1. DECLARATION OF PERSONAL INTEREST

No declarations of personal interest were received from any members present.

2. URGENT ITEMS

The Maritime and Country Parks Officer noted that after receiving a notice from the Wynnes Company in relation to the intention for a ship to traverse the harbour in June 2020 an urgent meeting had been arranged with the company on 7 March 2019. He elaborated that the proposal was related to the transformers in and . He noted that the timetable of the proposal did not coincide with the harbour's schedule and busy season, a discussion would be held at the meeting in terms of the impact on the harbour and the significant and necessary work to enable the ship to traverse the harbour along with other options outside the main season. He confirmed that an update on the proposal would be provided at the Committee's next meeting on 9 October 2019.

In response to a question, the Maritime and Country Parks Officer noted that the proposal would not incur costs for the Council. He expanded that some owners might be offered to move to Pwllheli or to a location that was not part of the ship's navigation path.

A member enquired about the duration of the work. In response, the Maritime and Country Parks Officer noted that subject to the tide, the work would last approximately 3 months. He added that he would contact the Chairman, businesses local to the harbour and Madoc Yacht Club following the meeting.

In response to a question by a member, the Maritime and Country Parks Officer noted that he would discuss community benefit with the company but the company would certainly be responsible for the costs.

The Maritime and Country Parks Officer noted that it was intended to review the Harbour Bye-laws. He elaborated that discussions with the Legal Section and a timetable were in Page 4 PORTHMADOG HARBOUR CONSULTATIVE COMMITTEE 6/3/19

place, it was intended for the new bye-laws to be operational in May 2020. He confirmed that a report on the bye-laws would be submitted to the next meeting on 9 October 2019.

A member enquired about the consultation arrangements. In response, the Maritime and Country Parks Officer noted that the consultation would be extensive, and would include the Sailing Association, Porthmadog Town Council, Trinity House and the Maritime and Coastguard Agency. He added that a notice of the consultation would appear in the press.

Peter L. Williams (RNLI Representative) and Will Walker Jones (RNLI) were congratulated on their appointments as Chairman and Operational Manager of RNLI Cricieth.

3. MINUTES

The Chairman signed the minutes of the previous meeting of this Committee, held on 10 October 2018, as a true record.

4. PRESENTATION ON THE PORT MARINE SAFETY CODE

Mr Forkanul Quader of the Maritime and Coastguard Agency Inspectorate was welcomed to the meeting.

The Maritime and Country Parks Officer set out the context, noting that the Maritime Service had responded to the recommendations noted in the report received from the Maritime and Coastguard Agency Inspectorate on the safety arrangements and systems of Gwynedd municipal harbours and compliance with the Marine Safety Code following an inspection in 2017. He noted his appreciation of the Senior Harbours Officer and the Harbour Masters' work. He explained that a follow-up inspection had been held on 5-6 March 2019 where the inspector noted that the Service had firm foundations noting suggestions for improvement. He noted that all Harbour Committees members had received an invitation to the Committee for the presentation. He stated his appreciation for Forkanul Quader's work and professional guidance.

A presentation was given by Forkanul Quader, who noted that the Code was not statutory but that it was relevant and the need for safety control systems and risk assessments to be in place and that they correspond with the scale of activities undertaken at the Harbour. He listed the relevant legislation noted in the Code.

He noted the following main points in terms of what required the Council's attention:  That Porthmadog Harbour had a status of a Competent Harbour Authority, as no commercial vessels had navigated the harbour in 23 years, the Council should consider whether or not it intended to keep the status which imposed additional requirements on the Council.  That internal review arrangements had been set up but that operational work was needed with an opportunity for Harbour Masters to collaborate.  There was a need to review the Porthmadog Harbour Bye-laws to ensure that they coincided with current practices.  Pwllheli Harbour may be exempted from some of the requirements relating to pollution.  Hafan Pwllheli generated an income, with the narrowing channel it was difficult for vessels to cross and navigate the channel. A hydro-graphic survey was needed and dredging works.

