Executive Summary

Reports on the Schools Budget Outturn position for 2013/14 and on School Balances and Clawback for 2013/14 were presented to all three of the Forum's Standing Working Groups.

This report summarises the recommendations arising from these considerations.

Decision Required

The Forum is asked to

a) Note the 2013/14 Schools Budget Outturn report and the 2013/14 School Balances and Clawback report; b) Ratify the Working Groups' recommendations: c) In light of the alternative proposals expressed at the three Working Groups, determine if the Chair of the Forum should the Secretary of State about in year allocations from the DSG reserve; d) Note that further analysis of school balances will be provided at a future meeting.

Background Reports on the Schools Budget Outturn position for 2013/14 and on School Balances and Clawback for 2013/14 were presented to the Early Years Block Working Group, High Needs Block Working Group and Schools Block Working Group in June 2014.

A copy of the Outturn report is attached at Appendix A and a copy of the Schools Balances report is attached at Appendix B.

The report at Appendix B incorporates updated figures on school clawback at 31 March 2014. It also includes in an Annex details of the movement in balances at an individual school level. The version of the individual school balances information now provided incorporates comments arising from Working Group considerations and incorporates data around: • balance as a % of budget adjusted for approved exemptions; • balance per pupil adjusted for approved exemptions.

The Schools Block Working Group had also requested that the school balances information to be included in the report to the Forum and Cabinet Member providing an indication of the accuracy of schools individual budget forecasts. However, when this data was calculated it produced results that were difficult to interpret and may have been misleading. This analysis has not therefore been included in the data provided to Forum. Further work will be undertaken around the accuracy of school budget forecasts and this will be provided at a future meeting.

In summary, the final financial outturn position for the Schools budget for 2013/14, excluding Individual Schools Budgets, had under spent by (£7.414m) as set out below: • centrally services budgets have under spent by (£2.303m), • commissioned services budgets have under spent by (£4.186m), • Early years PVI have under spent by (£0.764m) • de-delegated budgets have under spent by (£0.161m).

The overall under spend in schools delegated budgets is (£4.377m). This is the net total of surplus and deficit balances carried forward by individual schools. In essence this under spend means that School balances have increased by £4.377m.

Further details are provided in the appendices.

Recommendations arising from each of the Working Groups are provided below:

High Needs Block Working Group

In connection with the 2013/14 Schools Budget Outturn report, the Working Group:

a) Noted the report; b) Noted that although the Out County Budget had underspent in 2013/14, the budget had been kept at the same level for 2014/15 as it was likely to face considerable pressure during the year. This was because Lancashire special schools were running at capacity and the Forum's Invest to Save fund was no longer operational due to changes in the School and Early Years Finance (England) Regulations;

c) Noted that SERF unit funding for 2014/15 was held at the 2013/14 level would need to be reviewed this year once the new SEN Code of Practice was published. Further information would be provided to the Forum if additional resources were required; d) Supported the DSG reserve for 2014/15 being set at 1% of the 2014/15 DSG i.e. £8.4m; e) Supported the Chair of the Forum writing to the Secretary of State to seek permission to distribute on a one off basis some of the £10.964m of available funding held in the DSG reserve to ease the budget pressures facing schools and academies relating to the introduction of Government policy around the SEND reforms and universal infant free school meals; f) Supported the remaining funding being held in the DSG reserve over the £8.4m being distributed on a one off basis in 2015/16, in accordance with the decisions to be taken as part of the budget setting process; g) Supported strong guidance accompanying the distribution of any one off funding in 2015/16 to urge schools to use this funding for one-off expenditure, for example maintenance funding, and not to commit it to ongoing staffing costs or hold it in reserve.

In connection with the 2013/14 School Balances and Clawback report, the Working Group:

a) Noted the report and that the level of balances had increased by £4.377m; b) Noted that the number of schools in deficit had reduced in 2013/14, however the aggregate level of deficits had increased; c) Noted that the more stringent monitoring arrangements recently agreed by Forum and administered by the School Improvement Challenge Board (SICB) around schools in financial difficult were being implemented: d) Noted that the level of school balances did make requests for additional school funding at County Council level difficult to achieve; e) Noted that school balances nationally were attracting attention from the DfE; f) Requested that further analysis of school balances be undertaken, including • Balances as a % of budget; • Level of balance per pupil; • Correlation of schools facing clawback against those purchasing support from School Financial Services; g) Requested that revised School Balances data with % balance and balance per pupil data be re-circulated to the Group and made available to the other working groups for comment; h) Supported the application of clawback of £84,137 to 3 special schools; i) Supported Clawback from special schools being transferred into the DSG reserve and distributed to special schools through the formula in 2015/16, in accordance with proposals to be agreed by the Forum during the budget setting process for 2015/16; j) Noted that schools with balances over guideline attracted 50% clawback in year 1, but that this rose to 100% clawback of the figure above guideline in the second and subsequent years that schools were above guideline; k) Noted the high variance between schools forecasts and the actual outturn position and that requested that further analysis of this situation be undertaken, perhaps with those schools on or near their forecast removed; l) Requested the Chair of the Forum write to schools to emphasise the importance of constructing accurate budgets and monitoring these.

