RE: Section 14 – number of persons appointed to NDCA General Board

Dear Minister Yurek,

Reference is made to the following part of Section 14 of the Conservation Authorities Act (CA Act): Agreement on number of members (2.1) Despite subsections (1), (2) and (5), the total number of members of the authority and the number of members that each participating municipality may appoint may be determined by an agreement that is confirmed by resolutions passed by the councils of all of the participating municipalities. 2001, c. 9, Sched. K, s. 1 (6).

I am writing on behalf of the General Board of the Nickel District Conservation Authority (o/a Conservation Sudbury) to provide background information related to the current number of Members appointed by the council of the City of .

Based on the number derived from the schedule listed in Subsection 2(2) of the CA Act, the City of Greater Sudbury (CGS) may appoint four representatives. The number of Members that the CGS currently appoints is nine. It is important to know that in 2001, the City of Greater Sudbury came into being as a result of amalgamation of the former City of Sudbury and four neighbouring Towns. At that time there were seven appointed Members at the Authority based on the above-mentioned schedule: three from Sudbury and one each from Nickel Centre, Rayside-Balfour, Valley East and Walden.

Although there is no formal agreement in place, several documents that inform us as to how the current practice came into being are appended. The first is a brief Request for Decision dated December 2, 2010 (Appendix A). This report recommended that the NDCA General Board be expanded from seven members to nine, and that one of the citizens be a youth. The second document (Appendix B) is CGS Resolution 2010-459 that implemented the change referred to in the aforementioned report. Lastly, the minutes of the CGS Appointment Committee of January 27, 2015. Resolution NC2015-05 removed the requirement that one of the citizen appointees would be a youth (Appendix C).

With respect to the 70% municipal council representation requirement also noted in Section 14, Conservation Sudbury’s General Board will be assisting the Council of the City of Greater Sudbury in resolving this matter. As indicated in my letter of March 26, 2021, we are committed to presenting you with a reasonable councillor/citizen ratio that would be in place prior to the October 2022 municipal election so that the ensuing round of appointments to the authority’s board would be in compliance with the revised CA Act.

In closing, please know that all changes to the Act proclaimed into law that will require amendment(s) to the Authority’s Administrative by-law will be approved by the General Board at a future public meeting.