He confirmed that the Maritime Service had very good practices including the use of telemetrics. He noted that there was commitment to the safety controls system with the Duty Holders taking responsibility on the first page of the Council's Marine Safety Code.

The Cabinet Member for Economic Development noted that he had met with the inspector to discuss his report and a few things needed addressing. He elaborated that he was quite confident that it would be possible to respond to the matters raised by the inspector. He explained that the inspector had praised the professionalism and commitment of the Maritime Service officers.

In response to a question by a member, the Maritime and Country Parks Officer noted that it was intended to contact the Council’s Legal Unit, the Welsh Government and the British Government to submit an application to remove the status of Porthmadog Harbour as a Competent Harbour Authority. He explained that the status entailed substantial work and responsibility under the Piloting Act 1987 and that removing the status would not prevent any ships from traversing the Harbour as part of the transformer work in Trawsfynydd and Ffestiniog. He noted that he hoped that the members would support the proposal.

In response to a further question, the Maritime and Country Parks Officer noted that removing Porthmadog Harbour's status as a Competent Harbour Authority would mean that Porthmadog Harbour would have the same status as the other harbours managed by the Council. The inspector explained that there were two types of statuses, Statutory Harbour Authority and Competent Harbour Authority, Porthmadog Harbour would continue as a Statutory Harbour Authority. He noted that given that no commercial ships had navigated the harbour in 23 years, what reason was there for retaining a status that imposed additional requirements on the Council in terms of training?

Members noted their appreciation of the presentation.

RESOLVED to accept the information.

5. UPDATE ON HARBOUR MANAGEMENT MATTERS

The Senior Harbours Officer guided the members through the report and drew attention to the following main points:

 It was envisaged that an underwater inspection of the harbour moorings would be held before Easter, subject to the moorings contractor's commitments and the weather conditions.  The post of a full-time Harbour Assistant was being advertised for Porthmadog Harbour, the officer would provide assistance to the Harbour Master with his duties and responsibilities and would also work at Aberdyfi and Barmouth harbours when needed.

A brief summary of the harbour's budgets and the financial situation up to the end of February 2019 was provided. The Maritime and Country Parks Officer provided details of the budgets noting that the income collected was £10,754 lower than the target income. He noted that an overspend of approximately £20,000 was anticipated for the end of the 2018/19 financial year, but given the size and responsibility of the Harbour and that financial resources had been committed for maintenance that was an investment in the Harbour. He drew attention to 2019/20 fees and charges.

In response to an observation from a member with regards to the Black Rock Sands Beach parking fees, the Maritime and Country Parks Officer noted that beach costs were funded under the beaches' budget and that beach expenditure and income was not part of the harbours budget.

A member drew attention to the fact that the Harbour officers worked on the beaches at times. He enquired whether the hours spent completing the work would be re-paid under the beaches budget. In response, the Maritime and Country Parks Officer noted that an arrangement was in place where beach officers and Harbour officers collaborated at times Page 6 PORTHMADOG HARBOUR CONSULTATIVE COMMITTEE 6/3/19

on work in the Harbour and on the beaches to deliver the best benefit to Gwynedd residents in accordance with Ffordd Gwynedd. Porthmadog Harbour Master presented a report summarising the navigation and operational matters that had arisen during the period between October 2018 and February 2019, including maintenance matters and incidents during the period. He noted that navigation buoy number 10 had come to the shore, therefore a further Notice to Mariners had been released in addition to what was noted in the report.

A member noted that it was good to see photographs expressing gratitude for the work involved with the sea wall in Borth-y-Gest with those who had originally objected to the proposal now welcoming it as it had improved the situation.

The RNLI Representative noted that the RNLI safety signs proposed to be erected in the area were very good signs. He drew attention to the fact that Cricieth RNLI had saved 10 individuals from the North Bank near Black Rock Sands Beach during 2018 which was a significant percentage of the total number of lives saved in the and Ireland during the year with 182 lives saved during that time. A member noted that it was an effective and very important Service.

In response to a question from a member regarding the ice cream concession, the Porthmadog Harbour Master noted that the tender would be advertised during March. The member added that he was eager for the tender to be advertised as soon as possible.

