Case o. 1

Permission for berthing and operation of motor yatch/motor boats the property abutting Sy.o. 31/4 of Penha da Franca in Bardez taluka, by Mr. Agnelo J. Fernandes,(GCZMA//1011/27)

Decision: The GCZMA members opined that there exists a bird sanctuary and thick mangroves within buffer area of the wildlife eco-sensitive area. The GCZMA members where not infavour of that the proposal and opined that prior approval from Forest Department should be obtained

Case o. 2

Permission for laying GAIL 24” dia Pipeline & OFC across ala in , by GAIL () Limited, (GCZMA//1011/ 12).

Decision: After presentation done by the officials of GAIL (India), Ltd., it was decided to approve the proposal for laying GAIL 24” dia pipeline & OFC., subject to Compensatory Afforestation of the mangrove species be carried out in consultation with Forest Department, over thrice the area lost. Similarly a monitoring group should be set up to monitor the pipe laying process in such eco-sensitive and vulnerable areas.

Permission for setting up of Reverse Osmosis Water Generation Plant at IS HASA at Dabolim, by Commanding Officer, IS HASA Dabolim(GCZMA/S/1011/10)

Decision: Deferred, More details are required from the project proponent as regards to the development sought to be carried out in the matter. It is suggested that rain water harvesting should be undertaken

Case o. 4

Extension of Jetty 50 mts. towards Betim side for Fisheries Complex Malim and joining of space between the jetty and Auction shed by Fisheries Department (GCZMA//1011/17)

Decision: The detail presentation was given by Directorate of Fisheries, where Dr. Sharmila Monteiro was present. GCZMA members raised a queries on impact of flow of water, congestion and constriction of the river, reclamation of the area, sea level rise impacts on account of the proposed extension of jetty. It was also decided that Fisheries Department should undertake a Rapid EIA study and place the matter to GCZMA.

Case o. 5

Proposed OC for floating pontoon jetty and undertaking barge repairs along the riverside adjoining in Survey o. 41/2 of Village Vagurbem of Ponda Taluka, by M/s. Sudarshan Dry Docks (GCZMA//0910/67)

Decision: Deferred, as there is a pending SCN for alleged violation of CRZ Notification, 1991in the same Sy Nos. The matter to be taken up after disposing the SCN

Regularization of the reconstructed structure in bearing survey o.25/6(Part) of Assagao village, Bardez taluka, by Mr. Audumbar Sirsaikar(GCZMA//0809/74).

Decision: Deferred, Matter to be heard. Both complainant and project proponent should be present.

Case o. 3

Shack Policy 201011

Decision: Member Secretary briefed the GCZMA members about the proposal received from Tourism Department on shacks. Whereby they have proposed to maintain same number of shack like last year, due to the condition imposed by GCZMA last year to freeze number of shack. Director (Tourism) explained that there are few additional request for putting up shacks in other areas. MS, GCZMA explained the matter in Vikas Bhagat V/s. GCZMA in Hon’ble High Court, regarding shack on beaches at Palolem. It appears that during highest high tide in the month of December/January, water level goes beyond Tourism Department allotted shacks. Hence they fall between LTL and HTL. GCZMA Members where of the view that such a situation of shack, in LTL and HTL should not be allowed. As regard the other matter GCZMA decided to defer the issue to the next meeting.

Decision: The activity like Ice plant is permitted as per CRZ Notification for the existing fishing activity. The matter regarding regularizing the 03 structures erected should be decided separately by GCZMA sub-committee. On deciding the above matters, approval be conveyed.

CVAC sought time to respond and sought the NIO references / recommendations on the issue. Counsel for M/s Pinky Shipyard opposed the grant of additional time and sought for conclusion of the hearing. GCZMA members informed both the parties to place their arguments on the merits of the case and the Writ Petition which they have filed.

GCZMA decided that even though CVAC prayer for adjournment was devoid of substance, but in view of natural justice and directions of High Court; it opportunity of hearing, tentatively on 07/01/2011 (Friday) at 3.00 pm. Both the parties were also asked to file their written submissions along with copy of the Writ Petition. They were also asked to file advance copies of submission to other party before next date of hearing and also file counter reply if consider necessary.

Goa Foundation who has sought time through written application has been granted additional time.

Case 2: In the matter of the compliant filed by Shri. Khemlo Sawant, against illegal operation of jetties by M/s. Sesa Goa at Amona, Bicholim – Goa.

