The First part of tender should contain Earnest Money amounting to Rs. 5,000.00 (Rupees Five Thousand only) in the form of FDR / CDR / Pay Order etc. duly pledged in favor of the Superintending Engineer, EDC, Agra along with other relevant & desired information / documents / details etc. and the Second part of tender should contain rates only. Both the part of tender should be superscripted with Tender No., Part No. of Tender and its due date. Second part of tender shall not be opened if the desired information / documents / details / Ernest money are not found intact in the 1st part of tender. Only such firms/contractors shall be eligible to undertake the job who will produce satisfactory evidence such as details of experience, registration in service tax, EPF, ESI and Labour department etc. 2. The tenderers are requested to submit the price schedule/ tender Performa etc. duly filled as required failing which it may prevent the tender from being considered. 3. Tenderers should state the earliest completion period for the work from the date of receipt of full instructions as to enable them to proceed with the work. 4. Any portion of the terms and conditions as laid down in the condition of contract form which is not clear to tenderer should be got clarified before submission of tender. Tenderers are requested to adhere to all clause of the contract form to facilitate finalization of contract. 5. The Price quoted should be after deduction/discount etc. and should be firm during the currency of the contract and no variation should be allowed for any reason whatsoever. 6. The Corporation does not pledge to accept the lowest rates or any tender and reserve the right to accept the whole or any portion of any tender as they may think fit without assigning any reason for non acceptance or selection whatsoever. The Corporation also reserve the right to order to increase or decrease the quantity of work in accordance with the conditions of Form ”A” of UPPCL/DVVNL. The quantity mentioned in the Quantity and Price schedule is tentative, but the work shall be got executed in accordance with passed and sanctioned estimates and packages from the competent authorities. 7. The earnest money amounting to Rs. 5,000 /- (Rupees Five Thousand only) in shape of FDR/Call deposit of a scheduled Bank payable at Agra, should be submitted in a separate envelope along with tender in favor of Superintending Engineer, Electricity Dist. Circle, Agra failure to do so may prevent tender from being considered. 8. A security/performance guarantee @ 10% of the value of contract shall have to be deposited by the Tenderer, of the contractual amount in the form of FDR/CDR/Bank Guarantee duly pledged in favor of Superintending Engineer, Electricity Dist. Circle, Agra, otherwise the same shall be deducted from the Contractor’s bill itself. The security and performance guarantee so deposited/deducted, whatsoever or in any manner, as per terms of agreement shall be liable to be refundable after receipt of successful completion report from the Supervising Engineer of the Contract and subject to the condition that nothing has been found outstanding as Misc. against the contactor. However, the condition of Form ”A” of UPPC/DVVNL shall prevail in this direction. 9. The tender should be made valid for a period of 90 days from the date of opening of tender. 10. The successful tenderer shall be required to pay all legal charges that may have to be incurred for vetting the Contract documents and also the stamps, form etc. for the execution of agreement. 11. Any action on the part of tender to revise the price/prices and or to change the structure of price/prices at his own instance after the opening of tender may result in rejection of the tender and also debarring him from submission of tender to the Corporation atleast for one year. 12. The tenderers are required to submit the details of their past experience in connection with the execution of such work executed by them in past or in present in UPPCL/DVVNL or in any other similar public works department on the following Performa:-

