Life is all about decisions. Writing this column was a decision. Determining how harsh to be in the analysis and conclusions to follow was another decision. During every harness race contested across the world, Judges are tasked with making decisions. Their job is to protect the wagering public’s interest and ensure that the participants in each race play by the rules. The position is filled with pitfalls as decision-making is often subjective and any set of eyes could have a differing opinion. Ultimately, after losing between 10 and 15 lengths (it is difficult to say for sure because she was so far removed from the field in the center of the track), Lindy’s Stardust would regain her composure and easily trot by some very tired and seemingly overmatched horses to win at odds of 1-5. Rightfully, the inquiry sign was lit to examine whether the filly obeyed the rules. After a long look, the decision was made to disqualify the horse. Reportedly, according to those in attendance, the reason given for the disqualification was that the filly “failed to lose significant ground while on a break.” With that explanation seemingly inaccurate to anyone watching, I reached out to Presiding Judge Tim Schmitz, who was kind enough to share the thought process of him and his colleagues. “The horse didn’t lose sufficient ground. He never lost ground to the trailing horses for eight seconds.” Schmitz admitted that driver David Miller did everything he could to help the horse get back to a trot and lose ground in the process. In the view of the Presiding Judge, the horse was simply a runaway and couldn’t be controlled at that moment. I did not see the race live. When alerted that something odd occurred, I immediately queued up the replay. My instant reaction was shock. The horse and driver clearly obeyed each of the breaking rules I’ve memo- rized over the last 30 years. How could there be a disqualification? After discussing the situation with Mr. Schmitz, my opinion that it was a bad call hasn’t swayed even one inch, but hearing the explana- tion has me less appalled and more looking to make sure this never happens in the future. Why? Because the Judges didn’t follow the regulations as they appear in the Kentucky Rulebook. The important details are outlined in bold below: Section 11. Breaking.