Early Years Block Working Group

In connection with the 2013/14 Schools Budget Outturn report, the Working Group:

a) Noted the report; b) Supported the DSG reserve for 2014/15 being set at 1% of the 2014/15 DSG i.e. £8.4m; c) Supported the Chair of the Forum writing to the Secretary of State to seek permission to distribute on a one off basis some of the £10.964m of available funding held in the DSG reserve to ease the budget pressures facing schools and academies relating to the introduction of Government policy around the SEND reforms and universal infant free school meals; d) Supported the remaining funding being held in the DSG reserve over the £8.4m being distributed on a one off basis in 2015/16, in accordance with the decisions to be taken as part of the budget setting process; e) Noted that no further details were available surrounding the Early Years Pupil Premium Grant were currently available, and that PPG funding was outside the DSG.

In connection with the 2013/14 School Balances and Clawback report, the Working Group:

a) Noted the report and that the level of balances had increased by £4.377m; b) Noted that school balances nationally were attracting attention from the DfE; c) Supported the application of clawback of £9,291 to 4 nursery schools; d) Supported Clawback from nursery schools being transferred into the DSG reserve and distributed to nursery schools through the formula in 2015/16, in accordance with proposals to be agreed by the Forum during the budget setting process for 2015/16; e) Noted the high variance between schools forecasts and the actual outturn position; f) Supported the Chair of the Forum writing to schools to emphasise the importance of constructing accurate budgets and monitoring these; g) Requested that the authority investigate the possibility of commissioning compulsory training for school finance and leadership staff, perhaps involving School Financial Services, on managing school budgets, which could be funded from clawback; h) Noted that this may best be achieved by offering training that was phase specific so that the challenges, circumstances and examples of good practice could be more relevant; i) Noted that this would require an amendment to the Scheme for Financing Schools in Lancashire.

Schools Block Working Group

In connection with the 2013/14 Schools Budget Outturn report, the Working Group:

a) Noted the report;

b) Supported the DSG reserve for 2014/15 being set at 1% of the 2014/15 DSG i.e. £8.4m; c) Expressed a view that it may be counter productive for the Chair of the Forum to writeg to the Secretary of State to seek permission to distribute on a one off basis some of the £10.964m of available funding held in the DSG reserve as: • This may draw attention to the level of school balances in Lancashire; • Any redistribution would require the establishment of additional mechanisms and administration; • Schools will already have set budget plans for the year and any late allocations may impact on forecasting; d) Supported the DSG reserve over the £8.4m being distributed on a one off basis in 2015/16, in accordance with the decisions to be taken as part of the budget setting process; e) Supported strong guidance accompanying the distribution of any one off funding in 2015/16 to urge schools to use this funding for one-off expenditure, for example maintenance funding, and not to commit it to ongoing staffing costs or hold it in reserve.

In connection with the 2013/14 School Balances and Clawback report, the Working Group:

a) Noted the report and that the level of balances had increased by £4.377m; b) Noted that school balances nationally were attracting attention from the DfE; c) Supported the application of clawback of £134,012 to 31 primary schools; d) Supported Clawback from primary schools being transferred into the DSG reserve and distributed to primary schools through the formula in 2015/16, in accordance with proposals to be agreed by the Forum during the budget setting process for 2015/16; e) Noted the high variance between schools forecasts and the actual outturn position; f) Supported the Chair of the Forum writing to schools to emphasise the importance of constructing accurate budgets and monitoring these; g) Requested that the authority investigate the possibility of commissioning compulsory training for school finance and leadership staff, including school governors, on managing school budgets, which could be funded from clawback; h) Suggested that the school balances information to be included in the report to the Forum and Cabinet Member in July include an indication of the accuracy of schools individual budget forecasts. For 2013/14 the report will be presented to the Early Years, Schools Block and High Needs Block Working Groups, and each report will draw out the key issues relevant to the remits of the different groups.

