The Worshipful the Mayor informed Members of two events to be held in support of her charities. They were a concert "Fanfare & Serenade" on 25th March, 2000 and a Barn Dance at Stockbridge on 8th April, 2000.

467.1 Policy and Resources Committee - 12th January, 2000

467.1.1 Resolved:

That the Minutes be received.

467.1.2 Minute 374 - The LSVT Budget for Transaction Costs

Resolved:

(1) That a budget for LSVT transaction costs of £3,884,000 be approved.

(2) That Section 25 consent be obtained from the Department of the Environment Transport and the Regions to advance this sum to Testway Housing.

(In accordance with Standing Order 19 Councillors Marsh, Mrs. Menzies and Smith declared a non-pecuniary interest.) (Councillor N. Whiteley was not present at the meeting during consideration of this item.)

467.4.2 Minute 404 - Communicable Diseases: Testing of Surgical Staff

Resolved:

(1) That the Department of Health and the NHS Executive be requested to review the practicability and safety of the current health screening of medical staff for communicable diseases.

(2) That the Government be requested to increase its spending on research on Hepatitis C, in line with other research programmes. That it investigates fully needle stick injuries and the implementation of safety products, such as Needle-Pro and Zero- Stik syringes or other equivalent British products, to ensure greater protection of NHS staff and patients.

(3) When the Secretary of State for Health is in possession of the hepatitis C, UK "Look Back" investigation report, appropriate measures are introduced to improve health & Safety procedures, to protect patients and staff, within the health service.

467.6.2 Minute 425.1.3 - Safeguarding and Developing External IT Communications

Resolved:

That the installation of equipment and services described in the report be approved for the provision of Internet access services to officers, Members and the public and that the start up costs of the service of £20,000 and the annual running costs of £28,500 be included in the Council’s 2000/2001 estimates.

467.6.3 Minute 426.1.1 - Housing Investment Programme 2000/01

Resolved:

That the programmes set out in the schedule to the report, be approved

467.6.4 Minute 426.2.2 - Housing Investment Programme 2000/01

467.6.5 Minute 426.3.1 - Assistant Tourism Officer

Resolved:

That £15,920 be included in the 2000/2001 revenue budget for the creation of a new assistant tourism officer to meet the demands of the increased work arising from tourism.

467.6.6 Minute 426.3.3 - Valley Leisure Limited: Grant 2000/2001

Resolved:

That a grant to Valley Leisure Limited for 2000/2001 in the sum of £475,000 be approved and that a contribution in the sum of £22,680 be made to the Public Building Repair Fund.

467.6.7 Minute 427 - General Fund Revenue Account 2000/01

Resolved:

(1) That the estimates and transfers of funds contained in the report be approved and that a special precept in respect of the unparished areas of Andover of £210,023 and a general precept of £3,258,487 for the year 2000/2001 be levied.

(2) That the charge for meals on wheels be increased to £1.35 per meal with effect from 10th April 2000.

467.6.8 Minute 428 - Capital Programmes 2000/01

Resolved:

That the General Fund Capital Programme (at Annex A to E) of Appendix 1 and the Housing Investment Programme (at Annex F) of Appendix 1 to the minutes of Policy and Resources Committee, be approved.

467.6.9 Minute 429 - Treasury Policy Statement

Resolved:

(1) That the half yearly Treasury Policy Statement be noted.

(2) That the Head of Finance be authorised to exercise borrowing powers contained in the Local Government and Housing Act 1989 during the financial year ending 31st March 2001:-

For such amounts as are required to meet the Capital requirements approved by the Council within the limits of borrowing approvals granted for the Council by the Secretary of State for the Environment; for periods not exceeding the maximum prescribed in the currently applicable circulars; and

for such amounts as may be required for defraying expenditure to be met from estimates or for Capital finance pending receipt of such sums due to the General Fund for the same period.

(3) That the following borrowing limits be set for 2000/2001:

That a total borrowing limit of £40M be set for 2000/2001.

That a short term borrowing limit of £20M be set for 2000/2001.

That a maximum limit of 50% be set on the proportion of loans for which the interest rate payable can be varied by the lender or by external factors in 2000/2001.

(4) That the Head of Finance be authorised to enter into leasing arrangements on behalf of the Authority for items approved for the year ended 31st March 2001.

467.6.10 Minute 430 - Public Buildings Repair Fund Estimate 2000/01

Resolved:

That the programme of repairs as set out be in Appendix 2 to the minutes, be approved and financed from the Public Building Repair Fund.

