PROPOSED PARTIAL SUMMARY VACATION OF A PUBLIC UTILITY EASEMENT LOCATED AT 162 NORTH MAUDE LANE (Abandonment NO. ABA2008-00185)

RECOMMENDATION:

That the City Council, by Resolution, approve the applicant’s request for the partial summary vacation of an easement for electrical purposes, as set forth in a Grant of Easement recorded February 10, 1964, in Book 6919, Page 1 of Official Records, and as shown on the attached Location Map.

DISCUSSION:

This summary vacation has been requested by the applicant so she can increase the existing square footage of her usable lot size and possibly build a garage/storage area.

The current vacation meets the criteria for a Summary Vacation in accordance with the Streets and Highways Code because the area proposed to be vacated has not been used for the purpose for which it was dedicated or acquired for five consecutive years immediately preceding the proposed vacation. The proposed vacation has been reviewed by the Electrical Division and there are no objections.

VALUE:

City Council Policy No. 5.5 waives the requirements of compensation to the City when the abandonment meets the criteria for a summary vacation. Therefore, the City has no compensable interest in the easement.

IMPACT ON BUDGET:

There is no impact on the General Fund.