Mr/ Khemlo Sawant complainant in the matter present. Adv. Ramani and officers of M/s Sesa Goa present. Mr. Sawant explained, in brief, his grievances and detailed that the operations of loading / unloading of mineral ore on the two jetties at Amona is illegal as the jetties are itself illegal with the construction being carried out without any permissions from the authorities concerned. He claimed that all certificates given by M/s Sesa Goa have been fabricated and are bogus in nature.

Adv. Ramani stated that the matter or complaint is made is in respect of two jetties where mineral ore transportation takes place. He stated that jetties are permitted from 1969 by the Captain of Ports and that they have undertaken renovation of the jetties in 1987. As per the Captain of Ports rules they have paid dues for use of riverine land on 24/10/1996.

When GCZMA questioned the veracity of 1969, Captain of Ports letter and plans annexed to it, approved if any, it was informed that the plans have been misplaced in their Office and during transmission period since last 40 years and that they would provide the same after search.

Adv. Ramani denied the charges made by Shri Khemlo Sawant while the complainant further alleged that the Company is generating fraudulent documents. He pointed out to the plan for dredging in which police case is filed.

GCZMA directed M/s Sesa Goa, to provide relevant documents, approved plans of jetties for construction (1969) and repairs (1987) and other documents. Hearing adjourned to the next date.

57.7 Any other matters.

1. MS, GCZMA explained the functioning of GCZMA since the last meeting held on 29/08/2010 and the decisions taken during that time. Dr. A. G. Untawale, Member, GCZMA sought information on the complaints made regarding illegal felling of mangroves at entrance to Panaji,Merces and Ribander. Besides the illegal cutting of sand dune vegetation at Miramar. MS, informed that the Police complaint has been filed and Dy. Collector (Tiswadi) is currently inquiring in the matter.

2. Chairman (GCZMA) brought to the notice the matter regarding CRZ issues raised during security Co-Ordination Meeting on Coastal Security Chaired by Hon’ble Home Minister. It was explained the GCZMA has taken necessary steps in consultation with Director

(Panchayats). Various matters regarding illegal construction in Canacona beach belt have been stayed either by Appellate Authority or the Hon’ble High Court and they are currently sub- judice. In Canacona there are temporary wooden structures and tents / shacks put up by traditional inhabitants which are permissible activities and which the Police are seeking removal citing security concerns and law and order problems. Chairman (GCZMA) directed that appropriate reply be send to Home Department highlighting the facts in these cases.

3. MS, GCZMA sought the approval of GCZMA to constitute a teams of 03 members of GCZMA each to conduct spot inspections or violation and direct action immediately at site under the authority of GCZMA. All such decisions taken would be ratified in the ensuring meetings of GCZMA full body. This was approved. GCZMA decided to review the 05 member sub- committee to hear all cases pertaining to violations of CRZ with full authority of GCZMA on fortnightly basis. The decisions shall be ratified in the next ensuing GCZMA meeting and orders issued thereafter.

57.8.6 Other matters.

Case no. 1 : Matter of India Oil Corporation, construction of retail outlet / shopping unit at M/s Heera Petroleum pump, Panaji.

MS, GCZMA explained the matter pursuant to the LAQ in Assembly. From the records available in file and the reply filed by IOC and petrol pump owner is it seen that, approval has been obtained from all Authorities. The area is in CRZ-II of CCP. This construction is on landward side of existing structure. GCZMA decided to drop the show cause notice and permit occupancy of the structure constructed. No additional constructions are allowed and fencing is required to be erected on mangrove side to prevent any damage to mangroves. No land filling allowed.

Case no. 2 : Matter of construction of Residential Complex at Colva village in Sy. no. 58/1, 2, 3 and 5 of Shri Agnel Alcasoas.

MS, GCZMA explained that the construction at site was approved in 1994 and construction commend for the 1 st phase of the complex which got completed. When 2 nd phase was to be constructed, TCP informs that the project proponent that the area is just touching 500 mts. CRZ line. The site was inspected by Engineer Pascoal Noronha, Member (GCZMA) who has seeen that the construction part on the landward side of the 500 m line. Since it is an ongoing construction, GCZMA decided to permit the same subject to the approval conveyed by TCP, as during the relevant time of approval, project site was totally outside 500 mts. CRZ area.

Case no. 3 : Matter of delineation of the land mass in river Zuari of M/s Crystal Island at Quelossim, Cortalim.