467.6.11 Minute 434 - New Political Management Arrangements

Resolved:

(1) That, in preparation for the enactment of the Local Government Bill, officers make provision to consult the public to identify their preferred choice of model for new political management arrangements from the options set out under the Bill;

(2) That, in the period before the new political management arrangements come into effect under the Act, interim arrangements be put in place to provide Members and officers with experience of working within a new executive decision making structure and that it be implemented in 2 phases as follows;

2.1 That the Leader and Cabinet model be implemented for a trial period in accordance with existing legislation.

2.2 That ten Members, cross party, comprised of 7 Conservatives and 3 Liberal Democrats, be appointed to the "Executive".

2.3 That the "Executive" as a whole have responsibility for the executive functions and that it meets in public.

2.4 That some Members of the "Executive" have a Policy Portfolio under cross cutting headings such as: Economic, Social, Environmental and Resources.

2.5 That one overall Policy and Scrutiny Committee, politically proportionate, under which Policy Panels will be formed to assist with the formulation of policies, be appointed; that the Panels broadly correspond to the portfolios in the "Executive" and be politically proportionate with every non-executive Member having one seat on one Panel and that terms of reference be drawn up to set out details of operation.

2.6 That a non-"Executive" member be appointed by Council to chair the Policy and Scrutiny Committee.

2.7 That a minimum of 5 working days elapse before any decision of the "Executive" becomes effective and that during this period the Policy and Scrutiny Committee have the opportunity to ‘call-in’ the decision for scrutiny; the detail of the rules for ‘call-in’ to be established.

2.8 That Community Forums with advisory powers only be established to ensure a close link between the Member and their constituents and to develop the strategy of well- being outlined in Part I of the Bill.

2.9 That a Standards Committee be established comprising two non-executive Members of Council and a Chairman drawn from outside the Council.

2.10 That, subject to regulations on this matter, two Development Control committees deal with all planning matters.

2.11 That consultation arrangements be finalised when further information is available.

2.12 That the Members Allowances Working Party be called to review Members’ allowances.

2.13 That the following phased approach for the introduction of the interim political arrangements be approved:

Phase 1

2.13.1 That, with effect from 17th May 2000, the membership of the Policy and Resources Committee be reduced to 10 and all the powers, duties and delegated powers that vested in the current Policy and Resources Committee be retained by the new Policy and Resources Committee.

2.13.2 That, for the purposes of Part 1 of the Local Government and Housing Act 1989, 3 seats be allocated to the Liberal Democrat Group.

2.13.3 That the appointment of Members to the Policy and Resources Committee be considered at the Annual Council Meeting on 17th May, 2000.

2.13.4 That the Corporate Scrutiny Panel, appointed by the Chief Executive, and the Chairmen’s Panel be replaced by a Policy and Resources Panel; the membership of the Panel to be the Members of the Policy and Resources Committee and terms of Reference for the Policy and Resources Panel to be agreed.

Phase 2

2.13.5 That, by the beginning of September 2000 and subject to a further report to Council on the detail of the implementation, all existing committees and sub- committees, with the exception of the Policy and Resources Committee, cease to exist and all powers, duties and delegated powers previously vested in them vest in the Policy and Resources Committee. That the Policy and Resources Committee be renamed at this stage. The Policy and Scrutiny Committee and Panels, Standards Committee and other Committees, including those set out in Appendix 2 of the report, also be established.

2.14 That the timescale for implementation in Appendix 3, be approved.

(3) That, having gained some experience of working within a new executive structure under the interim model, a Proposal be drawn up detailing how the public’s preferred model will operate and that, subject to consultation, the Proposal be sent to the Secretary of State in accordance with the legislation prior to full implementation.

Resolved:

467.6.13 Minute 437 - Appointment of Representative - Shepherds Spring Infant School

Resolved:

That Mrs. Y. Jones be nominated to represent the Council on the Governing Body of Shepherds Spring Infant School.

467.6.14 Minute 438 - Disability Discrimination Act

Resolved:

That the report be noted.

468 To adopt a resolution relating to the Council Tax for 2000/2001

Resolved:

(1) That having approved the revised revenue estimates for the year 1999/2000 and the revenue estimates for the year 2000/2001 together with the revised capital programme for the year 1999/2000 and the capital programme for the year 2000/2001.

(2) That for the purposes of Section 35(2)(d) of the Local Government Finance Act 1992 the sum of £210,023 being part of the aggregate sum of expenses in relation to allotments, burial ground, sports grounds and playgrounds incurred by the Council in performing in the unparished area of Andover functions performed elsewhere in the area by a Council, or The Chairman of a , shall be treated as Special Expenses and, any expenditure other than the £210,023 herein specified shall be treated as general expenses.

3) That it be noted that at its meeting on the 5th January 2000 the Council calculated the following for the year 2000/2001 as its tax base in accordance with regulations made under Section 33(5) of the Local Government Finance Act 1992: -

3(a) 42,796.00 being calculated by the Council, in accordance with regulation 3 of the Local Authorities (Calculation of Council Tax Base) Regulations 1992 as amended by the Local Authorities (Calculation of Council Tax Base)(Amendment)() Regulations 1999, as its council tax base for the year.