13. The tenderer should enclose the list of experienced Engineer/Workers available with them for the purpose / job giving all full particulars about experience of the above 14. The work tender in question shall be completed within 30 days from the date of last issued of the material 15. Clearance of site shall also be given to the successful contractor by the supervising engineer well in advance but any delay in giving the same shall also not be counted in completion period and the delay on this account shall also be confirmed by the supervising engineer in writing so that relief may be granted accordingly. 16. Any work which may not have been specifically mentioned in the specification, but which in usual or necessary in the efficient working of work shall be deemed to have been included in the scope of work under the specification. 17. All the work shall be carried out as per RESPO specification and in accordance with Indian Electricity Rules 1956 or any revision thereof which may be issued during the currency of the Contract and the requirement of any other regulation in Act in India to which the work may be subjected. 18. The Contractor shall provide and arrange all necessary arrangement for safety of staff / labour /employees employed by him at site of work. The Purchaser Engineer of the Department shall not be in any way responsible for any accident, minor or fatal to any person at the site of work. 19. All disputes and claims shall be subject to Agra Court. 20. Payment for the work shall be made in accordance with the provisions as laid down in Form”A” of UPPCL from O&M/ Deposit/Section-5 /System improvement funds, by the Executive Engineer concerned. All the taxes applicable on work contract shall be deducted from the Contractor’s bill itself. 21. In case of delay in completion of work, the penalty @ of ½% per week and maximum 10% of Contracted value of remaining work shall be charged. 22. The Tenderers prior to submitting Tender shall ensure that all the relevant papers being submitted are properly signed & stamped. 23. The Contractors are required to mention their postal address complete in all respect where desired in the tender specification for correspondence purposes or any other legal purpose, whatsoever in any manner and if there is any subsequent change in the address takes place in future, in that event the same should invariably be intimated under registered cover in writing mentioning the Tender and its due date.

The duty hours of operator shall be 10.00 am to 6.00 pm with a interval of 30 minutes in noon. The Computer operator will avail holidays as per the Nigam’s Prescribed holiday list, but he may be called any time due to urgency of work by the Supervising Engineer. 4. Suitable space, table, chair and electricity alongwith computer shall be provided by the Corporation. 5. All necessary arrangements for safety of Datas shall be made by the contractor. 6. All type of reports, computer typing work is also to be performed by the Operator of computer. 7. The agreement period is for one Year, but it can be terminated at any time by the Supervising Engineer without assigning any reasons thereof. 8. The Computer operator will never be the employee of the Corporation. 9. In case operator is not provided in that event payment of that day shall not be paid. 10. All rules and regulations in respect to wages Act, Labour Act etc shall be followed by the contractor. 11. Service Tax, as legally applicable, shall be paid, if the firm is registered for the same with the concerning department 12. NOTE ‘These conditions will be read and construed along with General conditions in Form “A” of UPPCL, but in case there is any conflict or inconsistency between the General Conditions and Special conditions, in that event the provision of Special Conditions shall prevail.”

SCOPE OF WORK The Tender is for the work of Providing Computer Operator for the office of EDD-IV Kirawali, EDSD-I Kagarol and EDSD-III Fatehpur Sikri which as per provision of General conditions, Special conditions of the tender. If the successful contractor fails to execute the work at any stage, in that event the work shall be got executed from other outer agency, for which extra actual expenditure plus 15% supervision charges thereon shall be recovered from the contractor and the security shall be forfeited. Letter sent to this effect under Postal Certificate shall be considered enough for this purpose from the supervising engineer/ Superintending Engineer, Electricity Distribution circle, DVVNL, Agra.

SUPERVISING ENGINEER Executive Engineer, Electricity Distribution Division-IV, Kirawali, shall be responsible for the successful completion of work on behalf of Dakshinanchal Vidhut Vitaran Nigam Limited, in accordance with the terms and conditions thereof .In the event of any conflict between the contractor and the Supervising Engineer, the decision of the Superintending Engineer,, Electricity Distribution circle, DVVNL, Agra, shall be final and binding upon both the parties.

EARNEST MONEY The tenderers are required for submit the earnest money amounting to Rs. 5000.00 [Rupees Five Thousand only], in the form of FDR/CDR/ Bank draft, duly pledged in favour of the Superintending Engineer,, Electricity Distribution Circle, DVVNL, Agra, through the first part of the tender and accordingly the second part of tender shall only be opened only after receiving the proper and adequate Earnest Money through the first part of tender.

VALIDITY OF TENDER Tenderers are required to submit their tenders valid for Ninety days and the validity certificate shall also be submitted to this effect on the proforma enclosed with the tender specification herewith.

