAR.

Ha Tien was just a 10-minute ride away, and we had asked to be dropped off at the bus station. Our plan was to catch the next bus to the Mekong Delta town of Can Tho. At the Ha Tien bus station, the scam really got underway. The moto drivers brought us to a market area that we later realized was not the real bus station. There, a skinny guy with long, straggly hairs on his throat appeared. He had a glossy pamphlet displaying bus times, and told us there were no more buses from Ha Tien today. We would have to go to the next town instead—Ban Ho—to catch a bus. The scam my mom had read about involved a skinny guy with “a hairy neck” appearing at the bus station. The warnings about him could be summed up as, “If an English-speaking guy with a hairy neck shows up offering solutions that seem too good to be true, they probably are.” I kept whispering to my mom, “It looks like the hairy neck guy! This could be a scam!” but he was the second hairy-throated guy we’d seen that morning, and she didn’t want to jump to conclusions unfairly. We went on a long bike ride soon after arriving, along narrow paths that wind through the delta by the water. It was really fun. My bike was a little bit too big, and happened to have a very wobbly steering wheel, and I crashed a lot. The first time, I bonked straight into a cement wall. Several times, I fell onto grass and debris, and I almost fell into the river once or twice, and stuff like that. Once, I almost hit a stray dog. Another time, I hit my mom’s back tire. That’s all very swell and all, but the worst time was when I almost hit an old lady who was planting flowers. I didn’t hit her, but I swerved, and then a second later, I fell off the path and squashed some plants. This, of course, was no more a bus station than the one at Ha Tien had been. But after 15 minutes of waiting, a grubby, overcrowded local bus pulled up—not actually even a real bus, just a battered minibus which, in my opinion, is a lot worse than a normal bus because it’s always much bumpier and noisier. Anyway, someone came out and told us the bus fare, asking for five times the regular price. My parents, who were both really angry by this time, argued it down to double. As we were boarding the bus, we realized we’d been tricked yet again—the bus wasn’t even going to Can Tho, but to a different town in the delta from which we would have to change to a second bus, making it a much longer trip. Visiting The Cu Chi Tunnels Near Saigon

hen we were in Saigon, we visited the Cu Chi tunnels. The tunnels are leftover from the Vietnam War, and are a couple hundred Wkilometres long. They were made by the Viet Cong. During the war, people slept in them even though there were bats inside, and that’s how they lived during the war. The tunnels helped them win, because they could disappear underground when the other side was trying to attack them. Nowadays you can visit the tunnels for a tour if you want, and crawl inside them. The first tunnel we went down was extremely small and dark. Some of the adults were panicking, but my sister and I were as cool as cucumbers. We showed them the way out with the light from our cell phone because they thought it was too dark. The second tunnel we tried had been widened a bit for tourists and was a little brighter, but also much longer. I think it would have been really hard to live in those tunnels. The bus ride to get to Cu Chi from Saigon was really long, but visiting the tunnels was really cool.

hat do the US Army and the sale of real estate have in common? They both have a “don’t ask, don’t tell” policy. In the real estate Wworld it is called “caveat emptor” or buyer beware. The law in this area is that except for hidden defects that make the property dangerous or unfit to live in, sellers do not have to disclose hidden defects in a property that is for sale. There is no duty to disclose defects that only affect the value of the property. There is an obligation to disclose deficiencies discovered after the Agreement is signed but before closing. However, Vendors are not liable if they have no knowledge of the latent defect. If vendors make any kind representation at all, they can be held liable if it is later discovered there is a problem with the property. As well, any attempts to hide existing problems will also lead to legal liability for the vendor. The Ontario Real Estate Association created a form to attempt to deal with this situation. It is called the Seller Property Information Statement. It asks Vendors to provide information about the property that is being sold. If the information is accurate and complete it can be helpful to a purchaser. The form also states that “The Broker/Sales Representative shall not be held responsible for the accuracy of any information contained herein” and “Note: sellers are responsible for the accuracy of all answers”. The questions on the form are vague and may be difficult to answer without specialized knowledge, even for the vendor. This can lead to more problems for the vendor and the real estate agent, including law suits arising out of the answers provided. Several cases have made their way through the Guidance, Protection courts where purchasers have sued vendors and/or real estate agents for the information provided on the form. In Ward v. t is 8am, and the narrow cobblestone roads of Ollantaytambo are filled with cars, buses, Imoto-taxis and pedestrians. This town, situated northwest of Cusco and in the Sacred Valley, is a common thoroughfare for tourists on their way to Machu Picchu. This morning, I am in the main square (Plaza de Armas, see picture below) silently watching the movement around me. I’ve been in this town for three days, and I feel like I could stay forever.
