Decision

The Panel approved the Minutes of Meeting of the Planning Panel held on 5 June 1997 as a correct record of the proceedings.

PP106 APPLICATION U/94/1107/OUT - PROPOSED RESIDENTIAL DEVELOPMENT IN OUTLINE (APPROXIMATELY 30 SHELTERED UNITS, 13 AMENITY/MAINSTREAM UNITS, AND 313 OTHER DWELLINGS) WITH ASSOCIATED OPEN SPACE, PLAY AND RECREATIONAL FACILITIES, 5,000 SQUARE FEET RETAIL UNIT, (ROADS AND INFRASTRUCTURE IN DETAIL) (AMENDED SUBMISSION) AT WESTHAUGH FARM, CORNTON ROAD, STIRLING

r/decision/environment/pp26697 At its meeting on 5 June 1997, the Panel had agreed to defer consideration of the application pending the holding of a Development Plan Departure Hearing to consider representations from the public. The hearing had taken place on 23 June 1997. The Minute of the hearing had been circulated to Members. The Head of Planning and Environmental Strategy made reference to the Minute and gave an account of the hearing. He also advised that since the hearing had been held, a letter had been received from Cornton Community Council complaining that the hearing had not been widely advertised and suggesting that the development should be on a brown field site. Another Cornton resident had objected in similar terms.

Some concern was expressed regarding the phasing of benefits which were expected to arise from the development. These included social housing, a play area, and refurbishment of the local primary school. It was suggested that the Council should ensure that the benefits should be available at the beginning of the development and should not appear very late in the process. Confirmation was also sought as to the nature of the decision to be taken at the meeting. Mr Jeffries, Planning Officer, explained that the social housing aspect of development was dependent on discussions with Scottish Homes. The phasing of other aspects of the development would be dealt with in the Section 50 Agreement. It was pointed out that the proposed outline terms of the Section 50 Agreement contained in Appendix 3 to the submitted report indicated the proposed timescale for funds to be transferred to the Council. The recommendation in the submitted report was not that final approval be given. This would require to await the approval of the Secretary of State and the conclusion of the Section 50 Agreement. In response to the question, the Head of Planning and Environmental Strategy confirmed that part of the development site was in land indicated as a Green Belt in the Finalised Draft Local Plan.

Decision

The Committee agreed:-

(1) to indicate that the Council would be minded to approve the applications subject to the conditions in Appendices 1 and 2 to the Report and to the conclusion of an agreement under Section 75 of the Town and Country Planning () Act 1997 in the terms shown in Appendix 3 to Report; and

(2) that the Application be referred to the Secretary of State for Scotland as the Council had a financial interest in site and was a departure from the approved Development Plan (Stirling Area Local Plan).

PP107 APPLICATION S/97/0136/DET - DETAILED PLANNING APPLICATION FOR ERECTION OF A SINGLE STOREY DWELLINGHOUSE WITHIN A VACANT HOUSE PLOT AT PLOT 8, OF GLENFINGLAS ROAD, BRIG O’TURK - MR J PULLAR, C/O AN TIGH MOR TROSSACHS, LOCH ACHRAY

At its meeting on 5 June 1997, the Panel had agreed to defer consideration of the application pending the showing of a video of the site and its context. The video was shown to Members. Concern was expressed that the development would create a block impression viewable from the Dukes Pass and that this might accentuate the problem of the existing adjacent property known as Runrig. It was questioned whether the design of the proposed house would be in the vernacular. It was suggested that it might be possible to move the house within the site to a less intrusive position.

r/decision/environment/pp26697 Mr Skinner, Planning Officer, indicated that the design for the proposed house was very much preferable to the adjacent property. He also pointed out that there was an existing consent for housing on the site which had dated back to the time of Perth and Kinross County Council. He accepted that it would be possible to look at the positioning of the house in the site. It was suggested that the Report be withdrawn meantime to allow for discussions with the applicant as to siting of the house within the site.

Decision

The Panel agreed to allow the Director of Environmental Services to withdraw the Report for the purpose of discussion with the applicant as to the siting of the proposed house.

PP108 PROPOSED RESIDENTIAL DEVELOPMENT, BUSINESS PARK AND RECREATIONAL PURPOSES (RENEWAL OF OUTLINE PLANNING CONSENT REF N/91/1261) AT BARBUSH QUARRY, - ANDREW FLEMING & SONS PER MONTGOMERY FORGAN ASSOCIATED, EDEN PARK HOUSE, CUPAR, FIFE

Outline Planning Consent for the development had been granted by the Secretary of State following the conjoined Public Inquiry in Dunblane in 1991/2. That Consent had expired in October 1996. The Consent had been subject to the conclusion of a Master Plan. The Master Plan had yet to be concluded. It was recommended that the application be approved subject to conditions which had been expanded to take account of new circumstances, in particular, the sensitivity of Dunblane Cemetery which lay within the site.

Decision

The Panel agreed:-

(1) to approve the renewal of Planning Permission subject to the conditions outlined in Appendix 2 to the submitted report;

(2) to undertake procedures relating to a departure from the Development Plan and notification of development which the Council has an interest as indicated in the Appendix to Report; and

(3) the application be referred to the Secretary of State under the Town and Country Planning (Development Contrary to Development Plans) (Scotland) Direction 1996 and the Town and Country Planning (Notification of Application) (Scotland) Direction 1995 prior to any decision notice being issued.

The Chair adjourned the meeting the meeting at 11.20 am to allow for discussions with a number of members of the public who had appeared at the meeting in relation to the next item on the Agenda.

The meeting recommenced at 11.30 am with the same Members present with the exception of Councillor Hendry.

ARCHITECTS

The Chair advised that during the short adjournment he had taken the opportunity to speak with members of the public who had attended the meeting in relation to this item. He emphasised that it was not appropriate for people objecting to the application to turn up at the Panel at which the application was being considered and expect to be heard. There were channels for making objections and these should be used. He indicated that having heard members of the public he was minded to defer consideration of the application to the next meeting to allow a public meeting to take place.

Decision

The panel agreed to defer consideration of the application to the following meeting.

PP111 APPLICATION 2/97/0291/DET - DETAILED PLANNING APPLICATION FOR THE CHANGE OF USE OF LAND TO FORM WATER SKI CLUB, BUILDING AND FACILITY (RELOCATION OF EXISTING OPERATION) AT WEST SHORE, LOCH ACHRAY, TROSSACHS - TROSSACHS WATER SKI CLUB PER DAVID CONWAY, 11 CLAREDON PLACE, STIRLING

The application related to a site on the side of Loch Achray immediately adjacent to the previous site occupied by the applicants for their shore based facilities. The lease on the previous site had expired and the applicants were seeking to relocate onto the adjacent land. John Skinner, Planning Officer, referred to Appendix 2 to the submitted Report which considered the draft Local Plan Policy Framework for Sport on Lochs. He pointed out that the Loch in question fell within those categorised as having limited potential for additional use and facilities.

It was suggested that water skiing was not appropriate for this area and that it would lower the amenity value of the Loch. Preference should be for quieter activities. The application was contrary to policies C4, E9 and E10. The Panel should bear in mind that the Loch was within a national scenic area.

Other Members pointed out that the application did not involve any increased use of the Loch. This was an application from an established club which had community support.

Decision

The Panel agreed to approve the application subject to the conditions attached to the submitted Report.