PRICES The tenderers are required to submit their rates and price as “Firm” and no price variation shall be allowed on any ground, and the tender of the nature of price variation shall be liable to be rejected out rightly.

SECURITY DEPOSIT The successful contractor shall be required to furnish to the Corporation security deposit and performance guarantee @ 10% of contractual amount of the tender in the form of FDR/ CDR/ Bank draft, duly pledged in favour of the Superintending Engineer,, Electricity Distribution Circle, DVVNL, Agra, or in any other terms as deemed fit and proper by the Superintending Engineer, EDC, DVVNL, Agra. Necessary stamp duty shall also be paid by the successful tenderer.

REFUND OF SECURITY The security and performance guarantee @ 10% of the contractual amount so deposited or deducted what so ever in any manner, as per terms of agreement, shall be liable to be refundable after receipt of successful completion report from the Supervising engineer of the contract and subject to the conditions that nothing has been found out standing as Misc. against the contractor. However the condition of From “A” of UPPCL, shall prevail in this direction.

INCREASE/ DECREASE IN QUANTITY The Corporation reserves the right to order to increase or decrease the quantity of work in accordance with the conditions of Form “A” of UPPCL. The quantity mentioned in the Quantity and Price Schedule is tentative, but the work shall be got executed in accordance with passed and sanctioned estimates and packages from the Competent Authorities. PENALTY A penalty @ ½% per week subject to maximum10%, and penalty as mentioned in the special conditions shall also be applicable and recovered from the contractor. Apart from this penalty as mention in the special condition shall also prevail.

DETAILS OF EXPERIENCE The tenderers are required to submit the details of their past experience also in connection with the execution of such work executed by them in past or in present in UPPCL or in any other similar public works department on the following proforma. JURISDICTION

The contract executed shall be governed by the Law of India for the time being in force and shall be subject to the jurisdiction of High Court of Judicature at Allahabad.

INTRODUCTION

The Executive Engineer, Electricity Urban Distribution Division, Firozabad intimated that agreement for providing of computer operator is going to be over in the month of 03/2014 and thus he requested that outside agency for providing of computer operator to him for proper running of computer due to acute shortage of staff. Keeping in view the shortage of staff and for ensuring proper working of division, the Superintending Engineer, Electricity Distribution Circle, Firozabad took initiations for inviting tenders. PUBLICATION OF TENDER NOTICE

The tender notice for inviting tenders was sent to the following news papers for its publication vide letter No. 1433/EDC/F/T-General dated 11.03.2014, which was published on the dates, mentioned below against each. 1. Copy of the tender notice published in the aforesaid news papers are available in the related tender file and the same may also be referred and perused to invariably. SALE OF TENDER SPECIFICATION The time and date for sale of tender specification was fixed as 12.00 hrs. of 26.03.2014 on payment of Rs. 115.00 [Rupees One Hundred Fifteen only] and the same was accordingly sent for its publication. It was also published that in case date fixed for sale of tender specification happens holiday, in that event tenders shall be sold on next working day upto the scheduled time. OPENING OF TENDERS Tenderers were well intimated not only through the publication of tender notice, but also through the tender specification to submit their tenders up to 15.00 hrs. of 26.03.2014, which were scheduled to be opened after 15.30 hrs. on 26.03.2014 subject to the condition that in case opening day happens holiday in that event tenders shall be received upto schedule time of next working day. Therefore tenders so received upto 15.00 hrs. of 26.03.2014 were opened after 15.30 hrs. of 26.03.2014, by the Superintending Engineer, Electricity Distribution Circle, Firozabad, in presence of office superintendent as well as in present of the tenderers who were present at the time of opening of the tenders.

EARNEST MONEY All the tenderers were well required to submit their Earnest money amounting to Rs. 3000.00 [Rupees Three Thousand only] in the form of FDR/CDR/Bank draft, duly pledged in favour of the Superintending Engineer, Electricity Distribution Circle, DVVNL, Firozabad, through the first part of tender and accordingly on opening of the first part of the tenders, the following detailed Earnest Moneys were received.

