Jindal Global University (JGU). He also serves as founding Co-Director of Jindal Initiative on Research in Intellectual Property & Competition (JIRICO). His research is on the role of technology and innovation in shaping societies, technical standards/SSOs and patent licensing, national IPR policies as well as STI policies, especially in developing and emerging economies. He teaches courses in economics, economic analysis of law; innovation and society and technology policy. He is an affiliated faculty at the Center for IP Research, Maurer School of Law, Indiana University (Bloomington), USA, and a visiting associate professor at the Institute for Innovation Research, Hitotsubashi University in Tokyo, Japan. He has been a Research Fellow at the Max Planck Institute for Innovation and Competition (Munich), Germany. He is a recipient of the Max Planck Society fellowship, and Erasmus Mundus scholarship awarded by the European Commission. He holds a Ph.D. from the Max Planck Institute for Innovation and Competition in Munich (LMU/University of Munich, Germany); LL.M. (European Master in Law and Economics) from Erasmus University Rotterdam, University of Hamburg and University of Manchester; M.Sc. in Economics from Madras School of Economics, College of Engineering, Anna University; and B.A. Honors in Economics from Delhi University. Vishwas H. Devaiah is Associate Professor at the JGLS, Executive Director of the Centre for Intellectual Property and Technology Law (CIPTEL), and Co-Director of JIRICO where he has led research and capacity building of JIRICO. He also serves as the Managing Editor of JGLS’s flagship journal, Jindal Global Law Review, which is published by Springer. His primary areas of interest are patent law, health law and biotechnology law.     LINA M. KHAN Amazon’s Antitrust Paradox abstract. Amazon is the titan of twenty-first century commerce. In addition to being a re- tailer, it is now a marketing platform, a delivery and logistics network, a payment service, a credit lender, an auction house, a major book publisher, a producer of television and films, a fashion designer, a hardware manufacturer, and a leading host of cloud server space. Although Amazon has clocked staggering growth, it generates meager profits, choosing to price below-cost and ex- pand widely instead. Through this strategy, the company has positioned itself at the center of e- commerce and now serves as essential infrastructure for a host of other businesses that depend upon it. Elements of the firm’s structure and conduct pose anticompetitive concerns—yet it has escaped antitrust scrutiny. This Note argues that the current framework in antitrust—specifically its pegging competi- tion to “consumer welfare,” defined as short-term price effects—is unequipped to capture the ar- chitecture of market power in the modern economy. We cannot cognize the potential harms to competition posed by Amazon’s dominance if we measure competition primarily through price and output. Specifically, current doctrine underappreciates the risk of predatory pricing and how integration across distinct business lines may prove anticompetitive. These concerns are height- ened in the context of online platforms for two reasons. First, the economics of platform markets create incentives for a company to pursue growth over profits, a strategy that investors have re- warded. Under these conditions, predatory pricing becomes highly rational—even as existing doctrine treats it as irrational and therefore implausible.

Wong-Ervin* Federal Trade Commission Investigations and litigation involving standard-essential patents (SEPs) have begun to spring up around the globe. On April 29, 2014, the European Commission (EC) confirmed that it adopted two decisions, one involving Samsung Electronics Co., Ltd. and the other involving Motorola Mobility Inc. (MMI), that for the first time in the European Union (EU), establish a framework for determining whether and under what circumstances patent owners seeking to enforce SEPs in the European Economic Area (EEA) may violate EU antitrust laws. Both decisions create a “safe harbor” approach from injunctive relief, under which implementers can demonstrate that they are a “willing licensee” by agreeing that a court or a mutually agreed arbitrator shall adjudicate the fair, reasonable and non-discriminatory (FRAND) terms in the event that negotiations fail. The decisions do not preclude injunctive relief for FRAND-encumbered SEPs per se, nor do they make findings on the definition of a “willing licensee” outside the safe harbor.1 While the EC’s approach is similar to the approach taken by the U.S. Federal Trade Commission (FTC) in MMI/Google, there are differences. For example, the EC’s decisions preclude injunctions only in the EEA, and only on patents granted in the EEA, whereas the FTC’s consent decree in MMI/Google covers patents issued or pending in the United States or anywhere else in the world. The pay-off method is an easy to use and understand analysis method that is based on using value scenarios and real options-thinking. The method is designed for the analysis of assets that suffer from difficulties in estimation precision and often face high uncertainty. This paper shows how patent valuation can be enhanced with the help of the pay-off method, based on any of the three ‘conventional’ patent valuation methods. A numerical case about how the pay-off method can be used together with the discounted cash flow method is presented. The method is already in use by a number of multi- national companies for valuation of R&D and is on its way to be introduced into the IPR functions of a number of corporations.