CRZ line was demarcated for the said land mass (island like structure) at Quellosim of M/s Crystal Island Ltd. The site was inspected jointly by Dr. Simon de Souza and DSLR. The area is low lying paddy (not cultivated) and marshy. It is eco-sensitive zone with mangroves fringe. M/s Crystal Island have sought to correct the delineation as given earlier.

GCZMA discussed the request and have found no substantive grounds enough to change / alter the delineation. Request rejected.

Case no. 4 : Additional shacks as per request of Director (Tourism).

MS, GCZMA and Director (Tourism) explained the request made by Hon’ble MLA’s of Siolim ( for 2 shacks at Anjuna / Vagator) and Mandrem ( for shacks at Gaudewada, Morjim). They explained that space for shacks are available and that some more can be permitted. It was

24 seen that the matter of shacks is presently before the Hon’ble High Court and that the number of shacks have been frozen for 03 years.

It was decided that spot site inspection should be carried out GCZMA sub-committee and matter referred to Hon’ble High Court with site feasibility report.

Case no. 5 : In the matter of permission granted for dry dock for one Mr. Raymond D’Sa, D’Sa Engineering at Cortalim.

MS, GCZMA explained that approval was conveyed by GCZMA for construction of dry- dock to one M/s D’Sa Engineering. The adjacent dry dock owner, M/s Vipul Shipping complained that M/s D’Sa Engineering has encroached in his area and that the dry dock is being built in riverine area besides there is no access to the land. GCZMA office held the approval in abeyance. Replies have been received from D’Sa Engineering. It is seen that Captain of Ports has allowed use of riverine land.

It was decided that spot inspection should be conducted by GCZMA sub-committee and approval reconveyed after confirming factual details at site.

Case no. 6: In the matter of illegal construction of road in the property of M/s Suvarna Bandekar and M/s Heritage Builders at Sernabatim in Sy. no. 16/4 by Mr. Govec Cardozo

MS, GCZMA explained the matter of complaints made regarding illegal construction in aforesaid area by the said Cardozo. The Dy. Collector (Salcete) report also indicate fresh road being made without approvals. This is a serious NDZ violation.

GCZMA directed that spot inspection should be conducted by GCZMA sub-committee and road removed. Other inspection to be carried out and action taken.

59.1 Personal Hearing in cases referred by Hon’ble High Court of Bombay at Goa

59.1.1 Ms. Lucille D’Souza v/s (a) GCZMA & (b) Ravindra Jana ……. W.P. o. 294 of 2010 ………. In the matter of demolition of unauthorized portion of Club Tito’s &Club Mambo’s at Calangute

Decision: Adv. Brijesh Sardessai appearing for David D’Souza/ Lucille D’Souza was present and seeks time for presenting the case after 03/06/2011. Adv. Bhupesh Prabhudessai, appearing for Ravindra Jana was present and states that he has no objection for adjourning the hearing. Adv. B. 59.1.2 Mr. Prakash B. Sardessai v/s GCZMA ……. W.P. o. 290 of 2010 …… in the matter of illegal reclamation of land filling in river portion Sy. o. 30/1, Cortalim ( near M/s Sardessai Engg. Workshop)

Proceedings: Mr. Prakash Sardessai present in person alongwith Adv. Vishwesh Sardessai. Mr. Prakash Sardessai states that he has brought along documents issued by the DSLR in which he claims that the area concerned is a sapal owned by the Private Party Mr. Tarai and taken on lease by Don Bosco and part of which is occupied V.M. Salgaonkar Shipyard. This land bears Sy. o. 5676 which is part of old survey records. He claims only part of it has been surveyed under the new survey records for which he has obtained a plan from the DSLR of the whole area which is marked at exhibit ‘D’ to W.P. o. 390. The new survey plan is submitted alongwith the reply as Annexure VIII. For the purpose of indication he says that he has interpolated the plan to resize it as per the scale, given at Annexure VIII. Member sought for clarifications regarding the Annexures and the details of the areas marked in the Annexures VI, VII & VIII visàvis the interpolated drawing submitted by Shri Sardessai, reference through the old cadastral survey document. Clarification were given by Shri Sardessai as to the extend of the land in possession with M/S Sardessai Engineering works. Mr. Sardessai further submits that in the year 1971 captain of Ports has granted in access to 9000 sq. mtrs for the purpose of shipyard. He states that subsequently Captain of Ports has been claiming rent as port dues and also sought for resurvey or survey records from the DSLR as per this plans and permission granted in 1971. Plan is at page 95 attached to W.P. o. 390 on a specific question pertaining to the use of river front not exceeding 9000 as mentioned in the Captain of Ports letter dated 9 th July 1971 Mr. Sardessai states that the area of 9000 sq. mtrs. was already existing as reclaimed in 1971 itself further he states that permission to bank the barges is in the water portion which is the rivers front and not the river front for which permission has been granted to him. He states that Captain of Ports has confirmed construction of Shipyard on 9970 sq. mtrs before the Hon’ble High Court and Supreme Court details are in his reply. In his submission a letter dated 7 th June 1993 from Assistant Survey and Settlement officer addressed to Captain of Ports in which it is mentioned that no old survey is conducted during Portuguese period in respect of S. o. 30/1(the copy Xeroxed and taken on records). He further states that he does not agree with the finding with Dy.