A member noted that Councillor Nia Jeffreys would be undertaking the Caru Port work in his place and it was intended to extend the lights next to the Ganolfan to go around.

The Leisure Interests Representative provided an update on Madoc Yacht Club's plan to increase the number of pontoons in the harbour. He noted that all the relevant paperwork in terms of installing the pontoons in the harbour, including the exact location of the main extension and the pontoon fingers, had been submitted to Natural Resources Wales. He explained that Madoc Yacht Club had received a response from Natural Resources Wales confirming that all the relevant paperwork had been received. He elaborated that it was proposed to install the additional 24 meter main pontoon sections and fingers at the beginning of April, in time for the new season, and the work would be carried out by Intermarine UK Limited. RESOLVED to note and accept the report. 6. THE HARBOUR COMMITTEE'S CONSTITUTION Reference was made to the Committee’s constitution noting that the Committee had been established under article 6 of the Porthmadog Harbour Revision Order 1998. It was highlighted that there were two empty seats, the seat of a landowners' interests representative and another empty seat. It was noted that it was intended to contact Porthmadog Sailing Club in terms of nominating a representative to the empty seat after they had submitted a request.

MEETING Porthmadog Harbour Consultative Committee DATE 9th October 2019 TITLE Update on Harbour Management Matters AUTHOR Senior Harbours Officer

1. Introduction.

1.1 The Committees main function is to consider, discuss and advise on matters relating to the management, safety and development of the Harbour and to receive Member’s observations on matters relating to Porthmadog Harbour.

1.2 The purpose of this report is to provide a brief update for the attention of the Committee on harbour matters for the period March 2019 to October 2019, in order to receive feedback from the members on safety matters and the operational matters of the Harbour.

1.3 The Porthmadog Harbour Committee is a statutory Harbour Committee, set up in accordance with Section 6(2) (a-j) of the Porthmadog Harbour Revision Order 1998. The order provides that fifteen (15) members serve on the Porthmadog Harbour Consultative Committee. A comprehensive list of the groups and organisations represented on the Harbour committee can be seen in the Harbour Order.

2. Porthmadog Moorings and Boat Registration.

2.1 In 2019/20 figures for on moorings in the Harbour were as follows:-

2.2 There has been 128 boats on annual moorings in 2019. This compares with 131 in 2018 and 135 in 2017. It is apparent that this figure has remained relatively consistent over the last three years

2.3 On the whole when comparing all Gwynedd Council Harbours, there has been a decrease in the number of customers over the past year in all harbours.

2.4 There were 887 Power Boats registered in Gwynedd in 2019. 33 Boats were registered at Porthmadog Harbour compared 38 in 2018.

2.5 There were 30 Power boats registered at Morfa Bychan in 2019

2.6 There were 844 Personal watercraft registered in Gwynedd in 2019.

2.7 There were 55 Personal watercraft registered at Porthmadog harbour and 184 registered at Morfa Bychan compared to 200 the previous year.

2.8 Copies of all data relating to occupancy and registration is appended.

3. Port Marine Safety Code.

3.1.1 The Port Marine Safety Code ('PMSC') sets out a national standard for every aspect of port marine safety. Its aim is to enhance safety for everyone who uses or works in the port marine environment. It applies to all Statutory Harbour Authorities.

The Code represents good practice as recognised by a wide range of industry stakeholders and Gwynedd Council understands that a failure to adhere to good practice may be indicative of a Page 8 harbour authority being in breach of certain legal duties. It is necessary for the Service to receive the comments and views of Consultative Committee Members on the suitability of the Port Marine Safety Code and to regularly receive observations on its contents, in order that it may be reviewed as relevant to the harbour activities, navigational aids, suitability of by-laws, safety matters and general day to day work at Porthmadog Harbour.

3.1.2 Between the 19th and 21st September 2017, a thorough inspection was carried out by Capt Forkanul Quader and Capt David Turner as auditors from the Maritime and Coastguard Agency on the existing safety arrangements and systems of Gwynedd Municipal Harbours, in order to ensure compliance with the Port Marine Safety Code. Upon inspection, the Service were advised of enhancements that could be made to existing systems within its safety management system to assist in compliance with the provisions of the Code.