Recommendations

Early Years Block, High Needs Block and Schools Block

Members are asked to note the report and recommend to the Forum that the:

Schools Block

• overspend on PRC of £0.725m is transferred to the Schools in Financial Difficulty (SiFD) reserve;

Early Years Block, Schools Block and High Needs Block

• DSG reserve for 2014/15 is set at 1% of the 2014/15 DSG i.e. £8.4m;

• Chair of the Forum write to the Secretary of State to seek permission to distribute on a one off basis some of the £10.964m of available funding held in the DSG reserve to ease the budget pressures facing schools and academies relating to the introduction of Government policy around the SEND reforms and universal infant free school meals;

• remaining funding held in the DSG reserve over the £8.4m will be distributed on a one off basis in 2015/16 in accordance with the decisions taken as part of the budget setting process.

Background

Following the introduction of the National Funding Reforms a new Forum Working Group structure was introduced for 2013/14 aligned with the Dedicated Schools Grant funding blocks. The 2013/14 outturn will be presented to all of the Working Groups. Each working group will consider the elements of the outturn report that relate to their block and a combined report will be presented to the Forum in July. The working groups will consider the following:

• Early Years – Changes in contingency relating to Early Years growth; • High Needs Block – All remaining centrally retained budgets; • Schools Block – School balances, Schools in Financial Difficulty and Premature Retirement Costs (PRC).

As Forum Members are aware, the Schools and Early Years Finance (England) Regulations do not allow savings accrued in centrally retained budgets in the previous financial year to be distributed in the current financial year. These must be held in the DSG reserve and distributed in future years with the Forums agreement.

2013/14 outturn

In 2013/14 The Dedicated Schools Grant (DSG) (and associated grants from the Education Funding Agency (EFA)) funded expenditure that is defined in the regulations as forming the Schools Budget. The Schools Budget consists of delegated budgets allocated to and managed by individual schools (in total the Individual Schools Budget (ISB)), special schools, the free entitlement to education for 3 and 4 year olds and for the first time budgets for Pupil Referral Units (PRUs) and the 2 year old offer. In addition provision is also made for pupils who the Authority manages centrally, such as some high cost Special Educational Needs provision where pupils are placed out of county. In 2013/14 the DfE sub-divided the DSG into three un-ring fenced allocations:

• Early Years Block – funds 2, 3 and 4 year olds; • Schools Block – funds primary schools and secondary schools; • High Needs Block – funds PRUs and pupils with high needs at special schools, maintained primary and secondary schools and their academy equivalents, pupils in sixth form and Further Education colleges.

The Schools Budget was agreed by the Forum in January 2013. The EFA confirmed Lancashire's formula was compliant with the regulations in February 2013. Overall the schools budget has under spent by (£11.792m) as shown in the table below:

Central Services – Under spend (£2.303m) • Early Years Block - 2 year old offer under spend (2.2m) - The Forum have previously advised that the pump priming funding for the 2 year old offer would under spend in 2013/14 and it has been agreed that this can be carried forward to 2014/15. During the year the Secretary of State gave approval to Lancashire to convert up to £1.4m of this under spend to capital. This transfer will only be actioned as and when representatives from the Early Years Consultative Group approve capital projects to deliver the 2 year old offer;

• High Needs Block - Inclusion and Disability Support Service delivered a saving of (£0.8m) as a result of vacancies in the Special Educational Needs and Disabilities (SEND) Learner Support team;

These under spends have been offset by an over spend on Schools PRC of £0.7m resulting from restructuring schools in financial difficulty. It is proposed that this overspend will be charged against the SiFD reserve in 2014/15.

Commissioned Services – Under spend (£4.186m) • High Needs Block - The contingency of (£2.0m) provided for high needs top up funding was not required in the light of the savings identified below;

• High Needs Block - Inclusion and Disability Support Service delivered a saving of (£2.6m) resulting from lower than forecast growth in out-county placements (£2.5m) together with various small savings of (£0.1m) on other budget lines;

These under spends have been offset by an over spend on SERF unit funding of £0.4m to provide funding in 2013/14 at the same level as in 2012/13 as agreed by the Forum in July 2013;

Early Years PVI – Under spend (£0.764m) The overall under spend resulted from a lower than anticipated take up in the 3 & 4 year old offer.

De-delegated Budgets – Under Spend (£0.161m) The movement in de-delegated budgets are detailed in the table below. The under spend of £0.161m has been added to a new de-delegation reserve in accordance with the Schools and Early Years Finance (England) Regulations. This reserve will be used to offset the cost of any de-delegations agreed by the Forum for 2015/16.