Collector and SDO Mormugao in respect of area denoted as 3150 in excess of 9000. He categorically submits that there is not violation of CRZ violation as in force and that he aggrieved by the extensive damage done to him. 03 photographs were shown to Mr. Prakash Sardessai which he denies to be his property and he states that these photographs are fabricated.

The hearing concluded for Orders before the GCZMA.

Decision: After perusing all the records of the case the documents produced and relied upon by Shri Prakash Sardessai including the orders passed by this Authority dated 27/02/2009 and 25/03/2010 including the order dated 19/10/2010 in W.P. o. 390/2010; the members concluded that there has been illegal reclamation of 3150 sq. mts by encroaching upon the river Zuari, as confirmed in the report of the Deputy Collector & SDO (Mormugao) the contentions made out by the said Shri Prakash Sardessai regarding reclamation carried out prior to 1991 and use of 9000 sq. mts of river front for the purpose of dry dock have been clearly clarified in GCZMA’s earlier orders dated 27/02/2009 and 25/03/2010. The earlier decision of the GCZMA is retaliated. Orders to be issued accordingly.

59.1.3 Ms/ Ingrid Ryna Fernandes v/s (a) GCZMA (b) Constance Alex Fernandes ……… W.P. o. 329 of 2010 …… in the matter of alleged illegal construction of new structure behind existing house in Sy. o. 238/20B, Calangute.

Proceeding: In the matter of Adv. Rohit Bras D’sa appearing for Ms. Ingrid Ryna Fernandes present. The petitioner Ms. Ingrid Ryna Fernandes also present Shri Constance Alex Fernandes is also present in person. Adv. Rohit Bras D’sa states and submits that Shri Constance Alex Fernandes has undertaken complete reconstruction of the existing structure at a site and he stated and submits that the construction / reconstruction which has been undertaken is in total violation of the approvals conveyed by the GCZMA which speaks of repairs and renovation in terms of the Hon’ble High Court Orders in W.P. o. 422 of 1998. It is his case that no reconstruction/construction or new construction of whatsoever nature can be put up in CRZIII areas until the Orders of the Hon’ble High Court in MCA o. 427 of 2007 in W.P. o. 422 of 1998 are complied with. He states that Shri Constance Alex Fernandes has undertaken a new construction by demolishing completely the existing structure from its very footing / foundation and has replaced the entire character of the structure itself. He further states that not only is this is a complete new construction but, assuming it to be construction which can be permitted it is still constructed far beyond the existing plinth size / area of the existing structure for which repairs / renovation was earlier granted by the GCZMA. He further submits with reference to a site inspection report of the Office of Senior Town Planner, (page 36 of W.P.) in which an additional store room has been constructed admeasuring 9.61 sq. mtrs. which is not having any approval from any Authority concerned. Adv. Rohit Bras D’sa draws attention of the Authority to a report prepared by Mr. Bhobe at page 5 of the writ which indicates the stage wise details of the progress of the construction being made. It is the submission of the Authority that independent clarification of the report shall be undertaken. It is his point in conclusion that due approval from TCP board should have been taken since it is the matter in reconstruction which is a new development in terms of DPR 1971.

Mr. Constance Alex Fernandes request for time to present his case with the help of a legal aid and his counsel. Adv. Rohit Bras D’sa has no objection for this presentation and he would like to excuse himself during the course of the subsequent in course of this subsequent hearing time granted accordingly.

Decision: Matter be posted in the first week of June and due notices shall be served.

It is further ordered the site inspection shall be conducted by the Authority including ground level mapping and verification of documents / permissions.