Being calculated by the Council, in accordance with regulation 6 of the regulations, as its council tax base for the year for dwellings in those parts of its area to which one or more special items may relate.

4. That the following amounts be now calculated by the Council for the year 2000/2001 in accordance with Sections 32 to 36 of the Local Government Finance Act 1992: -

4(a) £42,879,727 being the aggregate of the amounts, which the Council estimates for the items, set out in Section 32(2)(a) to (e) of the Act.

4(b) £33,183,714 being the aggregate of the amounts, which the Council estimates for the items, set out in Section 32(3)(a) to (c) of the Act

4(c) £ 9,696,013 being the amount by which the aggregate at 4(a) above exceeds the aggregate at 4(b) above, calculated by the Council, in accordance with Section 32(4) of the Act, as its budget requirement for the year

4(d) £ 5,646,490 being the aggregate of the sums which the Council estimates will be payable for the year into its general fund in respect of redistributed non-domestic rates and revenue support grant, increased by the amount which the Council estimates will be transferred in the year from its collection fund to its general fund in accordance with Section 97(3) of the Local Government Finance Act 1988 and increased by the amount of the sums which the Council estimates will be transferred from its collection fund to its general fund pursuant to the Collection Fund (Community Charges) England Directions 1994 under section 98(5) of the Local Government Finance Act 1988 made on the 7th February 1994.

4(e) £94.62 being the amount at 4(c) above less the amount at 4(d) above, all divided by the amount at 3(a) above, calculated by the Council, in accordance with Section 33(1) of the Act, as the basic amount of its council tax for the year

4(f) £791,036 being the aggregate amount of all special items referred to in Section 34(1) of the Act.

4(g) £76.14 being the amount at 4(e) above less the result given by dividing the amount at 4(f) above by the amount at 3(a) above, calculated by the Council, in accordance with Section 34(2) of the Act, as the basic amount of its council tax for the year for dwellings in those parts of its area to which no special item relates

Being the amounts given by multiplying the amounts at 4(h) above by the number which, in the proportion set out in Section 5(1) of the Act, is applicable to dwellings listed in a particular valuation band divided by the number which in that proportion is applicable to dwellings listed in valuation band D, calculated by the Council, in accordance with Section 36(1) of the Act, as the amounts to be taken into account for the year in respect of categories of dwellings listed in different valuation bands.

5(a) That it be noted for the year 2000/2001 the County Council have stated the following amounts in precepts issued to the Council, in accordance with Section 40 of the Local Government Finance Act 1992, for each of the categories of dwellings shown below: -

469 Large Scale Voluntary Transfer

Resolved:

That, having received and considered the Director of Service’s report, on the proposed Transfer of Housing Stock to Testway Housing Limited

(1) the transaction contemplated by the Agreement for Transfer of Housing Stock, to be made between Testway Housing Limited and Test Valley Borough Council, be approved (subject to agreement of its final terms in accordance with 2) below);

(2) the Director of Services and the Head of Legal Services, in consultation with members of the LSVT Panel, be authorised to do or procure to be done any act matter or thing in any way relating to or in connection with the said transfer in order to give effect thereto, including negotiation and agreement of the final terms of all documentation;

(3) the execution (whether by application of the Council’s Seal (to Deeds) or otherwise), delivery and performance of the Agreement for Transfer of Housing Stock (including all ancillary agreements detailed in the Schedules thereto) to be made between Testway Housing Limited and Test Valley Borough Council in the form agreed pursuant to 2) above, and any other agreement, document transfer and deed to be entered into thereunder or in connection therewith (including the Deeds of Warranty scheduled to the Agreement for Transfer of Housing Stock which are to be granted to Testway Housing Limited and to its funders) be authorised; and

(4) the Head of Legal Services or the Directors of Resources or Services or the Chief Executive be authorised to sign such documents and attest the application of the Council’s seal pursuant to this resolution.

(5) Policy and Resources Committee be authorised to approve the set-up costs of Testway Housing Limited.

(In accordance with Standing Order 19, Councillors Marsh, Mrs. Menzies, Smith and Whiteley declared a non-pecuniary interest.)

470 Notice of Motion

In accordance with Standing Order No 5(4) the following Motion, proposed by Councillor Mrs. Leach and seconded by Councillor Palmer stood referred to the Leisure Committee for consideration and report:-

“That the Council request Valley Leisure Limited to review and adjust its charges to users of the Romsey Rapids facility, the Council’s particular concern being that all adults receiving state benefits including Income Support should qualify for reduced (concessionary) entrance fees.”