1. Dedicated Schools Grant Central Items Reserve, £22.863m

For 2013/14 the Forum agreed a policy to set the DSG Reserve 1% of the DSG. This was equivalent to £8.4m in 2013/14. This reserve has seen a significant amount of movement during the 2013/14. At the request of the Forum (£1.4m) was transferred into the Invest to save reserve. £7.1m has been transferred into the reserve as a result of increased income and under spends in centrally managed budgets as discussed above, £3.7m was transferred back into the DSG reserve from closed reserves. Other

adjustments show a net movement of (£1.0m) out of the reserve. This is made up of allocations previously agreed by the Forum for:

• SERF units £0.6m; • ACERS £0.3m; • social workers in schools £0.1m; • a deficit that we have been unable to recover from an academy £0.1m; • savings in the ISB relating to a closing a school and interest on balances amounting to (£0.1m).

The Forum has also set aside £0.6m of this reserve to be used to support the development of a prioritised programme of carbon and energy reduction measures for Lancashire schools via the provision of interest free loans.

£1.8m on this reserve has been allocated across all phases as part of the budget setting process for 2014/15.

In 2014/15 the total DSG settlement received by the authority amounted to £841.9m. It is proposed to set the DSG reserve for 2014/15 at 1% of the 2014/15 DSG, i.e. £8.4m.

2. Schools in Financial Difficulty Reserve, £4.203m

In March 2014, the Forum agreed to transfer £3.0m into the schools in financial difficulty reserve in order mitigate the key pressures and liabilities on the Schools Budget. The remaining movement on this reserve was a result of a small under spend on the Schools Budget PRC and a small overspend on the Schools in Financial Difficulties budgets.

3. Invest to Save Reserve – Closed

The Forum created the Invest to save reserve to support capital projects in schools that would deliver overall savings to the schools budget. In July 2013, the forum agreed to transfer £1.4m into the reserve together with £0.2m of clawback to support further capital invest to save schemes. Following advice received from the EFA, the Invest to save reserve could no longer be used to fund capital projects without the specific approval of the Secretary of State. The Forum agreed at their meeting of 18 March 2014 that £3.0m should be transferred to the schools in financial difficulty reserve and the balance of £2.6m transferred to the DSG reserve.

4. Carbon Reduction Reserve, £1.0m

The movement in this reserve represents a transfer in of £0.9m for the estimated charge for the school budget relating to the Governments carbon reduction scheme in 2013/14, and a transfer out of £0.8m representing the actual charge to the school budget in 2012/13. From April 2014/15 schools have been removed from CRC commitments. As a result the DfE have top sliced each LAs DSG settlement. The £1.0m balance on this reserve has been allocated across all phases as part of the budget setting process for 2014/15 6

5. Supply Teacher Reimbursement, £1.4m

The Forum has previously agreed to maintain this reserve at a level of £1.0m to act as a hedge against excessive claims. During the year, the scheme delivered a surplus of £0.4m; this will be re-distributed to scheme members during this term.

6. Combined Services Budget

In March 2014 the Forum were provided with an update on the progress made to date on Early Intervention, Social Workers in schools, Multi Agency Safeguarding Hub and Domestic Abuse. The Forum also agreed that the under spend on these budgets amounting to £0.918m in 2013/14 could be carried forward into 2014/15.

Additional Funding to be allocated in 2015/16

The table below forecasts the movements in the DSG reserve in 2014/15.

The Forum has already set aside £4.2m of the DSG reserve for commitments already agreed for the two year old offer, the alternative provision trial and in setting the 2014/15 budget. £0.7m has been added to the reserve through the transfer of the PRC overspend to the SiFD reserve.

Having set the DSG reserve at 1% of DSG at £8.4m, this will leave £10.964m to be distributed during the 2015/16 budget setting process.

Budget Pressures 2014/15

The Forum is aware of a number of budget pressures facing schools and academies in 2014/15. As members are aware the Schools and Early Years Finance (England) Regulations specifically prohibit any reallocation of funding, other than high needs top up and early years re-determinations in year. However cost pressures exist

7 around the introduction of the SEND reforms and the introduction of infant free school meals.

It is proposed that the Chair of the Forum write to the Secretary of State to seek permission to utilise some of the £10.964m of available funding held in the DSG reserve to ease the budget pressures facing schools and academies relating to the introduction of Government policy around the SEND reforms and universal infant free school meals.

It is proposed that the remaining funding held in the DSG reserve over the £8.4m will be distributed in 2015/16 in accordance with the Forums instructions.