3.1.3 As a follow up to that initial inspection, during the period 4th – 6th March 2019, the Service received a further visit from Capt Forkanul Quader to see how the suggested enhancements had been implemented. Upon examination, Capt Quader advised that he was satisfied the Service were in compliance with the provisions of the Port Marine Safety Code and he subsequently made a presentation before the Porthmadog Harbour Consultative Committee to explain the provisions of the Port Marine Safety Code and confirm his findings.

3.1.4 Although the Port Marine Safety Code for the Harbours is regularly reviewed by the Service, Members of the Consultative Committee are reminded of their duty to submit observations on the suitability of the Safety Code and to receive observations on the work arrangements of the harbours, so that the safety Code can be reviewed to ensure that it is relevant to harbour operations, local propriety.

4. Staffing Matters.

The Harbour Authority is pleased to inform the Consultative Committee that Mr Richard Hughes has been appointed as the full time Assistant Harbourmaster based at Porthmadog Harbour, to assist the Harbourmaster with his duties and responsibilities. Mr Hughes, who lives in , previously held the position of Principal Powerboat Instructor at the ‘Plas Heli’ sailing academy at Pwllheli harbour. As and when required, Mr Hughes will also be assisting with work in the harbours of Barmouth and Aberdyfi.

5. Financial Matters.

5.1 A brief summary of the harbours budgets and current financial situation up to the end of September 2019 will be distributed at the meeting.

5.2 During this period it was necessary to commit financial resources for the following;

 The employment of a full time Harbour Assistant  Maintenance of navigational aids and beacons  Inspection and maintenance of Council moorings  Maintenance and operation of the of Harbour patrol vessel  Maintenance of grounds and street furniture  Purchase of safety signs for Borth y Gest  Y Dwyfor vessel. Investment to maintain the boat in order to meet the Code of Practice requirements and maintain lifting apparatus. The vessel is permanently located at Porthmadog harbour to facilitate the movement of navigation aids in the Porthmadog Channel.

Page 9 5.3 Fees and Charges. 2019/20.

With regard to the prospective fees and charges for Porthmadog Harbour together with the Powerboat and Personal Watercraft launching fees for 2020/21, it is the intention of the service to adjust the fees in line with the rate of inflation. At this time the Service is yet to receive confirmation of the rates to be applied.

A draft of the proposed fees and charges will be distributed at the meeting.

6. Harbourmasters Report. The Harbourmaster at Porthmadog will provide a summary of the Navigational and Operational matters undertaken and encountered during the period March 2019 - October 2019 inclusive, including maintenance issues. A copy of his report is attached.

H 1 Navigational Issues

1.1 The course of the navigable channel into the harbour has generally remained constant over the summer period with occasional sandbank growth leading to one or two minor adjustments of the navigational marks, particularly in the area near Borth-Y-Gest.

1.2 The starboard aids to navigation No 1 and No 3 buoys were commissioned into service to assist mariners in negotiating the sand bar at the entrance to the Porthmadog channel. It is anticipated that additional buoyage will be required in the channel in preparation for the start of next season, dependent upon the movement of the sandbanks within the estuary.

1.3 The ‘Fairway’ Buoy will require refurbishment over the winter period and subject to Trinity House approval, it will be removed from the channel for this purpose. Once completed the buoy will be returned to the water as soon as possible subject to weather conditions and the availability of a mooring contractor. The future purchase of a new safe water mark (‘Fairway’ Buoy) remains as an option for the Service.

1.4 The navigational aids within the channel on the approach to Porthmadog Harbour have been subject to maintenance with extensive work yet to be undertaken to refurbish a number of the channel buoys. This will form part of the harbourmaster’s winter work programme.

1.5 There is currently two (2) Local Notice to Mariners in force for the Harbour of Porthmadog.

1.5.1 Local Notice to Mariners 12/19.The Port aid to Navigation No 8 Buoy at position 52°53.506’ N 004°09.786’W is currently off station.