All the tenderers were well required to submit their tenders valid for 90 days alongwith validity certificate to this affect and while going through the tenders it has been observed that all the tenderers have submitted their offer valid for 90 days alongwith validity certificate and thus all the tenders are valid for 90 days. CLEARNANCE OF LIABLITIES The liabilities, on account of the execution of the aforesaid work, shall be cleared from the funds of O&M or from the funds received for the purpose from higher ups. VARIATION All the tenderers have mentioned in their offer that DA, VDA if increased by the government, the same will be charged accordingly which may also taken into consideration while finalizing the tenders. SERVICE TAX All the tenderers have also desired that they will charged service tax extra which may also be taken into consideration while finalizing the tenders. COMPARISON OF RATES The lowest rates have been offered by M/s. Arora Sales Corporation, 13, Mohan Nagar, Firozabad, for the work of providing of 04 Nos. Computer operators in Electricity Urban Distribution Division, Firozabad @ Rs. 9141.00 per month, which is almost as similar as have already been allowed by other circles of Agra Zone, Agra which are justified as per following analysis of rates.

SCOPE OF WORK

The tender is for the work of providing of computer operators in the office of Executive Engineer, Electricity Urban Distribution Division, Firozabad, which shall be executed in accordance with the provision of General conditions, Special conditions of the tender. If the successful contractor fails to execute the work at any stage, in that event the work shall be got executed from other outer agency, for which extra actual expenditure plus 15% supervision charges thereon shall be recovered from the contractor and the security shall be forfeited. Letter sent to this effect under Postal Certificate shall be considered enough for this purpose from Superintending Engineer, Electricity Distribution circle, DVVNL, Firozabad.

SUPERVISING ENGINEER Executive Engineer, Electricity Urban Distribution Division, Firozabad, shall be responsible for the successful completion of work on behalf of Dakshinanchal Vidhut Vitaran Nigam Limited, in accordance with the terms and conditions thereof. In the event of any conflict between the contractor and the Supervising Engineer, the decision of the Superintending Engineer, Electricity Distribution circle, DVVNL, Firozabad, shall be final and binding upon both the parties.

PRICES The rate, mentioned in the Quantity and Price scheme are as “Firm” and no price variation shall be allowed on any ground.

SECURITY DEPOSIT & REFUND OF SECURITY The Security @ 10% amounting to Rs. 43877.00 shall be deducted from the contractor’s running bills proportionately which shall be liable to be refundable after receipt of successful completion report from the Supervising Engineer of the contract and subject to the conditions that nothing has been found out standing as Misc. against the contractor. However the condition of From “A” of UPPCL, shall prevail in this direction.

COMPUTER OPERATOR

The contractor shall be responsible for providing computer with operator at his own cost, risk and responsibility. The operator to be provided shall not be in any way the employee of the Corporation. He shall be remain the employee of the contractor. COMPLETION PERIOD

The work shall be completed by the contractor within a period of 12 months from the date of execution of agreement / date of intent to start the work.

LETTER OF INTENT

Letter of intent has also been issued vide letter No. 1993/EDC[F]/T-257 [2013-2014] dtd. 29.03.2014, which may also be taken into consideration in completion of work.

INCREASE/ DECREASE IN QUANTITY The Corporation reserves the right to order to increase or decrease the quantity of work in accordance with the conditions of Form “A” of UPPCL.

PENALTY If the operator does not come in the office in that event a penalty @ Rs. 300.00 per day shall be imposed and deducted from the contractor bill. In case operator of the computer goes on leave in that event contractor shall provide an other suitable and competent operator.

PAYMENT Payment shall be made in accordance with the provisions as laid down in Form ‘A’ of UPPCL from the O.M. funds or from the funds to be released by the higher ups. VARIATION IN RATES Variation in rates in respect to basic and DA as per Govt. orders shall be applicable. At present the rates are being allowed as per following details. Sl. JURISDICTION The contract executed shall be governed by the Law of India for the time being in force and shall be subject to the jurisdiction of High Court of Judicature at Allahabad.