59.2.1 Ramesh Hotel at Utorda, Majorda ……… in respect of complaint filed by one Mr. Ligorio Pereira .

Decision: Site Inspection was examined and compliance status pursuant to the GCZMA earlier direction for removal of stone pitched wall and the compliance of the High Court Order in the matter of Maharani Guest House was established. The Project Proponent desires to put up a concrete wall on the landward side of the property to prevent rain water from entering the basement of the structure at site. The Project proponent desires to provide natural drainage access for the storm water at site.

Members perused the details and concluded that the project proponent can carry out the activity as per the plans approved for time being as requested. Stop Work Order/ Show Cause otice stands discharged for this purpose only.

59.2.2 Complaint against illegal road constructed by Armando Cardozo in the property of Hermitage Builders and arayan R. Bandekar in Sy. o. 16/4, 16/4A of Sernabatim

Decision: Deferred. As Eng. Pascoal oronha was unable to remain present for the hearing and he had some submission to be made before the members of the Authority as to what he observed when present for the Site Inspection.

59.4 Any other matters. 59.4.1 Fencing done by Department of Tourism on the Betim Side under Mandovi bridge was appreciated by the Authority.

Decision: The Authority decided to request the Department of Tourism to continue the fencing in its property from RD workshop to Malim Fishing Jetty.

59.4.2 Mangroves behind KTC Bus Stand: Members expressed concern over the alleged destruction of mangroves by the construction of road adjoining the exit of KTC bus stand, Panaji right up to the sewerage plant of PWD at Patto. It is seen that the requisite 50 mts buffer has not been maintained from the prescribed mangrove growth at site.

Decision: It has been decided that an inquiry needs to be conducted in the matter for which appropriate notices should be issued to EDC and other authorities concerned.

59.4.2.1 The Complaint received from the Captain of Ports Department, Panaji Goa, with reference to the massive Earth Cutting at Survey o. 41/2 at Vagurbem, in Ponda Taluka carried out by Rudresh aik.

Decision: The Authority decided that a site inspection which is scheduled should verify the discrepancy brought to its notice. After conducting the Site inspection, if any violations are noticed; than Show Cause otice and Stop Work Order has to be issued and earlier approval granted for floating pontoons and undertaking barge repairs along the riverside should be withdrawn.

59.8 Any other matters.

59.8.1 Regarding Sand mining / extraction in the State of Goa.

Members expressed their views and opined that the traditional authorized sand extraction activity bears no harm in the riverine / estuarine coastal ecology and infact helps in maintaining the rivers clean thereby preventing environmental degradation of the riverine areas. This sand extraction activity should

49 be capped at its present limit, prohibited at the mouth of the rivers and no unauthorized and over extraction should be permitted. Regular sand extraction, also prevents formation of the sand bars at the mouth of the river, which helps in river navigation process.

As per the CRZ Notification, 2011 the water portion being declared as a CRZ area, sand extraction becomes a prohibited activity. The water portion was not included in CRZ Notification, 1991 and hence the prohibitory clause pertaining to sand mining was not applicable for the activity of sand mining / extraction in the waters (river & estuary regions).

Decision: The Directorate of Mines and Geology should undertake a study to identify plausible effects of traditional sand extraction activity in the riverine / estuarine areas in the State of Goa through Department of Geology of or any reputed Institute of Higher Education or ational Institute Oceanography, Dona Paula who could also suggest such measures of sustainable extraction, dredging, river bed cleansing process etc. Department of Science, Technology and Environment should also do a similar study in this respect.

Matters regarding reports received from the office of the Deputy Collectors with reference to the Show Cause otice.

Decision: The GCZMA members decided that after the Summary Inquiry Report has been received from the Office of the Deputy Collector, and the alleged violations are not clearly mentioned it has been decided to direct the concerned Village Panchayat / Municipal Council to carry out a site inspection to ascertain if the structure/construction has been removed /demolished and submit ATR and than place it for the meeting of the GCZMA.

59.8.2 Mapping of Sand dunes, Khazan lands and Mangroves on the Goa Coast.

MS. GCZMA explained to the Members, regarding the special provisions in CRZ-V of the CRZ Notification 2011 and the requirement to undertake Mapping of Sand dunes, khazan Lands and mangroves on the Coast/estuaries. The proposal received from the M/s RSI Hyderabad, was placed before the Members. Members noted that M/s RSI Hyderabad had earlier carried out a detail survey of the Coastal structures in terms of directions of Hon’ble High Court.

Decision: It was decided to accept the proposal of M/s RSI Hyderabad for the mapping of sand dunes, khazan Lands and mangroves. The project cost needs to be revised from Rs. 38.00 lakhs, to include estuarine portions also. The Proposal be sent to the Government in this regard.
