 “BYLAWS OF SOUTHLAKE HOMEOWNERS ASSOCIATION, INC.”

This document, dated June 26, 1998, is titled “Bylaws of Southlake Homeowners Association, Inc., a Florida Corporation Not for Profit.” The Association was organized pursuant to the provisions of Chapter 617 of the Florida Statutes. The purpose and objective of the Association is to (1) own and maintain the Common Areas, (2) enforce the covenants and restrictions contained in the “Declaration” and, (3) exercise any other rights, powers, and duties granted to it under the Declaration or Articles.

 “ DECLARATION OF COVENANTS, CONDITIONS, RESTRICTIONS, AND EASEMENTS FOR SOUTHLAKE”

Beazer Homes Corp., a Tennessee corporation, d/b/a Panitz Homes, prepared and wrote these covenants, conditions, restrictions, and easements on June 26, 1998. The document was filed in St. Johns County, FL, on July 9, 1998. (O.R. 1332 PG 820)

The “Declaration” contains thirteen (13) different articles and is a guide to Southlake’s management of the property. For example; (1) Article IV relates to the rights of homeowners; (2) Article VI explains the “Architectural Control” in order to preserve the natural beauty and aesthetic design of the Southlake community and; (3) Article VIII relates to how residents use and preserve their property as a desirable place to live.

 “ARTICLES OF INCORPORATION OF SOUTHLAKE HOMEOWNERS ASSOCIATION, INC.”

This legal and notarized document was filed with the Secretary of State in Tallahassee, Florida, on July 8, 1998. The “Articles” explain that the Southlake Homeowners Association is a not-for-profit corporation and exercises all rights, powers and duties to be granted to the “Declaration of Covenants, Conditions, Restrictions, and Easements for Southlake.” (DOC#: N98000004002)

Board of Directors and Architectural Review Board Meetings

Since concerns and questions from residents have increased, for the remainder of 2008, the BOD has unanimously voted to hold monthly meetings at the Southlake Amenity Center. The new dates and new formats are:

August 12 September 9 October 14 November 11 (Veteran’s Day) December 1 (Annual Meeting) 6:30 p.m. —The Architectural Review Board meets with residents. The residents will be permitted to speak one at a time on a first-come-first-serve basis to the board.

7:00 p.m.—The Homeowners Board of Directors meeting begins.

All residents are welcome to attend!

Have you paid your Special Assessment?

All Southlake homeowners were notified by letter that a Special Assessment was due July 1, 2008. The assessment for $114.00 was approved by the BOD on November 13, 2007. The money will be used to offset the rise in costs for inflation, insurance, lawn maintenance and other expenses that are necessary to keep our budget in the black.

Accordingly, any payment from a homeowner that is received after October 1, 2008, will be considered late and will bear interest at the rate of 18% per annum.

everal homeowners did not comply with nor mail in their ARB Request Form to the Community Association SManager for their property improvements. The Southlake CCR’s state that no exterior construction, modification, alteration, or other improvement of any kind will be allowed on any lot unless/until the plan(s) for such construction or alteration is approved in writing by the Architectural Review Board. Fines can be imposed if the homeowner does not follow the guidelines. (Refer to Article VI, Section 3)

All homeowners are required to:

1. Complete an ARB request form;

2. Mail two (2) copies of the construction plans, specifications, and all proposed landscaping;

3. Include a site plan showing the proposed changes;

4. Include all paint chips (when applicable), fence type, stain colors, and other appropriate support materials. (Include a maintenance plan for all fence proposals.)

5. Submit your application form, drawings, and other required documents to:

The committee will respond to your request in approximately thirty (30) days.

In May, Nanak’s Landscaping made enhancements to Southlake’s front entrance and to the parking lot entrance. The installation of new plants, new bushes, mulch for all the beds, and new palm trees was completed on schedule. The proper materials selected for Southlake’s landscape were chosen to deliver beauty and to provide ease of maintenance.

Covenant Enforcement Committee (CEC)

This newly formed Committee enforces the guidelines listed in the “Declaration of Covenant, Condition, Restrictions and Easements for Southlake.” Violators will be notified by mail as to the date of their scheduled hearing. Future hearing dates are scheduled for July 29, August 26, September 30, October 28, and November 25. No hearings are scheduled in December.

 PARK YOUR CAR IN YOUR DRIVEWAY. If a car is parked along the side of the road, the vehicle may prohibit the driver’s view of a small child or may be difficult for emergency vehicles to pass.

 Maintain your lot. Mow, water, weed, fertilize, edge, and sweep up or blow your grass clippings away. DO NOT place yard waste or any contaminant into our storm drains. These materials will end up in our rivers and coastal waters.

 DO NOT park any trailer, boat, camper, etc., in your driveway or on the street. (Article VIII, Section 14)

 The Board of Directors is seeking a volunteer to replace a recently vacated position. Please notify First Coast or the BOD if you are interested.

 Florida Statutes state that all dogs must be kept on a leash. Please keep your dogs on a leash and remember to pick up their droppings when walking your pets.

 Southlake renters. The “Declaration of Covenants, Conditions, Restrictions and Easements for Southlake” Article I; Definitions (l) states: “…, any person residing on any portion of the Property for a period of sixty (60) consecutive days or longer shall be deemed a permanent resident.”

I-95 AND CR 210 CONSTRUCTION UPDATES

Progress! Its official: The County Road 210 and Interstate 95 south bound exit ramp and entrance ramp will begin construction this summer. Completion will take about a year. Funding for this project has been going on for about three years.

OUTER BELTWAY!

The construction for this biggest beltway has hit a glitch. Northeast Florida’s regional transportation initiative has stalled because of a state tax regulation. FDOT indicates this can be resolved either by legislation or the court system. This beltway connects Clay County traffic crossing the Shands Bridge with a limited access highway to a new Interstate 95 interchange between County Road 210 and International Golf Parkway (IGP). It diverts traffic off our crowded local roadways like CR 210, SR 16, and IGP. It will relieve congestion at intersections of CR210 and I-95 as well as IGP and I-95.

ALERT! ALERT! ALERT!

BE ON THE LOOKOUT FOR thieves at Southlake!

he Board of Directors is looking for your support and would greatly appreciate feedback from anyone who Tmay have information regarding the theft of items and destruction of our property taken from the beautiful and re-nourished front entrance of our Community.

Sometime on July 10th when the landscaper arrived to turn on the sprinkler system and to water the front entrance plants, the irrigation timer was missing. The timer had been ripped off from the stucco, and the wires had been disconnected. Two of the rotor heads were also discovered missing. In addition, three newly planted rose bushes were stolen from the front entrance. (A police report was filled out with the St. Johns County Sheriff’s Dept.)

Nanak’s Landscaping will replace these items at an additional cost to the Southlake homeowners. The BOD is making every attempt to keep costs down. When thieves take over costs go up and the homeowners pay the price. Be aware of your surroundings and report sightings to the police. Thank you! Neighborhood Watch Program Meeting

All residents are invited to attend this meeting on September 25th (Thursday). The meeting will take place at the Southlake Amenity Center and begin promptly at 6:30p.m. The topic is “Water Conservation.”

Under 508 Recipient Services, you can find 3.0 Customer Mail Receptacles. 3.1.3 Use for Mail “ … no part of a mail receptacle may be used to deliver any matter not bearing postage, including items or matter placed upon, supported by, attached to, hung from, or inserted into a mail receptacle. Any mailable matter not bearing postage and found as described above is subject to the same postage as would be paid if it were carried by mail.”