2013/14 Outturn

The overall under spend on the schools budget is covered in the 2013/14 outturn reports presented to the Early Years Block, High Need Block and Schools Block Working Groups. This report discusses the under spend of (£4.377m) in schools delegated budgets. This is the net total of surplus and deficit balances carried forward by individual schools. In essence this under spend means that School balances have increased by £4.377m. This report discusses the under spend of in Schools delegated budgets and clawback.

The table below shows the movement on school balances at the end of the financial year 2013/14 compared to 2012/13. No schools converted to academies in 2013/14. The figures below exclude the movement in year and closing balance for the one school that closed in the year.

Annex A details the movement in balances at an individual school level.

The DfE intends that schools should take spending decisions in the context of greater stability and predictability, which should assist budget planning and avoid the tendency to hold large surplus balances without good reason.

In summary during 2013/14: • 292 Schools operated an in year deficit, spending funding from reserves; • 312 schools operated an in year surplus increasing the reserves they hold; • At the 31st March 2014 25 schools had deficit balances compared to 27 at 31st March 2013.

The increase in schools balances of £4.277m compares to a forecast reduction in balances of £15.839m which was indicated by schools’ spending plans for 2013/14. The actual outturn had deviated significantly from early indications and this size of variance has not been uncommon in the past few years as show in the table below.

Over the past 6 years balances have shown an upward trend, the dip in 2012/13 was as a result of academy conversions (figure pre academy conversions £53.200m. It should be noted that there is now a greater degree of certainty in ISB allocations since former standards funds were transferred into the DSG in 2011/12. Despite this greater certainty in budget allocations at the start of the year the variance between forecast outturn and actual outturn is still unacceptable. This raises concerns about schools ability to plan their finances accurately. In 2013/14 school balances represent 8.3% of ISB allocations in 2013/14.

It may be helpful if the Chair of the Forum were to write a joint letter to schools with the County Treasurer to emphasise the importance of constructing accurate budgets and monitoring these.

2013/14 Guideline Balance and Clawback The Forum are reminded that the regulatory framework covering school balances and clawback states:

4.2 It will no longer be a requirement for schemes to have a balance control mechanism. The revised paragraph reads: “The scheme may contain a mechanism to clawback excess surplus balances. Any mechanism should have regard to the principle that schools should be moving towards greater autonomy, should not be constrained from making early efficiencies to support their medium-term budgeting in a tighter financial climate, and should not be burdened by bureaucracy. The mechanism should, therefore, be focused on only those schools which have built up significant excessive uncommitted balances and/or where some level of redistribution would support improved provision across a local area.” LAs should, therefore, consider removing or relaxing their existing mechanism with effect from 1st April 2011.

School Balances and Clawback arrangements for 2013/14 and future years were agreed by the Forum at their meeting of 2 July 2013 and are set out below for information:

Guideline Balances For all phases guideline balance is the maximum of £40,000 or 12% of the schools Consistent Financial Reporting (CFR) income.

Clawback Rates For all phases the following clawback rates will be applied at 31st March 2014 and in subsequent years: • A clawback rate of 50% is to be applied to any balance above guideline (after adjusting for exemptions) as at 31 March 2014, or in the first year a school exceeds the new guideline (after adjusting for exemptions) • A clawback rate 100% is to be applied to any balance in excess of guideline where the guideline has been breached for two or more consecutive years.

Exemptions The following exemptions will be applied to clawback • Existing capital bonds are honoured until project completion. Capital bond rules as previously agreed by the Forum will still apply to these in that if the scheme does not proceed, funding will be forfeit • Funds accumulated by schools where there is a contractual agreement, as part of a grant allocation or dual use agreement, for facilities to be replaced on a fixed basis (i.e. an all weather pitch) will continue to be exempt from clawback • Any funding allocated on an academic year basis to schools by the DfE or other Government department will have 5/12 this exempt from clawback • No further exemptions will be allowed.

As at 31st March 2014, clawback totalling £227,440 will be applied to 38 schools as shown in the table below:

Use of Clawback

Officers have sought clarification from the EFA regarding how clawback can be distributed to schools. Their advice is that the Forum can distribute clawback through: • the formula in 2015/16; • high needs budgets; • early years budgets.

It is proposed that clawback: • totalling £227,440 is applied to the 38 schools as detailed in the table above;

• is held in the this DSG Reserve for the remainder of 2014/15 and distributed through the formula as a one off allocation in 2015/16 in accordance with proposals to be agreed by the Forum during the budget setting process for 2015/16; • is distributed by phase according to the amount clawed back from that phase, i.e. primary clawback will be distributed through the primary formula, secondary through the secondary formula etc.