1.5.2 Local Notice to Mariners 13/19. An unlit temporary port aid to navigation has been placed at position 52°54.571’ N 004° 08.699’ W to assist mariners in negotiating a spit of sand that had encroached into the navigable channel

1.6 The Service is to receive its annual inspection of the Navigational Aids within the Harbour and channel approach by Trinity House staff between14th-16th October. The service will receive a report on their findings thereafter.

1.7 Mariners are reminded of the need to navigate the channel 1.5 hours either side of high water when navigating a vessel with a draft in excess of 1.5 metres. Mariners are also reminded that contact should be made with the harbour office prior to any approach, to obtain the latest navigational information.

Page 11 H 2 Operational Issues

2.1 The vessel Dwyfor has been subject to maintenance to ensure that it complied with the required workboat code and lifting apparatus regulations. In particular the vessel required engine maintenance following a hydraulic pump failure at a total cost to the Service of £2250.00. This caused the vessel to be out of service for a period of time due to the availability of spare parts with due consideration to the age of the vessel and its operating equipment.

2.2 A twenty four metre (24 m) extension to the existing pontoon structure owned and managed by the Madog Yacht Club has been installed in the harbour, providing extra berthing facilities for club members and visitors alike.

H 3 Maintenance

3.1 Inspection and Maintenance of the moorings in the harbour was carried out at the beginning of the season to enable the mooring contractor to replace any worn equipment. In total ten (10) riser chains were found to be in need of replacement together with a number of mooring buoys which were also replaced at a cost to the Service of £1560

3.2 Tarmac work has now been completed on the approach to the harbour frontage from the car park area located adjacent to Lombard Street. Tarmac work around the bases of new posts forming part of metal fencing and an associated gate access between the harbour office and the rear of the Canolfan has also been completed.

3.3 Benches around the harbour environment have been refurbished with further work still to be completed. The service continues to receive requests for the placement of benches around the harbour and at Borth –Y-Gest, but there is only limited space available. A review of the matter is currently being undertaken by the Service and in consequence no further requests are being considered at this time.

3.4 The harbour grounds have continued to be subject to litter removal together with maintenance of the grass verges and hedges. With the agreement of members of the Canolfan, harbour staff now undertake the maintenance of the grass verge bordering the harbour walkway adjacent to the harbour-side wall of the Canolfan. The harbour slipway has also been subject to regular maintenance.

3.5 The harbourmaster will introduce the maintenance work programme to be carried out at Porthmadog harbour during the period October 2019 – February 2019. Feedback from Committee members is requested on any additional work that will need to be considered and included in the work programme.

H 4 Other Matters

4.1 Borth-Y-Gest. Concrete plinths have been installed near the front of the car park overlooking the bay and benches have now been put in position to provide seating for persons wishing to rest and enjoy the environment.

Page 12 4.1.1 The Service remains committed to tidy the grassed area at the end of the car park where numerous vessels are currently stored despite local opposition. During the process, unseaworthy vessels and rusted trailers will be removed. It is now finally hoped to complete this work over the forthcoming winter period.

4.2 RNLI Safety signage. RNLI safety signs were erected in the area of Morfa Bychan to enhance safety measures. Proofs for additional RNLI safety signs have now been received, which are ultimately to be erected in the area of Borth-Y-Gest.

4.3 The Service has received the benefit of work experience personnel over the summer period who have assisted harbour staff in cleaning the harbour environment at Porthmadog. The Service is also grateful for the help received from local groups and individuals who have undertaken beach cleaning activities on the nearby beach of Black Rock Sands.

4.4 Harbour Byelaws. The Service continues to work towards updating the Porthmadog Byelaws in association with the Legal department of Gwynedd Council.

H5 Events

5.1 The following events were held at Porthmadog Harbour in 2019.

 Moveable Feast Event  Events and activities undertaken by the Madog Yacht Club including a Celtic Longboat Rowing Race Between Porthmadog and Pwllheli and a charity event in support of the RNLI.  Motorcycle Event  Once again a number of film and television companies visited the area surrounding the harbour and nearby Black Rock Sands
